13(2) के अनुसार उसको मौजूदा अिधकतम खुदरा क)मत को बनाए रखना होगा।

(ग) अगर िनमाताU ने उपयु. सारणी के :तंभ (5) म7 वDणत अिधकतम क)मत पर सरकार को वा:तव म7 भुगतान कया है या यह देय है

तो वे :थानीय कर/ को जोड़ सकते है।

(घ) औषध (मूय िनयं ण) आदेश, 2013 के पैराJाफ 11 म7 दए गए ावधान/ के तहत स बिWधत िनमाताU को उपयु. सारणी के :तंभ

(5) म7 िविन;द< अिधकतम क)मत के आधार पर अनुसूिचत िविनDमितय/ के पैक/ के िलए अिधकतम क)मत िनधा&रत कर7। िनमाता औषध

(मूय िनयं ण) आदेश, 2013 के पैराJाफ 24 के तहत फॉम V म7 अिधसूचना क) तारीख से आईपीडीएमएस के माYयम से भरकर

एनपीपीए को एक मूय सूची जारी कर7। तथा उसक) कॉपी राZय औशिध िनयं क/ और िविनमाता िवतरक को जारी कर7।

(ड.)

औषध (मूय िनयं ण) आदेश, 2013 के 24 (4) के उपबंध/ के अनुसार =येक फुटकर िव?ेता और िवतरक िविनमाता !ारा दए

गए 6प म7 ऐसे प&रसर, जहां कारबार को इस कार कया जा रहा है क उससे परामश के इ[छुक कसी \ि. के िलए प2ंच आसान हो,

वहां उसके कसी सहजदृ^ य भाग पर क)मत सूची और पूरक सूची, यद कोई हो, को संदDषत करेगा।

(च) उपयु. सारणी के :तंभ (5) म7 िविन;द< अिधकतम क)मत के िलए िविन;द< अनुसूिचत िविनDमितय/ के िविन;द< िविभ_ तरीके और

बलता से िभ_ अगर मौजूदा िनमाताU !ारा एक नई औषिध को लांच करता है तो उसे पहले औषध (मूय िनयं ण) आदेश, 2013 के

पैराJाफ 2(न) के अनुसार औषध (मूय िनयं ण) आदेश, 2013 के तहत सूची II म7 िविन;द< फाम प् के माYयम से एनपीपीए म7 मूय

िनधारण हेतु आवेदन करना होगा।

(छ) उपयु. अनुसूिचत िविनDमितय/ क) उ=पादन/आयात और िब?) के स बWध म7 िनमाताU को औषध (मूय िनयं ण) आदेश, 2013 के

सूची II के फॉम III को आईपीडीएमएस के माYयम से भरकर एनपीपीए को हर ितमाही क) &रपोट :तुत करेगा। उपयु. अनुसूिचत

िविनDमितय/ के िनमाण को कोई िनमाता उ=पादन बWद करने का इ[छुक हो तो इसक) सूचना एनपीपीए को अवगत करायेगा। इसके

स बWध म7 अगर अनुसूिचत िविनDमितय/ के उ=पादन और आयात को बWद करने का इ[छुक है तो बWद करने क) ितिथ से छः महीने पहले

सूची aप् के फॉम aट म7 भरकर एनपीपीए को :तुत करेगा।

(ज) िविनमाता या िवपणन क पनी, उपरो. किथत सारणी म7 दशाये अिधकतम मूय और शतb का पालन नहc करती हd तो वे आव^यक

व:तुएँ अिधिनयम, 1955 के साथ प&ठत डीपीसीओ, 2013 के ावधान/ के अधीन fयाज सिहत अिधभा&रत रािश को जमा करने के िलए

दायी ह/गे।

(झ) इस आदेश म7 उपरो. सारणी के :तंभ (2) म7 क) त=:थानी िवि< म7 िविन;द< ऐसी िविनDमितय/ के पैक/ क) अिधकतम क)मत िनयत

होने के प&रणाम:वGप, अिधकतम और खुदरा मूय िनधा&रत आदेश यद कोई हो, जो क इस आदेश से पूव जारी 2ए है, :वतः ही

अिध?मण हो जाय7गे।

ORDER

New Delhi, the 22nd December, 2016

S.O. 4127 (E).—In exercise of the powers conferred by paragraphs 4, 6, 10, 11, 14, 16, 17 and 18 of the Drugs

(Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30^th May, 2013 and S.O. 701(E) dated 10^th March, 2016

issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing

Authority (hereinafter referred as NPPA) hereby fixes the prices as specified in column (5) of the table herein below as

ceiling price exclusive of local tax applicable, if any, in respect of the Scheduled formulations specified in the

corresponding entry in column (2) of the said Table with the strength and unit specified respectively in the corresponding

entries in columns (3) and (4) thereof:

Note :

(a)

All manufacturers of scheduled formulations, selling the branded or generic or both the versions of scheduled

formulations at a price higher than the ceiling price (plus local taxes as applicable) so fixed and notified by the

Government, shall revise the prices of all such formulations downward not exceeding the ceiling price specified in

column (5) in the above table plus local taxes as applicable, if any.

(b)

All the existing manufacturers of above mentioned scheduled formulations having MRP lower than the ceiling

price specified in column (5) in the above table plus local taxes as applicable, if any, shall continue to maintain the

existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013.

(c)

The manufacturers may add local taxes only if they have paid actually or if it is payable to the Government on the

ceiling price mentioned in column (5) of the above said table.

(d)

The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in

accordance with the ceiling price specified in column (5) of the above table as per provisions contained in

paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V from

date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State

Drug Controller and dealers.

(e)

As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list,

if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a

manner so as to be easily accessible to any person wishing to consult the same.

(f)

Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above

table launches a new drug as per paragraph 2 (u) of the DPCO, 2013 such existing manufacturer shall apply for

prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013.

(g)

The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of

production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through

IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish

information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in

Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.

(h)

The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit

the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013

read with Essential Commodities Act, 1955.

Consequent to the issue of ceiling price of such formulation as specified in column (2) of the above table in this

notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of

Note:

(a) All manufacturers of scheduled formulations, selling the branded or generic or both the versions of scheduled

formulations at a price higher than the ceiling price (plus local taxes as applicable) so fixed and notified by the

Government, shall revise the prices of all such formulations downward not exceeding the ceiling price specified

in column (5) in the above table plus local taxes as applicable, if any.

(b) All the existing manufacturers of above mentioned scheduled formulations having MRP lower than the ceiling

price specified in column (5) in the above table plus local taxes as applicable, if any, shall continue to maintain

the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013.

(d) The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in

accordance with the ceiling price specified in column (5) of the above table as per provisions contained in

paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V

from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy

to State Drug Controller and dealers.

(e) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price

list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business

in a manner so as to be easily accessible to any person wishing to consult the same.

(f) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the

above table launches a new drug as per paragraph 2 (u) of the DPCO, 2013 such existing manufacturer shall

apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the

DPCO, 2013.

(g) The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect

of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013

through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation

shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled

formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of

discontinuation.

(h) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to

deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control)

Order, 2013 read with Essential Commodities Act, 1955.

(i) Consequent to the issue of ceiling prices of such formulations as specified in column (2) of the above table in

this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of

notification, stand(s) superseded.

S.O.4129(E).— In implementation of directions given in line with review order issued vide letter no.

31015/54/2016-PI.I dated 14.9.2016 passed by the Department of Pharmaceuticals and in exercise of the powers

conferred by paragraphs 4, 10, 11, 14, 16, 17 and 18 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E)

dated the 30th May, 2013 and S.O. 701(E) dated 10th March, 2016 issued by the Government of India in the Ministry of

Chemicals and Fertilizers, and in supersession of the Order of the Government of India in the Ministry of Chemicals and

Fertilizers (National Pharmaceutical Pricing Authority) No. S.O. 1951(E), dated 2nd June, 2016 regarding formulation

pack mentioned in the table at Sl. No. 25 , in so far as it relates to formulation pack mentioned in the table below, except

in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority,

hereby fixes the price as specified in column (5) of the table herein below as ceiling price exclusive of local tax

applicable, if any in respect of the Scheduled formulation specified in the corresponding entry in column (2) of the said

Table with the strength and unit specified respectively in the corresponding entries in columns (3) and (4) thereof:

(ड.) उपयु. गैर अिधकत क)मत (खुदरा मूय) केवल उपयु. िनमाता/िवपणन के िलए लागू है जैसा क उWह/ने औषध (मूय िनयं ण)

आदेश, 2013 के तहत अनुबs मूय िनधारण/संशोधन के िलए फॉम I पर जमा कया गया था और सरकार !ारा िनधा&रत सभी लागू

वैधािनक आव^यकताU क) पूDत के अधीन ासंिगक िविधय//िनयम/ के अWतगत जैस क केWtीय/राZय लाइसेhसग ऑिथ&रटी के स4म

ािधकारी !ारा मेWयूफेMचuरग लाइस7स मंजूरी के तहत संबंिधत िविनDमत िनमाता/िवपणन क पिनयां जो अनुपालन करती है।

(च) उपयु. िविनDमितय/ क) उ=पादन/आयात और िब?) के स बWध म7 स बिWधत िनमाताU को औषध (मूय िनयं ाण) आदेश, 2013 के

िनमाण को कोई िनमाता उ=पादन बWद करने का इ[छुक हो तो इसक) सूचना एनपीपीए को अवगत करायेगा। इसके स बWध म7 अगर

िविनDमितय/ के उ=पादन और आयात को बWद करने का इ[छुक है तो बWद करने क) ितिथ से छः महीने पहले सूची II के फॉम IV म7 भरकर

statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the Central/State

Licensing Authority, as may be applicable, by the concerned manufacturers/marketing companies.

production/import and sale of product in Form-III of Schedule-II of the DPCO, 2013 through IPDMS.

Manufacturers, in case intending to discontinue above said formulations, shall furnish information to the NPPA, in

Commodities Act, 1955.

(a) The manufacturers of above mentioned formulations i.e. “new drug” under paragraph 2(u) of the DPCO, 2013

shall fix the retail price as specified in column (6) of the table hereinabove.

(b) The manufacturers may add local taxes only if they have paid actually or it is payable to the Government on the

retail price mentioned in column (6) of the above said table.

(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price

list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business

in a manner so as to be easily accessible to any person wishing to consult the same.

(e) The above mentioned retail price is applicable only to the individual manufacturers/marketeers as mentioned

above i.e. who have applied for the same by submitting Form-I for price fixation /revision as stipulated under

DPCO, 2013 and subject to fulfillment of all the applicable statutory requirements as laid down by the Govt.

under relevant statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the

Central/State Licensing Authority, as may be applicable, by the concerned manufacturers/marketing companies.

(f) The concerned manufacturers of above said formulations shall furnish quarterly return to the NPPA, in respect

of production / import and sale of product in Form-III of Schedule-II of the DPCO, 2013 through IPDMS.

Manufacturers, in case intending to discontinue above said formulations, shall furnish information to the NPPA,

in respect of discontinuation of the production and/or import of above said formulation in Form-IV of Schedule-

II of the DPCO, 2013 at least six months prior to the intended date of discontinuation.

(g) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price notification

and notes specified hereinabove, then the concerned manufacturer/marketing company shall be liable to deposit

the overcharged amount along with the interest thereon under the provisions of the DPCO, 2013 read with the

Essential Commodities Act, 1955.

(h) Consequent to the issue of retail price of the aforesaid formulations as specified in column (2) of the above

mentioned table in this notification, the price order(s) if any, issued for concerned manufacturer / marketer prior

to the above said date of notification, stand(s) superseded.
