का.आ. 4246(अ).—जबᳰक, ᳰदनांक 09 जून, 2016 के भारत के राजपᮢ असाधारण, भाग- II, ख᭛ ड-3, उप-

ख᭛ ड (ii) मᱶ ᮧकािशत गृह मंᮢालय, भारत सरकार कᳱ ᳰदनांक 09 जून, 2016 कᳱ अिधसूचना सं. का.आ. 2053(अ) के तहत

जगदलपुर मᱶ ᮧथम अपर सᮢ ᭠ यायाधीश ᮰ी संजीव कुमार तमक को रा᭬ ᮝीय अ᭠ वेषण अिभकरण अिधिनयम, 2008 (2008

का 34) कᳱ धारा-11 कᳱ उप-धारा (1) के ᮧयोजनाथᭅ अिधसूिचत िवशेष ᭠ यायालय कᳱ अ᭟ यᭃता करने के िलए ᭠ यायाधीश के

ᱨप मᱶ िनयु᭍ त ᳰकया गया था;

और जबᳰक, ᮰ी संजीव कुमार तमक, िज᭠ हᱶ उ᭍ त िवशेष ᭠ यायालय कᳱ अ᭟ यᭃता करने हेतु ᭠ यायाधीश के ᱨप मᱶ इस

ᮧकार िनयु᭍ त ᳰकया गया था, का ᭭ थानांतरण हो गया है;

और जबᳰक, के᭠ ᮤीय सरकार ने, रा᭬ ᮝीय अ᭠ वेषण अिभकरण अिधिनयम, 2008 कᳱ धारा 11 कᳱ उप-धारा (1) के

अंतगᭅत ᮧद᭜ त शिᲦयᲂ का ᮧयोग करते ᱟए, ᳰदनांक 29 ᳰदस᭥ बर, 2016 के भारत के राजपᮢ, असाधारण, भाग-II, ख᭛ ड-3,

उप-ख᭛ ड (ii) मᱶ ᮧकािशत ᳰदनांक 29 ᳰदस᭥ बर, 2016 कᳱ अिधसूचना सं᭎ या का.आ. 4219(अ) के तहत ᮧथम अपर सᮢ

᭠ यायाधीश, जगदलपुर के ᭠ यायालय को रा᭬ ᮝीय अ᭠ वेषण अिभकरण अिधिनयम, 2008 (2008 का 34) कᳱ धारा 11 कᳱ

उप-धारा (1) के ᮧयोजनाथᭅ अनुसूिचत अपराधᲂ के िवचारण के िलए िवशेष ᭠ यायालय के ᱨप मᱶ अिधसूिचत ᳰकया था,

िजसका ᭃेᮢािधकार छ᭜ तीसगढ़ के िसिवल िडि᭭ᮝ᭍ ट उ᭜ तर ब᭭ तर कांकेर, जगदलपुर, दिᭃण ब᭭ तर (द᭠ तेवाड़ा) ि᭭थत ब᭭ तर,

तथा कᲂडागांव तक था;

अत: अब, के᭠ ᮤीय सरकार, उ᭍ त अिधिनयम कᳱ धारा-11 कᳱ उप-धारा (3) के अंतगᭅत ᮧद᭜ त कᳱ गई शिᲦयᲂ का

ᮧयोग करते ᱟए तथा 09 जून, 2016 कᳱ अिधसूचना सं᭎ या का.आ. 2053(अ) का अिधᮓमण करते ᱟए, िसवाय उन कायᲄ के

िज᭠ हᱶ ऐसे अिधᮓमण के पूवᭅ स᭥ पाᳰदत कर िलया गया था अथवा करने से लोप कर ᳰदया गया था, छ᭜ तीसगढ़ उ᭒ च ᭠ यायालय

के माननीय मु᭎ य ᭠ यायाधीश कᳱ िसफाᳯरश पर ᮰ीमती िᮧिस᭨ ला पॉल होरो, ᮧथम अपर सᮢ ᭠ यायाधीश, जगदलपुर को,

एतद᳇ारा, उ᭍ त िवशेष ᭠ यायालय कᳱ अ᭟ यᭃता करने के िलए ᭠ यायाधीश के ᱨप मᱶ िनयु᭍ त करती है।

NOTIFICATION

New Delhi, the 29th December, 2016

S.O. 4246E).—Whereas, vide notification of the Government of India in the Ministry of Home Affairs number

S.O. 2053(E), dated the 9^th June, 2016, published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii)

dated the 9^th June, 2016, Shri Sanjeev Kumar Tamak, 1^st Additional Sessions Judge at Jagdalpur was appointed as the

Judge to preside over the Special Court notified for the purposes of sub-section (1) of section 11 of the National

Investigation Agency Act, 2008 (34 of 2008);

And whereas, Shri Sanjeev Kumar Tamak who was so appointed as Judge to preside over the said Special Court

has been transferred;

And whereas, in exercise of the powers conferred by sub-section (1) of section 11 of the National Investigation

Act, 2008, the Central Government vide notification number 4219(E), dated the 29th December, 2016, published in the

Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii) dated the 29th December, 2016, notified the Court of

1^st Additional Sessions Judge at Jagdalpur as Special Court for the purposes of sub-section (1) of section 11 of the

National Investigation Agency Act, 2008 (34 of 2008), having jurisdiction over Civil District Uttar Bastar Kanker, Bastar

at Jagdalpur, Dakshin Bastar (Dantewada) and Kondagaon of Chhattisgarh for the trial of Scheduled Offences;

Now, therefore, in exercise of the powers conferred by sub-section (3) of section 11 of the National

Investigation Act, 2008, and in supersession of the notification number S.O. 2053(E), dated the 9^th June, 2016, except as

respects things done or omitted to be done before such supersession, the Central Government, on the recommendations of

the Hon’ble Chief Justice of the High Court of Chhattisgarh, hereby appoints Shrimati Prisilla Paul Horo, 1^st Additional

Sessions Judge, Jagdalpur as the Judge to preside over the said Special Court.
