अिधसूचना

नई ᳰद᭨ली, 3 जनवरी, 2017

का.आ. 67(अ).—िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986

(1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ

का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार,

जनसाधारण कᳱ जानकारी के िलए िजनके उससे ᮧभािवत होने कᳱ संभावना है ᮧकािशत कᳱ जाती है; और यह सूचना दी जाती है ᳰक उᲦ

ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती

हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार

िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु

पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: [email protected] पर िलिखत

ᱨप मᱶ भेज सकेगा ।

ᮧाᱨप अिधसूचना

ᳲसगािलया रा᳦ीय उ᳒ान पि᳟म बंगाल रा᭔य के दाᳶजᳲलग िजले मᱶ 78.60 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ है और यह

पि᳟म मᱶ नेपाल, उᱫर मᱶ िसᳰᲥम और पूवᭅ मᱶ दाᳶजᳲलग वन ᮧभाग से िघरा ᱟआ है;

और, रा᳦ीय उ᳒ान देश के पृथक जैव ᮧांत के अधीन आता है और एक सुिभ᳖ जीन कोष का ᮧितिनिध᭜व करता है तथा वह

संरᭃण ईकाई के ᱧप मᱶ ऊँचाई संबंधी िविवधता, िभ᳖ता, नैसᳶगकता के ᳞ापक जैिवक िभ᳖ता के साथ शीतो᭬ण और अ᭨पीय जलवायु वन

कᳱ कुछ अि᳇तीय ᮧजाितयᲂ का ᮧितिनिध᭜व करता है;

और, ᭃेᮢ मᱶ रेड पा᭛डा, िहमालयन काला भालू जैसी दुबᭅल ᭭तनधारी के कुछ ᮧजाितयां और िव᳡ के सबसे अिधक पᭃी ᮧाणी

ज᭠तु ᭃेᮢᲂ मᱶ से एक है जहां लगभग 550 ᮧजाितयां है िजनके अंतगᭅत समूहᲂ को ᳞ापक पᳯरᭃेᮢ है । एक छोटे से ᭃेᮢ के भीतर फलता

फुलता है;

और, ᭃेᮢ मᱶ सपᲃ कᳱ ᭭ तर से अिधक ᮧजाितयां हᱹ और उभयचरᲂ कᳱ 200 से अिधक ᮧजाितयां हᱹ। म᭜᭭य ᮧाणी जीव भौगोिलक

ᱨप से ᮧचुर है और भारत चीन, भारत- मलायन और पूवᱮ ᭃेᮢᲂ के भारतीय उपᭃेᮢ को जोड़ता है। कᳱट जनसं᭎या ᮧचुर है और बᱟत

अिधक फैली ᱟई है।

और, यह ᭃेᮢ ᭭वदेशी वन᭭पित और जीवज᭠तु के अनुसंधान और पᳯररᭃण के िलए पाᳯरि᭭थितक और वै᭄ािनक कारण से

मह᭜वपूणᭅ है;

और, संरिᭃत और सुरिᭃत ᭃेᮢ कᳱ िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पाᳯरि᭭थितक पयाᭅवरणीय

और जैव िविवधता के दृि᳥कोण से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ

उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ और उनकᳱ संᳰᮓयाᲐ और ᮧसं᭭करणᲂ को ᮧितिष᳍ करना आव᭫यक है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण)

अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (1) ᳇ारा ᮧदᱫ

शिᲦयᲂ का ᮧयोग करते ᱟए, ᳲसगािलया रा᳦ीय उ᳒ान कᳱ सीमा लगभग 0 से 2 ᳰकलोमीटर कᳱ िव᭭तार ᭃेᮢ पᳯरवतᱮ करती है कᳱ

पाᳯरि᭭थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका

िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार ᳲसगािलया रा᳦ीय उ᳒ान

कᳱ सीमा शू᭠य से दो ᳰकलोमीटर (दिᭃण मᱶ नेपाल बाडᭅर और उᱫर मᱶ िसᳰᲥम) तक हᱹ। पाᳯरि᭭थितक संवेदी जोन का ᭃेᮢ 52.60 वगᭅ

ᳰकलोमीटर है ऐसे जोन का सीमा वणᭅन उपाबंध I के ᱨप मᱶ संलᲨ है।

(2) उᲦ पाᳯरि᭭थितक संवेदी जोन के अंतगᭅत आने वाले 9 ᮕामᲂ और उनके जीपीएस समकᭃ कᳱ सूची उपाबंध II के ᱧप मᱶ संलᲨ है ।

(3) पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ के साथ अᭃांश तथा देशांतर उपाबंध III के ᱧप मᱶ संलᲨ है ।

(4) ᳲसगािलया रा᳦ीय उ᳒ान जीपीएस समकᭃ और पाᳯरि᭭थितक संवेदी जोन उपाबंध IIIक मᱶ ᳰदए गए है ।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन के िलए राजपᮢ मᱶ

अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय लोगᲂ से परामशᭅ करके और इस अिधसूचना मᱶ ᳰदए गए

अनुबंधᲂ का पालन करते ᱟए एक आंचिलक महायोजना तैयार करेगी ।

(2)

आचंिलक महायोजना का रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत कᳱ जाएगी ।

(3)

पाᳯरि᭭ थितक संवेदी जोन आचंिलक महायोजना रा᭔य सरकार ᳇ारा ऐसी रीित से जो इस अिधसूचना मᱶ िविन᳸द᭬ ट ᳰकया जाए

और सुसंगत के᭠ᮤीय और रा᭔य िविधयᲂ के और कᱶᮤीय सरकार ᳇ारा जारी मागᭅदशᱮ िस᳍ांतᲂ के अनुᱨप तैया कया जाएगा ।

(4)

आंचिलक महायोजना, सभी संबंिधत रा᭔य िवभागᲂ के परामशᭅ से तैयार ᳰकया जाएगा, अथाᭅत्:-

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

शहरी िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलका ;

(vi)

राज᭭ व ;

(vii)

कृिष ;

(viii)

पि᳟म बंगाल रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ,

(ix)

ᳲसचाई; और

(x)

लोक िनमाᭅण िवभाग ।

आंचिलक महायोजना मᱶ जब तक इस अिधसूचना मᱶ ऐसा िवᳶनᳰद᳥ न हो तब तक अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना

और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ ᳰकया जाएगा और आचंिलक महायोजना सभी अवसंरचना के सुधार और अिधक दᭃ

तथा पाᳯरि᭭थितक अनुकूल होने वाले ᳰᮓयाकलाप इस ᮧकार िविन᳸द᳥ न हो।

आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-संभरᲂ

के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत

ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, जनजातीय ᭃेᮢᲂ,

कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोउ᳒ान, झीलᲂ और अ᭠य जल िनकायᲂ

का अ᭤यकंन करेगी ।

आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी िजससे पाᳯरि᭭थितक अनुकूल िवकास

᭭थानीय समुदायᲂ कᳱ जीवकोपाजᭅन सुरᭃा के िलए सुिनि᭫ चत ᳰकया जा सके ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय

करेगी, अथाᭅत् :--

(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए गए

पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार के पूवᭅ

अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद सं0 12,

24, 29,38 और 39 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭थितक अनुकूल आरामगाह जैसे

टᱶट, लकड़ी के मकान आᳰद;

(ii) िव᳒मान सड़कᲂ को चौड़ा करना तथा उनका सुदृढ़ीकरण और नई सड़कᲂ का संिनमाᭅण ;

(iii) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग;

(iv) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭थानीय सुख- सुिवधाएं हᱹ; और

(v) िहम और वषाᭅ जल संचय ।

परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के

अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006

(2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए अनु᭄ात नहᱭ होगा :

परंतु यह भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ ᮧतीत होने वाली कोई ᮢुᳯट, मानीटरी सिमित के िवचार

ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार ठीक कᳱ जाएगी और उᲦ ᮢुᳯट के ठीक करने कᳱ कᱶᮤीय सरकार के

पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग

का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।

परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त

या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोत - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और नवीकरण के

िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलापᲂ, जो ऐसे ᭃेᮢᲂ के िलए

हािनकारक हᱹ, को ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप जो आंचिलक महायोजना का भाग ᱨप हᲂगे ।

(ख) पयᭅटन महायोजना पयᭅटन िवभाग, रा᭔य सरकार के वन और पयाᭅवरण िवभाग, के परामशᭅ से तैयार होगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार कᱶᮤीय

सरकार, पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी मागᭅिनदेशᲂ और रा᳦ीय ᳞ाᮖ संरᭃण ᮧािधकरण ᳇ारा

जारी मागᭅदशᱮ िस᳍ांतᲂ के अनुसार होगा और पाᳯरि᭭थितक संवेदी जोन कᳱ वहम ᭃमता के अ᭟ययन पर आधाᳯरत होगा

िजसमᱶ पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा ।

(ii) होटल और सैरगाहᲂ के नए संिनमाᭅण ᳲसगािलया रा᳦ीय उ᳒ान एक ᳰकलोमीटर के भीतर पाᳯरि᭭थितक अनुकूल पयᭅटक संबंध

पयᭅटकᲂ के अ᭭थायी ᳞वसाय के िलए आवास के िलए अनु᭄ात हᲂगे अ᭠यथा नहᱭ;

परंतु रा᳦ीय उ᳒ान कᳱ सीमा से एक ᳰकलोमीटर के परे पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक नए होटलᲂ और ᳯरसोटᲃ

कᳱ ᭭थापना को पाᳯरि᭭थितक अनुकूल पयᭅटन सुिवधाᲐ के िलए पूवᭅ िनि᳟त और नाम᳸द᳥ ᭃेᮢᲂ मᱶ और पयᭅटन महायोजना के

अनुसार अनु᭄ात ᳰकया जाएगा ।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार को

वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकरणᲂ ᳇ारा

अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत ᭃेᮢ, शैल

िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ पहचान कᳱ जाएगी और उ᭠हᱶ

संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना

बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थलᲂ - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और सां᭭कृितक

मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ योजनाएं तैयार

करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए पि᳟म बंगाल रा᭔ य सरकार का पयाᭅवरण िवभाग वायु

(ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ

मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य पि᳟म बंगाल सरकार का पयाᭅवरण िवभाग वायु

(ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ

मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण तथा िनयंᮢण)

अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -

(i)

पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन

मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अᮧैल, 2016 नगरपािलक

(ii)

᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए

योजनाएं तैयार करᱶगे ;

(iii)

जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;

(iv)

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय

᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और

जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का. िन. 343 (अ) तारीख 28 माचᭅ, 2016 ᳇ारा ᮧकािशत

जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गित आवास के अनुकूल रीित मᱶ िवनयिमत हᲂगी और इस संबंध मᱶ आंचिलक महायोजना मᱶ

िवशेष उपबंध समािव᳥ ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत

होने तक, रा᭔य सरकार पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित सुसंगत अिधिनयमᲂ के अधीन तथा त᳍ीन बनाए गए िनयमᲂ और

िविनयमᲂ के अधीन यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

(12) औ᳒ोिगक इकाईयां - (क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ उ᳒ोगᲂ कᳱ ᭭थापना िविध के अनुसार ᭭थािपत

िव᳒मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के िलए अनु᭄ात कᳱ जाएगी अ᭠यथा नहᱭ ।

(ख) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ᭟ विन ᮧदूषण उ᭜प᳖ करने वाले ᳰक सी नए उ᳒ोग कᳱ ᭭ थापना नहᱭ

कᳱ जाएगी ।

4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप पयाᭅवरण

(संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ और त᳍ीन बनाए गए िनयमᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका मᱶ

घरेलू आव᭫यकताᲐ के िसवाए नहᱭ हᲂगी िजसमᱶ िनजी उपयोग के िलए

मकानᲂ के संि᳖माᭅण या मर᭥मत के िलए भूिम को खोदना और मकान बनाने

के िलए देशी टाइलᲂ का िनमाᭅण भी सि᭥मिलत है ;

(ख) खनन संᳰᮓयाएं, माननीय उᲬतम ᭠यायालय कᳱ ᳯरट यािचका (िसिवल)

सं. 1995 का 202 टी.एन. गौडाबमᭅन िथᱧमूलपाद बनाम भारत सरकार के

मामले मᱶ आदेश तारीख 4 अग᭭त, 2006 और ᳯरट यािचका (सी) सं. 2012

का 435 गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख

21 अᮧैल, 2014 के अंतᳯरम आदेश के अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।

2.

आरा मीलᲂ कᳱ ᭭थापना ।

पाᳯरि᭭थितक संवेदी जोन के भीतर नई और िव᳒मान आरा मीलᲂ का िव᭭ तार

अनु᭄ात नहᱭ होगा ।

3.

ᳰकसी खतरनाक व᭭तुᲐ का

उपयोग या उ᭜पादन ।

लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠यथा उपबंिधत के िसवाय) ।

4.

जल या वायु या मृदा या ᭟ विन ᮧदूषण

काᳯरत करने वाले उ᳒ोगᲂ कᳱ ᭭ थापना ।

पाᳯरि᭭थितक संवेदी जोन के भीतर नए और ᮧदूषण काᳯरत करने वाले

िव᳒मान उ᳒ोगᲂ का िव᭭ तार अनु᭄ात नहᱭ होगा ।

वािणि᭔यक जल संसाधन िजसके अंतगᭅत भू-

जल संचयन भी है ।

(क) भूिम के अिधभोगी के वा᭭तिवक कृिष और घरेलू खपत के िलए जल का

िन᭬कषᭅण (सतही और भूिमगत जल) अनु᭄ात होगा ।

(ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत जल का

िन᭬कषᭅण के िलए संबंिधत िविनयामक ᮧािधकरण पूवᭅ िलिखत अनु᭄ा

अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह िन᭬कषᭅण करेगा, भी है ।

(ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।

(घ) जल के संदूषण या ᮧदूषण, िजसके अंतगᭅत कृिष भी है, को रोकने के िलए

सभी उपाय ᳰकए जाएंगे ।

10.

᭡लाि᭭टक के थैलᲂ का उपयोग ।

लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय)

11.

िवदेशी ᮧजाितयᲂ को लाना ।

लागू िविधयᲂ के अनुसार ᮧितिष᳍ (अ᭠ यथा उपबंिधत के िसवाय)

िविनयिमत ᳰᮓयाकलाप

12.

होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना ।

पाᳯरि᭭थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के अ᭭थायी ᳞वसाय के

िलए आवास के संबंध मᱶ संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर या

पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक, जो भी िनकट हो, के भीतर ही नए

वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ :

पर᭠तु व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे और

पाᳯरि᭭थितक संवेदी जोन के िव᭭तार तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या

िव᳒मान ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।

13.

संिनमाᭅण ᳰᮓयाकलाप ।

(क) संरिᭃत ᭃेᮢ कᳱ एक ᳰकलोमीटर कᳱ सीमा के भीतर ᳰकसी भी ᮧकार के

नए वािणि᭔ यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ

सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने कᳱ

अनुमित दी जाएगी ।

(ख) ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत संिनमाᭅण

ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और िविनयमᲂ, यᳰद

कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित से ही ᭠ यूनतम पर रखे

जाएंगे ।

(ग) इसके अितᳯर᭍ त, एक ᳰकलोमीटर से परे पाᳯरि᭭थितक संवेदी जोन के

िव᭭ तार तक स᳊ावपूवᭅक ᭭थानीय आव᭫यकताᲐ के िलए संिनमाᭅण और अ᭠य

संिनमाᭅण ᳰᮓयाकलापᲂ को महायोजना के अनुसार िविनयिमत ᳰकया जाएगा।

14.

पयᭅटन से संबंिधत ᳰᮓयाकलाप जैसे गमᭅ वायु

गु᭣ बारᲂ आᳰद ᳇ारा रा᳦ीय उ᳒ान के ऊपर से

उड़ना जैसे ᳰᮓयाकलाप करना।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

15.

सड़क, रेल और यातायात।

नए राजमागᭅ या रेल वाहन का संि᳖माᭅण नहᱭ ᳰकया जाएगा। िव᳒मान

सड़क और रेल यातायात कᳱ रात मᱶ (6 बजे अपरा᭮न से 5 बजे पूवाᭅ᭮न तक)

िविनयिमत ᳰकया जाएगा।

16.

ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ

अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ का

िन᭭सारण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

17.

वायु और यानीय ᮧदूषण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

18.

᭟विन ᮧदूषण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

19.

भूिमगत जल का िन᭭सारण।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

20.

वृᭃᲂ कᳱ कटाई ।

(क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन, सरकारी

या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी ।

(ख) वृᭃᲂ कᳱ कटाई संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके अधीन

बनाए गए िनयमᲂ के उपबंध के अनुसार िविनयिमत होगी ।

(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा कायᭅ योजना मᱶ ᳰदए गए

िववरण का अनुसरण ᳰकया जाएगा ।

21.

िव᳒ुत केबलᲂ का पᳯरिनमाᭅण।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

22.

जैव सा᮫गी का पुन: उपयोग।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

23.

िव᳒ुत लाइनᲂ रोधन।

भूिमगत केबल को बढ़ावा देना।

24.

िव᳒मान सडकᲂ को चौड़ा करना।

उिचत पयाᭅवरण समाघात िनधाᭅरण और ऐसे शमन उपायᲂ, जो लागू हᲂ, के

अनुसार ᳰकया जाएगा।

25.

होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ

बाड लगाना ।

पाᳯरि᭭ थितक संवेदी जोन के भीतर व᭠यजीव के ᭭वतंᮢ संचलन होटलᲂ या

अ᭠ य वािणि᭔ यक ᭭ थापनᲂ कᳱ अनुमित के उ᳎े᭫य से कांटेदार वायर से उनकᳱ

संपितयᲂ मᱶ बेडा नहᱭ लगाया जाएगा और न ही एक मीटर से ऊंचाई से कोई

बेडा होगा ।

ᳰकसी िव᳒मान बाडा पर यह अनुबंध लागू नहᱭ होगा आंतᳯरक महायोजना मᱶ

उि᭨लिखत समय सीमा के अनुसार आंतᳯरत ᳰकया जाएगा।

26.

कृिष ᮧणाली का भारी पᳯरवतᭅन।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

27.

रािᮢ मᱶ यािनक यातायात का संचलन ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

वािणि᭔ यक साइनबोडᭅ और होᳺडग ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग ।

पाᳯरि᭭ थितक संवेदी जोन मᱶ देशीय माल से उ᭜पादᲂ का उ᭜पादन करने वाले

गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा उ᳒ोग, कृिष उ᳒ान, कृिष या

कृिष आधाᳯरत देशीय माल से औ᳒ोिगक उ᭜पादᲂ का उ᭜पादन उ᳒ोग जो

पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ डालते हᱹ, अनु᭄ात ᳰकए जाएंगे ।

30.

गैर–इमारती वन उ᭜पादᲂ का संᮕहण।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

31.

ᮝै᳴कग और कैᳲपग ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

32.

पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण ।

नदी और ᮧाकृितक नाले के तट से 1 से 10 और साथ ही 100 मीटर तक कᳱ

पहाड़ी ढाबᲂ पर तब तक आंचिलक महायोजना के अधीन अ᭠यथा अनुमित

ᮧदान न कᳱ गई हो।

33.

ठोस अपिश᳥ ᮧबंधन ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

5. पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी

सिमित का गठन करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

(i)

संब᳍ उपायुᲦ

अ᭟यᭃ;

(ii)

पयाᭅवरण (िजसके अंतगᭅत िवरासत संरᭃण भी है) के ᭃेत्र मᱶ कायᭅरत गैर

सरकारी संगठन का एक ᮧितिनिध, पि᳟म बंगाल सरकार ᳇ारा तीन वषᭅ कᳱ

अविध के िलए नामिन᳸द᳥ ᳰकया जाए।

सद᭭य;

(iii)

पाᳯरि᭭थितक और पयाᭅवरण के ᭃेᮢ का एक िवशेष᭄ िजसᱶ पि᳟म बंगाल

सरकार ᳇ारा तीन वषᭅ कᳱ अविध के िलए नामिन᳸द᳥ ᳰकया जाए।

सद᭭य;

(iv)

पि᳟म बंगाल ᮧदूषण िनयंᮢण बोडᭅ का ᮧितिनिध

सद᭭य;

(v)

िजला भूिम और भूिम सुधार अिधकारी का ᮧितिनिध-

सद᭭य;

(vi)

रा᭔य जैव िविवधता बोडᭅ का सद᭭य

सद᭭य;

(vii)

ᮧभागीय वन अिधकारी

सद᭭य-सिचव ।

िनदᱷश िनबंधन:

(1) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(2) सिमित कᳱ अविध तीन वषᭅ के िलए होगी।

(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ)

तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍

गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा

संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और

जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन पयाᭅवरण

और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे

ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥

᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन

करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।

(6) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ,

औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

NOTIFICATION

New Delhi, the 3rd January, 2017

S.O. 67(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-

section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected

thereby and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry

of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to

the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Draft Notification

WHEREAS, the Singalila National Park is spread over an area of 78.60 Sq. Km in Darjeeling district in the state

of West Bengal and it is surrounded by Nepal in the West, Sikkim in the North and Darjeeling Forest Division in the East;

AND WHEREAS, The National Park, falls under a separate biotic province of the country and represents a

distinct gene pool and it represents some unique species of temperate and alpine forest with wide variety biota of the

altitudnal variation, diversity, naturalness as conservation unit;

AND WHEREAS, The region has some species of rare mammals like Red Panda, Himalayan Black Bear and is

one of the richest avifauna area of the world where 550 species approximately covering wide range of groups thrive with

in a small space;

AND WHEREAS, The region has more than 70 species of snakes and more than 200 species of Amphibians.

The fish fauna is geographically rich and connects Indo-China, Indo-Malayan and Indian sub-region of oriental regions.

The insect population is extremely rich and greatly diversified;

AND WHEREAS, This area is important for ecological and scientific reason of research and preservation of the

gene pool of indigenous flora and fauna;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is

specified in paragraph 1 of this notification around the protected area of Singalila National Park as Eco-sensitive zone

from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their

operations and processes in the said Eco-sensitive Zone; and

NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)

of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent

varying from zero to two kilo meter around the boundary of Singalila National Park of the Eco-sensitive Zone

(hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1.

Extent and boundaries of Eco-sensitive Zone.- (1) The extent of Eco-sensitive Zone varies from zero (Nepal

Border on Western Side and Sikkim on Northern Side) to two kilo-meters from the boundary of Singalila National Park.

The area of Eco sensitive Zone is 52.60 square kilometres. The boundary description of such zone is given in

Annexure-I.

(2)

The list of 9 villages and their GPS co-ordinates falling under the said Eco-sensitive Zone is annexed as

Annexure-II.

(3)

The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as

Annexure-III.

(4)

The GPS coordinates of Singalila National Park and Eco-sensitive Zone are given in Annexure-III A.

2.

Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with the local people and adhering to the stipulations given in this

notification.

(2)

The Zonal Master Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned

State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(viii) West Bengal State Pollution Control Board;

(ix) Irrigation; and

(x) Public Works Department

for integrating environmental and ecological considerations into it.

The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and

activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure

and activities to be more efficient and eco-friendly.

(6)

The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that needs attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural

areas, orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly

development for livelihood security of local communities.

3.

Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1)

Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related

development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 12, 24, 29, 38 and 39 in column (2)

of the table in paragraph 4, namely:-

(i)

Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly

tourism activities;

(ii)

Widening and strengthening of existing roads and construction of new roads;

(iii)

Small scale industries not causing pollution;

(iv)

Cottage industries including village industries, convenience stores and local amenities; and

(v)

Rainwater harvesting.

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2)

Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation

and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3)

Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master

Plan, which shall form part of the Zonal Master Plan;

(b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with the Department of

Forests and Environment of the State Government;

(c) The activity of tourism shall be regulated as under, namely:-

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the

Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the

Singalila National Park except for accommodation for temporary occupation of tourists related to eco-friendly tourism

activities:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the

Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre defined and designated

areas for Eco-tourism facilities as per Tourism Master Plan.

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4)

Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of this notification and such plan shall form part of the Zonal Master Plan.

(5)

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6)

Noise pollution.- The Environment Department of the State Government or West Bengal State Pollution

Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in

accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules

made thereunder.

(7)

Air pollution.- The Environment Department of the State Government or West Bengal State Pollution Control

Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance

with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made

thereunder.

(8)

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made thereunder.

(9)

Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid

Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and

Climate Change vide notification number S.O. 1357 (E), dated the 8^th April, 2016 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture; and

(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10)

Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in

accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of

India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the

28^th March, 2016, as amended from time to time.

(11)

Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master

Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12)

Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone

shall be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-

sensitive Zone shall be permitted.

4.

List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco

sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules

made thereunder, and be regulated in the manner specified in the table below, namely:-

permitted within the Eco-sensitive Zone.

Prohibited (except as otherwise provided) as per applicable

laws.

Regulated activities

12.

Establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted

within one kilometer of the boundary of the protected area

or the boundary of the Eco-sensitive Zone whichever is

nearer except for accommodation for temporary occupation

of tourists related to eco-friendly tourism activities.

Provided that, beyond one kilometer and upto the

extent of the Eco-sensitive Zone, all new tourism activities

or expansion of existing activities shall be in conformity

with the Tourism Master Plan.

13.

Construction activities.

(a) No new commercial construction of any kind shall be

permitted within one kilometer from the boundary of

protected area or of the Eco-sensitive Zone whichever is

nearer.

Provided that, local people shall be permitted to

undertake construction in their land for their residential use

including the activities listed in sub-paragraph (1) of

paragraph 3:

(b) Provided further that the construction activity related to

small scale industries not causing pollution shall be

regulated and kept at the minimum, with the prior

permission from the competent authority as per the

applicable rules and regulations, if any.

(c) Beyond one kilometer upto the extent of Eco-Sensitive

Zone, construction for bone fide local needs shall be

allowed and other construction activities shall be regulated

as per the Zonal Master Plan.

Road, railway and traffic.

No new Highway or Railway line construction will be

done. Traffic of existing roads and railway should be

regulated in number and speed in night (from 6 P.M to

5 A.M).

Discharge of treated effluents and solid

waste in natural water bodies or land area.

Air and vehicular pollution.

Regulated under applicable laws.

Noise pollution.

20.

Felling of trees.

(a) There shall be no felling of trees in the forest or

Government or revenue or private lands without prior

permission of the competent authority in the State

Government.

(b) the felling of trees shall be regulated in accordance with

the provisions of the concerned Central or State Acts and

the rules made thereunder.

(c) in case of Reserve Forests and Protected Forests, the

Working Plan prescriptions shall be followed.

21.

Erection of electric cables.

Regulated under applicable laws.

22.

Recycling of Bio degradable material.

Regulated under applicable laws.

23.

Insulation of electric lines.

Promote underground cabling.

24.

Widening and strengthening of existing

roads.

Shall be done with proper Environment Impact Assessment

and mitigation measures, as applicable.

Fencing of existing premises of hotels and

lodges.

Regulated under applicable laws.

In order to allow free movement of wildlife, hotels or other

commercial establishments within the Eco-sensitive Zone

shall not fence their properties with barbed wire and no

fence shall be higher than one meter. Any existing fence

not complying with this stipulation shall be modified as per

the time lines mentioned in the Zonal Master Plan.

26.

Drastic change of agriculture systems.

27.

Movement of vehicular traffic at night.

Regulated under applicable laws.

28.

Sign boards and hoardings.

Regulated under applicable laws.

29.

Small

scale

industries

not

causing

pollution.

Non polluting, non-hazardous, small-scale and service

industry, agriculture, floriculture, horticulture or agro-

based industry producing products from indigenous goods

from the Eco-sensitive Zone, and which do not cause any

adverse impact on environment shall be permitted.

30.

Collection of Non-timber forest products.

Regulated under applicable laws.

31.

Trekking and camping.

Regulated under applicable laws.

32.

Protection of hill slopes and river banks.

No construction activity unless otherwise permitted under

the Zonal Master Plan shall be undertaken on the hill with

slopes more than 1 to 10 and also upto 100 meters from the

banks of any river, and natural nallah.

33.

Solid Waste Management.

5.

Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(i)

Concerned Deputy Commissioner Chairman;

(ii)

One representative of Non-Governmental Organisations working

in the field of environment (including heritage conservation) to be

nominated by the Government of West Bengal for a period of

three years

Member;

(iii) An expert in the area of ecology and environment to be

Member;

nominated by the Government of West Bengal for a

period of three years

(iv)

Representative of West Bengal Pollution Control Board Member;

(v) Representative of District Land & Land Reforms Officer Member

(v)

Member State Bio Diversity Board

Member; and

(vi) Divisional Forest Officer

Member-Secretary

Terms of Reference:

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2)

The tenure of the Committee shall be three years.

(3)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533(E), dated the 14^th September, 2006, and are falling in

the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4

thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior

environmental clearances under the provisions of the said notification.

The activities that are not covered in the Schedule to the notification of the Government of India in the

falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the table under

paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific

conditions and referred to the concerned regulatory authorities.

(5)

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-

charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986

against any person who contravenes the provisions of this notification.

(6)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from industry associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(7)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wildlife Warden in the State Ministry of Environment, Forest

and Climate Change as per performa appended at Annexure IV.

(8)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

(9) The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

6.

The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.
