सा.का.िन.18(अ).—खादी और ᮕामो᳒ोग आयोग अिधिनयम, 1956 कᳱ धारा 15 कᳱ उपधारा (2) के खंड (ट) के

साथ पᳯठत धारा 27 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, खादी और ᮕामो᳒ोग आयोग, के᭠ᮤ सरकार कᳱ पूवᭅ ᭭वीकृित से,

खादी िच᭮न िविनयम, 2013 को संशोिधत करने के िलए एत᳏ारा िन᳜िलिखत िविनयम बनाता है, अथाᭅत्:—

इन िविनयमᲂ को खादी िच᭮न (संशोधन) िविनयम, 2017 कहा जाएगा।

(2)

ये सरकारी राजपᮢ मᱶ ᮧकाशन कᳱ तारीख से ᮧवृᱫ हᲂगे।

खादी िच᭮न िविनयम, 2013 मᱶ, फॉमᭅ-I मᱶ, उपाबंध 5 के ᭭थान पर िन᳜िलिखत उपाबंध ᮧित᭭थािपत ᳰकया

जाएगा, अथाᭅत्:—

‘‘उपाबंध 5

᭭वघोषणा के िलए फॉमᱷट

हाथ से बुना, हाथ से काता, खादी वᳫ पर खादी िच᭮न लेबल तथा टैग लगाने के िलए शपथ पᮢ

(रा᭔य ᭭टॉ᭥प अिधिनयम के अनुसार मू᭨य के ᭭टॉ᭥प पेपर पर ᳰदया जाने वाला शपथ पᮢ)

महोदय,

मᱹ/हम एत᳏ारा पुि᳥ करता/करते/वचन देता ᱠँ/देते हᱹ ᳰक .............. (अिधिनयम/िवधान का नाम िजसके अंतगᭅत

सं᭭था पंजीकृत है) के अंतगᭅत पंजीकृत .......... (सं᭭था का नाम) खादी और खादी उ᭜पादᲂ का उ᭜पादन/᳞ापार/िबᮓᳱ कर रहा

ᱠँ/रहे हᱹ तथा हमᱶ संिहता के अंतगᭅत खादी और ᮕामो᳒ोग आयोग ᳇ारा ᮧमािणत ᳰकया गया है और हमारे पास आयोग ᳇ारा

जारी वैध ᮧमाण पᮢ है।

मᱹ/हम पुि᳥ करता ᱠँ/करते हᱹ ᳰक

हमारी सं᭭था असली खादी वᳫ तथा उ᭜पाद अथाᭅत् हाथ से काता, हाथ से बुना तथा खादी और ᮕामो᳒ोग आयोग अिधिनयम

मᱶ यथा पᳯरभािषत ᮧाकृितक रेशे का उ᭜पादन/᳞ापार/िबᮓᳱ (जो भी लागू हो) करती है।

हमारी सं᭭था ᮧमािणत खादी सं᭭था या खादी और ᮕामो᳒ोग आयोग से अन᭠य ᱨप से ᮧा᳙ खादी उ᭜पादᲂ का ᳞ापार/िबᮓᳱ

करने का िवचार करती है तथा खादी सं᭭था ने इन िविनयमᲂ के अंतगᭅत जारी ‘‘खादी िच᭮न’’ ᮧा᳙ कर िलया है।

खादी िच᭮न िविनयम 2013, 2 अ᭍टूबर, 2013 से लागू ᱟआ है तथा अिधिनयम के अ᭠तगᭅत कोई ᳞िᲦ या सं᭭था खादी या

खादी उ᭜पादᲂ कᳱ ᳰकसी ᱨप मᱶ या तरीके से खादी िच᭮न ᮧमाण पᮢ ᮧा᳙ ᳰकए िबना िबᮓᳱ या अ᭠य ᮧकार से ᳞ापार नहᱭ

करेगी।

उसी ᮧकार ᳰकसी सूती वᳫ कᳱ िबᮓᳱ या ᳞ापार खादी िच᭮न लगाए िबना ᳰकसी ᱨप मᱶ या तरीके से अ᭠य ᮧकार से नहᱭ

ᳰकया जाएगा।

इन खादी िच᭮न लेबलᲂ तथा टैगᲂ का ᮧयोग असली सूती, ऊनी, रेशमी या इन खादी वᳫᲂ यािन हाथ से काते, हाथ से बने

िम᮰ण मᱶ ही ᳰकया जाएगा।

मᱹ/हम िविनयमᲂ के अधीन यथा िविन᳸द᳥ असली खादी वᳫ पर ही खादी िच᭮न लेबलᲂ तथा टैगᲂ के ᮧयोग के िलए अकेले

िज᭥मेवार ᱠँगा/हᲂगे तथा इसका कोई उ᭨लंघन होने पर मेरे/हमारे िवᱨ᳍ उिचत कानूनी कारᭅवाई कᳱ जा सकती है।

मᱹ/हम घोषणा करता ᱠँ/करते हᱹ ᳰक उपयुᭅᲦ सूचना सही है और इसका स᭎ती से पालन ᳰकया जाएगा और इसके उ᭨लंघन होने

पर मᱹ/हम अकेले िज᭥मेवार ᱠँगा/हᲂगे जो मेरे/हमारे िवᱨ᳍ कानूनी कारᭅवाई के िलए आव᭫यक हो सकती है।

New Delhi, the 10th January, 2017

G.S.R. 18(E).—In exercise of the powers conferred by section 27 read with clause (k) of sub-section

(2) of Section 15 of the Khadi and Village Industries Commission Act, 1956 (61 of 1956), the Khadi and

Village Industries Commission, with the previous sanction of the Central Government, hereby makes the

following regulations to amend the Khadi Mark Regulations, 2013, namely:—

(1)

These regulations may be called the Khadi Mark (Amendment) Regulations, 2017.

(2)

They shall come into force on the date of their publication in the official Gazette.

In the Khadi Mark Regulations, 2013, in Form I, for Annexure 5, the following Annexure shall be

substituted, namely:-

Format for Self Declaration

Affidavit for using Khadi Mark Labels and tags on hand-woven, hand-spun, Khadi vastra

(Affidavit to be affixed on Stamp Paper of the value as per State Stamp Act)

Dear Sir,

I/We hereby confirm/undertake that ____________ (Name of the institution) registered under

________________ (Name of Act/legislation under which the institution is registered) intends to produce /

trade / sell / (whichever is applicable) in Khadi and Khadi products and we have been certified by the Khadi

and Village Industries Commission under a Code and possess a valid Khadi Certificate issued by the

Commission.

I/We confirm that

Our Institution produce / trade / sell (whichever is applicable) a genuine khadi vastra and products i.e. hand

spun, hand woven and of natural fibre as defined in the KVIC Act.

Our Institution intends to trade / sell khadi products exclusively procured from Certified Khadi Institution or

KVIC & the khadi institution should have obtained “khadi mark” issued under these regulations.

Khadi Mark Regulation 2013 has come into force from 2^nd October 2013 and under the act, no person or

institution shall sell or otherwise trade in Khadi or Khadi products in any form or manner without obtaining a

Khadi Mark Certificate.

Similarly, no textiles shall be sold or traded otherwise as Khadi in any form or manner without it bearing a

Khadi Mark.

These Khadi Mark labels and tags will only be used on genuine cotton, wool, silk or mixture of these khadi

vastra i.e. hand-spun, hand-woven.

I/We will be solely responsible for the usage of Khadi Mark labels and tags only on genuine Khadi vastra as

specified under the Regulations and any violation of the same can draw appropriate legal actions against

us/me.

I/We declare that the information given above is true and will be adhered to strictly and I/We will be solely

responsible for any violation of the same that may entail legal action against me/us.
