भारत सरकार 7ारा अंगीकृत रा ीय वायु गुणव3 ता सूचकांक (ए: यूआई) के अनुसार िविभ< न तर* के वायु दूषण के

िनदान के िलए क =ीय दूषण िनयंण बोड0 7ारा तारीख 25 नवB बर, 2016 को माननीय उD चतम < यायालय के सम एक

Eेिडड Fर प*स ए: शन H लान और उपयु: त उपाय  तुत कए गए थे िजनम और उपांतरण कया गया था;

और जबक माननीय उD चतम < यायालय ने अपने दनांक 02 दसB बर, 2016 के आदेश म क =ीय सरकार को िनदेश

दया क वह Eेिडड Fर प*स ए: शन H लान क4 जांच करके पया0वरण (संरण) अिधिनयम, 1986 (1986 का 29) क4 धारा 3

क4 उप धारा (1) के अधीन उपयु: त अिधसूचना जारी करे;

और जबक मामले क4 जांच क4 गई है तथा उस पर िविधवत् िवचार करने के बाद क =ीय सरकार यह उपयु: त

समझती है क उपयु0: त आदेश* के अनुसरण म एक उपाय के Oप म Eेिडड Fर प*स ए: शन H लान के काया0< वयन का काय0

पया0वरण (संरण) अिधिनयम, 1986 (1986 का 29) क4 धारा 3 क4 उप धारा (1) के अधीन पया0वरण दूषण (िनवारण

एवं िनयंण) ािधकरण (िजसे इसके प6 चात् 'ईपीसीए' कहा गया है) को सTपा जाए;

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 12th January, 2017

S.O. 118(E).—Whereas high level of air pollution in Delhi and National Capital Region of Delhi has been a

matter of serious concern and requires urgent measures to address the issue, particularly with reference to episodic rises

in pollution levels;

And whereas a Graded Response Action Plan and appropriate measure to address different levels of air pollution

as per National Air Quality Index (AQI) adopted by Government of India was submitted by the Central Pollution Control

Board on the 25^th November, 2016 before the Hon’ble Supreme Court which was further modified;

And whereas the Hon’ble Supreme Court in its order dated the 2^nd December, 2016 has directed the Central

Government to examine the Graded Response Action Plan and issue appropriate notification under sub-section (1) of

section 3 of the Environment (Protection) Act, 1986 (29 of 1986);

And whereas the matter has been examined, and after due consideration the Central Government considers it

appropriate to entrust the task of implementing the Graded Response Action Plan as a measure under sub-section (1) of

section 3 of the Environment (Protection) Act, 1986 (29 of 1986) to the Environment Pollution (Prevention and Control)

Authority (hereinafter referred to as ‘EPCA’) in compliance of the aforesaid orders;

Now, therefore, in pursuance of sub-section (1) of section 3 of the Environment (Protection) Act, 1986 (29 of

1986), the Central Government hereby assigns the task of implementation of the Graded Response Action Plan to the

EPCA established under sub-section (3) of section 3 of the said Act vide notification number S.O.93 (E), dated the 29th

January, 1998 and re-constituted from time to time by the Central Government.
