सा.का.िन. 63(अ).—कᱶᮤीय सरकार, िशᭃु अिधिनयम, 1961 (1961 का 52) कᳱ धारा 37 कᳱ उपधारा

(1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए और कᱶᮤीय िशᭃुता पᳯरषद् से परामशᭅ करने के प᳟ात् िशᭃुता िनयम,

1992 मᱶ और संशोधन करने के िलए िन᳜िलिखत िनयम बनाती है, अथाᭅत्-

1 (1) इन िनयमᲂ का संिᭃ᳙ नाम िशᭃुता (संशोधन) िनयम, 2017 है।

(2) वे राजपᮢ मᱶ ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे।

2. िशᭃुता िनयम, 1992, मᱶ--

(i) िनयम 14 के ᭭थान पर िन᳜िलिखत िनयम रखा जाएगा, अथाᭅत् -

“14. अिभलेख और िववरिणयां:- (1) अनुसूची 3 मᱶ िविन᳸द᳥ ᱨपिवधान -I के अनुसार िशᭃु और िनयोᲦा के बीच

ᳰकया गया िशᭃुता का संिवदा िनयोᲦा ᳇ारा रिज᭭ᮝीकरण के िलए पोटᭅल-साइट पर अᮕेिषत ᳰकया जाएगा।

(2) ᮧ᭜येक ᳞ावसाियक िशᭃु तथा वैकि᭨पक ᳞वसाय िशᭃु ᳇ारा अनुसूची 3 यथािविन᳸द᳥ ᱨपिवधान 2 मᱶ कायᭅ

डायरी अनुरिᭃत कᳱ जाएगी और स᳙ाह मᱶ एक बार उसके पयᭅवेᭃक ᳇ारा ᮧितह᭭ताᭃᳯरत कᳱ जाएगी।

(3) ᮧ᭜येक िनयोᲦा अपने ᭭थापन मᱶ िशᭃुता ᮧिशᭃण ᮧा᳙ कर रहे ᳞वसाय िशᭃुᲐ कᳱ उपि᭭थित का एक

रिज᭭टर अनुरिᭃत और अिनयिमत और अᮧािधकृत अनुपि᭭थित के िलए कᳱ गई कारᭅवाई ᮧ᭜येक मास के अंत मᱶ उᲦ

रिज᭭टर मᱶ अिभिलिखत कᳱ जाएगी।

(4) ᮧ᭜येक िनयोᲦा, ᮧ᭜येक ितमाही के िलए अपने ᭭थापन मᱶ िनयोिजत ᳩातक, तकनीिशयन और तकनीिशयन

(᳞ावसाियक) िशᭃुᲐ ᳇ारा ᳰकए गए कायᭅ और ᳰदए गए ᮧिशᭃण का एक अिभलेख बनाकर रखेगा तथा ᮧ᭜येक

ितमाही के अ᭠त मᱶ अनुसूची 3 मᱶ िविन᳸द᳥ िशᭃुता ᮧाᱧप मᱶ एक ᳯरपोटᭅ संबंिधत िनदेशक, ᮧादेिशक िशᭃुता

ᮧिशᭃण बोडᭅ को भेजेगा।”

(ii) अनुसूची 3 मᱶ __

(क) ᱨपिवधान-1क ᱨपिवधान-3, ᱨपिवधान-3क, ᱨपिवधान-4, िशᭃुता ᱨपिवधान-1, िशᭃुता ᮧिशᭃण

᭭कᳱम-1, िशᭃुता ᮧिशᭃण योजना-2 (आरडीएटी के िलए), िशᭃुता ᮧिशᭃण ᭭कᳱम-3 (रा᭔य/संघ रा᭔य

ᭃेᮢ), िशᭃुता ᱨपिवधान -2 का लोप ᳰकया जाएगा;

(ख) “िशᭃुता ᮧᱨप-3” को िशᭃुता ᮧᱨप-1 के ᱨप मᱶ पुनःसं᭎याᳰकत ᳰकया जाएगा।

तथा कᳱ अिधसूचना सं᭎या सा.का.िन. 198(अ) तारीख 26 फरवरी, 2016 ᳇ारा अंितम संशोधन ᳰकया

गया था।

MINISTRY OF SKILL DEVELOPMENT AND ENTREPRENEURSHIP

NOTIFICATION

New Delhi, the 20th January, 2017

G.S.R. 63(E).—In exercise of the powers conferred by Sub-section (1) of Section 37 of the

Apprentices Act, 1961 (52 of 1961), the Central Government, after consulting the Central Apprenticeship

Council, hereby makes the following rules further to amend the Apprenticeship Rules, 1992, namely: -

1. (1) These rules may be called the Apprenticeship (Amendment) Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Apprenticeship Rules, 1992, ──

(i) for rule 14, the following rule shall be substituted, namely:–

“14. Records and Returns, ── (1) A contract of apprenticeship as entered between an apprentice and

the employer as per Format-1 specified in Schedule III shall be forwarded on the portal-site by the

employer for registration.

(2) Work dairy in Format – 2 as specified in Schedule III shall be maintained by each Trade apprentice

and Optional trade apprentice and countersigned by his supervisor once in a week.

(3) Every employer shall maintain a register of attendance of the apprentices undergoing

apprenticeship training in his establishment and action taken for irregular and unauthorised absence

shall be recorded in the said register at the end of each month.

(4) Every employer shall maintain a record of the work done and training undertaken by the graduate,

technician and technician (vocational) apprentices engaged in his establishment, for each quarter and

at the end of each quarter shall send a report in Form Apprenticeship specified in Schedule-III to the

Director, Regional Board of Apprenticeship Training concerned.”

in Schedule III, ──

(a) Format-1A, Format-3, Format-3A, Format-4, Form Apprenticeship-1, Apprenticeship Training

Scheme-1, Apprenticeship Training Scheme -2(For RDAT), Apprenticeship Training Scheme -

3(State/Union Territory), Form Apprenticeship-2 shall be omitted;

(b) “Form Apprenticeship-3” shall be renumbered as “Form Apprenticeship-1.”.
