ᮧशु᭨क आधाᳯरत बोली ᮧᳰᮓया के मा᭟यम से िवतरण लाइसᱶिसयᲂ ᳇ारा िव᳒ुत के अ᭨पाविधक (अथाᭅत् एक ᳰदन से

अिधक और एक वषᭅ तक कᳱ अविध के िलए) ᮧापण हेतु ᳰदशा-िनदᱷश।

1.1

िव᳒ुत अिधिनयम, 2003 कᳱ धारा 63 के अनुपालन मᱶ कᱶᮤ सरकार ने ᳰदनांक 30 माचᭅ, 2016 को भारत

के राजपᮢ (असाधारण) (भाग-I, खंड-1) मᱶ ᮧकािशत संक᭨प स᭎या 23/25/2011-आरएंडआर (खंड-III) के मा᭟यम

से "ᮧशु᭨क आधाᳯरत बोली ᮧᳰᮓया के मा᭟यम से िवतरण लाइसᱶिसयᲂ ᳇ारा िव᳒ुत कᳱ अ᭨पाविध (अथाᭅत् एक ᳰदन

से अिधक और एक वषᭅ तक कᳱ अविध के िलए) ᮧापण के िलए संशोिधत ᳰदशा-िनदᱷश" अिधसूिचत ᳰकए थे।

2.0

कᱶᮤ सरकार एतद᳇ारा अ᭠य बातᲂ के साथ-साथ ᳯरवसᭅ ऑ᭍शन ᮧᳰᮓया मᱶ ᭭वत: िव᭭तार को कायाᭅि᭠वत

करने और कुछ ᮧावधानᲂ को और अिधक ᭭प᳥ करने के िलए उᲦ ᳰदशा-िनदᱷशᲂ मᱶ िन᳜िलिखत संशोधन अिधसूिचत

करती है जो ᳰदनांक 01 जनवरी, 2017 से ᮧभावी हᲂगे।

2.1

ᳲबदु सं. 3.3 का पैरा: "ᮧापक अथवा उनके एआर ई-बोली पोटᭅल पर मांग-पᮢ ᮧ᭭तुत कर सकते हᱹ और

इवᱶट का सृजन कर सकते हᱹ। सभी बोलीदाता पीएफसीसीएल को अिधकतम ᭃमता, जहां तक बोलीदाता बोली

लगाने का इ᭒छुक है, के िलए 500 ᱧपए ᮧित मेगावाट के अपेिᭃत शु᭨क का भुगतान करने पर ई-बोली इवᱶट मᱶ भाग

लेने मᱶ सᭃम हो सकᱶगे। अपेिᭃत शु᭨क तथा लागू कर एमएसटीसी िलिमटेड ᳇ारा पोटᭅल के मा᭟यम से, उपल᭣ध

करवाए गए ई-भुगतान गेटवे ᳇ारा जमा ᳰकए जाएंगे। बोली-ᮧᳰᮓया के पूरा होने के प᳟ात, केवल सफल

बोलीदाता(Ა) को ही, ᮧ᭜येक बोलीदाता को आबंᳯटत माᮢा के िलए, इन शु᭨कᲂ का भुगतान करना होगा।

पीएफसीसीएल ᳇ारा, शेष रािश को िबना ᳰकसी ᭣याज के सात (7) कायᭅ ᳰदवसᲂ के भीतर वापस कर ᳰदया जाएगा।

चयिनत न होने वाले बोलीदाता(Ა) ᳇ारा जमा ᳰकए गए शु᭨क को भी, इवᱶट के पूरा होने के 7 कायᭅ ᳰदवसᲂ के

भीतर, पीएफसीसीएल ᳇ारा िबना ᳰकसी ᭣याज के वापस कर ᳰदया जाएगा।"

इसे िन᳜ानुसार पढ़ा जाए:

"ᮧापक(कᲂ) अथवा उनके एआर ई-बोली पोटᭅल पर मांग-पᮢ ᮧ᭭तुत कर सकते हᱹ और इवᱶट का सृजन कर सकते हᱹ।

सभी बोलीदाता पीएफसीसीएल को उस िवशेष मांग के िलए, िजसके िलए बोलीदाता बोली लगाने का इ᭒छुक है

यूᳯटिलटी ᳇ारा अपेिᭃत कुल ᭃमता के िलए, 500 ᱧपए ᮧित मेगावाट ᮧित मांग के अपेिᭃत शु᭨क का भुगतान करने

पर ई-बोली इवᱶट मᱶ भाग लेने मᱶ सᭃम हो सकᱶगे। अपेिᭃत शु᭨क तथा लागू कर एमएसटीसी िलिमटेड ᳇ारा पोटᭅल

के मा᭟यम से, उपल᭣ध करवाए गए ई-भुगतान गेटवे ᳇ारा जमा ᳰकए जाएंगे। बोली-ᮧᳰᮓया के पूरा होने के प᳟ात,

केवल सफल बोलीदाता(Ა) को ही, ᮧ᭜येक बोलीदाता को आबंᳯटत माᮢा के िलए, इन शु᭨कᲂ का भुगतान करना

होगा। पीएफसीसीएल ᳇ारा, शेष रािश को िबना ᳰकसी ᭣याज के सात (7) कायᭅ ᳰदवसᲂ के भीतर वापस कर ᳰदया

जाएगा। चयिनत न होने वाले बोलीदाता(Ა) ᳇ारा जमा ᳰकए गए शु᭨क को भी, इवᱶट के पूरा होने के 7 कायᭅ ᳰदवसᲂ

के भीतर, पीएफसीसीएल ᳇ारा िबना ᳰकसी ᭣याज के वापस कर ᳰदया जाएगा।"

2.2

ᳲबदु सं.7.10 का पैरा: "िन᭬कासन के प᳟ात संिᭃ᳙ सूची मᱶ आने वाले बोलीदाता को ᮧणाली ᳇ारा

उ᭜पाᳰदत ई-मेल ᳇ारा ही ᳞िᲦगत ᱨप से सूिचत ᳰकया जाएगा। ᳯरवसᭅ नीलामी आरंिभक मू᭨य ᮧ᭭तावᲂ के खुलने

के 120 िमनट के भीतर शुᱨ होनी चािहए और िबना ᳰकसी िव᭭तार (᭭वतः या अ᭠यथा) के अगले 120 िमनटᲂ कᳱ

अविध के िलए जारी रहेगी। ᳯरवसᭅ नीलामी के दौरान, बोलीदाताᲐ के पास, उनके ᳇ारा दशाᭅए गए ᮧशु᭨क मᱶ एक

पैसा या इसके गुणक मᱶ कमी करने और उनके ᳇ारा उ᭞धृत कᳱ गई ᮧमाᮢा मᱶ एक मेगावाट या इसके गुणक मᱶ

बढ़ोतरी करने का िवक᭨प होगा। ᳯरवसᭅ नीलामी के दौरान मौजूदा ᭠यूनतम ᮧशु᭨क को सभी बोलीदाता देख सकᱶगे।"

इसे िन᳜ानुसार पढ़ा जाए:

"िन᭬कासन के प᳟ात संिᭃ᳙ सूची मᱶ आने वाले बोलीदाता को ᮧणाली ᳇ारा उ᭜पाᳰदत ई-मेल ᳇ारा ही ᳞िᲦगत

ᱨप से सूिचत ᳰकया जाएगा। ᳯरवसᭅ नीलामी आरंिभक मू᭨य ᮧ᭭तावᲂ के खुलने के 120 िमनट के भीतर शुᱨ होनी

चािहए और अगले 120 िमनटᲂ कᳱ अविध के िलए जारी रहेगी। ᳯरवसᭅ नीलामी के दौरान, बोलीदाताᲐ के पास,

उनके ᳇ारा दशाᭅए गए ᮧशु᭨क मᱶ एक पैसा या इसके गुणक मᱶ कमी करने और उनके ᳇ारा उ᭞धृत कᳱ गई ᮧमाᮢा मᱶ

एक मेगावाट या इसके गुणक मᱶ बढ़ोतरी करने का िवक᭨प होगा। ᳯरवसᭅ नीलामी के दौरान मौजूदा ᭠यूनतम ᮧशु᭨क

को सभी बोलीदाता देख सकᱶगे।"

बशतᱷ ᳰक ई-ᳯरवसᭅ नीलामी के िनधाᭅᳯरत बंद ᳰकए जाने से पूवᭅ अंितम 10 (दस) िमनट के दौरान, यᳰद सबसे कम

मौजूदा बोली से कम कᳱ बोली ᮧा᳙ होती है तो ई-ᳯरवसᭅ नीलामी को बंद ᳰकए जाने का समय अंितम ᮧा᳙ बोली

समय से 10 (दस) िमनट तक ᭭वत: ही बढ़ जाएगा। ᭭वत: िव᭭तार कᳱ यह ᮧᳰᮓया 10 (दस) िमनट कᳱ अविध तक

जारी रहेगी िजसके दौरान ऐसी कोई बोली ᮧा᳙ न हो जो वतᭅमान ᭠यूनतम बोली से कम हो।"

Amendment to the Guidelines for short-term (i.e. for a period of more than one day to one year)

Procurement of Power by Distribution Licensees through Tariff based bidding process.

No. 23/25/2011-R&R (Vol-III) 1.0 .—INTRODUCTION

1.1

In compliance with section 63 of the Electricity Act, 2003, the Central Government had notified the

"revised Guidelines for short term (i.e. for a period of more than one day to one year) Procurement of Power by

Distribution Licensees through Tariff based bidding process" vide resolution No. 23/25/2011-R&R(Vol-III)

published in the Gazette of India (Extraordinary) (Part- I, Section-1) on 30^th March, 2016.

2.0

The Central Government hereby notifies the following amendments in the said guidelines inter-alia to

implement auto extension in the reverse auction process and to bring more clarity in some of the provisions, to

be effective from 1^st January, 2017:

2.1

The Para at point No. 3.3: “The Procurer(s) or their AR can raise indents on the e-Bidding portal

and create events. All the Bidders would be able to participate in the e-Bidding events on making payment of

the requisite fees of

500 per MW for the maximum capacity, a bidder is willing to bid, to PFCCL. The

requisite fee plus applicable taxes shall be deposited through the portal by e-Payment Gateway provided by

MSTC Ltd. After the completion of the bidding process, only successful Bidder(s) will have to pay these

charges for the quantum allocated to each bidder. The balance amount will be refunded by PFCCL within

seven (7) working days without any interest. The fee deposited by non Selected Bidder(s) will also be

refunded by PFCCL within seven (7) working days of completion of the event without any interest.”

May be read as under:

“The Procurer(s) or their AR can raise indents on the e-Bidding portal and create events. All the Bidders

would be able to participate in the e-Bidding events on making payment of the requisite fees of Rupees 500

per MW per requisition for the total capacity sought by the Utility for that particular requisition for which the

bidder is willing to bid, to PFCCL. The requisite fee plus applicable taxes shall be deposited through the

portal by e-Payment Gateway provided by MSTC Ltd. After the completion of the bidding process, only

successful Bidder(s) will have to pay these charges for the quantum allocated to each bidder. The balance

amount will be refunded by PFCCL within seven (7) working days without any interest. The fee deposited by

non Selected Bidder(s) will also be refunded by PFCCL within seven (7) working days of completion of the

event without any interest.”

2.2

The Para at point No. 7.10: “The shortlisted Bidder after elimination will be intimated individually

by system generated emails only. The Reverse auction should start within 120 minutes of opening of Initial

Price Offers and shall continue for a period of next 120 minutes without any extension (automatic or

otherwise). During the Reverse Auction the Bidders will have the option of reducing the tariff quoted by them

in decrements of one paise or multiples thereof and to increase the quantum quoted by them by 1 MW or

multiples thereof. During the Reverse Auction the prevailing Lowest Tariff would be visible to all the

Bidders.”

May be read as under:

“The shortlisted Bidder after elimination will be intimated individually by system generated emails only. The

Reverse auction should start within 120 minutes of opening of Initial Price Offers and shall continue for a

period of next 120 minutes. During the Reverse Auction the Bidders will have the option of reducing the tariff

quoted by them in decrements of one paise or multiples thereof and to increase the quantum quoted by them

by 1 MW or multiples thereof. During the Reverse Auction the prevailing Lowest Tariff would be visible to all

the Bidders.

Provided that during the last 10 (ten) minutes before the scheduled close time of e-Reverse auction, if a price

bid is received which is lower than the lowest prevailing price bid recorded in the system during e-Reverse

auction, the close time of e-Reverse auction will be automatically extended by 10 (ten) minutes from the time

of the last price bid received. This process of auto extension will continue till there is a period of 10 (ten)

minutes during which no price bid is received which is lower than the prevailing lowest price bid ".
