सा.का.िन.1168(अ).—नागᳯरकता अिधिनयम 1955 (1955 का 57) कᳱ धारा 18 ᳇ारा ᮧद᭜ त शिᲦयᲂ का ᮧयोग करते ᱟए

के᭠ ᮤीय सरकार नागᳯरकता िनयम, 2009 का और संशोधन करने के िलए िन᭥ निलिखत िनयम बनाती है, अथाᭅत्:-

(1) इन िनयमᲂ का संिᭃ᭡ त नाम नागᳯरकता (संशोधन) िनयम, 2016 है।

(2) ये राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख को ᮧवृ᭜ त हᲂगे।

2. नागᳯरकता िनयम, 2009 (िजसे इसमᱶ इसके प᭫ चात् उ᭍ त िनयम कहा गया है) मᱶ िनयम 11 के उप िनयम (3) मᱶ, िन᭥ निलिखत

पर᭠ तुक अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“पर᭠ तु यह और ᳰक अफगािन᭭ तान, बां᭏ लादेश और पाᳰक᭭ तान के अ᭨ पसं᭎ यक समुदायᲂ (अथाᭅत् िह᭠ दु, िस᭍ ख, बौ᳍, जैन, पारसी

और ईसाई) से संबंिधत ᳰकसी ᭪ यिᲦ ᳇ारा ᮧ᭭ तुत आवेदन कᳱ बाबत कले᭍ टर कᳱ अनुपि᭭थित मᱶ, कल᭍ टर ᳇ारा िलिखत मᱶ ᮧािधकृत

कोई अिधकारी जो उप-खंड मिज᭭ ᮝेट कᳱ पंिᲦ से कम का न हो आवेदक को रा᭔ य िन᭬ ठा कᳱ शपथ ᳰदलाएगा।”

3. उ᭍ त िनयम के िनयम 38 के उप-िनयम (1) मᱶ, पर᭠ तुक के प᭫ चात् िन᭥ निलिखत पर᭠ तुक अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“पर᭠ तु यह और ᳰक अफगािन᭭ तान, बां᭏ लादेश और पाᳰक᭭ तान के अ᭨ पसं᭎ यक समुदायᲂ (अथाᭅत् िह᭠ दू, िस᭍ ख, बौ᳍, जैन, पारसी

और ईसाई) से संबंिधत ᳰकसी ᭪ यिᲦ ᳇ारा ᮧ᭭ तुत आवेदन कᳱ बाबत कले᭍ टर, उप-आयु᭍ त अथवा िजला मिज᭭ ᮝेट कᳱ अनुपि᭭थित मᱶ,

आवेदन अथवा घोषणा, यथाि᭭थित, कले᭍ टर, उपायु᭍ त अथवा िजला मिज᭭ ᮝेट ᳇ारा िलिखत मᱶ ᮧािधकृत कोई अिधकारी जो उप-खंड

मिज᭭ ᮝेट कᳱ पंिᲦ से कम का न हो, कᳱ उपि᭭थित मᱶ ह᭭ ताᭃᳯरत कᳱ जाए या शपथ ᳰदलाई जाए।”

4. उ᭍ त िनयमᲂ कᳱ अनुसूची 1 मᱶ,-

(क) ᮧाᱧप 2 मᱶ,-

5. उ᭍ त िनयमᲂ कᳱ अनुसूची 4 मᱶ, ᮓ. सं. 1 और ᮓ.सं.

(ख) उपरो᭍ त (क) के अधीन न आने वाले सभी अ᭠ य ᭪ यिᲦ –

(i) आवेदन के साथ

(ii) रिज᭭ ᮝीकरण ᮧमाणपᮢ ᮧदान करना

(2) धारा 5(1) (ग) के अधीन –

(क) अफगािन᭭ तान, बां᭏ लादेश और पाᳰक᭭ तान मᱶ अ᭨ पसं᭎ यक

(4) धारा 5(1) (ड.) और धारा 5(1) (च) के अधीन –

(क) अफगािन᭭ तान, बां᭏ लादेश और पाᳰक᭭ तान मᱶ अ᭨ पसं᭎ यक

समुदाय (अथाᭅत् िह᭠ दु, िस᭍ ख, बौ᳍, जैन, पारसी तथा ईसाई) से

संबंध रखने वाले ᭪ यिᲦयᲂ कᳱ बाबत –

(i) आवेदन के साथ

(ii) रिज᭭ ᮝीकरण ᮧमाणपᮢ ᮧदान करना

NOTIFICATION

New Delhi, the 23rd December, 2016

G.S.R.1168(E).— In exercise of the powers conferred by section 18 of the Citizenship Act, 1955 (57 of 1955), the Central

Government hereby makes the following rules further to amend the Citizenship Rules, 2009, namely:—

1. (1) These rules may be called the Citizenship (Amendment) Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Citizenship Rules, 2009 (hereinafter referred to as the said Rules),in rule 11, in sub-rule (3), the following proviso

shall be inserted, namely:—

“Provided that in respect of an application submitted by any person belonging to minority community in

Afghanistan, Bangladesh and Pakistan (namely, Hindus, Sikhs, Buddhists, Jains, Parsis and Christians), in the absence of the

Collector, an officer not below the rank of the Sub-Divisional Magistrate authorised in writing by the Collector, may

administer to the applicant the oath of allegiance.”.

In rules 38 of the said Rules, in sub-rule (1), after the proviso, the following proviso shall be inserted, namely:—

“Provided further that in respect of an application submitted by any person belonging to minority community in

Afghanistan, Bangladesh and Pakistan (namely, Hindus, Sikhs, Buddhists, Jains, Parsis and Christians), in the absence of the

Collector, Deputy Commissioner or the District Magistrate, the application or declaration may be signed in the presence of,

or the oath administered by, an officer not below the rank of the Sub-Divisional Magistrate authorised in writing by the

Collector, or Deputy Commissioner or the District Magistrate, as the case may be.”.

4. In Schedule I to the said Rules,—

(a) in Form II,—

(i) in the sentence under asterisk (*) marks, the words and brackets “before whom the registration,

declaration or oath of allegiance is made or taken (i.e. the Collector, Deputy Commissioner, District Magistrate)”

shall be omitted;

(ii) under the entries relating to Documents to be attached with the application by the applicant, paragraph

4 shall be omitted;

(b) in Form III,—

(i) in the sentence under asterisk (*) marks, the words and brackets “before whom the registration,

declaration or oath of allegiance is made or taken (i.e. the Collector, Deputy Commissioner, District Magistrate)”

shall be omitted;

(ii) under the entries relating to Documents to be attached with the application by the applicant, paragraph

5 shall be omitted;

(i) in the sentence under asterisk (*) marks, the words and brackets “before whom the registration,

declaration or oath of allegiance is made or taken (i.e. the Collector, Deputy Commissioner, District Magistrate)”

shall be omitted;
