नई ᳰद᭨ ली, 15 ᳰदस᭥ बर, 2016

का. आ.4106(अ) .— के᭠ᮤीय सरकार, रा᳦ीय राजमागᭅ अिधिनयम 1956 (1956 का 48) (िजसे इसमᱶ इसके

प᳟ात् उᲦ अिधिनयम कहा गया है) कᳱ धारा 3क कᳱ उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, यह समाधान हो

जाने के प᳟ात् ᳰक “पि᭫ चम बंगाल रा᭔य मᱶ जलपाईगुडी िजले मᱶ रा᳦ीय राजमागᭅ सं᭎या 31 के ᳰक.मी. 624.400 (माल

बाज़ार) पर मौजूदा लेवल ᮓॉᳲसग (एलसी) के ᭭ थान पर आरयुबी के िनमाᭅण” के लोक ᮧयोजन के िलए वह भूिम अपेिᭃत है,

िजसका संिᭃ᭡ त वणᭅन नीचे अनुसूची मᱶ ᳰदया गया है, ऐसी भूिम का अजᭅन करने के अपने आशय कᳱ घोषणा करती है ।

कोई ᭪ यिᲦ, जो उ᭍ त भूिम मᱶ िहतब᳇ है, उ᭍ त अिधिनयम कᳱ धारा 3ग कᳱ उपधारा (1) के अधीन पूवᲃ᭍ त ᮧयोजन

के िलए ऐसी भूिम के उपयोग पर राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से इ᭍ कᳱस ᳰदन के भीतर आपिᱫ ᮧकट कर

सकेगा ।

ऐसी ᮧ᭜येक आपि᭜ त सᭃम ᮧािधकारी, अथाᭅत् अितᳯर᭍ त िवशेष भूिम अिधᮕहण अिधकारी, जलपाईगुडी िजला को

िलिखत ᱧप मᱶ ᮧ᭭ तुत कᳱ जाएगी और उसमᱶ उसके आधार अिधकिथत ᳰकए जाएंगे और सᭃम ᮧािधकारी आपिᱫकताᭅ को

᭪ यिᲦगत ᱨप मᱶ या ᳰकसी िविधक पेशेवर ᳇ारा सुने जाने का अवसर देगा और ऐसी सभी आिप᭜ तयᲂ कᳱ सुनवाई के प᭫ चात

तथा ऐसी और जांच करने के प᭫ चात् , यᳰद कोई हो, िजसे सᭃम ᮧािधकारी आव᭫ यक समझे, आदेश ᳇ारा या तो आपिᱫयᲂ को

अनु᭄ात कर सकेगा या अननु᭄ात कर सकेगा ।

उᲦ अिधिनयम कᳱ धारा 3ग कᳱ उपधारा (2) के अधीन सᭃम ᮧािधकारी ᳇ारा ᳰकया गया कोई आदेश अंितम

होगा।

इस अिधसूचना के अंतगᭅत आने वाली भूिम कᳱ आयोजनाएं और अ᭠य ᭣यौरे सᭃम ᮧािधकारी के उᲦ कायाᭅलय मᱶ

उपल᭣ध हᱹ और उनका िहतब᳃ ᳞िᲦयᲂ ᳇ारा िनरीᭃण ᳰकया जा सकता है ।

NOTIFICATION

New Delhi,the 15th December, 2016

S.O. 4106(E).—In exercise of the powers conferred by sub-section (1) of section 3A of the National Highways

Act, 1956 (48 of 1956)(hereinafter referred to as the said Act), the Central Government, after being satisfied that for the

public purpose, that land, the brief description of which is given in the Schedule below, is required for "Construction of

RUB in place of existing Level Crossing (LC) at km 624.400 (Mal Bazar) of NH-31 in the District of Jalpaiguri, in

the state of West Bengal", hereby declares its intention to acquire such land:

Any person interested in the said land may, within twenty-one days of publication of this notification in the

Official Gazette, object to the use of such land for the aforesaid purpose under sub-section (1) of section 3C of the said

Act.

Every such objection shall be made to the Competent Authority, namely, the Special Land Acquisition

Officer, Jalpaiguri District, in writing and shall set out the grounds thereof and the competent authority shall give the

objector an opportunity of being heard, either in person or through a legal practitioner, and may after hearing all such

objections and after making such further enquiry, if any, as the competent authority thinks necessary, by order, either

allow or disallow the objections.

Any order made by the competent authority under sub-section (2) of section 3C of the said Act shall be final.

The land plans and other details of the land covered under this notification are available and can be inspected by

the interested person at the aforesaid office of the competent authority.

Description of Land to be acquired with or without structure falling within the stretch of land from km 624.541

to km 624.865 and km 623.850 to km 624.541 for proposed “Construction of RUB in place of existing Level Crossing

(LC) at km 624.400 (Mal Bazar) of NH-31 in the District of Jalpaiguri, West Bengal”.
