अिधसूचना
नई ᳰद᭨ली, 13 ᳰदस᭥बर, 2016
का.आ. 4031(अ).— भारत सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं. का. आ. 2700 (अ)
तारीख 5 अटूबर, 2015, उन सभी ᳞िᲦयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से, िजसको उस राजपᮢ कᳱ
ᮧितयां, िजसमᱶ यह अिधसूचना अंतᳶव᳥ है, उपल᭣ध करा दी गई थी, साठ ᳰदन कᳱ अविध के भीतर आᭃेप और सुᭃाव आमंिᮢत करते ᱟए
एक ᮧाᱧप अिधसूचना ᮧकािशत कᳱ गई थी;
और, उᲦ राजपᮢ, िजसमᱶ उᲦ अिधसूचना अंतᳶव᳥ है, कᳱ ᮧितयां जनता को 5 अटूबर, 2015 को उपल᭣ध करा दी गई थी;
और, उᲦ ᮧाᱧप अिधसूचना के उᱫर मᱶ सभी ᳞िᲦयᲂ और पणधाᳯरयᲂ से कोई आᭃेप और सुᭃाव ᮧा᳙ नहᱭ ᱟए है;
और, घाटीगांव ᱟकना व᭠यजीव अभयार᭛य ᮕाम घाटीगांव, िजला वािलयर के िनकट अवि᭭थत है और 26° से 26°15´ उ.
उᱫर अᭃांश और 77°50´ से 78°12´ पू. पूवᭅ देशांतर के बीच है िजसे म᭟य ᮧदेश सरकार अिधसूचना संया 15-16-75 डैश-2, ᳰदनांक 1
मई, 1981 अिधसूिचत करती है, यह ᭃेᮢ 512 वगᭅ ᳰकलोमीटर तक फैला ᱟआ है;
और, घाटीगांव ᱟकना व᭠यजीव अभयार᭛य ᮕेट इंिडयन बा᭭टडᭅ (अरडेओᳯटस िनगᳯरके᭡स) और अभयार᭛य के अ᭠य ज᭠तु चीतल
(एिसस एिसस), चᱭकरा (गजेला ᭭पा.), नीलगाय (बोसेलेफस ᭭पा.), लकड़बघा (हैयना हैयना), भालू (यूरसस ᭭पा.), घिड़याल
(ᮓोकोडायलस ᭭पा.), ᳴कगᳰफशर (एलकेडो ᭭पा.) का एक का᭨पिनक आ᮰य᭭थल है;
और, अभयार᭛य कᳱ मुय वन᭭पित खैर (अकाᳰकया ᭭पा.), गुजᭅन (डेपटेरोकारपस टरबीनाटस), तᱶदु (डायसपारोस
मेलानोजाइलोन), पालाश (बुटेया मोनोसपेरमा) और ᳯरयᲂझा (अकािसया ᭭पा.) आᳰद है और खुले घास के मैदान, िजजोपूस ᭭पा. छोटी
झािड़यᲂ, से ढके ᱟए है, भूई झाड़ी (ईगारोसᳯटस टेिनला), लैपोरसा (अᳯरसटेडा बाई सेᳯटᳯरस) और भनजुरा (अपलूदा मुᳯटका) इन ᭭थानᲂ
पर उपल᭣ध घासᲂ मᱶ से कुछ है;
और, घाटीगांव ᱟकना व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ
िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ
उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष करना आव᭫यक है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण) अिधिनयम,
1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग
करते ᱟए, म᭟य ᮧदेश रा᭔य मᱶ घाटीगांव ᱟकना व᭠यजीव अभयार᭛य पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᳟ात् पाᳯरि᭭थितक
संवेदी जोन कहा गया है) घाटीगांव ᱟकना अभयार᭛य कᳱ सीमा 100 मीटर से 2 ᳰकलोमीटर सीमा ᭃेᮢ को अिधसूिचत करती है, िजसका
िववरण िन᳜ानुसार है, अथाᭅत् :-
1.
पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार घाटीगांव ᱟकना व᭠यजीव
अभयार᭛य कᳱ सीमा से 100 मीटर से 2 ᳰकलोमीटर िव᭭तार के साथ 1100.4601 वगᭅ ᳰकलोमीटर ᭃेᮢ पर फैला ᱟआ है और जीपीएस
िनदᱷशांक के साथ सीमा का वणᭅन उपाबंध Iक मᱶ ᳰदया गया है ।
(2) अᭃांश, देशांतर और सीमा ᭣यौरे के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ ᮓमशः उपाबंध Iख और III के ᱨप मᱶ
उपाब है ।
(3) पाᳯरि᭭थितक संवेदी जोन िजला िशवपुरी, म᭟य ᮧदेश के अंतगᭅत आने वाले 13 ᮕामᲂ तक फैला ᱟआ है और पाᳯरि᭭थितक
संवेदी जोन के 100 मीटर और 2 ᳰकलोमीटर के भीतर आने वाले ᮕामᲂ कᳱ सूची उपाबंध II के ᱨप मᱶ उपाब है ।
2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ मᱶ अंितम
अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस अिधसूचना मᱶ संल न अनुबंधᲂ
के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।
(2)
आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होगी ।
(3)
रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा
सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार होगी ।
(4)
आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी संब
िवभागᲂ के परामशᭅ से तैयार होगी, अथाᭅत्:--
(i) पयाᭅवरण ;
(ii) वन ;
(iii) नगर िवकास ;
(iv) पयᭅटन ;
(v) नगरपािलका ;
(vi) राज᭭ व ;
(vii) कृिष ;
(viii) म᭟य ᮧदेश रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ ;
(ix) ᳲसचाई ; और
(x) लोक िनमाᭅण िवभाग।
(5)
आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ
करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार से िविन᳸द᭬ ट न हो और आचंिलक महायोजना मᱶ सभी अवसंरचना के िवकास तथा
ᳰᮓयाकलापᲂ को और अिधक दᭃ और पाᳯरि᭭ थितक अनुकूल ᱧप मᱶ ᮓमगिणत हᲂगे ।
(6)
आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ
के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत
ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।
(7)
आंचिलक महायोजना सभी िव᳒मान उपासना ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ,
ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलो᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन
करेगी ।
(8)
आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को पाᳯरि᭭ थितक अनुकूल िवकास और ᭭ थानीय समुदायᲂ कᳱ
जीवकोपाजᭅन को सुिनि᭫ चत करते ᱟए िविनयिमत होगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय
करेगी, अथाᭅत् :--
(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए
पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा:
परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ
अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं012,
20, 25,33 और सं. 36 के सामने सूचीब ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए िलए पाᳯरि᭭थितक अनुकूल
कुटीर जैसे टᱹट, लकड़ी के मकान आᳰद;
(ii) िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ करना तथा नई सड़कᲂ का संिनमाᭅण;
(iii) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग;
(iv) वषाᭅ जल संचय;
(v) कुटीर उ᳒ोगᲂ मᱶ ᮕाम उ᳒ोग, भंडारण कᳱ सुिवधा और ᭭थानीय सुख-सुिवधाएं सि᭥मिलत हᱹ :
परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के
अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006
(2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :
परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के िवचार ᮧा᳙
करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ कᱶᮤीय सरकार के पयाᭅवरण,
वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।
परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग
का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।
परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु त
या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।
(2) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो पयᭅटन महायोजना का भाग ᱨप मᱶ िन᳜िलिखत
हᲂगे।
(ख) पयᭅटन महायोजना पयᭅटन िवभाग, ᳇ारा राज᭭ व और वन िवभाग और पयाᭅवरण िवभाग के परामशᭅ से तैयार होगी ।
(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-
(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤ सरकार के
पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िसांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी
पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िसांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और
पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;
(ii) पाᳯरि᭭थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭ थायी अिधभोग के िलए वास सुिवधा के िसवाय घाटीगांव ᱟकना
व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ होगा ;
परंतु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दूरी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक नए होटल और ᳯरसोटᭅ कᳱ
᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया
जाएगा ।
(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को
वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात
ᳰकया जाएगा ।
(3) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल
िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ
संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना
बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(4) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक
मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार
करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।
(5) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या म᭟य ᮧदेश रा᭔य
ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के
उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(6) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग या म᭟य ᮧदेश रा᭔य
ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के
उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िसांत और िविनयम तैयार करेगा ।
(7) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण, जल (ᮧदूषण िनवारण तथा िनयंᮢण)
अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।
(8) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -
(i)
पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन
मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक
ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;
(ii)
᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए
योजनाएं तैयार करᱶगे ;
(iii)
जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;
(iv)
अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय
᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा।
(9) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और
जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना िज.एस. आर 343 (अ) तारीख 28 माचᭅ 2016 ᳇ारा ᮧकािशत
जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।
(10) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ
िवशेष उपबंध सि᭥मिलत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा
उसके अनुमोᳰदत होने तक, मानीटरी सिमित सुसंगत अिधिनयमᲂ और ᮧवृᱫ िनयमᲂ और इसके अ᭟यधीन बनाए गए िविनयमᲂ के अधीन
यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।
(11) औ᳒ोिगक इकाइयां – (क) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ का ᭭थाप᳖ िविध के अनुसार
᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोग के िसवाय अनु᭄ात नहᱭ ᳰकए जाएंगे ।
(ख) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ᭟विन ᮧदूषण के कोई नए उ᳒ोग का ᭭थाप᳖ अनु᭄ात नहᱭ
ᳰकया जाएगा ।
4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण

तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012 का 435 गोवा
फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014 के
अंतᳯरम आदेश के कठोर अनुसरण का ᮧचालन होगा ।

पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार
अनु᭄ात नहᱭ होगा ।
(3)
जल या वायु या मृदा या ᭟ विन ᮧदूषण काᳯरत करने
वाले उ᳒ोगᲂ कᳱ ᭭ थापना ।
पाᳯरि᭭थितक संवेदी जोन के भीतर नए और िव᳒मान ᮧदूषण काᳯरत करने
वाले उ᳒ोग का िव᭭ तार अनु᭄ात नहᱭ होगा ।
(4)
जलावन लकड़ी का वािणि᭔यक उपयोग ।

᭭ थापना को अनु᭄ात नहᱭ ᳰकया जाएगा :
परंतु िव᳒मान का᳧ आधाᳯरत उ᳒ोग िविध के अनुसार िनरंतर बने रहᱶगे ;
(9)
खाई भूिम ।
पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा के भीतर कोई नया मलखात भूिम का
᭭थाप᳖ अनु᭄ेय नहᱭ होगा परंतु िव᳒मान खाई भूिम का इस शतᭅ के अ᭟यधीन
संचालन ᳰकया जा सकेगा ᳰक खुले ᭭थान पर जलाने कᳱ ᳰᮓया अनु᭄ात नहᱭ कᳱ
जाएगी ।
(10)
बकरी पालन ।
लागू िविधयᲂ के अनुसार ᮧितिष (अ᭠ यथा उपबंिधत के िसवाय) ।
(11)
पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण ।
कोई संिनमाᭅण ᳰᮓयाकलाप तब तक नहᱭ ᳰकया जाएगा जब तक ᳰक रा᭔य
᭭तरीय सिमित ᳇ारा 1 से 10 से अिधक पहाड़ी ढलानᲂ पर और ᳰकसी नदी के
तटᲂ और ᮧाकृितक नाला से 100 मीटर तक अ᭠यथा अनु᭄ात न कर ᳰदया ।
िविनयिमत ᳰᮓयाकलाप
(12)
होटलᲂ और ᳯरसोटᲄ का ᭭थापन ।
पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ को अ᭭थायी
अिधभोग के िलए वास सुिवधा के िसवाय संरिᭃत ᭃेᮢ सीमा के एक
ᳰकलोमीटर के भीतर कोई नया वािणि᭔यक होटल और ᳯरसोटᭅ अनु᭄ात नहᱭ
हᲂगे :
तथािप, पाᳯरि᭭थितक संवेदी जोन के एक ᳰकलोमीटर से परे और उसकᳱ सीमा
तक सभी नए पयᭅटन ᳰᮓयाकलाप या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार
पयᭅटन महायोजना और रा᳦ीय ᳞ाᮖ संरᭃण ᮧािधकरण के मागᭅ-िनदᱷशᲂ के
अनुᱨप हᲂगे ।
(13)
संिनमाᭅण ᳰᮓयाकलाप ।
(क) संरिᭃत ᭃेᮢ या पाᳯरि᭭थितक संवेदी जोन जो भी िनकट हो कᳱ सीमा से
एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार का वािणि᭔यक संिनमाᭅण अनु᭄ात
नहᱭ ᳰकया जाएगा:
परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब ᳰᮓयाकलापᲂ सिहत
उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी
जाएगी ।
पर᭠तु यह और ᳰक ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से
संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और
िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही
᭠ यूनतम पर रखे जाएंगे ।
(ख) इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी जोन से परे, सदभािवक ᭭ थानीय
आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक
संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱨप हᲂगे।

(14)
जलावन लकड़ी का वािणि᭔यक उपयोग ।

(16)
वृᭃᲂ कᳱ कटाई ।
(क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी
या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ वृᭃᲂ कᳱ कोई कटाई नहᱭ होगी ।
(ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन
बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।
(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅयोजना मᱶ ᳰदए गए िववरण
का अनुसरण ᳰकया जाएगा।
(17)
वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-जल
संचयन भी है ।
(क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का
िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा ।
(ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का
िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा अपेिᭃत
होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी है ।
(ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।
(घ) जल के संदूषण या ᮧदूषण, िजसके अंतगᭅत कृिष भी है, को रोकने के िलए
सभी उपाय ᳰकए जाएगे ।
(18)
िव᳒ुत केबलᲂ और दूरसंचार टावरᲂ का पᳯरिनमाᭅण ।
भूिमगत केबलᲂ को ᮧो᭜ साहन देना ।
(19)
होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ बाड
लगाना ।
लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(20)
िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ सुदृढ
करना तथा नई सड़कᲂ का संिनमाᭅण ।
उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय यथा लागू अनुसार
हᲂगे ।
(21)
रािᮢ मᱶ यािनक यातायात का संचलन ।
लागू िविधयᲂ के अधीन वािणि᭔यक ᮧयोजन के िलए िविनयिमत हᲂगे ।
(22)
िवदेशी ᮧजाितयᲂ को लाना।
लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।
(23)
ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ उपचाᳯरत

गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या
कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो
पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।

िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

- अ᭟यᭃ;
(ख)
मुय वन संरᭃक, शेर पᳯरयोजना, वािलयर
सद᭭य ;
(ग)
िजला कलटर,िजला वािलयर
सद᭭य ;

अधीᭃण इंजीिनयर, लोक िनमाᭅण िवभाग, वािलयर
सद᭭य ;
(ङ)
अधीᭃण इंजीिनयर, लोक ᭭वा᭭᭝य िवभाग, वािलयर

िजला पंचायत सिचव का मुय कायᭅपालक अिधकारी

6. िनदᱷश िनबंधन
(1) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।
(2) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।
(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ)
तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष
गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा
संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और
जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।
(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण
और वन मंᮢालय कᳱ अिधसूचना संयांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे
ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥
᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा।
(5) मानीटरी सिमित का सद᭭य-सिचव या संब उपायु त, ऐसे ᳞िᲦ के िवᱨ, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन
करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।
(6) मानीटरी सिमित मुा दर मुा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ,
औ᳒ोिगक संगमᲂ या संब पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मुय जीव वाडᭅन उपाबंध IV मᱶ
उपबंिधत ᱨप िवधान के अनुसार उ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।
(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए
समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

इस अिधसूचना के उपबंधᲂ को ᮧभाव देने के िलए कᱶᮤीय सरकार और रा᭔ य सरकार अितᳯर त उपाय, यᳰद कोई हᲂ, िविन᳸द᭬ ट
कर सकᱶगे ।

भारत के माननीय उᲬतम ᭠यायालय या माननीय उᲬ ᭠यायालय या माननीय रा᭬ ᮝीय हᳯरत ᮧािधकरण ᳇ारा पाᳯरत कोई आदेश

NOTIFICATION
New Delhi, the 13th December, 2016
S.O. 4031(E).— WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide
notification of the Government of the India in the Ministry of Environment, Forest and Climate Change number S.O
2700 (E), dated the 5th October 2015, inviting objections and suggestions from all persons likely to be affected thereby
within the period of sixty days from date on which copies of the Gazette containing the said notification were made
available to the public;
And WHERAS, the copies of the Gazette containing the said notification were made available to the public on
the 5th October 2015.
And WHERAS, no objections and suggestions were received from persons and stakeholders in response to the
draft notification.
And WHERAS, the Ghatigaon Hukna Wildlife Sanctuary situated near village Ghatigaon, in Gwalior District
and lying between 26o to 26o15’ north latitude and 77o50’to 78o12 east longitude notified vide Government of Madhya
Pradesh notification No. 15-16-75 Das-2, dated the Ist May, 1981 is spread over an area of 512 square kilometres ;
AND WHEREAS, the Ghatigaon Hukna Wildlife Sanctuary is an ideal habitat of Great Indian Bustard (Ardeotis
nigriceps) and the other main fauna of the sanctuary are Cheetal (Axis axix), Chinkara (Gazella sp.), Nelgai (Boselephus
sp.), Hyena (Hyaena sp.), Bear (Ursus sp.), crocodile (Crocodylus sp.), Kingfisher (Alcedo sp.);
AND WHEREAS, the main flora of the sanctuary are Khair (Acacia sp.), Gurjan (Dipterocarpus turbinatus),
Tendu (Diospyros melanoxylon), Palas (Butea monosperma) and Reonjha (Acasia sp.) etc. and open medos are at places
covered with low bushes of Zizyphus sp. Bhuy bhushi (Eragrostis tenelle) Lapurse (Aristida by sterix) and Bhanjura
(Apluda mutica) are some of the grasses present in the area;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is
specified in paragraph 1 of this notification, around the protected area of Ghatigaon Hukna Wildlife Sanctuary as Eco-
sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their
operations and in the said Eco-sensitive Zone;
NOW THEREFORE, in exercise of the powers conferred by sub-section (1), clauses (V) and (xiv) of sub
section (2) and sub section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule
(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area varying from
100 meters to 2 kilometers around the boundary of the Ghatigaon Hukna Wildlife Sanctuary in the State of Madhya
Pradesh as Ghatigaon Hukna Wildlife Sanctuary Eco- sensitive Zone (hereinafter referred to as the Eco-sensitive Zone)
details of which are on under, namely :-

1. Extent and boundaries of Eco-sensitive Zone.- (1)The Eco-Sensitive Zone is spread over an area of 1100.4601
square kilometers with an extent varying from 100 meters to 2 kilometers around the boundary of Ghatigaon Hukna
Wildlife Sanctuary and the boundary description along with Geographical Positioning System coordinates is given in
Annexure-IA.
(2) The maps of the Eco-sensitive Zone along with latitudes, longitudes and boundary details are appended as Annexures
I-B and III respectively.
(3) The Eco-sensitive Zone is spread over 13 villages falling in Shivpuri District of Madhya Pradesh and the list of
villages falling within 100 meter and 2 kilometers of the Eco-sensitive Zone is appended as Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.
(2)
The said Plan shall be approved by the Competent Authority in the State Government.
(3)
The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner
as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines
issued by the Central Government, if any.
(4)
The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal;
(vi) Revenue;
(vii) Agriculture;
(viii) Madhya Pradesh State Pollution Control Board;
(ix) Irrigation; and
(x) Public Works Department,
for integrating environmental and ecological considerations into it.
(5)
The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,
unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and
activities to be more efficient and eco-friendly.
(6)
The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that needs attention.
(7)
The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, tribal areas, agricultural areas, fertile lands, green areas, such as, parks and like places, horticultural
areas, orchards, lakes and other water bodies.
(8)
The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly
development for livelihood security of local communities.
3.
Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of local residents, and for the activities listed against serial numbers 12, 20, 25, 33 and 36 in column (2)
of the Table in paragraph 4, namely:-

(i)
eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly
tourism activities;
(ii)
widening and strengthening of existing roads and construction of new roads;
(iii)
small scale industries not causing pollution;
(iv)
rainwater harvesting; and
(v)
cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph.
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Tourism.- (a)The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests
and Environment of the State Government.
(c) The activity of tourism shall be regulated as under, namely:-
(i)
all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to
time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the
Eco-sensitive Zone;
(ii)
new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the
Ghatigaon Hukna Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-
friendly tourism activities :
Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the
Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre defined and designated
areas for eco-tourism facilities as per Tourism Master Plan;
(iii)
till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(3) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(4) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,
and cultural significance shall be identified in the Eco-sensitive Zone and plans for their conservation shall be prepared
within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(5) Noise pollution.- The Environment Department of the State Government or Madhya Pradesh State Pollution Control
Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance
with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made
thereunder.
(6) Air pollution.- The Environment Department of the State Government or Madhya Pradesh State Pollution Control
Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance
with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made
thereunder.

(7)
Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.
(9)
Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10)
Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in
accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of
India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th
March, 2016, as amended from time to time.
(10) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is
prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(11) Industrial units
(a) No establishment of new wood based Industries within the Eco-sensitive Zone shall be permitted except the
existing wood based Industries set up as per the law.
(b) No establishment of any new Industry causing water, air, soil, noise pollution within the Eco-sensitive Zone
shall be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco -sensitive Zone
shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder, and be regulated in the manner specified in the Table below, namely:-

permitted within the Eco-sensitive Zone.

Setting up of industries causing water or air or

sensitive Zone shall be permitted.

Establishment of new major hydroelectric projects
and thermal projects.

No establishment of new trenching grounds shall be
permitted within the limits of Eco-sensitive Zone :
Provided that the existing trenching grounds maybe
operated subject to the conditions that no open burning
shall be allowed.
10.
Goat farming.
Prohibited (except as otherwise provided) as per applicable
laws.
11.
Protection of hill slopes and river banks.
No construction activity, unless otherwise permitted by
State Level Committee, shall be undertaken on the hill with
slopes more than 1 to 10 meters and also upto 100 meters
from the banks of any river, and natural nallah.
Regulated Activities
12.
Establishment of hotels and resorts.
No new commercial hotels and resorts shall be permitted
within one kilometer of the boundary of the protected area
or up to the boundary of the Eco-sensitive Zone whichever
is nearer except for accommodation for temporary
occupation of tourists related to eco-friendly tourism
activities:
Provided that, beyond one kilometer or up to the extent
of the Eco-sensitive Zone, all new tourism activities or
expansion of existing activities shall be in conformity with
the Tourism Master Plan.
13.
Construction activities.
(a) No new commercial construction of any kind shall be
permitted within one kilometer from the boundary of
protected area or up to the boundary of the Eco-sensitive
Zone whichever is nearer:
Provided that, local people shall be permitted to
undertake construction in their land for their residential use
including the activities listed in sub-paragraph (1) of
paragraph 3:
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the competent authority as per the
applicable rules and regulations, if any.
(b) Beyond one kilometer upto the extent of Eco-Sensitive
Zone, construction for bone fide local needs shall be
allowed and other construction activities shall be regulated
as per the Zonal Master Plan.
14.
Commercial use of firewood.
Regulated under applicable laws (with prior approval of
Chief Wildlife Warden of the State).
15.
Undertaking activities related to tourism like
over-flying the national park area by aircraft, hot-
air balloons.
Regulated under applicable laws (with prior approval of
Chief Wildlife Warden of the State).
16.
Felling of trees.
(a) There shall be no felling of trees in the forest or
Government or revenue or private lands without prior
permission of the Competent Authority in the State
Government.
(b) The felling of trees shall be regulated in accordance
with the provisions of the concerned Central or State Acts
and the rules made thereunder.

(c) In case of Reserve Forests and Protected Forests, the
Working Plan prescriptions shall be followed.
17.
Commercial water resources including ground
water harvesting.
(a)The extraction of surface water and ground water shall
be permitted only for bona fide agricultural use and
domestic consumption of the occupier of the land.
(b) Extraction of surface water and ground water for
industrial or commercial use including the amount that can
be extracted, shall require prior written permission from
the concerned Regulatory Authority.
(c) No sale of surface water or ground water shall be
permitted.
(d) Steps shall be taken to prevent contamination or
pollution of water from any source including agriculture.

5. Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective
monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-
(a) Divisional Commissioner, Gwalior -Chairman;
(b) Chief Conservator of Forest, Lion Project, Gwalior-Member;
(c) District Collector, district Gwalior-Member;
(d) Superintending Engineer Public Work Department,Gwalior-Member;
(e) Superintending Engineer Public Health Department,Gwalior- Member;
(f) Chief Executive Officer of Jila Panchayat Secretary-Member;
(g) One representative of None Governmental Organisation working in
the field of environment to be
nominated by the Government of Madhya Pradesh for a period of three years-Member;
(h) An expert in the area of ecology and environment to be nominated by the Government of Madhya
Pradesh for a period of three years-Member;
(i) District Officer of the Town and Country Planning Department-Member;
(j) Regional Officer Madhya PradeshPollution Control Board, Gwalior-Member;
(k) Member of Biodiversity Board- Member ;
(l) Wildlife Warden of the Ghatigaon Wildlife Sanctuary, Gwalior-Member -Secretary.
6.
Terms of reference.- 1. The tenure of the Monitoring Committee shall be three years.
2. The Monitoring Committee shall monitor the compliance of the provisions of this notification.
3. The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
4. The activities that are not covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are
falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph
4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and
referred to the concerned regulatory authorities.
5. The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment
(Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.
6. The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from industry associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
7. The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of
every year by the 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at
Annexure-IV.
8. The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions
of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme
Court of India or the High Court or National Green Tribunal .
