अिधसूचना

नई ᳰद᭨ली, 9 जनवरी, 2017

का.आ. 72(अ).—िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986

(1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा

ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के

उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ

संभावना है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले

भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके

प᳟ात् िवचार ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है,

इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण,

वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते:

ᮧाᱨप अिधसूचना

रामपरा व᭠ यजीव अभयार᭛ य, लगभग 15.01 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला है और गुजरात रा᭔य के बांकानेर मु᭎यालय के

साथ मोरठी िजले मᱶ अᭃांश 22 31’82’’ उᱫर और 22 34’ 88 ‘’ के म᭟य और 70 55’54’’ पूवᭅ और 70 58’ 59’’ पूवᭅ

देशांतर के म᭟य अवि᭭थत है;

और, रामपरा व᭠यजीव अभयार᭛य मᱶ ᮧचुर और सघन जैव िविवधता पैच मᱶ से एक है िजसमᱶ पौधᲂ कᳱ कुल

270 ᮧजाितयां हᱹ, िजसमᱶ वृᭃᲂ कᳱ 52 ᮧजाितयां, झािड़यᲂ कᳱ 39 ᮧजाितयां, आरोहकᲂ कᳱ 41 ᮧजाितयां, जड़ी-बूᳯटयᲂ कᳱ

37 ᮧजाितयां और घासᲂ कᳱ 41 ᮧजाितयां शािमल हᱹ और यह चारᲂ ओर से उᱫम सागौन वनᲂ से िघरा ᱟआ है;

और, अभयार᭛य मᱶ उभयचरᲂ जैसे मेढ़क, टो᭙स, ᭢लैप-शेल कछुआ और ᭭टार कछुआ का आवास है और गुजरात

पाᳯरि᭭थितक िशᭃा और अनुसंधान (जीईईआर) संगठन के ᳇ारा वषᭅ 1998 के अ᭟ययन मᱶ अभयार᭛य मᱶ 10 पᳯरवारᲂ, 16

जेनरा और मकिड़यᲂ कᳱ 21 ᮧजाितयां, सरीसृपᲂ कᳱ 15 ᮧजाितयां, पिᭃयᲂ कᳱ 93 ᮧजाितयां और ᭭तनधाᳯरयᲂ कᳱ 16

ᮧजाितयां अिभिलिखत कᳱ गई हᱹ;

और, रामपरा व᭠यजीव अभयार᭛य मᱶ मु᭎य जीव-ज᭠तु ᮧजाितयᲂ जैसे भेिड़या, ᳲचकारा, लकड़ब᭏घा, िसयार,

बनिवलाव, लोमड़ी, साही, बनैला सूअर, ᭣लू बुल, खरगोश आᳰद सि᭥मिलत हᱹ, के साथ वन᭭पित कᳱ कई दुलᭅभ और

संकटाप᳖ ᮧजाितयां हᱹ;

और, रामपरा व᭠ यजीव अभयार᭛ य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ

िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक

संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण

(संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) और उपधारा (2) के खंड (v) और खंड (xiv) और

उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, रामपरा व᭠ यजीव अभयार᭛ य कᳱ सीमा के लगभग 0.25 ᳰकलोमीटर

और 4.25 ᳰकलोमीटर तक के म᭟य चारᲂ ओर के िव᭭ताᳯरत ᭃेᮢ को रामपरा व᭠ यजीव अभयार᭛ य पाᳯरि᭭थितक संवेदी

जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण

िन᳜ानुसार है, अथाᭅत् :—

(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) रामपरा व᭠ यजीव अभयार᭛ य पाᳯरि᭭थितक संवेदी जोन

का ᭃेᮢ 39.3351 वगᭅ ᳰकलोमीटर तक होगा। पाᳯरि᭭थितक संवेदी जोन और संरिᭃत ᭃेᮢ के चारᲂ ओर पाᳯरि᭭थितक संवेदी

जोन का ᭠यूनतम और अिधकतम िव᭭तार लगभग 0.25 ᳰकलोमीटर और 4.25 ᳰकलोमीटर के म᭟य होगा।

(2) रामपरा व᭠ यजीव अभयार᭛ य और रामपरा पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबंध 1 के ᱨप मᱶ उपाब᳍ है ।

(3) रामपरा व᭠ यजीव अभयार᭛ य के भू-मंडलीय ि᭭थित ᮧणाली (जीपीएस) ᳲबदु और रामपरा पाᳯरि᭭थितक संवेदी जोन

उपाबंध 2 के ᱨप मᱶ उपाब᳍ है ।

(4) रामपरा पाᳯरि᭭थितक संवेदी जोन मᱶ आने वाले 8 ᮕामᲂ कᳱ सूची उपाबंध 3 के ᱨप मᱶ उपाब᳍ है ।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के िलए राजपᮢ

मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और इस

अिधसूचना मᱶ संल᭏ न अनुबंधᲂ के सामंज᭭ य से आंचिलक महायोजना तैयार करेगी ।

(2)

आचंिलक महायोजना रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत कᳱ जाएगी।

(3)

रा᭔य सरकार ᳇ारा पाᳯरि᭭ थितक संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मᱶ िविन᳸द᭬ ट ᱨप तथा

सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के सामंज᭭ य और कᱶᮤीय सरकार ᳇ारा जारी मागᭅिनदᱷशᲂ, यᳰद कोई हᲂ, ᳇ारा तैयार

होगी ।

(4)

आंचिलक महायोजना, पयाᭅवरणीय और पाᳯरि᭭थितक िवचारᲂ को समाकिलत करने के िलए रा᭔ य सरकार के सभी

संब᳍ िवभागᲂ के परामशᭅ से तैयार कᳱ जाएगी, अथाᭅत्:--

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

नगर िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलका ;

(vi)

राज᭭ व ;

(vii)

कृिष ;

(viii)

गुजरात रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ ;

(ix)

ᳲसचाई; और

(x)

लोक िनमाᭅण िवभाग ।

आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत

नहᱭ करेगी, जब तक ᳰक इस अिधसूचना मᱶ िविन᳸दष् ट न हो,और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ

मᱶ और अिधक दᭃता और पाᳯरि᭭थितक अनुकूलता का संवधᭅन करेगी ।

आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के

ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा

पाᳯरि᭭थितक और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष

ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, जनजाित ᭃेᮢ फलो᳒ान, झीलᲂ

और अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।

आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन

मᱶ िवकास को पाᳯरि᭭थितक अनुकूल िवकास के िलए िविनयिमत करेगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए

िन᳜िलिखत उपाय करेगी, अथाᭅत् :--

(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत

ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन

नहᱭ होगा:

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य

सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के

᭭तंभ (2) के अधीन मद सं. 10, 21, 26, 36 और सं. 37 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात

ह◌ो◌ं सकᱶगे, अथाᭅत् :-

(i)

पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक

अनुकूल आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;

(ii)

िव᳒मान सड़कᲂ को चौड़ा और सुदृढ़ बनाना ;

(iii)

ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोग;

(iv)

कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधाजनक भंडार और ᭭ थानीय सुख-सुिवधाएं हᱹ; और

(v)

वषाᭅ जल संचयन ।

परंतु यह और ᳰक जनजातीय भूिम का उपयोग रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या

त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी

(वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए

अनु᭄ात नहᱭ होगा :

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, मानीटरी सिमित के

िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ

सूचना कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को देनी होगी।

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा

मᱶ भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।

परंतु यह और भी ᳰक हᳯरत ᭃेᮢ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अᮧयु᭍ त

या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोतᲂ - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण

और पुनᱧ᭞भूतकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास

ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप पयᭅटन महायोजना के अनुसार हᲂगे जो ᳰक

आंचिलक महायोजना के भाग ᱨप मᱶ होगी ।

(ख) पयᭅटन महायोजना पयᭅटन िवभाग ᳇ारा रा᭔ य सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार कᳱ जाएगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार

कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय ᳇ारा जारी मागᭅिनदेशᲂ के अनुसार होगा िजसमᱶ

पाᳯरि᭭थितक पयᭅटन पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व ᳰदया जाएगा और पाᳯरि᭭थितक

संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय

रामपरा व᭠ यजीव अभयार᭛ य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात

नहᱭ होगा ;

परंतु संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दूरी से परे पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा तक

नए होटल और ᳯरसोटᭅ कᳱ ᭭थापना पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितक पयᭅटन सुिवधा के िलए पूवᭅ

पᳯरभािषत और िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात हᲂगी ।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ

के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत

िविनयामक ᮧािधकरणᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश

आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ

पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के अंितम

ᮧकाशन कᳱ तारीख से छह मास के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग

होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और

सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से छह माह के भीतर

उनके संरᭃण कᳱ योजनाएं तैयार कᳱ जाएगी तथा ऐसी योजना आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदूषण – पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग

या गुजरात रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ ᭟विन ᮧदूषण (िविनयमन और िनयंᮢण) िनयमᲂ के अनुसार पयाᭅवरणीय (संरᭃण)

अिधिनयम, 1986, 2000 के अंतगᭅत तैयार करेगा ।

(7) वायु ᮧदूषण - पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग

या गुजरात रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके

अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण सामा᭠य मानकᲂ के िलए

पयाᭅवरणीय ᮧदूिषत आ᭒छाᳰदत के िन᭭सारण के अंतगᭅत पयाᭅवरणीय (संरᭃण) अिधिनयम, 1986 और उसके अधीन बनाए

गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -

(i)

पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के पयाᭅवरण, वन और जलवायु

पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख

8 अᮧैल, 2016 नगरपािलक ठोस अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;

(ii)

᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के

िलए योजनाएं तैयार करᱶगे ;

(iii)

जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया

जाएगा ;

(iv)

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी

पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या

भ᭬ मीकरण अनु᭄ात नहᱭ होगा।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के

पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सा.का.िन. 343(अ) तारीख

28 माचᭅ, 2016 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ ᮧबंध िनयम, 2016 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत कᳱ जाएंगी और इस संबंध मᱶ

आंचिलक महायोजना मᱶ िविन᳸द᳥ उपबंध सि᭥मिलत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य

सरकार के सᭃम ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय

गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

(12) औ᳒ोिगक इकाइयां - (क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ िव िध के अनुसार ᭭ थािप त िव ᳒मान का᭬ ठ आधाᳯर त

उ᳒ोगᲂ के िस वाए नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा ।

(ख) जल, वायु, मृदा, ᭟ विन ᮧदूषण काᳯर त करने वाले ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ ᭭ थापना

को अनु᭄ात नहᱭ ᳰक या जाएगा ।

4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ या िविनयिमत ᳰकये जाने वाले ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन

ᳯरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत

सरकार के मामले मᱶ तारीख 21 अᮧैल, 2014, के अंतᳯरम आदेश के

अनुसरण मᱶ सवᭅदा ᮧचालन होगा ।

िन᭬कषᭅण करेगा, भी है;

(ग) सतही जल या भूजल का िवᮓय अनु᭄ात नहᱭ होगा;

(घ) जल के संदूषण या ᮧदूषण, िजसके अंतगᭅत कृिष भी है, को रोकने

के िलए सभी उपाय ᳰकए जाएंगे ।

10.

होटलᲂ और ᳯरसोटᲄ कᳱ ᭭थापना ।

पाᳯरि᭭ थितक पयᭅटन ᳰᮓयाकलाप से संबंिधत पयᭅटकᲂ के िलए

अ᭭थायी ᳞वसाय के िलए आवास के संबंध मᱶ पाᳯरि᭭थितक संवेदी

जोन या संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर के भीतर, दोनᲂ

मᱶ से जो समीप हो नए वािणि᭔यक होटलᲂ और ᳯरसोटᲄ को

अनु᭄ात ᳰकया जाएगा अ᭠यथा नहᱭ;

तथािप, व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर से परे

और पाᳯरि᭭ थितक संवेदी जोन के िव᭭ तार तक सभी नए पयᭅटन

ᳰᮓयाकलापᲂ या िव᳒मान ᳰᮓयाकलापᲂ का िव᭭ तार पयᭅटन

महायोजना के अनुᱨप होगा ।

11.

संिनमाᭅण ᳰᮓयाकलाप।

(क)

संरिᭃत ᭃेᮢ कᳱ एक ᳰकलोमीटर कᳱ सीमा के भीतर

ᳰकसी भी ᮧकार के नए वािणि᭔ यक संिनमाᭅण को अनु᭄ात नहᱭ

ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप-पैरा (1) मᱶ सूचीब᳍

ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम

मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी ।

ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत

संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ

और िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ

अनुमित से ही ᭠ यूनतम पर रखे जाएंगे ।

(ख) एक ᳰकलोमीटर से आगे और पाᳯरि᭭थितक संवेदी जोन कᳱ

सीमा तक वा᭭ तिवक ᭭ थानीय आव᭫ यकताᲐ के िलए संिनमाᭅण कᳱ

अनु᭄ा दी जाएगी और अ᭠ य वािणि᭔ यक संिनमाᭅण ᳰᮓयाकलाप

आंचिलक महायोजना के अनुᱨप हᲂगे।

12.

ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ

अनुपचाᳯरत बिह᮲ाᭅव और ठोस अपिश᳥ᲂ

पᳯरसंपि᭜ तयᲂ मᱶ कांटेदार से बाड नहᱭ लगाएंगे और कोई भी बाड़

एक मीटर से ऊंची नहᱭ होगी । कोई िव᳒मान बाड़, जो इस

उपदशᭅ का अनुपालन नहᱭ करती है, को आंचिलक महायोजना मᱶ

वᳶणत समय-सीमा के अनुसार उपांतᳯरत ᳰकया जाएगा ।

23.

कृिष ᮧणािलयᲂ मᱶ आमूल पᳯरवतᭅन ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

24.

रािᮢ मᱶ यािनक यातायात का संचलन ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

25.

वािणि᭔ यक साइनबोडᭅ और होᳺडग ।

करती है जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :—

िनदᱷश िनबंधन

(1) पाᳯरि᭭थितक संवेदी जोन सिमित अंितम अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(2) मानीटरी सिमित का कायᭅकाल तीन वषᭅ का होगा।

(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के

अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर

आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के

िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के त᭜ कालीन

पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के

अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे

ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे

संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱧ᳍, जो इस अिधसूचना के ᳰकसी उपबंध

का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम

होगा ।

(6) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या

िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

NOTIFICATION

New Delhi, 9th January, 2017

S.O. 72(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and

sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required

under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be

affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after

the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made

available to the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so

specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh

Draft Notification

Whereas, the Rampara Wildlife Sanctuary is spread over an area of 15.01 square kilometre and situated

between latitude 22 31’ 82” N and 22 34’88’’ N and between 70 55’54’’ E and 70 58’59’’ E longitude in Morbi district

with the headquarters at Wankaner in the State of Gujarat.

And whereas, the Rampara Wildlife Sanctuary is one of the richest and compact bio-diversity patches with a

total 270 species of plants which include 52 species of trees, 39 species of shrubs, 41 species of climbers, 97 species of

herbs and 41 grasses and it is covered on all sides by very good quality teak forest;

And whereas, the sanctuary is a home to Amphibians such as Frogs, Toads, Flap-shell Turtle and Star tortoise

and the study carried out by the Gujarat Ecological Education and Research (GEER) foundation in the year 1998 has

recorded 10 families, 16 genera and 21 species of spiders in the sanctuary, 15 species of reptiles, 93 species of birds

and 16 species of mammals;

And whereas, the Rampara Wildlife Sanctuary includes Wolf, Chinkara, Hyana, Jackal, Jungle Cat, Fox,

Porcupine, Wild boar, Blue bull, Hare, etc. as the major faunal species along with many rare and endangered species of

flora;

And whereas, it is necessary to conserve and protect the area the extent and boundaries of which is specified in

paragraph 1 of this notification around the protected area of Rampara Wildlife Sanctuary as Eco-sensitive Zone from

ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their

operations and processes in the said Eco-sensitive Zone;

Now therefore, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-section

(2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986, (29 of 1986) read with sub-rule (3) of

rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent

varying between 0.25 km and 4.25 kilometer around the boundary of Rampara Wildlife Sanctuary of the Eco-sensitive

Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as under, namely:-

Extent and boundaries of Eco-sensitive Zone.—(1). The area of Eco-sensitive Zone of Rampara Wildlife

Sanctuary is 39.3351 square kilometre and the minimum and maximum extent of the Eco-sensitive Zone is 0.25

kilometer and 4.25 kilometer surrounding the protected area.

(2).

Map of Rampara Wildlife Sanctuary and Rampara Eco-sensitive Zone is appended as Annexure I.

(3).

The Global Positioning System (GPS) points of Rampara Wildlife Sanctuary and Rampara Wildlife Sanctuary

Eco-sensitive Zone is given at Annexure-II.

(4). The list of the eight villages falling within Rampara Eco-sensitive Zone is appended as Annexure III.

Zonal Master Plan for Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with the local people and adhering to the stipulations given in this

notification.

(2) The Zonal Master Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines

issued by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned

State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism ;

(v) Municipal ;

(vi) Revenue ;

(vii) Agriculture;

(viii) Gujurat State Pollution Control Board;

(ix) Irrigation; and

(x) Public Works Department,

for integrating environmental and ecological considerations into it.

(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and

activities, unless so specified in this notification and the said Master Plan shall factor in improvement of all

infrastructure and activities to be more efficient and eco-friendly.

(6)

The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that needs attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural

areas, orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly

development for livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related

development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 10, 21, 26, 36 and 37 in column

(2) of the Table in paragraph 4, namely:-

(i)

eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly

tourism activities;

(ii) widening and strengthening of existing roads and construction of new roads;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries, convenience stores and local amenities; and

(v) rainwater harvesting:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation

and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master

Plan, which shall form part of the Zonal Master Plan;

(b) The Tourism Master Plan shall be prepared by the Department of Tourism, in consultation with the Department of

Forests and Environment of the State Government;

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the

Eco-sensitive Zone;

(ii) new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the

tourism activities:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of

the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre defined and

designated areas for Eco-tourism facilities as per Tourism Master Plan.

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall

be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of

the Monitoring Committee.

(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of the final notification and such plan shall form part of the Zonal Master Plan.

Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall

be prepared within six months from the date of publication of the final notification and incorporated in the Zonal

Master Plan.

(6) Noise pollution.—The Environment Department of the State Government or Gujarat State Pollution Control Board

shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the

provisions the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.—The Environment Department of the State Government shall draw up guidelines and regulations

for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8)

Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental

(Protection) Act, 1986 and rules made therein. -

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out in accordance with the provisions of the Solid

Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and

Climate Change vide notification number S.O. 1357 (E), dated the 8^th April, 2016 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-

biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the

Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in

accordance with the provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of

India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the

28^th March, 2016, as amended from time to time.

Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master

Plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall

monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12)

Industrial units.—(a) No establishment of new wood based industries within the proposed Eco-sensitive

Zone shall be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-

sensitive Zone shall be permitted.

List of activities prohibited or to be regulated within Eco-sensitive Zone.—All activities in the Eco

sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the

rules made thereunder, and be regulated in the manner specified in the table below, namely:-

No new or expansion of existing saw mills shall be permitted within the

Eco-sensitive Zone.

10.

Establishment of hotels and

resorts.

No new commercial hotels and resorts shall be permitted within one

kilometer of the boundary of the protected area or the boundary of the

Eco-sensitive Zone whichever is nearer except for accommodation for

temporary occupation of tourists related to eco-friendly tourism activities:

Provided that, beyond one kilometer and upto the extent of the Eco-

sensitive Zone, all new tourism activities or expansion of existing activities

shall be in conformity with the Tourism Master Plan.

11.

Construction activities.

(a) No new commercial construction of any kind shall be permitted within

one kilometer from the boundary of protected area or of the Eco-sensitive

Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction

in their land for their residential use including the activities listed in sub-

paragraph (1) of paragraph 3:

Provided further that the construction activity related to small scale

industries not causing pollution shall be regulated and kept at the

minimum, with the prior permission from the competent authority as per

the applicable rules and regulations, if any.

(b) Beyond one kilometer upto the extent of Eco-sensitive Zone,

construction for bone fide local needs shall be allowed and other

construction activities shall be regulated as per the Zonal Master Plan.

Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(a) Collector, MorbiÑChairman;

properties with barbed wire and no fence shall be higher than one meter.

Any existing fence not complying with this stipulation shall be modified as

per the time lines mentioned in the Zonal Master Plan.

Forest, Government of IndiaÑMember;

(i) Deputy Conservator of Forests (In Charge of the Sanctuary), RajkotÑMember Secretary.

Terms of reference.— (1) The Monitoring Committee shall monitor the compliance of the provisions of the final

notification.

(2) The tenure of the Monitoring Committee shall be three years.

(3)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533(E), dated the 14^th September, 2006, and are falling in the Eco-

sensitive Zone, except the prohibited activities as specified in column(3) of the table under paragraph 4 thereof, shall

be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central

Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the

provisions of the said notification.

The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14^th September, 2006 but are

falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the table under

paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific

conditions and referred to the concerned regulatory authorities.

(5)

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-

charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986

against any person who contravenes the provisions of the final notification.

(6)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from industry associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(7)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wildlife Warden in the State Ministry of Environment, Forest

and Climate Change as per performa appended at Annexure IV.

(8)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

(9) The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or the National Green Tribunal.
