नई ᳰद᭨ली, 19 जनवरी, 2017

का.आ. 186(अ).—भारत सरकार के ᮰म और रोजगार मंᮢालय कᳱ अिधसूचना सं. का.आ. 2832(अ), तारीख

1 िसतंबर, 2016 ᳇ारा उन सभी ᳞िᲦयᲂ कᳱ जानकारी के िलए िजनके उससे ᮧभािवत होने कᳱ संभावना थी, उस तारीख से,

िजसको उᲦ अिधसूचना मᱶ अंतᳶव᳥ भारत के राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ, दो मास कᳱ अविध कᳱ

समाि᳙ तक जानकारी तथा आᭃेप और सुझाव आमंिᮢत करते ᱟए, ᭠यूनतम मजदूरी अिधिनयम, 1948 (1948 का 11) कᳱ

धारा 5 कᳱ उपधारा (1) के खंड (ख) कᳱ अपेᭃानुसार कृिष िनयोजन मᱶ लगे ᱟए कमᭅचाᳯरयᲂ के अनूसूची मᱶ उि᭨लिखत ᮧवगᲄ

को संदेय दैिनक मजदूरी के पुनरीᭃण ᭠यूनतम दरᲂ का ᮧाᱨप ᮧ᭭ताव भारत के राजपᮢ, असाधारण, भाग-II, खंड 3,

उप-खंड (ii) मᱶ ᮧकािशत ᳰकया गया था;

उᲦ राजपᮢ कᳱ ᮧितयां तारीख 2 िसतंबर, 2016 को जनता को उपल᭣ध करा दी गई थᱭ ;

उᲦ ᮧ᭭ताव के संबंध मᱶ ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकया गया ;

अतः, अब, के᭠ᮤीय सरकार, उᲦ अिधिनयम कᳱ धारा 5 कᳱ उपधारा (2) और धारा 4 कᳱ उपधारा (1) के खंड (i) के

खंड (ख) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए और कृिष िनयोजन मᱶ लगे ᱟए कमᭅचाᳯरयᲂ को संदेय मजदूरी कᳱ ᭠यूनतम

दरᲂ के पुनरीᭃण के संबंध मᱶ भारत के राजपᮢ, असाधारण, भाग-II, खंड 3 उप-खंड (ii) मᱶ ᮧकािशत भारत सरकार के ᮰म

और रोजगार मंᮢालय कᳱ अिधसूचना सं. का.आ. 1520(अ), तारीख 20 अᲦूबर, 2005 को, उन बातᲂ से िसवाय अिधᮓांत

करते ᱟए िज᭠हᱶ ऐसे अिधᮓमण से पहले ᳰकया गया है या करने का लोप ᳰकया गया है सलाहकार बोडᭅ से परामशᭅ करने के

प᳟ात् ᭭तंभ (1) मᱶ उसके सामने उि᭨लिखत कमᭅचाᳯरयᲂ के ᮧवगᲄ को संदेय उससे उपाब᳍ अनुसूची के ᭭तंभ (2) मᱶ ᭭तंभ (4)

से यथािविन᳸द᳥ दैिनक मजदूरी कᳱ ᭠यूनतम दरᲂ का पुनरीᭃण करती है ।

(1) मजूदरी कᳱ ᭠यूनतम दरᱶ राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से ᮧभावी हᲂगे ।

(2) मजदूरी कᳱ ᭠यूनतम दरᲂ मᱶ िन᳜िलिखत शािमल होगा ।

(क)

इसके अधीन उि᭨लिखत अनुसची के भाग-1 के ᭭तंभ (2), (3) और (4) मᱶ उपवᳶणत और उसके ᭭तंभ (1) मᱶ

यथािविन᳸द᳥ कृिष िनयोजन मᱶ लगे ᱟए कमᭅचाᳯरयᲂ के ᮧवगᭅ को संदेय मजदूरी कᳱ मूल दरᱶ ; और

(ख)

᭭तंभ (1) मᱶ उि᭨लिखत कमᭅचाᳯरयᲂ के ᮧवगᲄ के िलए, उᲦ अनुसूची के भाग-II के ᭭तंभ (2), ᭭तंभ (3) और ᭭तंभ (4)

मᱶ उपवᳶणत दरᲂ पर एक िवशेष भᱫा (िजसे इसमᱶ इसके प᳟ात् पᳯरवतᭅनीय महंगाई भᱫा कहा गया है) और पᳯरवतᭅनीय

मंहगाई भᱫे के ᮧ᭜येक वषᭅ 30 जून और 31 ᳰदसंबर को समा᳙ होने वाली छह मास कᳱ पूवᭅवतᱮ अविध के िलए औ᳒ोिगक

कमᭅकारᲂ के औसत उपभोᲦा मू᭨य सूचकांक (आधार 2001=100) के आधार पर ᮧ᭜येक वषᭅ 1 अᲦूबर और 1 अᮧैल को शुᱨ

होने वाले ᮧ᭜येक छह माह के अंतराल मᱶ मु᭎य ᮰मायुᲦ (के᭠ᮤीय) ᳇ारा उᲦ अनुसूची के भाग 2 के ᭭तंभ (2), ᭭तंभ (3) और

᭭तंभ (4) मᱶ िविन᳸द᳥ दर पर और रीित मᱶ समायोिजत ᳰकया जाएगा ।

भाग 3

᭭प᳥ीकरण : इस अिधसूचना के ᮧयोजन के िलए,-

(क) इस अिधसूचना कᳱ अनुसूची मᱶ यथािविन᳸द᳥ सभी ᭭थान ᮓमशः ᭃेᮢ “क”, और ᭃेᮢ “ख” मᱶ सि᭥मिलत हᲂगे और िजसके

अंतगᭅत कोई नगर िनगम या नगरपािलका या छावनी बोडᭅ या ᳰकसी िविश᳥ ᭭थान कᳱ अिधसूिचत ᭃेᮢ सिमित कᳱ सीमा से

15 ᳰकलोमीटर कᳱ दूरी के भीतर आने वाले ᭭थान भी है और ᭃेᮢ “ग” मᱶ वे अ᭠य सभी ᭭थान सि᭥मिलत हᲂगे िजनका अनुसूची

मᱶ उ᭨लेख नहᱭ ᳰकया गया है और िजन पर ᭠यूनतम मजदूरी अिधिनयम, 1948 (1948 का 11) का िव᭭तार है । िवᱫ मंᮢालय

के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ को मकान ᳰकराया भᱫा के भुगतान के ᮧयोजन के िलए समय-समय पर जोड़े गए ᭭थानᲂ को

इस अिधसूचना मᱶ िविन᳸द᳥ वगᱮकरण के ᮧयोजन के िलए ऐसी तारीख से जोड़ा गया माना जाएगा ।

(ख) जहां ᳰकसी ᭃेᮢ मᱶ इस अिधसूचना ᳇ारा िनयत मजदूरी कᳱ ᭠यूनतम दर उपयुᭅᲦ िनयोजन मᱶ िनयोिजत कमᭅचाᳯरयᲂ के

िलए रा᭔य सरकार ᳇ारा िनयत मजदूरी कᳱ ᭠यूनतम दरᲂ से कम है िजसके संबंध मᱶ रा᭔य सरकार समुिचत सरकार है, उन ᭃेᮢᲂ

के संबंध मᱶ रा᭔य सरकार ᳇ारा िनयत मजदूरी कᳱ दर इस अिधसूचना के अधीन संदेय मजदूरी कᳱ ᭠यूनतम दर मानी जाएगी ।

(ग) (i) “अकुशल कायᭅ” से ऐसा कायᭅ अिभᮧेत है िजस कायᭅ के साधारण ᮧचालन मᱶ कम या कौशल या अनुभव कᳱ अपेᭃा

अंतवᭅिलत नहᱭ है ।

(ii) “अधᭅकुशल कायᭅ” से ऐसा कायᭅ अिभᮧेत है िजसमᱶ कुछ सीमा तक अनुभव के मा᭟यम से अᳶजत कौशल या सᭃमता

अंतवᭅिलत है तथा ᳰकसी कुशल कमᭅचारी कᳱ पयᭅवेᭃकᳱय या मागᭅिनदᱷशन के अधीन कायᭅ पालन करने मᱶ सᭃम है और

िजसके अंतगᭅत अकुशल पयᱷवेᭃकᳱय कायᭅ भी है ।

(iii) “कुशल कायᭅ” से ऐसा कायᭅ अिभᮧेत है िजसमᱶ कायᭅ पर अनुभव के मा᭟यम से या ᳰकसी तकनीकᳱ या ᳞वसाियक

सं᭭थान मᱶ ᮧिशᭃु के ᱨप मᱶ ᮧिशᭃण के मा᭟यम से अᳶजत कौशल या सᭃमता अंतवᭅिलत है और ऐसा कायᭅपालन

िजसमᱶ पहल और िनणᭅय के िलए आव᭫यकता होती है ।

(iv) “अ᭜यिधक कुशल कायᭅ” से ऐसा कायᭅ अिभᮧेत है िजसमᱶ पूणᭅता कᳱ कोई िडᮕी और कितपय कायᲄ के कायᭅ

िन᭬पादन पूणᭅ सᭃमता कᳱ आव᭫यकता होती है िजसके अंतगᭅत गहन तकनीकᳱ या ᳞वसाियक ᮧिशᭃण या कितपय

युिᲦयुᲦ अविध के िलए ᳞वहाᳯरक कायᭅ अनुभव के मा᭟यम से अᳶजत िलिपकᳱय कायᭅ है और ᳰकसी कमᭅकार से इन

कायᲄ के िन᭬पादन मᱶ अंतवᭅिलत कोई िनणᭅय या िविन᳟य के िलए पूणᭅ उᱫरदािय᭜व को संभालने कᳱ भी अपेᭃा है ।

(घ) मजदूरी कᳱ ᭠ यूनतम दरᲂ मᱶ िव᮰ाम के सा᭡ तािहक ᳰदन कᳱ मजदूरी शािमल है ।

(ङ) इस अिधसूचना ᳇ारा िनयत मजदूरी कᳱ ᭠ यूनतम दरᱶ ठेकेदारᲂ ᳇ारा िनयोिजत कमᭅचाᳯरयᲂ को भी लागू हᱹ ।

(च) िन:श᭍ त ᭪ यि᭍ तयᲂ को संदेय मजदूरी कᳱ ᭠ यूनतम दरᱶ वहᱭ हᲂगी, िजनका संदाय समुिचत ᮧवगᭅ के कमᭅकारᲂ को ᳰकया

जाता है ।

(छ) ᳫी, पुᱨष और उभयᳲलगी कमᭅचारी समान कायᭅ या समान ᮧकृित के कायᭅ के िलए, मजदूरी कᳱ समान दरᲂ के िलए

हकदार हᲂगे ।

(ज) मजदूरी कᳱ ᭠ यूनतम दर और पᳯरवतᭅनशील महंगाई भ᭜ ता दोनᲂ से िमलकर ᭠ यूनतम मजदूरी कᳱ दर बनेगी िजसे ᭠ यूनतम

मजदूरी अिधिनयम, 1948 (1948 का 11) के अधीन लागू ᳰकया जाएगा ।

NOTIFICATION

New Delhi, the 19th January, 2017

S.O. 186(E).—Whereas the draft proposal to revise the minimum rates of wages per day payable to the

Schedule mentioned categories of employees engaged in the employment of Agriculture was published in the Gazette of

India, Extraordinary, Part II, Section 3, Sub-section (ii), as required by clause (b) of sub-section (1) of section 5 of the

Minimum Wages Act, 1948 (11 of 1948), vide notification number S.O. 2832(E), dated the 1^st September, 2016 of the

Government of India in the Ministry of Labour and Employment for information and inviting objections and

suggestions from all persons likely to be affected thereby, till the expiry of the period of two months from the date on

which the copies of the Gazette of India containing the said notification were made available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read

with clause (i) of sub-section (1) of section 4 and sub-section (2) of section 5 of the said Act, and in supersession of the

notification of the Government of India in the Ministry of Labour and Employment, number S.O.1520(E), dated the

20^th October, 2005 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), relating to

revision of minimum rates of wages payable to the employees engaged in the employment of Agriculture, except as

respects things done or omitted to be done before such supersession, the Central Government after consulting the

Advisory Board hereby revises the minimum rates of wages per day, as specified in columns (2) to (4) of the Schedule

annexed hereto, payable to the categories of employees mentioned against them in column (1) thereof, in the

employment of Agriculture.

(1).

The revised minimum rates of wages shall be effective from the date of publication of this notification in the

Official Gazette.

(2).

The revised minimum rates of wages shall consist of,-

(a)

basic rates of wages as set out in columns (2), (3) and (4) of Part I of the Schedule mentioned hereunder and

payable to the categories of employees engaged in the employment of agriculture as specified in column (1)

thereof; and

(b) a special allowance (hereinafter referred to as Variable Dearness Allowance) at the rates as set out in columns

(2), (3) and (4) of Part II of the Schedule for the respective categories of employees mentioned in column (1)

thereof and the Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at

an interval of every six months commencing on 1^st October and 1^st April of every year on the basis of the

average Consumer Price Index Number for Industrial Workers (Base 2001=100) for the preceding period of six

months ending on 30^th June and 31^st December every year respectively, at the rate of and in the manner specified

in the columns (2), (3) and (4) of Part II of the said Schedule.

PART - III

Explanation : For the purposes of this notification, -

(a) Area “A” and Area “B” shall respectively comprise of all the places as specified in the Annexure to this notification

and include all places within a distance of fifteen kilometers from the periphery of Municipal Corporation or

Municipality or Cantonment Board or Notified Area Committee of a particular place, and Area “C” shall comprise of

all the other places not mentioned in the Annexure to which the Minimum Wages Act, 1948 (11 of 1948) extends.

The places added or upgraded from time to time by the Ministry of Finance for the purpose of payment of House

Rent Allowance to Central Government employees shall be taken to be added from such dates for the purpose of

classification specified in the Annexure to this notification;

(b) Where in any area the minimum rates of wages fixed by this notification are lower than the minimum rates of

wages fixed by the State Government for the employees of the aforesaid employments in relation to which the

State Government is the appropriate Government, the rates of wages fixed by the State Government shall in respect

of these areas, be deemed to be the minimum rates of wages payable under this notification;

(c)

(i)

“Unskilled Work” means work which involves simple operations requiring little or no skill or experience

on the job;

(ii)

“Semi-skilled Work” means work which involves some degree of skill or competence acquired through

experience on the job and which is capable of being performed under the supervision or guidance of a

skilled employee and include unskilled supervisory work;

(iii)

“Skilled Work” means work which involves skill or competence acquired through experience on the job

or through training as an apprentice in a technical or vocational institute and the performance of which

calls for initiative and judgement;

(iv)

“Highly Skilled Work” means work which calls for a degree of perfection and full competence in the

performance of certain tasks including clerical work acquired through intensive technical or professional

training or practical work experience for certain reasonable period and also requires of an worker to

assume full responsibility for the judgement or decision involved in the execution of the tasks;

(d)

The minimum rates of wages include the Wages for weekly day of rest;

(e)

The minimum rates of wages fixed by this notification are applicable to employees engaged by contractors also;

(f)

The minimum rates of wages payable to disabled employees shall be the same as payable to workers of the

appropriate category;

(g)

The men, women and transgender employees shall get the same rates of wages for the same work or work of

similar nature; and

(h)

Minimum rates of wages and variable dearness allowance both constitute the minimum rates of wages to be

enforceable under the Minimum Wages Act, 1948 (11 of 1948).

अंतᳶव᳥ राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थᱭ, दो मास कᳱ अविध कᳱ समाि᳙ तक जानकारी तथा आᭃेप

और सुझाव आमंिᮢत करता ᱟए, ᭠यूनतम मजदूरी अिधिनयम, 1948 (1948 का 11) कᳱ धारा 5 कᳱ उप-धारा (1) के खंड

(ख) कᳱ अपेᭃानुसार भारत के राजपᮢ, असाधारण, भाग II, खंड 3, उप-खंड (ii) मᱶ ᮧकािशत ᳰकया गया था ;

और उᲦ राजपᮢ कᳱ ᮧितयां 2 िसतंबर, 2016 को जनता को उपल᭣ध करा दी गई थᱭ ;

और उᲦ ᮧ᭭तावᲂ के संबंध मᱶ ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकया गया है ।

साथ पᳯठत धारा 3 कᳱ उपधारा (1) के खंड (क) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए और भारत के राजपᮢ, असाधारण,

भाग II, खंड 3, उप-खंड (ii) मᱶ ᮧकािशत भारत सरकार के ᮰म और राजगार मंᮢालय कᳱ अिधसूचना सं. का. आ. 1286(अ),

तारीख 20 मई, 2009 को, उन बातᲂ के िसवाय अिधᮓांत करते ᱟए, िज᭠हᱶ ऐसे अिधᮓमण से पहले ᳰकया गया है या करने का

लोप िगया गया है सलाहकार बोडᭅ के साथ परामशᭅ करने के प᳟ात्, ᭭तंभ (2) मᱶ उनके सामने उि᭨लिखत कमᭅचाᳯरयᲂ और

पूवᲃᲦ खानᲂ के िनयोजन मᱶ लगे ᱟए कमᭅचाᳯरयᲂ के ᮧवगᲄ को संदेय, उससे उपाब᳍ अनुसूची के ᭭तंभ (3) और ᭭तंभ (4) मᱶ

यथािविन᳸द᳥ दैिनक मजदूरी के ᭠यूनतम दरᲂ का पुनरीᭃण करती है ।

(1) ᭠यूनतम मजदूरी कᳱ पुनरीिᭃत दरᱶ, राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से ᮧभावी हᲂगी ।

(2) मजदूरी कᳱ पुनरीिᭃत दरᲂ मᱶ िन᳜िलिखत शािमल होगा,-

(क) इसके अधीन उि᭨लिखत अनुसूची के भाग-1 के ᭭तंभ (3) और ᭭तंभ (4) मᱶ उपवᳶणत और उसके ᭭तंभ (2) मᱶ

यथािविन᳸द᳥ पूवᲃᲦ खानᲂ मᱶ िनयोजन मᱶ िनयोिजत कमᭅचाᳯरयᲂ के ᮧवगᲄ को संदेय मजदूरी कᳱ मूल दरᱶ; और

मजदूरी कᳱ ᭠ यूनतम दरᲂ मᱶ मूल दरᱶ, िनवाᭅह भ᭜ ते अथाᭅत् िवशेष भ᭜ ते का ᭪ यय तथा आव᭫ यक व᭭ तुᲐ कᳱ

ᳯरयायती आपूᳶत का नकद मू᭨ य, यᳰद कोई हो, सिहत सभी समावेशी दरᲂ से िमलकर बनᱶगी ;

(ख)

मजदूरी कᳱ ᭠ यूनतम दरᲂ मᱶ सा᭡ तािहक िव᮰ाम-ᳰदन के िलए मजदूरी सि᭥ मिलत है ;

(ग)

᭠ यूनतम मजदूरी दरᱶ, ठेकेदारᲂ ᳇ारा लगाए गए कमᭅचाᳯरयᲂ को भी लागू हᲂगी ;

(ङ)

(i) ‘‘अकुशल कायᭅ’’ से ऐसा कायᭅ अिभᮧेत है, िजसमᱶ कायᭅ के संबंध मᱶ ऐसी साधारण संᳰᮓयाएं अंतवᭅिलत हᱹ,

िजनमᱶ अ᭨ प या कोई कौशल या अनुभव कᳱ अपेᭃा नहᱭ कᳱ जाती है ;

(ii)

‘‘अ᳍ᭅ कुशल कायᭅ’’ से ऐसा कायᭅ अिभᮧेत है, िजसमᱶ कायᭅ के संबंध मᱶ अनुभव के मा᭟ यम से अᳶजत कौशल या

सᭃमता कᳱ कोई ऐसी िडᮕी अंतवᭅिलत है जो कुशल कमᭅचारी के पयᭅवेᭃण या मागᭅदशᭅन के अधीन िन᭬ पादन

ᳰकए जाने यो᭏ य है और इसके अंतगᭅत पयᭅवेᭃण कायᭅ भी है;

(iii)

‘‘कुशल कायᭅ’’ से ऐसा कायᭅ अिभᮧेत है, िजसमᱶ कायᭅ के संबंध मᱶ अनुभव के मा᭟ यम से या ᳰकसी तकनीकᳱ या

᭪ यवसाियक सं᭭ थान मᱶ ᮧिशᭃु के ᱨप मᱶ ᮧिशᭃण के मा᭟ यम से अᳶजत कौशल या सᭃमता अंतवᭅिलत है और

िजसके िन᭬ पादन मᱶ पहल और िनणᭅय कᳱ अपेᭃा कᳱ जाती है;

(iv)

‘‘खिनक’’ से ऐसा कोई कमᭅकार अिभᮧेत है जो ᳰकसी खान मᱶ खुदाई, िबनाई, छंटाई, ᮓᳱᳲजग, ᮧसं᭭ करण के

मा᭟ यम से उ᭜ खनन/िन᭬ कषᭅण और ᳰकसी खान मᱶ सीधे ही लदाई और उसके अ᭠ य आनुषंिगक संकमᲄ मᱶ अंतवᭅिलत

है/लगा ᱟआ है ; और

(v)

‘‘अित कुशल कायᭅ’’ से ऐसा कायᭅ अिभᮧेत है, िजसमᱶ लंबे वषᲄ तक गहन तकनीकᳱ या वृि᭜ तक ᮧिशᭃण या

᭪ यवहाᳯरक कायᭅ अनुभव के मा᭟ यम से अᳶजत कितपय कायᭅ के िन᭬ पादन मᱶ िनपुणता और पूणᭅ सᭃमता कᳱ उ᭒ च

िडᮕी अपेिᭃत है और ᳰकसी कमᭅकार से यह भी अपेᭃा कᳱ जाती है ᳰक वह इन कायᲄ के िन᭬ पादन मᱶ अंतवᭅिलत

अपने िववेक या िविन᭫ चय कᳱ पूणᭅ िज᭥ मेदारी ले ;

(च)

ᳰकसी खान मᱶ या उसके संबंध मᱶ कायᭅरत या िनयोिजत कोई ᭪ यि᭍ त ‘‘भूिम के नीचे’’ कायᭅरत या िनयोिजत कहा

जाता है, यᳰद वह,-

(i)

ऐसी कूपकᳱ, जो डूब गई है या डूबने के अनुᮓम मᱶ रही है; या

(ii)

ᳰकसी ऐसे उ᭜ खनन मᱶ, िजसका भूिम के ऊ᭟ वᭅवतᱮ भूिम के नीचे िव᭭ तार है; या

(iii)

ᳰकसी खुले ढलाई कायᭅ मᱶ, िजसमᱶ उसके उ᭒ चतम ᳲबदु से उसके िन᭥ नतम ᳲबदु तक मापी गई उ᭜ खनन

कᳱ गहराई छह मीटर से अिधक है, मᱶ कायᭅरत है या िनयोिजत है;

(छ)

जहां संिवदा या करार या अ᭠ यथा के आधार पर ᳰकसी कमᭅकारी कᳱ मजदूरी कᳱ िव᳒मान दरᱶ,

अिधसूिचत दरᲂ से उ᭒ चतर हᱹ, वहां उ᭒ चतर दरᲂ का संरᭃण ᳰकया जाएगा और इस अिधसूचना के

ᮧयोजन के िलए मजदूरी कᳱ ᭠ यूनतम दरᲂ के ᱨप मᱶ माना जाएगा ;

(ज)

जहां ᳰकसी ᭃेᮢ मᱶ प᭜ थर खानᲂ के संबंध मᱶ इस अिधसूचना के अनुसार िनयत ᭠ यूनतम मजदूरी दरᱶ,

ᳰकसी खान या खदान मᱶ या ᳰकसी अ᭠ य ठहराव के अधीन ᳰकए गए प᭜ थर तुड़ाई या प᭜ थर पीसने के

िनयोजन मᱶ िनयोिजत कमᭅचाᳯरयᲂ के िलए रा᭔ य सरकार ᳇ारा िनयत ᭠ यूनतम मजदूरी से कम है, वहां

मजदूरी कᳱ उ᭒ चतर दर, प᭜ थर खानᲂ के िनयोजन मᱶ िनयोिजत कमᭅकारᲂ को संदेय होगी और वह

मजदूरी इस अिधसूचना के अधीन िनयत मजदूरी कᳱ ᭠ यूनतम दर के ᱨप मᱶ समझी जाएगी ;

(झ)

पुᱧष, ᭭ ᮢी और उभयᳲलगी कमᭅचारी वैसे ही कायᭅ या वैसी ही ᮧकृित के संकमᲄ के िलए मजदूरी कᳱ

वैसी ही दरᲂ के हकदार हᲂगे ;

(ञ)

᭠ यूनतम मजदूरी दरᱶ और पᳯरवतᭅनशील मंहगाई भ᭜ ता, दोनᲂ ही ᭠ यूनतम मजदूरी अिधिनयम, 1948

(1948 का 11) के अधीन ᮧवतᭅनीय होने वाली मजदूरी कᳱ ᭠ यूनतम दरᲂ का गठन करते हᱹ ।

S.O. 187(E).—Whereas the draft proposal to revise the minimum rates of wages per day payable to the

Schedule mentioned categories of employees engaged in the employment of “Gypsum Mines, Barytes Mines, Bauxite

Mines, Manganese Mines, China Clay Mines, Kyanite Mines, Copper Mines, Clay Mines, Magnesite Mines, White Clay

Mines, Stone Mines, Steatite Mines (including the mines producing Soap Stones and Talc), Ochre Mines, Asbestos

Mines, Fire Clay Mines, Chromite Mines, Quartzite Mines, Quartz Mines, Silica Mines, Graphite Mines, Felspar Mines,

Laterite Mines, Dolomite Mines, Red Oxide Mines, Wolfram Mines, Iron Ore Mines, Granite Mines, Rock Phosphate

Mines, Hematite Mines, Marble and Calcite Mines, Uranium Mines, Mica Mines, Lignite Mines, Gravel Mines, Slate

Mines and Magnetite Mines” was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), as

required by clause (b) of sub-section (1) of section 5 of the Minimum Wages Act, 1948 (11 of 1948) vide notification of

the Government of India in the Ministry of Labour and Employment number S.O. 2833(E), dated the 1^st September, 2016

for information and inviting objections and suggestions from all persons likely to be affected thereby, till the expiry of

the period of two months from the date on which copies of the Gazette of India containing the said notification were

made available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read with

clause (i) of sub-section (1) of section 4 and sub- section (2) of section 5 of the said Act, and in supersession of the

notification of the Government of India in the Ministry of Labour and Employment, published in the Gazette of India

Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 1286(E), dated the 20^th May, 2009, except as

respects things done or omitted to be done before such supersession, the Central Government after consulting the

Advisory Board hereby revises the minimum rates of wages per day, as specified in columns (3) and (4) of the schedule

annexed hereto, payable to the categories of employees mentioned against them in columns (2) thereof and engaged in

the employment of aforesaid mines.

(1)

The revised minimum rates of wages shall be effective from the date of publication of this notification in the

Official Gazette.

(2)

The revised minimum rates of wages shall consist of,-

(a) basic rates of wages as set out in columns (3) and (4) of Part – I of the Schedule mentioned hereunder and

payable to the categories of employees employed in the employment in the aforesaid mines as specified in column (2)

thereof; and

(b) a special allowance (hereinafter referred to as Variable Dearness Allowance) at the rate as set out in

columns (3) and (4) of Part – II of the said Schedule and payable to the categories of employees working in mines

mentioned in column (2) and the Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner

(Central) at an interval of every six months commencing on 1^st October and 1^st April of every year on the basis of the

average Consumer Price Index Number for Industrial Workers (Base 2001=100) for the preceding period of six months

ending on 30^th June and 31^st December every year respectively, at the rate of and in the manner specified in the columns

(3) and (4) of Part II of the Schedule.

Explanation: For the purposes of this notification, -

(a) the minimum rates of wages shall consist of all inclusive rates including the basic rates, the cost of living

allowance, namely, special allowance and the cash value of the concessional supply, if any, of essential

commodities;

(b) the minimum rates of wages includes the wages for weekly day of rest;

(d) the minimum rates of wages for disabled persons shall be the same as payable to the workers of the appropriate

category;

(e) (i) “unskilled work” means work which involves simple operations requiring little or no skill or experience on

the job;

(ii) “semi-skilled work” means work which involves some degree of skill or competence acquired through

experience on the job which is capable of being performed under the supervision or guidance of a skilled

employee and includes supervisory work;

(iii) “skilled work” means work which involves skill or competence acquired through experience on the job or

through training as an apprentice in a technical or vocational institute and the performance of which calls

for initiative and judgment;

(iv) “miner” means a worker who is directly involvedorengaged in excavation or extraction by way of digging,

picking, sorting, creasing, processing and loading and other incidental works thereto in a mine; and

(v) “highly skilled work” means work which calls for a high degree of perfection and full competence in the

performance of certain task acquired through intensive technical or professional training or practical work

experience for long years and also requires of a worker to assume full responsibility for his judgment or

decision involves in the execution of these tasks;

(f)

a person working or employed in or in connection with a mine is said to be working or employed “below ground”

if he is working or employed,-

(i)

in a shaft which has been or in the course of being sunk; or

(ii)

in any excavation which extends below superjacent ground; or

(iii)

in an open cast working in which the depth of the excavation measured from its highest to its lowest point

exceeds six metres;

(g)

where the existing rates of wages of any employee, based on contract or agreement or otherwise are higher than

the rates notified, the higher rates shall be protected and treated as the minimum rates of wages for purpose of this

notification;

(h)

where in any area the minimum rates of wages fixed by this notification are lower than the minimum rates of

wages fixed by the State Government for the employees of the aforesaid Employments in relation to which the

State Government is the appropriate Government, the rates of wages fixed by the State Government shall in

respect of these areas, be deemed to be the minimum rates of wages payable under this notification;

of a similar nature; and

the minimum rates of wages and Variable Dearness Allowance both constitute the minimum rates of wages to be

थी, दो मास कᳱ अविध के भीतर उनसे आᭃेप और सुझाव आमंिᮢत करने के िलए भारत सरकार के ᮰म और रोजगार मंᮢालय

कᳱ अिधसूचना का.आ. 2834(अ), तारीख 1 िसतंबर, 2016 ᳇ारा भारत के राजपᮢ, असाधारण, भाग II, खंड 3, उपखंड (ii)

रोजगार मंᮢालय कᳱ अिधसूचना को, उन बातᲂ के िसवाय अिधᮓांत करते ᱟए, िज᭠ हᱶ ऐसे अिधᮓमण से पूवᭅ ᳰकया गया है या

करने का लोप ᳰकया गया है, सलाहकार बोडᭅ से परामशᭅ करने के प᭫ चात् उपरो᭍ त िनयोजन मᱶ लगे ᱟए कमᭅचाᳯरयᲂ को संदेय

इससे उपाबध अनुसूची के ᭭ तंभ (2) से (4) मᱶ यथा िविन᳸द᭬ ट दैिनक मजदूरी कᳱ ᭠ यूनतम दरᲂ को पुनरीिᭃत करती है।

(1) मजदूरी कᳱ पुनरीिᭃत ᭠ यूनतम दरᱶ राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से ᮧभावी हᲂगी ।

(2) मज़दूरी कᳱ संशोिधत ᭠ यूनतम दरᱶ िन᭥ निलिखत से िमलकर बनेगी –

(क) मजदूरी कᳱ आधारभूत दरᱶ जैसी इसमᱶ इसके नीचे वᳶणत अनुसूची के भाग 1 के ᭭ तंभ (2) (3) और (4) मᱶ दी गई

हᱹ और ᭭ तंभ (1) मᱶ यथा िविन᳸द᭬ ट उपरो᭍ त िनयोजन के कमᭅचाᳯरयᲂ के वगᲄ को संदेय है ; और

(ख) अनुसूची के भाग II के ᭭ तंभ (2), (3) और (4) मᱶ कोई िवशेष भ᭜ ता (िजसे इसे इसके प᭫ चात् पᳯरवतᭅनीय

महंगाई भ᭜ ता कहा गया है) और ᭭ तंभ (1) मᱶ वᳶणत कमᭅचाᳯरयᲂ को संदेय है और पᳯरवतᭅनीय मंहगाई भ᭜ ता, मु᭎ य ᮰म

᭭प᳥ीकरण - अिधसूचना के ᮧयोजनाथᭅ,

(क)

ᭃेᮢ "क" और ᭃेᮢ "ख" मᱶ, इस अिधसूचना के उपाबंध मᱶ यथा िविन᳸द᭬ ट ᮓमश: भी ᭃेᮢ समािव᭬ ट होगᱶ

के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ को मकान ᳰकराया भᱫे कᳱ अदायगी के ᮧयोजन के िलए िवᱫ मंᮢालय ᳇ारा समय-

समय पर जोड़े गए अथवा ᮰ेणी मᱶ उ᳖यन ᳰकए गए ᭭थानᲂ को भी इस अिधसूचना उपाबंध मᱶ िविन᳸द᳥ वगᱮकरण के ᮧयोजन

के िलए ऐसी तारीखᲂ से जोड़ा गया समझा जाएगा ;

(ग)

"ग" वगᭅ ᮰े णी मᱶ जहां ᭠यूनतम मजदूरी ᭃेᮢवार आधार पर िनयत कᳱ गई है और जहां के᭠ᮤीय सरकार ने शीतकालीन

भᱫा या पवᭅतीय भᱫा या ᳰकसी अ᭠य िवशेष भᱫे का संदाय मंजूर ᳰकया है, सड़कᲂ/रनवे के िनमाᭅण या अनुरᭃण या िनमाᭅण

संᳰᮓयाᲐ िजसमᱶ भूिमगत िव᳒ुत, वायरलैस, रेिडयो, टेलीिवजन, टेलीफोन, टेलीᮕाफ और ऊपरी संचार केबलᲂ को डालने या

भूिमगत केबल डालने के कायᭅ, िव᳒ुत लाइनᱶ, जल आपूᳶत लाइनᱶ और सीवरेज लाइन शा िमल है, के अंतगᭅत ऐसे ही कायᭅ मᱶ

िनयोिजत कमᭅचाᳯरयᲂ को, उ᭠हᱶ अिधसूचना ᳇ारा िनधाᭅᳯरत देय ᭠यूनतम मजदूरी के अितᳯरᲦ इस ᮧकार िनयत ᭠यूनतम

मजदूरी के 10 ᮧितशत के बराबर रािश का भुगतान ᳰकया जाएगा :

परंतु ऐसे ᭭थानᲂ मᱶ जो समुᮤ तल से 6000 फुट से अिधक ऊंचाई पर ि᭭थत हᱹ, वहां 10 ᮧितशत अितᳯरᲦ मजदूरी

संद᭜ त कᳱ जाएगी।

(घ) गगनचु᭥बी इमारतᲂ अथाᭅत् तीस फुट अथवा इससे अिधक ऊँची इमारतᲂ मᱶ, एक ᳰदन मᱶ एक घंटे के िलए भी िनयोिजत

ᳰकये गये कमᭅकारᲂ को समुिचत ᮰ेणी हेतु ᭠यूनतम मजदूरी से बीस ᮧितशत अितᳯरᲦ मजदूरी का भुगतान ᳰकया जायेगा।

(ङ)

सुरंग मᱶ कायᭅ करने वाले कमᭅकारᲂ को इस अिधसूचना के अधीन समुिचत ᮰ेणी के िलए िनयत कᳱ गई ᭠यूनतम

मजदूरी के अितᳯरᲦ 20 ᮧितशत और भुगतान ᳰकया जाएगा।

(च) (i) "अकुशल कायᭅ" से वह कायᭅ अिभᮧेत है, िजसमᱶ ऐसी साधारण ᳰᮓयाएं शािमल हᱹ िजनके िलए कायᭅ के संबंध मᱶ

मामूली अथवा कोई कौशल अथवा अनुभव अपेिᭃत न हो;

(ii) “अ᳍ᭅ-कुशल कायᭅ" से वह कायᭅ अिभᮧेत है िजसमᱶ कायᭅ के अनुभव से अᳶजत कुछ माᮢा मᱶ कुशलता या दᭃता

सि᭥मिलत है और जो कुशल कमᭅचारी के पयᭅवेᭃण या मागᭅदशᭅन के अधीन ᳰकए जाने यो᭏य है तथा इसके अंतगᭅत

अकुशल पयᭅवेᭃी कायᭅ शािमल है;

(iii) “कुशल कायᭅ" से वह कायᭅ अिभᮧेत है, िजसमᱶ कायᭅ के अनुभव से या िशᭃु के ᱨप मᱶ ᳰकसी तकनीकᳱ या ᳞ावसाियक

सं᭭थान मᱶ ᮧिशᭃण के मा᭟यम से अᳶजत कुशलता या दᭃता और काम िजसके िलए नेतृ᭜ व और िविन᭫ चय अपेिᭃत है

(Iv) “अ᭜ यिधक कुशल कायᭅ" से ऐसा कायᭅ िजनमᱶ िलिपकᳱय कायᭅ शा िमल है, अिभᮧेत है िजसे करने के िलए सघन

तकनीकᳱ या वृितक ᮧिशᭃण या कितपय उिचत अविध के ᳞ावहाᳯरक कायᭅ अनुभव से अᳶजत संपूणᭅता और पूणᭅ

सᭃमता कᳱ आव᭫यकता होती है और कमᭅकार से यह अपेᭃा कᳱ जाती है ᳰक वह इन कायᲄ के िन᭬पादन के बाबत

ᳰकए जाने वाले िनणᭅयᲂ या िविन᳟यᲂ के िलए पूरा िज᭥मेदार है;

(छ) जहां ᳰकसी ᭃेᮢ मᱶ इस अिधसूचना ᳇ारा िनयत कᳱ गई मजदूरी कᳱ ᭠यूनतम दरᱶ रा᭔य सरकार ᳇ारा उपयुᭅᲦ िनयोजनᲂ मᱶ

िनयोिजत कमᭅचाᳯरयᲂ, िजनके संबंध मᱶ रा᭔य सरकार समुिचत सरकार है, के िलए िनधाᭅᳯरत मजदूरी कᳱ ᭠यूनतम दरᲂ से कम हᱹ

वहां रा᭔य सरकार ᳇ारा इन ᭃेᮢᲂ के संबंध मᱶ िनयत कᳱ गयी मजदूरी दरᱶ इस अिधसूचना के अंतगᭅत देय मजदूरी कᳱ ᭠यूनतम

दरᱶ समझी जायᱶगी;

(ज) जदूरी कᳱ ᭠यूनतम दरᲂ मᱶ सा᳙ािहक िव᮰ाम ᳰदवस के िलए देय मजदूरी भी शािमल है।

(झ) इस अिधसूचना के अंतगᭅत िनयत मजदूरी कᳱ ᭠यूनतम दरᱶ ठेकेदारᲂ ᳇ारा िनयोिजत कमᭅचाᳯरयᲂ पर भी लागू होती हᱹ;

S.O. 188(E).—Whereas the draft proposal to revise the minimum rates of wages per day payable to the

Schedule mentioned categories of employees engaged in the employment of “Construction or Maintenance of Roads or

Runways or in Building Operations including laying down Underground Electric, Wireless, Radio, Television,

Telephone, Telegraph and Overseas Communication Cables and similar other underground Cabling Work, Electric

Lines, Water Supply Lines and Sewerage Pipe Lines” was published in the Gazette of India, Extraordinary, Part II,

section 3, sub-section (ii) as required by clause (b) of sub-section (1) of section 5 of the Minimum Wages Act, 1948

(11 of 1948) vide notification of the Government of India in the Ministry of Labour and Employment number

S.O. 2834 (E), dated the 1^st September, 2016 for information and inviting objections and suggestions from all persons

likely to be affected thereby, till the expiry of the period of two months from the date on which copies of the Gazette of

India containing the said notification were made available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read with

clause (i) of sub-section (1) of section 4 and sub-section (2) of section 5 of the said Act, and in supersession of the

notification of the Government of India in the Ministry of Labour and Employment, published in the Gazette of India,

Part II, Section 3, Sub-section (ii), vide number S.O. 1285(E), dated the 20^th May, 2009, except as respects things done

or omitted to be done before such supersession, the Central Government after consulting the Advisory Board hereby

revises the minimum rates of wages per day, as specified in columns (2) to (4) of the Schedule annexed hereto, payable

to the categories of employees engaged in aforesaid employment.

(1).

The revised minimum rates of wages, shall be effective from the date of publication of this notification in the

Official Gazette.

(2)

The revised minimum rates of wages shall consist of,–

(a) basic rates of wages as set out in columns (2), (3) and (4) of Part I of the Schedule mentioned hereunder and

payable to the categories of employees in the aforesaid employment as specified in column (1) thereof; and

(b) a special allowance (hereinafter referred to as Variable Dearness Allowance) at the rate as set out in

columns (2), (3) and (4) of Part II of the said Schedule and payable to the employees mentioned in column (1) thereof

and the Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of

every six months commencing on 1^st October and 1^st April of every year on the basis of the average Consumer Price

Index Number for Industrial Workers (Base 2001=100) for the preceding period of six months ending on 30^th June and

31^st December every year respectively, at the rate of and in the manner specified in the columns (2), (3) and (4) of Part II

of the said Schedule.

Explanation: For the purposes of this notification,-

(a)

Area“A” and Area “B” shall respectively comprise of all the places as specified in the Annexure to this notification

and include all places within a distance of fifteen kilometres from the periphery of Municipal Corporation or

Municipality or Cantonment Board or Notified Area Committee of a particular place, and Area “C” shall comprise of

all the other places not mentioned in the Annexure to which the Minimum Wages Act, 1948 (11 of 1948) extends.

the places added or upgraded from time to time by the Ministry of Finance for the purposes of payment of House

Rent Allowance to Central Government employees shall be taken to be added from such dates for the purposes of

classification specified in the Annexure to this notification;

(e)

workers employed on tunnel working shall be paid twenty percent extra of the minimum wages fixed under this

notification for the appropriate category;

(f)

(i)

“unskilled work” means work which involves simple operations requiring little or no skill or experience

on the job;

(ii)

“semi-skilled work” means work which involves some degree of skill or competence acquired through

experience on the job and which is capable of being performed under the supervision or guidance of a

skilled employee and include unskilled supervisory work;

(iii)

“skilled work” means work which involves skill or competence acquired through experience on the job or

through training as an apprentice in a technical or vocational institute and the performance of which calls

for initiative and judgement;

(iv)

“highly skilled work” means work which calls for a degree of perfection and full competence in the

performance of certain tasks including clerical work acquired through intensive technical or professional

training or practical work experience for certain reasonable period and also requires of an worker to

assume full responsibility for the judgement or decision involved in the execution of the tasks;

(g)

where in any area the minimum rates of wages fixed by this notification are lower than the minimum rates of

wages fixed by the State Government for employees of the aforesaid employments in relation to which the State

Government is the appropriate Government, the rates of wages fixed by the State Government shall in respect of

these areas, be deemed to be the minimum rates of wages payable under this notification;

(h)

the minimum rates of wages include the wages for weekly day of rest;

(i)

the minimum rates of wages fixed by this notification are applicable to employees engaged by contractors also;

(j)

the minimum rates of wages payable to disabled employees shall be the same as payable to workers of the

appropriate category;

(k)

men, women and transgender employees shall be entitled for the same rates of wages for the same work or work

of similar nature; and

(l)

minimum rates of wages and special allowance both constitute the minimum rates of wages to be enforceable

under the Minimum Wages Act, 1948 (11 of 1948).

NOTIFICATION

New Delhi, the 19th January, 2017

S.O. 189(E).—Whereas the draft proposal to revise the minimum piece-rate wages and minimum guaranteed

time-rate wages per day payable to the employees engaged in the employment of stone mines in the whole of India was

published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide notification of the Government

of India in the Ministry of Labour and Employment number S.O. 2835(E), dated the 1^st September, 2016 as required by

clause (b) of sub-section (1) of section 5 of the Minimum Wages Act, 1948 (11 of 1948), for information and inviting

objections and suggestions from all persons likely to be affected thereby, with in a period of two months from the date

on which copies of the Gazette of India containing the said notification were made available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read with

clause (i) of sub-section (1) of section 4 and sub-section (2) of section 5 of the said Act, and in supersession of the

notification of the Government of India in the Ministry of Labour and Employment, published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 278(E), dated the 3^rd March, 2006, except as respects

things done or omitted to be done before such supersession, the Central Government after consulting the Advisory Board

hereby revises the minimum rates of wages per day, as specified in the Table below, payable to the employees engaged in

the employment of stone mines in the whole of India.

The revised minimum piece-rate wages and minimum guaranteed time-rate wages shall be effective from the date

of publication of this notification in the Official Gazette.

(2)

The said revised wages shall consist of basic rate of wages as set out in column (3) of the following Table, payable

to the employees engaged in the work mentioned in column (2) thereof, and a special allowance [hereinafter referred to as

Variable Dearness Allowance] at the rate set out in column (4) of the said Table for minimum piece rate of wages. The said

Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of every six

months commencing on 1^st October and 1^st April of every year on the basis of the average Consumer Price Index Number for

Industrial Workers (Base 2001=100) for the preceding period of six months ending on 30^th June and 31^st December every

year respectively, at the rate of and in the manner specified in the column (4) of the said Table.

Explanation: For the purposes of this notification,-

1. The basic minimum piece-rate of wages are inclusive of wages payable for the weekly day of rest;

2. the minimum rates of wages are applicable to employees engaged by contractors also;

3. where the prevailing rates of wages of any employee, based on contract or agreement or otherwise are higher

than the rates notified under the said Act, the higher rates shall be protected and treated as the minimum rates of

wages for purpose of this notification;

4. the minimum guaranteed wage, i.e. the fall-back wage for all piece rated employees shall be as specified under

column (3) of the said Table against each category of work;

5. the employer shall not make any deductions whatsoever from the aforesaid piece-rate of wages on account of

the cost of explosives, detonator, removal of soil, dewatering charges and similar other costs and the employer

will supply material for blasting, drilling of holes and dewatering facilities;

6. the minimum rates of wages for disabled persons shall be the same as payable to the workers of the appropriate

category;

7. men, women and transgender employees shall get the same rates of wages for the same work or works of a

similar nature; and

8. the minimum rates of wages and Variable Dearness Allowance both constitute the minimum rates of wages to

be enforceable under the Minimum Wages Act, 1948.

इसके नीचे वᳶणत अनुसूची के भाग I के ᭭ तंभ (2) मᱶ यथा उपदᳶशत मजदूरी कᳱ ᭠ यूनतम दरᲂ; और

(3) जहां, ᳰकसी कमᭅचारी के िलए ᳰकसी संिवदा या करार या अ᭠ यथा के आधार मजदूᳯरयᲂ कᳱ िव᳒मान दर पर इसमᱶ

अिधसूिचत दरᲂ से अिधक है तो वहां उ᭒ चतर दरᲂ को संरिᭃत ᳰकया जाएगा और उ᭠ हᱶ ऐसे कमᭅचाᳯरयᲂ को इस अिधसूचना के

ᮧयोजन के िलए लागू ᭠ यूनतम दर के ᱨप मᱶ माना जाएगा ;

(4) मजदूरी कᳱ ᭠ यूनतम दरᲂ मᱶ सा᭡ तािहक आराम के ᳰदन कᳱ मजदूरी भी सि᭥ मिलत होगी;

(5) मजदूरी कᳱ ᭠ यूनतम दरᱶ ठेकेदारᲂ ᳇ारा िनयोिजत कमᭅचाᳯरयᲂ को भी लागू होगी;

(9) जहां ᳰकसी ᭃेᮢ मᱶ इस अिधसूचना ᳇ारा िनयत मजदूरी कᳱ ᭠ यूनतम दरᱶ रा᭔ य सरकार ᳇ारा, िजसके संबंध मᱶ रा᭔ य

NOTIFICATION

New Delhi, the 19th January , 2017.

S.O. 190(E).— Whereas the draft proposal to revise the minimum rates of wages per day payable to the

categories of employees mentioned in the Schedule annexed there to and engaged in the employment of “Sweeping and

Cleaning excluding activities prohibited under the Employment of Manual Scavengers and Construction of Dry Latrines

(Prohibition) Act, 1993” was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide

notification of the Government of India in the Ministry of Labour and Employment number S.O. 2836 (E), dated the

1^st September, 2016, as required by clause (b) of sub-section (1) of section 5 of the Minimum Wages Act, 1948 (11 of

1948), for information and inviting objections and suggestions from all persons likely to be affected thereby, within a

period of two months from the date on which copies of the Gazette of India containing the said notification were made

available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read with

clause (i) of sub-section (1) of section 4 and sub-section (2) of section 5 of the Minimum Wages Act, 1948 (11 of 1948),

and in supersession of the notification of the Government of India in the Ministry of Labour and Employment, published

in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O.1994(E), dated the

7^th August, 2008, except as respects things done or omitted to be done before such supersession, the Central

Government after consulting the Advisory Board hereby revises the minimum rates of wages payable to the employees

engaged in the employment of Sweeping and Cleaning excluding activities prohibited under the Employment of Manual

Scavenges and Construction of Dry Latrines ( Prohibition) Act, 1993.

The revised minimum rates of wages shall be effective from the date of publication of this notification in the

Official Gazette.

The said revised wages shall consist of, –

(a) basic rates of wages as set out in column (2) of Part I of the Schedule mentioned hereunder; and

(b) a special allowance (hereinafter referred to as Variable Dearness Allowance) at the rate as set out in column

(2) of Part II of the said Schedule and payable to the employees working in areas mentioned in column (1) thereof. The

Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of every six

months commencing on 1^st October and 1^st April of every year on the basis of the average Consumer Price Index

Number for Industrial Workers (Base2001=100) for the preceding period of six months ending on 30^th June and

31^stDecember every year respectively at the rate of and in the manner specified in the column (2) of Part II of the

Schedule as below:

Explanation: For the purposes of the notification,-

1. Area “A” and Area “B” as indicated in Annexure to this notification shall respectively comprise all the places

as specified in the said Annexure as such areas, and include all places within a distance of fifteen kilometers

from the periphery of a Municipal Corporation or Municipality or Cantonment Board or Notified Area

Committee of a particular place. Area “C” shall comprise of all the other places not mentioned in Area “A” and

“B” of the Annexure and to which the Minimum Wages Act, 1948 extends;

2. the places added or upgraded from time to time by the Ministry of Finance for the purpose of payment of House

Rent Allowance to Central Government employees shall be taken to be added from the date of such addition or

up-gradation for the purposes of classification specified in Annexure to this notification;

3. where the existing rates of wages of any employee based on contract or agreement or otherwise are higher than

the rates notified herein, the higher rates shall be protected and treated as minimum rates of wages, applicable

for the purpose of this notification to such employees;

4. the minimum rates of wages include the wages for weekly day of rest;

5. the minimum rates of wages are applicable to employees employed by contractors also;

6. the minimum rates of wages for disabled persons shall be same as payable to the workers of appropriate

category;

7. the men, women and transgender employees shall get the same rates of wages for the same work or work of

similar nature;

8. the minimum rates of wages and Variable Dearness Allowance both constitute the minimum rates of wages to

be enforceable under the Minimum Wages Act, 1948 (11 of 1948);

9. where in any area the minimum rates of wages fixed by this notification are lower than the minimum rates of

wages fixed by the State Government for employees of the aforesaid employments in relation to which the State

Government is the appropriate Government, the rates of wages fixed by the State Government shall, in respect

of such areas, be deemed to be the minimum rates of wages payable under this notification.

का.आ. 191(अ).— ᭠ यूनतम मजदूरी अिधिनयम, 1948 (1948 का 11) कᳱ धारा 5 कᳱ उपधारा(1) के खंड(ख) ᳇ारा यथा

अपेिᭃत “पहरा और िनगरानी” के िनयोजन मᱶ लगे ᱟए और उससे उपाब᳍ अनुसूची मᱶ वᳶणत कमᭅचाᳯरयᲂ के वगᲄ को ᮧितᳰदन संदेय

मजदूरी कᳱ ᭠ यूनतम दरᲂ को पुनरीिᭃत करने के िलए ᮧाᱨप ᮧ᭭ ताव उसके ᳇ारा संभा᭪ य ᮧभािवत सभी ᭪ यि᭍ तयᲂ कᳱ सूचनाथᭅ और उस

तारीख से जब उ᭍ त अिधसूचना से अंतᳶव᭬ ट भारत के राजपᮢ कᳱ ᮧितयां आम जनता को उपल᭣ ध कराई गई थी, दो मास कᳱ अविध के

भीतर उनसे आᭃेप और सुझाव आमंिᮢत करने के िलए भारत सरकार के ᮰म और रोजगार मंᮢालय कᳱ अिधसूचना का.आ. 2837(अ),

तारीख 1 िसतंबर, 2016 ᳇ारा भारत के राजपᮢ, असाधारण, भाग II, खंड 3, उपखंड (ii) मᱶ ᮧकािशत ᳰकया गया था;

और उ᭍ त राजपᮢ कᳱ ᮧितयां जनता को 2 िसतंबर, 2016 को उपल᭣ ध कराई गई थी;

अत:, के᭠ ᮤीय सरकार, उ᭍ त अिधिनयम कᳱ धारा 4 कᳱ उपधारा (1) के खंड ( i) और धारा 5 कᳱ उपधारा(2) के साथ पᳯठत

धारा 3 कᳱ उपधारा (1) के खंड(ख) ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए, और उन बातᲂ के िसवाय अिधᮓांत करते ᱟए, िज᭠ हᱶ ऐसे

अिधᮓमण से पूवᭅ ᳰकया गया है या करने का लोप ᳰकया गया है और भारत के राजपᮢ, असाधारण, भाग II, खंड 3, उपखंड (ii) मᱶ

का.आ. सं. 2223(अ), तारीख 18 िसतंबर, 2008 ᳇ारा ᮧकािशत भारत सरकार के ᮰म और रोजगार मंᮢालय कᳱ अिधसूचना के

अिधᮓमण मᱶ, सलाहकार बोडᭅ से परामशᭅ करने के प᭫ चात् ‘पहरा और िनगरानी’ के िनयोजन मᱶ लगे ᱟए कमᭅचाᳯरयᲂ को संदेय मजदूरी कᳱ

᭠ यूनतम दरᲂ को पुनरीिᭃत करती है।

᭭ प᭬ टीकरण-- अिधसूचना के ᮧयोजन के िलए,--

(क) इस अिधसूचना के उपाबंध मᱶ ᮓमश: यथा उपदᳶशत ᭃेᮢ “अ” और ᭃेᮢ “आ” मᱶ उ᭍ त उपाबंध मᱶ यथािविन᳸द᭬ ट सभी ᭭ थान समािव᭬ ट

हᲂगे और नगर िनगम या नगर पािलका या छावनी बोडᭅ या ᳰकसी िविश᭬ ट ᭭ थान कᳱ अिधसूिचत ᭃेᮢ सिमित कᳱ पᳯरिध से प᭠ ᮤह

कᱶᮤीय सरकार के कमᭅचाᳯरयᲂ को गृह ᳰकराए भ᭜ ते के संदाय के ᮧयोजन के िलए िव᭜ त मंᮢालय ᳇ारा समय-समय पर जोड़े गए या

उ᭠ नयन ᳰकए गए ᭭ थानᲂ को ऐसे वधᭅन या उ᭠ नयन कᳱ तारीख से इस ᮧाᱨप ᮧ᭭ ताव के उपाबंध मᱶ िविन᳸द᭬ ट वगᱮकरण के ᮧयोजन के िलए

जोड़ा जाएगा;

(ग) जहां, ᳰकसी कमᭅचारी के िलए ᳰकसी संिवदा या करार या अ᭠ यथा के आधार मजदूᳯरयᲂ कᳱ िव᳒मान दर पर इसमᱶ अिधसूिचत दरᲂ से

अिधक है तो वहां उ᭒ चतर दरᲂ को संरिᭃत ᳰकया जाएगा और उ᭠ हᱶ ऐसे कमᭅचाᳯरयᲂ को इस अिधसूचना के ᮧयोजन के िलए लागू ᭠ यूनतम

दर के ᱨप मᱶ माना जाएगा ;

(घ) (i) “अधᭅ-कुशल कायᭅ” से वह कायᭅ अिभᮧेत है, िजसमᱶ कायᭅ पर अनुभव के मा᭟ यम से अᳶजत कुछ कौशल या सᭃमता अंतवᭅिलत है और

जो ᳰकसी कुशल कमᭅचारी के पयᭅवेᭃण या मागᭅदशᭅन के अधीन िन᭬ पाᳰदत ᳰकए जाने के िलए सᭃम है और इसके अंतगᭅत अकुशल

पयᭅवेᭃणीय कायᭅ भी है ।

(ii) “कुशल कायᭅ” से वह कायᭅ अिभᮧेत है, िजसमᱶ कायᭅ पर अनुभव के मा᭟ यम से या ᳰकसी तकनीकᳱ या ᭪ यवसाियक सं᭭ थान मᱶ ᮧिशᭃु के

ᱧप मᱶ ᮧिशᭃण के मा᭟ यम से अᳶजत कौशल या सᭃमता अंतवᭅिलत है और ऐसा कायᭅपालन िजसमᱶ पहल और िनणᭅय के िलए आव᭫ यकता

होती है ।

(ड.) मजदूरी कᳱ ᭠ यूनतम दरᲂ मᱶ सा᭡ तािहक आराम के ᳰदन कᳱ मजदूरी भी सि᭥ मिलत होगी;

(च) मजदूरी कᳱ ᭠ यूनतम दरᱶ ठेकेदारᲂ ᳇ारा िनयोिजत कमᭅचाᳯरयᲂ को भी लागू होगी;

(छ) िन:श᭍ त ᭪ यि᭍ तयᲂ कᳱ मजदूरी कᳱ ᭠ यूनतम दरᱶ वहᱭ हᲂगी, जो समुिचत ᮧवगᭅ के कमᭅचाᳯरयᲂ को संदेय है ;

(ज) ᭭ ᮢी, पुᱨष और उभयᳲलगी कमᭅचारी समान कायᭅ या समान ᮧकृित के कायᭅ के िलए, िजसके िलए उ᭠ हᱶ िनयोिजत ᳰकया जाता है,

मजदूरी कᳱ समान दरᲂ के िलए हकदार हᲂगे;

(झ) मजदूरी कᳱ ᭠ यूनतम दर और पᳯरवतᭅनशील महंगाई भ᭜ ता दोनᲂ से िमलकर ᭠ यूनतम मजदूरी कᳱ दर बनेगी िजसे ᭠ यूनतम मजदूरी

अिधिनयम, 1948 (1948 का 11) के अधीन लागू ᳰकया जाएगा ।

(ञ) जहां ᳰकसी ᭃेᮢ मᱶ इस अिधसूचना ᳇ारा िनयत मजदूरी कᳱ ᭠ यूनतम दरᱶ रा᭔ य सरकार ᳇ारा, िजसके संबंध मᱶ रा᭔ य सरकार समुिचत

सरकार है, पूवᲃ᭍ त िनयोजनᲂ के कमᭅचाᳯरयᲂ के िलए िनयत मजदूरी के ᭠ यूनतम दरᲂ से िन᭥ नतर है, वहां रा᭔ य सरकार ᳇ारा िनयत मजदूरी

के दरᱶ ऐसे ᭃेᮢᲂ के संबंध मᱶ इस अिधसूचना के अधीन संदेय मजदूᳯरयᲂ कᳱ ᭠ यूनतम दरᱶ समझी जाएं ।

NOTIFICATION

New Delhi, the 19th January , 2017.

S.O. 191(E).— Whereas the draft proposal to revise the minimum rates of wages per day payable to the

categories of employees mentioned in the Schedule annexed thereto and engaged in the employment of “Watch and

Ward” was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification of the

Government of India in the Ministry of Labour and Employment number S.O. 2837 (E), dated the 1^st September, 2016

as required by clause (b) of sub-section (1) of section 5 of the Minimum Wages Act, 1948 (11 of 1948), for information

and inviting objections and suggestions from all persons likely to be affected thereby, within a period of two months

from the date on which copies of the Gazette of India containing the said notification were made available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of section 3 read with

clause (i) of sub-section (1) of section 4 and sub-section (2) of section 5 of the said Act, and in supersession of the

notification of the Government of India in the Ministry of Labour and Employment, published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii), vide numbers S.O.2233(E), dated the 18^th September, 2008, except as

respects things done or omitted to be done before such supersession, the Central Government after consulting the

Advisory Board hereby revises the minimum rate of wages payable to the employees engaged in the employment of

‘Watch and Ward’.

The revised minimum rates of wages shall be effective from the date of publication of this notification in the

Official Gazette.

(2)

The revised minimum rates shall consist of, –

(a) basic rates of wages as set out in column (2) of Part I of the Schedule mentioned hereunder; and

(b) a special allowance (hereinafter referred to as Variable Dearness Allowance) at the rate as set out in column

(2) of Part II of the Schedule and payable to the employees working in areas mentioned in column (1) thereof. The

Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of every six

months commencing on 1^st October and 1^st April of every year on the basis of the average Consumer Price Index

Number for Industrial Workers (Base2001=100) for the preceding period of six months ending on 30^th June and

31^stDecember every year respectively at the rate of and in the manner specified in the column (2) of Part II of the

Schedule as below:

Explanation: For the purposes of the notification,-

(a) Area “A” and Area “B” as indicated in Annexure to this notification shall respectively comprise all the

places as specified in the said annexure as such areas, and include all places within a distance of fifteen

kilometres from the periphery of a Municipal Corporation or Municipality or Cantonment Board or

Notified Area Committee of a particular place. Area “C” shall comprise of all the other places not

mentioned in Area “A” and “B” of the Annexure and to which the Minimum Wages Act, 1948 (11 of

1948) extends;

(b) the places added or upgraded from time to time by the Ministry of Finance for the purposes of payment

of House Rent Allowance to Central Government employees shall be taken to be added from the date of

such addition or up-gradation for the purposes of classification specified in Annexure to this notification;

higher than the rates notified herein, the higher rates shall be protected and treated as minimum rates of

wages, applicable for the purpose of this notification to such employees;

(d) (i) “skilled work” means work which involves skill or competence acquired through experience on the

job or through training as an apprentice in a technical or vocational institute and the performance of

which calls for initiative and judgement;

(ii) “highly skilled work” means work which calls for a degree of perfection and full competence in the

performance of certain tasks including clerical work acquired through intensive technical or professional

training or practical work experience for certain reasonable period and also requires an worker to

assume full responsibility for the judgement or decision involved in the execution of the tasks;

(e) the minimum rates of wages include the wages for weekly day of rest;

(f) the minimum rates of wages are applicable to employees employed by contractors also;

(g) the minimum rates of wages for disabled persons shall be the same as payable to the workers of

appropriate category;

(h) the men, women and transgender employees shall be entitled for the same rates of wages for the same

work or work of similar nature;

(i) the minimum rates of wages and Variable Dearness Allowance both constitute the minimum rates of

wages to be enforceable under the Minimum Wages Act, 1948(11 of 1948); and

(j) where in any area the minimum rates of wages fixed by this notification are lower than the minimum

rates of wages fixed by the State Government for employees of the aforesaid Employments in relation to

which the State Government is the appropriate Government, the rates of wages fixed by the State

Government shall in respect of these areas, be deemed to be the minimum rates of wages payable under

this notification.

(ख) ᳇ारा यथा अपेिᭃत इससे उपाब᳍ अनुसूची मᱶ वᳶणत कमᭅचाᳯरयᲂ के ᮧवगᲄ (i) रेल के माल गोदामᲂ, पासᭅल कायाᭅलय ; (ii) अ᭠ य माल

गोदामᲂ, गोदामᲂ, भंडारण तथा अ᭠ य समान िनयोजन ; (iii) डाक और प᭜ तन ; और (iv) िवमानप᭜ तनᲂ (अंतराᭅ᭬ ᮝीय और घरेलू दोनᲂ मᱶ)

कागᲄ मᱶ लदाई और उतराई मᱶ लगे ᱟए कमᭅचाᳯरयᲂ को संदेय दैिनक मजदूरी कᳱ ᭠ यूनतम दर को पुनरीिᭃत करने के िलए है, जो भारत के

राजपᮢ, असाधारण, भाग II, खंड 3, उपखंड (ii) मᱶ भारत सरकार के ᮰म और रोजगार मंᮢालय कᳱ अिधसूचना सं. का.आ. 2838(अ)

तारीख 1 िसतंबर, 2016 ᳇ारा ᮧकािशत ᳰकया गया था, िजनसे उन सभी ᭪ यि᭍ तयᲂ से, िजनके उससे ᮧभािवत होने कᳱ संभावना है, उस

तारीख से, िजसको उस अिधसूचना अंतᳶव᭬ ट करने वाली राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ ध करा दी गई थी, दो मास कᳱ अविध मᱶ

आᭃेप और सुझाव आमंिᮢत ᳰकए गए थे ;

और उ᭍ त राजपᮢ कᳱ ᮧितयां तारीख 2 िसतंबर, 2016 को जनता को उपल᭣ ध करा दी गई थी ;

और उ᭍ त ᮧ᭭ ताव पर ᮧा᭡ त आᭃेपᲂ और सुझावᲂ पर कᱶᮤीय सरकार ᳇ारा िवचार ᳰकया जा चुका है ;

अत: अब, कᱶᮤीय सरकार, उ᭍ त अिधिनयम कᳱ धारा 5 कᳱ उपधारा (2) और धारा 4 कᳱ उपधारा (1) के खंड (i) के साथ पᳯठत

धारा 3 कᳱ उपधारा (1) के खंड (ख) ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए, सलाहकार बोडᭅ से परामशᭅ करने के प᭫ चात् भारत सरकार,

᮰म और रोजगार मंᮢालय, भारत के राजपᮢ, असाधारण, भाग II, खंड 3, उपखंड (ii) मᱶ का.आ. 1284(अ), तारीख 20 मई, 2009 मᱶ

ᮧकािशत अिधसूचना को िसवाय उन बातᲂ के िज᭠ हᱶ ऐसे अिधᮓमण से पूवᭅ ᳰकया गया है या करने का लोप ᳰकया गया है, अिधᮓांत करते

ᱟए उपरो᭍ त िनयोजन मᱶ िनयोिजत कमᭅचाᳯरयᲂ को संदेय ᭠ यूनतम मजदूरी को पुनरीिᭃत करती है ।

(1) मजदूरी कᳱ पुनरीिᭃत ᭠ यूनतम दर राजपᮢ मᱶ अिधसूचना के ᮧकािशत होने कᳱ तारीख से ᮧभावी होगी ।

(2) मजदूᳯरयᲂ कᳱ ᭠ यूनतम पुनरीिᭃत दर मᱶ—

(क) इसमᱶ इसके प᭫ चात् वᳶणत अनुसूची के भाग 1 के ᭭ तंभ (2) मᱶ यथा अिधकिथत मजदूᳯरयᲂ कᳱ आधारी दरᱶ, और

(ख) अनुसूची के भाग II के ᭭ तंभ (2) मᱶ एक िवशेष भ᭜ ता (िजसे इसमᱶ इसके प᭫ चात् पᳯरवतᭅनशील महंगाई भ᭜ ता कहा गया है), जो

उसके भाग 1 और भाग II के ᭭ तंभ मᱶ वᳶणत ᭃेᮢᲂ मᱶ कायᭅ कर रहे कमᭅचाᳯरयᲂ को संदेय है । पᳯरवतᭅनशील महंगाई भ᭜ ते को मु᭎ य ᮰म

᭭ प᭬ टीकरण-- अिधसूचना के ᮧयोजन के िलए,--

“आ” मᱶ वᳶणत नहᱭ है और िजन पर ᭠ यूनतम मजदूरी अिधिनयम, 1948 का िव᭭ तार होता है ।

(ख) कᱶᮤीय सरकार के कमᭅचाᳯरयᲂ को गृह ᳰकराए भ᭜ ते के संदाय के ᮧयोजन के िलए िव᭜ त मंᮢालय ᳇ारा समय-समय पर जोड़े गए या

जोड़ा जाएगा ।

(घ) मजदूरी कᳱ ᭠ यूनतम दरᲂ मᱶ सा᭡ तािहक आराम के ᳰदन कᳱ मजदूरी भी सि᭥ मिलत होगी ।

(ज) मजदूरी कᳱ ᭠ यूनतम दर और पᳯरवतᭅनशील महंगाई भ᭜ ता दोनᲂ से िमलकर ᭠ यूनतम मजदूरी कᳱ दर बनेगी िजसे ᭠ यूनतम मजदूरी

New Delhi, the 19th January , 2017.

S.O. 192(E).— Whereas the draft proposal to revise the minimum rates of wages per day payable to the

categories of employees mentioned in the Schedule annexed thereto and engaged in the employment of “Loading and

Unloading in (i) Goods-Sheds, Parcel Offices of Railways; (ii) Other Goods-sheds, Godowns, Warehouses and other

similar employments; (iii) Docks and Ports; and (iv) Passenger Goods and Cargo carried out at Airports (both

International and Domestic)” was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii)

vide notification of the Government of India in the Ministry of Labour and Employment number S.O. 2838 (E), dated

the 1^st September, 2016, as required by clause (b) of sub-section (1) of Section 5 of the Minimum Wages Act, 1948 (11

of 1948), for information and inviting objections and suggestions from all persons likely to be affected thereby, within

a period of two months from the date on which copies of the Gazette of India containing the said notification were made

available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas objections and suggestions received on the said proposal have been considered by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1) of Section 3 read

with clause (i) of sub-section (1) of Section 4 and sub-section (2) of section 5 of the said Act, and in supersession of the

notification of the Government of India in the Ministry of Labour and Employment, published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O.1284(E), dated the 20^th May, 2009, except as respects

things done or omitted to be done before such supersession, the Central Government after consulting the Advisory Board

hereby revises the minimum rate of wages payable to the employees engaged in the aforesaid employment.

(1) The revised minimum rates of wages shall be effective from the date of publication of this notification in the

Official Gazette.

(2)

The revised minimum wages shall consist of, –

(a) basic rates of wages as set out in column (2) of Part I of the Schedule mentioned hereunder; and

(b) a special allowance (hereinafter referred to as Variable Dearness Allowance) at the rate as set out in column

(2) of Part II of the said Schedule and payable to the employees working in areas mentioned in column (1) thereof. The

Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of every six

months commencing on 1^st October and 1^st April of every year on the basis of the average Consumer Price Index

Number for Industrial Workers (Base2001=100) for the preceding period of six months ending on 30^th June and

31^stDecember every year respectively at the rate of and in the manner specified in the column (2) of Part II of the said

Schedule as below:

Explanation: For the purposes of the notification,-

(a) Area “A” and Area “B” as indicated in Annexure to this notification shall respectively comprise all the

places as specified in the said Annexure as such areas, and include all places within a distance of fifteen

kilometers from the periphery of a Municipal Corporation or Municipality or Cantonment Board or

Notified Area Committee of a particular place. Area “C” shall comprise of all the other places not

mentioned in Area “A” and “B” of the Annexure and to which the Minimum Wages Act, 1948 (11 of

1948) extends;

(b) the places added or upgraded from time to time by the Ministry of Finance for the purpose of payment of

House Rent Allowance to Central Government employees shall be taken to be added from the date of

such addition or up-gradation for the purposes of classification specified in Annexure to this notification;

higher than the rates notified herein, the higher rates shall be protected and treated as minimum rates of

wages, applicable for the purpose of this notification to such employees;

(d) the minimum rates of wages include the wages for weekly day of rest;

(e) the minimum rates of wages are applicable to employees employed by contractors also;

(f) the minimum rates of wages for disabled persons shall be the same as payable to the workers of

appropriate category;

(g) the men, women and transgender employees shall be entitled for the same rates of wages for the same

work or work of similar nature;

(h) the minimum rates of wages and Variable Dearness Allowance both constitute the minimum rates of

wages to be enforceable under the Minimum Wages Act, 1948(11 of 1948).

का.आ. 193(अ).— ᭠ यूनतम मजदूरी अिधिनयम, 1948 (1948 का 11) कᳱ धारा 27 ᳇ारा यथा अपेिᭃत ᮧाᱨप

ᮧ᭭ ताव, भारत सरकार के ᮰म और रोजगार मंᮢालय कᳱ अिधसूचना सं. का.आ. 2092, तारीख 23 अᮧैल, 1983 को

संशोिधत करने के िलए है, जो भारत सरकार, ᮰म और रोजगार मंᮢालय, सं. का.आ. 2839(अ) तारीख 1 िसतंबर, 2016

᳇ारा ᮧकािशत ᳰकए गए थे, िजसमᱶ उन सभी ᭪ यि᭍ तयᲂ से िजनके उनसे ᮧभािवत होने कᳱ संभावना है, उस तारीख से, िजसको

उस अिधसूचना अंतᳶव᭬ ट करने वाली राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ ध करा दी गई थी, तीन मास कᳱ अविध मᱶ आᭃेप

और सुझाव मांगे गए थे ;

और उ᭍ त राजपᮢ कᳱ ᮧितयां तारीख 2 िसतंबर, 2016 को जनता को उपल᭣ ध करा दी गई थी ;

और कᱶᮤीय सरकार के उ᭍ त ᮧ᭭ ताव पर कोई आᭃेप और सुझाव ᮧा᭡ त नहᱭ ᱟए हᱹ ;

अत: अब, कᱶᮤीय सरकार, उ᭍ त अिधिनयम कᳱ धारा 27 ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए भारत सरकार,

᮰म और रोजगार मंᮢालय कᳱ अिधसूचना सं. का.आ. 2092, तारीख 23 अᮧैल, 1983, जो भारत के राजपᮢ, असाधारण,

भाग II, खंड 3, उपखंड (ii) मᱶ ᮧकािशत ᱟए थे, मे िन᭥ निलिखत संशोधन करती है, अथाᭅत्

उ᭍ त अिधसूचना मᱶ, "मᱶ रेलᲂ, माल गोदामᲂ, डाको और प᭜ तनᲂ मᱶ लदाई और उतराई" श᭣ दᲂ के ᭭ थान पर "मᱶ रेलᲂ,

माल गोदामᲂ, डाका प᭜ तनᲂ और हवाई अ᲻ᲂ (अंतराᭅ᭬ ᮝीय और घरेलू टᳶमनल दोनᲂ)" श᭣ द रखे जाएंगे ।

Ministry of Labour and Employment number S.O.2092 , dated the 23^rd April, 1983, was published in the Gazette of

India, Extraordinary, Part II, Section 3, Sub-section (ii), vide notification of the Government of India in the Ministry of

Labour and Employment number S.O. 2839(E), dated the 01^st September, 2016, as required by section 27 of the

Minimum Wages Act, 1948 (11 of 1948), for information and inviting objections and suggestions from all persons

likely to be affected thereby, within a period of three months from the date on which copies of the Gazette of India

containing the said notification were made available to the public;

AND whereas the copies of the said Gazette were made available to the public on the 2^nd September, 2016;

AND whereas no objections and suggestions have been received on the said proposal by the Central

Government;

NOW, THEREFORE, in exercise of the powers conferred by section 27 of the said Act the Central Government

hereby makes the following amendment in the notification of Government of India in the Ministry of Labour and

Employment, S.O. 2092 , dated the 23^rd April, 1983, published in the Gazette of India, Part II, Section 3, Sub-section (ii),

namely:-

In the said notification, for the words “the employment in loading and unloading in Railways, goods sheds,

docks and ports”, the words “the employment in loading and unloading in Railways, goods-sheds, docks, ports and

airports (both International and Domestic terminals)” shall be substituted.
