का.आ. 3692(अ).—भारत सरकार ने पेᮝोिलयम और खिनज पाइपलाईन (भूिम मᱶ उपयोग के अिधकार का अजᭅन)

अिधिनयम, 1962 (1962 का 50) (िजसे इसमᱶ इसके प᭫ चात् उ᭍ त अिधिनयम कहा गया है) कᳱ धारा 3 कᳱ उपधारा (1) के

अधीन जारी भारत सरकार के पेᮝोिलयम और ᮧाकृितक गैस मंᮢालय कᳱ अिध सूचना सं᭎ या का.आ. 2904(अ) तारीख

05.09.2016 ᳇ारा; उस अिधसूचना से संल᭏ न अनुसूची मᱶ िविन᳸द᭬ ट भूिम मᱶ गेल (इि᭛ डया) िलिमटेड ᳇ारा उ᭜ तर ᮧदेश

रा᭔ य मᱶ िवजयपुर-औरया-फूलपुर पाईप लाईन के मा᭟यम से ᮧाकृितक गैस के पᳯरवहन के िलए पाइपलाईन िबछाने के

ᮧयोजन के िलए उपयोग के अिधकार का अजᭅन करने के अपने आशय कᳱ घोषणा कᳱ थी;

और उ᭍ त राजपिᮢत अिधसूचना कᳱ ᮧितयां जनता को उपल᭣ ध करा दी गई थी;

और सᭃम ᮧािधकारी ने जनता से ᮧा᭡ त आᭃेपᲂ को परीᭃण के उपरांत अ᭭वीकृत कर ᳰदया है;

और सᭃम ᮧािधकारी ने, उ᭍ त अिधिनयम कᳱ धारा 6 कᳱ उपधारा (1) के अधीन भारत सरकार को अपनी ᳯरपोटᭅ दे

दी है;

और भारत सरकार ने, उ᭍ त ᳯरपोटᭅ पर िवचार करने के प᭫ चात् और यह संतु᳥ हो जाने पर ᳰक उ᭍ त भूिम

पाइपलाइनᱶ िबछाने के िलए अपेिᭃत है, उस मᱶ उपयोग के अिधकार का अजᭅन करने का िविन᭫ चय ᳰकया है;

अत: अब, भारत सरकार, उ᭍ त अिधिनयम कᳱ धारा 6 कᳱ उपधारा (1) ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए,

यह घोषणा करती है ᳰक इस अिधसूचना से संल᭏ न अनुसूची मᱶ िविन᳸द᭬ ट भूिम मᱶ पाइपलाइनᱶ िबछाने के िलए उपयोग के

अिधकार का अजᭅन ᳰकया जाता है;

और, भारत सरकार, उ᭍ त अिधिनयम कᳱ धारा 6 कᳱ उपधारा (4) ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए, िनदᱷश

देती है ᳰक पाइपलाइनᱶ िबछाने के िलए भूिम मᱶ उपयोग का अिधकार, इस घोषणा के ᮧकाशन कᳱ तारीख को, भारत सरकार मᱶ

िनिहत होने के बजाए, पाइपलाइनᱶ िबछाने का ᮧ᭭ ताव करने वाली गेल (इि᭛ डया) िलिमटेड मᱶ िनिहत होगा और तदुपᳯर, भूिम

मᱶ ऐसे उपयोग का अिधकार, इस ᮧकार अिधरोिपत िनबंधनᲂ और शतᲃ के अधीन रहते ᱟए, सभी िव᭨ लंगमᲂ से मु᭍ त, गेल

(इि᭛ डया) िलिमटेड मᱶ िनिहत होगा।

NOTIFICATION

New Delhi, the 29th November, 2016

S.O. 3692(E).—Whereas by notification of Government of India in Ministry of Petroleum and

Natural Gas numbers S.O. 2904(E) dated 05.09.2016; issued under sub-section (1) of Section 3 of

the Petroleum and Minerals Pipelines (Acquisition of Right of Users in Land) Act, 1962 (50 of 1962)

(hereinafter referred to as the said Act), Government of India declared its intention to acquire the

Right of User in the land specified in the Schedule appended to that notification for the purpose of

laying pipeline for transportation of natural gas through Vijaipur-Auraiya-Phulpur pipeline in the

State of Uttar Pradesh by GAIL (India) Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the objections received from the public to the laying of the pipeline have been

considered and disallowed by the competent authority;

And whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act,

submitted its report to Government of India;

And whereas Government of India after considering the said report and on being satisfied

that the said land is required for laying the pipelines, has decided to acquire the Right of User

therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said

Act, Government of India hereby declares that the Right of User in the land specified in the Schedule

appended to this notification is hereby acquired for laying the pipeline;

And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said

Act, Government of India hereby directs that the Right of User in the land for laying the pipeline

shall, instead of vesting in Government of India, vest, on this date of the publication of the

declaration, in the GAIL (India) Limited, free from all encumbrances.
