का.आ. 220 (अ).— कᱶᮤीय सरकार, व᭍ फ अिधिनयम, 1995 (1995 का 43) कᳱ धारा 9 कᳱ उपधारा (5) मᱶ अंतᳶव᭬ ट उपबंधᲂ

के अनुसरण मᱶ उ᭍ त अिधिनयम कᳱ धारा 9 कᳱ उपधारा 4 के अधीन कᱶᮤीय व᭍ फ पᳯरषद ᳇ारा बोडᲄ को जारी िनदेशᲂ से उ᭞भूत िववादᲂ

का िविन᭫ चय करने के ᮧयोजन के िलए ᭠ यायिनणᭅयन बोडᭅ का गठन करती है और ᭠ यायमूᳶत एम वाई इ᭍ बाल, भारत के उ᭒ चतम

᭠ यायालय के सेवािनवृ᭜ त ᭠ यायाधीश को इस अिधसूचना के ᮧकाशन कᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए या उनके स᭜ तर वषᭅ कᳱ आयु

पूणᭅ करने तक या आगामी आदेशᲂ तक, जो भी पूवᭅ᭜ तर हो, इसके पीठासीन अिधकारी के ᱧप मᱶ िनयु᭍ त करती है ।

पीठासीन अिधकारी को िववाद के अंितम िनपटान तक अिधकतम पांच लाख ᱧपये के अ᭟ यधीन ᮧित बैठक एक लाख ᱧपये कᳱ

समेᳰकत फᳱस संद᭜ त कᳱ जाएगी ।

3.

पीठासीन अिधकारी, मामले कᳱ सुनवाई के संबंध मᱶ कᳱ गई याᮢा के िलए उ᭒ च ᭠ यायालय के सेवारत ᭠ यायाधीश को यथाअनु᭄ेय

ऐसे याᮢा भ᭜ ते और दैिनक भ᭜ ते (टी ए /डी ए) का हकदार होगा ।

4.

पीठासीन अिधकारी, उसको ᭠ यायिनणᭅयन के िलए िनदᱷिशत िववाद के प᭫ चात् िववाद को तीन मास से अनिधक अविध या ऐसी

दीघाᭅविध, िजस पर पᭃकार िलिखत ᱧप मᱶ सहमत हो, के भीतर िविनि᭫ चत करेगा ।

5.

कायᭅवािहयां कᱶᮤीय व᭍ फ पᳯरषद भवन के पᳯरसरᲂ मᱶ संचािलत कᳱ जाएंगी ।

6.

कᱶᮤीय व᭍ फ पᳯरषद इस अिधसूचना के अधीन िववाद का िविन᭫ चय करने के िलए ऐसा सिचवीय और अ᭠ य ᭭ टाफ उपल᭣ ध

करवाएगा, जो पीठासीन अिधकारी ᳇ारा अपेिᭃत हो ।

7.

जब तक पीठासीन अिधकारी अपने आदेश मᱶ ᳰकसी पᭃकार को उसकᳱ सम᭭ त फᳱस और ᭪ ययᲂ या उसके भाग को संद᭜ त करने का

िनदेश नहᱭ देता है, तब तक िववाद के पᭃकार ᭠ यायिनणᭅयन मᱶ उपगत उनके अपने खचᱸ और ᭪ ययᲂ का वहन करᱶगे तथा पीठासीन

अिधकारी और उसके िविध या तकनीकᳱ सलाहकार कᳱ फᳱस और ᭪ ययᲂ को बराबर िह᭭ से मᱶ संयु᭍ त ᱧप से संद᭜ त करᱶगे ।

NOTIFICATION

New Delhi, the 19th January, 2017

S.O.220 (E).—In pursuance of the provisions contained in sub-section (5) of section 9 of the Waqf Act,

1995 (43 of 1995), the Central Government hereby constitutes the Board of Adjudication for the purpose of deciding

disputes arising out of directives issued to the Boards by the Central Waqf Council under sub-section (4) of section

9 of the said Act and appoints Justice M.Y. Eqbal, retired judge of the Supreme Court of India, as its Presiding

Officer, for a period of three years with effect from the date of publication of this notification or till he attains the age of

seventy years or until further orders, whichever is earlier.

The Presiding Officer shall be paid a consolidated fee of one lakh rupees per sitting subject to a maximum of

five lakh rupees upto the final settlement of the dispute.

3.

The Presiding Officer shall be entitled to such travelling allowance and daily allowance (TA/DA), as

are admissible to a serving Judge of the High Court, for journey performed in connection with hearing of the case.

4.

The Presiding Officer shall decide the dispute within a period not exceeding three months, or such longer

period as is agreed to by the parties in writing, after the dispute is referred to him for adjudication.

5.

Proceedings shall be conducted in the premises of the Central Waqf Council Bhawan.

6.

The Central Waqf Council shall make available such secretarial and other staff, as may be required by the

Presiding Officer, for deciding the dispute under this notification.

7.

The parties to the dispute shall bear their own costs and expenses incurred in the adjudication and jointly

pay in equal share the fees and expenses of the Presiding Officer and of his legal or technical adviser, if any appointed

for the purpose, unless the Presiding Officer in his order, direct a party to pay all or part of his fees and expenses.
