अिधसूचना

नई ᳰद᭨ली, 5 ᳰदस᭥बर, 2016

का.आ. 4028(अ).— भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 3237 (अ) तारीख

30 नव᭥बर, 2015, ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ

ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ है, उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए

एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;

और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई ᳯट᭡पणी, आᭃेप और सुझाव ᮧा᳙ नहᱭ ᱟए है;

बंᳲनग व᭠यजीव अभयार᭛य मिणपुर रा᭔य के तमगंलांग िजले मᱶ 115.8 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ है, मिणपुर रा᭔य

सरकार कᳱ अिधसूचना सं. 55/14/97, तारीख 8 िसतबंर, 1997 ᳇ारा अिधसूिचत है िजसमᱶ चार मह᭜वपूणᭅ नᳰदयᲂ, ᮧाकृितक झरनᲂ आᳰद

के अवगाह ᭃेᮢ मᱶ िविश᳥ अ᭨पाइन चारागाहᲂ और व᭠य पाᳯरि᭭थितक ᮧणािलयां पाई जाती हᱹ िजससे वान᭭पितक और िविवधता िजसके

अंतगᭅत मुंजक(मुयुᳯटयांसीनी), सांबर(ᱨसा यूिनकोलोर), तᱶदुआ(पᱶथेरा पाराडुस), िसयार(केिनस एयुरेयुस), साल(मेिनस एसपी), जंगली

सूअर(सूस ᭭ᮓोफा), बाघ(पᱶथेरा ᳯटिगᳯरस), जंगली िब᭨ली(फैिलस चोउस), माटᱷ᭠स(माटᭅस एसपी.), लमिच᭜ ता (िनयोफेिलस नेबेलोसा),

गो᭨डन कैट(केटो᭡यूमा टेिमिनकᳱ), लजीला वानर (नायसाइटीबस एसपी.) आᳰद भी पाई जाती हᱹ;

और, बंᳲनग व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ,

पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭ थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭ थितक संवेदी जोन मᱶ उ᳒ोगᲂ या

उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है ;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम,

1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उप धारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का

ᮧयोग करते ᱟए, मिणपुर रा᭔य मᱶ बंᳲनग व᭠यजीव अभयार᭛य कᳱ सीमा से शू᭠य (नागालै᭛ड सीमा), 3 से 9.5 ᳰकलोमीटर तक के

िव᭭ ताᳯरत ᭃेᮢ को बंᳲनग व᭠यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया

है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार बंᳲनग व᭠यजीव

अभयार᭛य कᳱ सीमा से शू᭠य (नागालै᭛ड सीमा), 3 से 9.5 ᳰकलोमीटर तक पᳯरवतᭅनीय िव᭭ताᳯरत होगा। बंᳲनग व᭠यजीव अभयार᭛य के

उᱫर मᱶ पाᳯरि᭭थितक संवेदी जोन शू᭠य ᳰकलोमीटर तक िव᭭ताᳯरत होगा िजसकᳱ सीमा नागालᱹड रा᭔य के साथ सि᭥मिलत होगी ।

पाᳯरि᭭थितक संवेदी जोन का ᭃेᮢ 233.5 वगᭅ ᳰकलोमीटर है ।

(2) पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा का वणᭅन उपाबंध I के ᱨप मᱶ ᳰदया गया है।

(3) व᭠यजीव अभयार᭛य तथा पाᳯरि᭭थितक संवेदी जोन के भू-िनदᱷशांक के अᭃांश और देशा᭠तर के साथ पाᳯरि᭭थितक संवेदी जोन

कᳱ सीमा का मानिच ᮢ उपाबंध II के ᱧप मᱶ उपाब᳍ है ।

(4) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले ᮕामᲂ कᳱ सूची ᮧमुख िब᭠दुᲐ के िनदᱷशांकᲂ के साथ उपाबंध III के ᱧप मᱶ उपाब᳍

है ।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना –(1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ

इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, इस अिधसूचना मᱶ संल᭏ न

अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।

(2)

आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।

(3)

पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप मᱶ ऐसी रीित से रा᭔ य सरकार तथा

सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य मᱶ भी तथा कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷश का िस᳍ांत, यᳰद कोई हᲂ, ᳇ारा तैयार

होगी ।

(4)

आंचिलक महायोजना, इसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक िवचारᲂ को समेᳰकत करने के िलए संब᳍ रा᭔ य सरकार के िवभागᲂ

के िन᭥ निलिखत सभी परामशᭅ से तैयार होगी, अथाᭅत्:--

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

शहरी िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलका ;

(vi)

राज᭭ व ;

(vii)

कृिष ; और

(viii)

मिणपुर रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, हᲂगे ।

आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ

करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᳥ न हᲂ और आचंिलक महायोजना मᱶ सभी अवसंरचना ᳰᮓयाकलापᲂ मᱶ दᭃता और

पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।

आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ

के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत

ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ

भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।

आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ

जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय

करेगी, अथाᭅत् :--

(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए

पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ

अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 26,

30, 34 और 39 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-

(i)

ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग;

(ii)

पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭थितक अनुकूल

आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;

(iii) वषाᭅ जल संचय; और

(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण िश᭨पकार भी हᱹ :

परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के

अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006

(2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙

करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶᮤीय सरकार के पयाᭅवरण,

वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग

का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।

परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयुᲦ

या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोतᲂ -- आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और

पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने

के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना का भाग ᱨप मᱶ

िन᳜िलिखत हᲂगे ।

(ख) पयᭅटन महायोजना पयᭅटन िवभाग, मिणपुर सरकार ᳇ारा राज᭭ व और वन िवभाग, मिणपुर सरकार के परामशᭅ से तैयार होगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤीय

सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण,

᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन,

पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर

आधाᳯरत होगा;

(ii) पाᳯरि᭭थितक संवेदी जोन के भीतर होटल और सैरगाहᲂ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगे।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार

को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ

᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल

िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ

संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना

बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक

मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार

करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदूषण

िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक

िस᳍ांत और िविनयम तैयार करेगा ।

(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग, वायु (ᮧदूषण

िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदूषण िनवारण तथा िनयंᮢण)

अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -

(i)

पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और जलवायु

पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016

नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;

(ii)

᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए

योजनाएं तैयार करᱶगे ;

(iii)

जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;

(iv)

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय

᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और

जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत

जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ

िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत

होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012

का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख

21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।

काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना ।

पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने

वाले उ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

जलावन लकड़ी का वािणि᭔यक उपयोग ।

लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

नए बृहत जल िव᳒ुत पᳯरयोजना का

᭭थापना ।

लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय) ।

11.

वृᭃᲂ कᳱ कटाई ।

(क) रा᭔य सरकार के सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन,

सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ

होगी ।

(ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन

बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।

पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के

िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या

पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए

वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :

पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और

पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या

िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।

13.

पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे रोप-वे,

गमᭅ वायु गु᭣बारᲂ आᳰद ᳇ारा अभयार᭛य

ᭃेᮢ के ऊपर से उड़ना जैसे ᳰᮓयाकलाप

करना।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

14.

संिनमाᭅण ᳰᮓयाकलाप ।

(क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से

एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण

अनु᭄ात नहᱭ ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ

सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ

अनुमित दी जाएगी ।

पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से

संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और

िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही

᭠ यूनतम पर रखे जाएंगे ।

(ख) इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी जोन से परे, सदभािवक ᭭ थानीय

आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक

संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।

15.

वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-

जल संचयन भी है ।

(क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का

िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा ।

(ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का

िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा

अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी है ।

(ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।

(घ) ᳰकसी ᮲ोत जल, िजसके अंतगᭅत कृिष भी है, के संदूषण या ᮧदूषण को

रोकने के िलए सभी उपाय ᳰकए जाएंगे ।

16.

कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

17.

िव᳒ुत केबलᲂ और दूरसंचार टावरᲂ का

पᳯरिनमाᭅण ।

भूिमगत केबलᲂ को ᮧो᭜ साहन देना ।

18.

होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ

बाड लगाना ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

19.

िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ

सुदृढ करना तथा नई सड़कᲂ का संिनमाᭅण ।

उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार

हᲂगे ।

20.

रािᮢ मᱶ यािनक यातायात का संचलन ।

लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।

21.

िवदेशी ᮧजाितयᲂ को लाना

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

22.

पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

23.

वािणि᭔ यक साइनबोडᭅ और होᳺडग ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

24.

वायु(िजसके अ᭠तगᭅत ᭟विन भी है ) और

यािनक ᮧदूषण।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

25.

ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ

उपचाᳯरत बिह᮲ाᭅव का िन᭭सारण ।

उपचाᳯरत बिह᮲ाᭅव के पुनचᭅᮓण को ᮧो᭜सािहत करना और अवमल या ठोस

अपिश᳥ᲂ के िनपटान के िलए िव᳒मान िविनयमᲂ का अनुपालन करना होगा ।

26.

ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग ।

पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले

गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या

कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो

पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।

27.

वन उ᭜पादᲂ और गैर का᳧ वन उ᭜पादᲂ का

संᮕहण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

28.

सुरᭃा बलᲂ के कᱹप।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

29.

नए का᭬ ठ आधाᳯरत उ᳒ोग।

पाᳯरि᭭ थितक संवेदी जोन के भीतर नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना

अनु᭄ात नहᱭ होगी:

परंतु पाᳯरि᭭ थितक संवेदी जोन मᱶ 100 ᮧितशत आयाितत का᭬ ठ ᭭ टाक

उपभोग करने वाले नए का᭬ ठ आधाᳯरत उ᳒ोग कᳱ ᭭ थापना कᳱ जा सकेगी ।

30.

पाᳯरि᭭थितक-अनुकूल पयᭅटन ᳰᮓयाकलाप के

िलए पयᭅटको के अ᭭थायी अिधभोग के िलए

पाᳯरि᭭थितक-अनुकूल कुटीर, जैसे ᳰक टᱶट,

लकड़ी के घर, आᳰद ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

31.

पाᳯरि᭭थितक-अनुकूल पयᭅटन ᳰᮓयाकलाप।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

32.

ठोस अपिश᳥ ᮧबंधन ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

संवᳶधत ᳰᮓयाकलाप

33.

᭭थानीय समुदायᲂ ᳇ारा चल रही कृिष और

बागवानी ᮧथाᲐ के साथ पशुपालन,

पशुपालन कृिष, जल कृिष और मछली

पालन।

लागू िविधयᲂ के अधीन अनु᭄ात हᲂगे ।

34.

वषाᭅ जल संचयन ।

सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

जैिवक खेती ।

सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ

5. पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी तीन वषᭅ कᳱ

अविध के िलए एक मानीटरी सिमित का गठन करती है जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

(क)

वन संरᭃक/ उप वन संरᭃक/ उ᳒ान और अभयार᭛य, मिणपुर सरकार-

अ᭟यᭃ;

(ख)

ᭃेᮢ का ᭔ये᳧ नगर योजनाकार-

सद᭭य;

(ग)

᭔ये᳧ पयाᭅवरण इंजीिनयर, मिणपुर रा᭔य ᮧदूषण िनयंᮢण बोडᭅ, इ᭥फाल

सद᭭य;

(घ)

पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत

संरᭃण भी है) का ᮧ᭜येक मामले मᱶ मिणपुर रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक

ᮧितिनिध-

सद᭭य;

(ङ)

मिणपुर सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄-

सद᭭य;

(च)

रा᭔य जैव िविवधता बोडᭅ का सद᭭य

सद᭭य;

(छ)

संबंध अितᳯरᲦ िजला मिज᭭ᮝेट/ सहायक कले᭍टर

सद᭭य;

(ज)

ᮧभागीय वन अिधकारी/तेमंगलांग

सद᭭य-सिचव।

िनदᱷश िनबंधन:

(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ का अनुपालन करेगी ।

(3) मानीटरी सिमित का कायᭅकाल तीन (3) वषᭅ का होगा।

(4) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ)

तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍

गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा

संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और

जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(5) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन

मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ,

िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ

पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(6) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन

करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।

(7) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ,

औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(8) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मु᭎य जीव वाडᭅन उपाबंध IV मᱶ

उपबंिधत ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

(9) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए

समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर᭍ त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट

कर सकᱶगे ।

भारत के माननीय उᲬतम ᭠यायालय या माननीय उᲬ ᭠यायालय या माननीय रा᭬ ᮝीय हᳯरत ᮧािधकरण ᳇ारा पाᳯरत कोई आदेश

या पाᳯरत होने वाले ᳰकसी आदेश, यᳰद कोई हᲂ, के अधीन, इस अिधसूचना के उपबंध हᲂगे ।

उपाबंध – I

बंिनग व᭠यजीव अभयार᭛य के पाᳯरि᭭थितक संवेदी जोन कᳱ पᳯरसीमा और सीमा

उᱫर: ᭭टेशन सं᭎या 1, अगाकᳱ धारा और बराक नदी के संगम, से शुᱨ करते ᱟए ᭭टेशन सं᭎या 3 मᱶ टकोऊ ᮕाम मᱶ पᱟंचने तक यह रेखा

अगाकᳱ धारा के साथ साथ पूवᭅ कᳱ ᳰदशा मᱶ चलती है और ᭭टेशन सं᭎या 2 को पार करती है ।

पूवᭅ: ᭭टेशन सं᭎या 3, (टकाऊ ᮕाम) से यह रेखा ᭭टेशन सं᭎या 4 (तामाह ᮕाम) तक पहाड़ी ᭃेᮢ अंतर ᮕाम सड़क (आईवीआर) के साथ-साथ

दिᭃणी ᳰदशा मᱶ चलती है उसके बाद इरांग नदी पर ᭭टेशन सं᭎या 6 तक आईवीआर के साथ-साथ जारी रहती है, उसके बाद ᭭टेशन सं᭎या

7 – इरांग नदी और अᳯट धारा लोक के संगम तक इरांग नदी के साथ- साथ चलती है।

दिᭃण: ᭭टेशन सं᭎या 7, इरांग नदी और अᳯट धारा/लोक के संगम से शुᱨ करते ᱟए यह रेखा ᭭टेशन सं᭎या 8 से गुजरते ᱟए सोनᮧम ᮕाम से

शुᱨ करते ᱟए एक छोटे लोक के साथ साथ पि᳟म कᳱ ओर चलती है उसके बाद ᭭टेशन सं᭎या 9 (सोनᮧम ᮕाम जहां आईवीआर अपा नदी

से होकर गुजरती है) तक सोनᮧम ᮕाम तक आईवीआर के साथ- साथ उसके बाद ᭭टेशन सं᭎या 11 (थरोन ᮕाम) तक पीड᭣᭨यूडी सड़क के

NOTIFICATION

New Delhi, the 5th December, 2016

S.O. 4028(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide

notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O.

3237 (E), dated 30^th November, 2015, inviting objections and suggestions from all persons likely to be affected thereby

within the period of sixty days from date on which copies of the Gazette containing the said notification were made

available to the public;

AND whereas, no comments, objections and suggestions received from persons and stakeholders in response to

the draft notification;

AND WHEREAS, Bunning Wildlife Sanctuary in the Tamenglong District in the State of Manipur, covering

over an area of 115.8 square kilometres, notified vide the State Government of Manipur notification number 55/14/97

dated the 8^th September, 1997, has got unique ecosystem of Alpine grassland and Forest ecosystem at the catchment of

four important rivers, natural water fall etc. hosting varied floral and faunal diversity including Barking deer

(Muntiacini), Sambar (Rusa unicolor), Leopard (Panthera pardus), Jackal (Canis aureus), Pangolin (Manis sp.), Wild

boar (Sus scrofa), Tiger (Panthera tigris), Jungle cat (Felis chaus), Martens (Martes sp.), Clouded leopard (Neofelis

nebulosa), Golden cat (Catopuma temminckii), Slow loris (Nycticebus sp.) etc;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is

specified in paragraph 1 of this notification around the protected area of the Bunning Wildlife Sanctuary as Eco-sensitive

Zone from ecological and environmental point of view and to prohibit industries or class of industries and their

operations and processes in the said Eco-sensitive Zone;

Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section

(2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule

5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from

zero (Nagaland Border), 3 to 9.5 kilometre from the boundary of the Bunning Wildlife Sanctuary in the State of Manipur

as the Bunning Wildlife Sanctuary Eco-sensitive Zone(hereinafter referred to as the Eco-sensitive Zone), details of which

are as under, namely:-

Extent and boundaries of Eco-sensitive Zone.-(1)The extent of Eco-sensitive Zone is varies from zero

(Nagaland Border), 3 to 9.5 kilometres from the boundary of the Bunning Wildlife Sanctuary and the extents of Eco-

sensitive Zone is zero kilometre at North of the Wildlife Sanctuary, which shares boundary with State of Nagaland and the

area of Eco- sensitive Zone is 233.5 square kilometre.

The boundary description of the Eco-sensitive Zone is appended as Annexure I.

(3)

The map of Eco-sensitive Zone boundary together with its latitude and longitude, Geo co-ordinates of Wildlife

Sanctuary and Eco-sensitive Zone are appended as Annexure II.

(4)

The list of the villages falling within Eco-sensitive Zone along with coordinates of prominent points is appended

as Annexure III.

Zonal Master Plan for the Eco-sensitive Zone.-(1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The Zonal Master Plan shall be approved by the Competent Authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

i. Environment;

ii. Forest;

iii. Urban Development;

iv. Tourism;

v. Municipal;

vi. Revenue;

vii. Agriculture; and

viii. Manipur State Pollution Control Board,

for integrating environmental and ecological considerations into it.

The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and

activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all

infrastructure and activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that need attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements,

types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,

orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in the Eco-sensitive Zone so as to ensure Eco-friendly

development and livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Landuse. - Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes

in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 26, 30, 34 and 39 in column (2) of

the Table in paragraph 4, namely:-

(i)

Small scale industries not causing pollution;

(ii)

Eco-friendly cottages for temporary occupation of tourists, such as

tents, wooden houses, for Eco-friendly

tourism activities;

(iii)

Rainwater harvesting; and

(iv)

Cottage industries including village artisans:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without

the prior approval of the State Government and without compliance of the provisions of article 244 of the Constitution or

the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of

Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State

Government, after obtaining the views of the Monitoring Committee, once in each case and the correction of said error

shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as provided under

this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and

efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and

rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3) Tourism.-(a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,

which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Manipur in consultation

with Department of Revenue and Forest, Government of Manipur.

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the eco-tourism guidelines issued by the National Tiger Conservation Authority, Ministry of

Environment, Forest and Climate Change (as amended from time to time) with emphasis on eco-tourism, eco-education

and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of this notification and such plan shall form part of the Zonal Master Plan.

(5)

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations

for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981(14 of 1981)and the rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for

the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981 (14 of 1981)and the rules made thereunder.

(8)

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974)and the rules made thereunder.

(9)

Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid

Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and

Climate Change vide notification number S.O. 1357 (E), dated the 8^th April, 2016 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10)

Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in

accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of

India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28^th

March, 2016, as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is

prepared and approved by the Competent Authority in the State Government and the Monitoring Committee shall

monitor compliance of vehicular movement under the relevant Act and the rules and regulations made thereunder.

List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Eco-

sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules

made thereunder and shall be regulated in the manner specified in the Table below, namely:-

B. Regulated Activities:

11.

Felling of trees.

(a) There shall be no felling of trees on the forest land or

Government or revenue or private lands without prior

permission of the competent authority in the State

Government.

(b) The felling of trees shall be regulated in accordance

with the provisions of the concerned Central or State

Act and the rules made there under.

12.

Commercial establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted

within one kilometer of the boundary of the protected

area or up to the boundary of the Eco-sensitive Zone

whichever is nearer except for accommodation for

temporary occupation of tourists related to eco-friendly

tourism activities:

Provided that, beyond one kilometer or up to the

extent of the Eco-sensitive Zone, all new tourism

activities or expansion of existing activities shall be in

conformity with the Tourism Master Plan.

13.

Undertaking activities related to tourism like

rope ways, over-flying the sanctuary area by hot-

air balloons, etc.

14.

Construction activities.

(a) No new commercial construction of any kind shall

be permitted within one kilometer from the boundary of

protected area or up to the boundary of the Eco-sensitive

Zone whichever is nearer:

Provided that, local people shall be permitted to

undertake construction in their land for their residential

use including the activities listed in sub-paragraph (1) of

paragraph 3:

Provided further that the construction activity related to

small scale industries not causing pollution shall be

regulated and kept at the minimum, with the prior

permission from the competent authority as per the

applicable rules and regulations, if any.

(b) Beyond one kilometer upto the extent of Eco-

sensitive Zone, construction for bone fide local needs

shall be allowed and other construction activities shall

be regulated as per the Zonal Master Plan.

15.

Commercial water resources including ground

water harvesting.

(a)The extraction of surface water and ground water

shall be permitted only for bona fide agricultural use and

domestic consumption of the occupier of the land.

(b) The extraction of surface water and ground water for

industrial or commercial use including the amount that

can be extracted, shall require prior written permission

from the concerned regulatory authority.

Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring

Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(a) The Conservator of Forests / Deputy Conservator of Forests/ Park and Sanctuary, Government of Manipur -

Chairman

(b) Senior Town Planner of the area - Member;

Board, Imphal-Member;

(d) A representative of Non-governmental Organisations working in

the field of environment (including

heritage conservation) to be nominated by the Government of Manipur for a term of three

year

–

Member;

(e) One expert in the area of ecology and environment to be nominated by the Government of Manipur -

Member;

(f) Member of State Biodiversity Board-Member;

(g) Concerned Additional District Magistrate/Assistant Collector- Member; and

(h) Divisional Forest Officer / Tamenglong- Member-Secretary.

Terms of Reference:

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3) The tenure of the Committee shall be three years.

(4)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006, and are falling in the Eco-

sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be

scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central

Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the

provisions of the said notification.

The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006 and are falling in

the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be

scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned

Regulatory Authorities.

The Member-Secretary of the Monitoring Committee or the concerned Deputy Conservator of Forests / Park

and Sanctuaryshall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of

1986) against any person who contravenes the provisions of this notification.

(7)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on

issue to issue basis.

(8)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wild Life Warden of the State per preformo appended at Annexure IV.

(9)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.

Annexure I

Limits and boundaries of the Eco-sensitive Zone of Bunning Wildlife Sanctuary

North: Starting from Station No.1, the confluence of Agaki stream and Barak River,the line runs easterly direction along

Agaki stream, crosses Station No.2, till it reaches Takou village at Station No.3.

East: From Station No.3 (Takou village), the line runs southerly direction along the hill-ridge Inter Village Road (IVR)

upto Station No.4 (Tamah village), then continues along the IVR upto Station No.6 on Irang river, then follows along the

Irang River upto Station No.7 - confluence of Irang River and Ati Stream/Lok.

South: Starting from Station No.7, confluence of Irang River and Ati Stream/Lok, the line runs towards west along a

small lok starting from Sonpram village crossing Station No.8, then along the IVR to Sonpram village upto Station No.9

(Sonpram village where IVR crosses Apa river), then along the PWD road upto Station No.11 (Tharon village), then

along the hill ridge IVR upto LongdiPabram village (Station No.12), then continues along the IVR passing Taipram

village (Station No.13) till it reaches Barak River (at Station No.7 of Jiri-Makru Wildlife sanctuary Eco-sensitive zone).

West: From the Station No.7 of Jiri-Makru Wildlife sanctuary Eco-sensitive zone, the line runs along the Barak River

upto Station No.1 which is the confluence of ApaThok stream and Barak River
