का.आ. 01(अ).—के᭠ᮤीय सरकार, कोयला धारक ᭃेᮢ (अजᭅन और िवकास) अिधिनयम, 1957 (1957 का 20)

(िजसे इसमᱶ इसके प᳟ात् उᲦ अिधिनयम कहा गया है) कᳱ धारा 4 कᳱ उप-धारा (1) के अधीन जारी, भारत सरकार के

कोयला मंᮢालय कᳱ अिधसूचना सं᭎यांक 2341(अ), तारीख 08 जुलाई, 2016 ᳇ारा, जो भारत के राजपᮢ, भाग II, ख᭛ड 3,

उप-ख᭛ड (ii), तारीख 11 जुलाई, 2016, मᱶ ᮧकािशत कᳱ गई थी, उᲦ अिधसूचना से उपाब᳍ अनुसूची मᱶ िविन᳸द᳥ पᳯरᭃेᮢ

कᳱ भूिम मᱶ िजसका माप 23.64 हे᭍टेयर (लगभग) या 58.41 एकड़ (लगभग) है, कोयले का पूवᱷᭃण करने के अपने आशय कᳱ

सूचना दी थी;

और के᭠ᮤीय सरकार का यह समाधान हो गया है ᳰक इस अिधसूचना मᱶ उपाब᳍ अनुसूची मᱶ िविहत उᲦ भूिम के

ᳰकसी भाग मᱶ कोयला अिभᮧा᭡य है;

अतः, अब, के᭠ᮤीय सरकार, उᲦ अिधिनयम कᳱ धारा 7 कᳱ उप-धारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए

इससे संलᲨ अनुसूची मᱶ वᳶणत 23.64 हे᭍टेयर (लगभग) या 58.41 एकड़ (लगभग) माप कᳱ उᲦ भूिम और ऐसी भूिम मᱶ के

या उस पर के सभी अिधकार के अजᭅन करने के अपने आशय ᳰक सूचना देती है;

ᳯट᭡पण 1 : इस अिधसूचना के अधीन आने वाले ᭃेᮢ के रेखांक सं᭎या आरईवी/11/2016, तारीख 27 अग᭭त, 2016 का

िनरीᭃण उपायुᲦ, िजला रामगढ़, झारख᭛ड के कायाᭅलय मᱶ या कोयला िनयंᮢक, 1, काउंिसल हाउस ᭭ᮝीट, कोलकाता –

700001 के कायाᭅलय मᱶ या महाᮧबंधक कुजू ᭃेᮢ, िजला रामगढ़, झारखंड के कायाᭅलय मᱶ या महाᮧबंधक (भूिम और

राज᭭व), सᱶᮝल कोलफᳱ᭨᭙स िलिमटेड, दरभंगा हाउस, राँची – 834001 या मु᭎य महाᮧबंधक (गवेषणा ᮧभाग), सᱶᮝल माइन

᭡लाᳲनग और िडजाइन इं᭭टी᭒यूट िलिमटेड, गᲂडवाना पैलेस, कांके रोड, राँची – 834001 मᱶ ᳰकया जा सकता है।

ᳯट᭡पण 2: उᲦ अिधिनयम कᳱ धारा 8 के उपबंधᲂ कᳱ ओर ᭟यान आकृ᳥ ᳰकया जाता है, िजसमᱶ िन᳜िलिखत उपबंध हᱹ :-

अजᭅन कᳱ बाबत आपिᱫयां.–

‘’8. (1) कोई ᳞िᲦ, जो ᳰकसी भूिम मᱶ िजसकᳱ बाबत धारा 7 के अधीन अिधसूचना िनकाली गई है, िहतब᳍ है, अिधसूचना

के िनकाले जाने से तीस ᳰदन के भीतर स᭥पूणᭅ भूिम या उसके ᳰकसी भाग या ऐसी भूिम मᱶ या उस पर के ᳰक᭠हᱭ अिधकारᲂ का

अजᭅन ᳰकए जाने के बारे मᱶ आपिᱫ कर सकेगा ।

᭭प᳥ीकरण.- इस धारा के अथाᭅ᭠तगᭅत यह आपिᱫ नहᱭ मानी जाएगी ᳰक कोई ᳞िᲦ ᳰकसी भूिम मᱶ कोयला उ᭜पादन के िलए

᭭वयं खनन संᳰᮓयाएँ करना चाहता है और ऐसी संᳰᮓयाएँ के᭠ᮤीय सरकार या ᳰकसी अ᭠य ᳞िᲦ को नहᱭ करनी चािहए ।

(2) उपधारा (1) के अधीन ᮧ᭜येक आपिᱫ सᭃम ᮧािधकारी को िलिखत ᱨप मᱶ कᳱ जाएगी और सᭃम ᮧािधकारी

आपिᱫकताᭅ को ᭭वयं सुने जाने का या िविध ᳞वसायी ᳇ारा सुनवाई का अवसर देगा और ऐसी सभी अपितयᲂ को सुनने के

प᳟ात और ऐसी अितᳯरᲦ जांच यᳰद कोई हो, करने के प᳟ात जो वह आव᭫यक समझता है वह या तो धारा 7 ᳰक उप-धारा

(1) के अधीन अिधसूिचत भूिम के या ऐसी भूिम मᱶ या उस पर के अिधकारᲂ के संबंध मᱶ एक ᳯरपोटᭅ या ऐसी भूिम के िविभ᳖

टुकड़ᲂ या ऐसी भूिम मᱶ या उस पर के अिधकारᲂ के संबंध मᱶ आपिᱫयᲂ पर अपनी िसफ़ाᳯरशᲂ और उसके ᳇ारा कᳱ गई

कायᭅवाही के अिभलेख सिहत िविभ᳖ ᳯरपोटᭅ के᭠ᮤीय सरकार को उसके िविन᳟य के िलए देगा।

(3) इस धारा के ᮧयोजनᲂ के िलए वह ᳞िᲦ ᳰकसी भूिम मᱶ िहतब᳍ समझा जाएगा जो ᮧितकर मᱶ िहत का दावा करने का

हकदार होता, यᳰद भूिम या ᳰकसी ऐसी भूिम मᱶ या उस पर के अिधकार इस अिधिनयम के अधीन अᳶजत कर िलए जाते हᱹ । ‘’

(ii) मᱶ तारीख 11 जून, 1983 मᱶ ᮧकािशत कᳱ गई थी, सᭃम ᮧािधकारी िनयुᲦ ᳰकया गया है ।

NOTIFICATION

New Delhi, the 29th December,2016

S.O. 01(E).—Whereas by the notification of the Government of India in the Ministry of Coal number

S.O. 2341(E), dated the 8^th July, 2016 issued under sub-section (1) of section 4 of the Coal Bearing Areas

(Acquisition and Development) Act,1957(20 of 1957) (hereinafter referred to as the said Act) and published in

the Gazette of India, part II, Section 3,Sub-section (ii), dated the 11^th July, 2016 the Central Government gave

notice of its intention to prospect for coal in 23.64 hectares (approximately) or 58.41 acres (approximately) of

the land in the locality specified in the Schedule annexed to the said notification;

And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands

prescribed in the Schedule appended to this notification;

Now, therefore, in exercise of powers conferred by sub-section(1) of section 7 of the said Act, the

Central Government hereby gives notice of its intention to acquire the land measuring 23.64 hectares

(approximately) or 58.41 acres (approximately) and all rights in or over such land as specified in the Schedule

appended hereto.

Note 1: The plan bearing number Rev/11/2016, dated the 27^th August, 2016 of the area covered by this

notification may be inspected in the office of the Deputy Commissioner, District Ramgarh, Jharkhand or at the

office of the Coal Controller,1, Council House Street, Kolkata -700 001 or at the office of the General

Manager, Kuju Area, District Ramgarh, Jharkhand or General Manager (Land and Revenue), Central

Coalfields Limited, Darbhanga House, Ranchi-834001 or Chief General Manager (Exploration Division),

Central Mine Planning and Design Institute Limited, Gondwana Place, Kanke Road ,Ranchi-834031,

Jharkhand.

Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:-

Objections to acquisition.-

“8. (1) Any person interested in any land in respect of which a notification under section 7 has been issued,

may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the

land of any rights in or over such land.

Explanation.—It shall not be an objection within the meaning of this section for any person to say that he

himself desires to undertake mining operations in the land for the production of coal and that such operations

should not be undertaken by the Central Government or by any other person.

(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the

competent authority shall give the objector an opportunity of being heard either in person or by a legal

practitioner and shall after hearing all such objections and after making such further inquiry if any, as he

thinks necessary either makes a report in respect of the land which has been notified under sub-section (1) of

section 7 or of right in or over such land or make different reports in respect of different parcels of such land

or of rights in or over such land to the Central Government ,containing his recommendations on the objections

,together with the record of the proceeding held by him, for the decision of the Government.

(3) For the purposes of the section, a person shall be deemed to be interested in land who would be entitled to

claim an interest in compensation if the land or any rights in or over such land were acquired under this Act”.

Note 3: The Coal Controller, 1, Council House Street, Kolkata-700 001 has been appointed by the Central

Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2518,

dated the 27^th May, 1983 published in part II, section 3, sub-section (ii) of the Gazette of India, dated the 11^th

June, 1983.
