का 31) क# धारा 194 के साथ प)ठत धारा 240 +ारा ,द- शि.य/ का ,योग करते 1ए भारतीय दवाला और

शोधन अमता बोड5 िन6िलिखत िविनयमन बनाता है, अथा5त्:-

1. संि( नाम और )ारंभ

(1) इन िविनयमन/ का नाम भारतीय दवाला और शोधन अमता (अनुसंधान सहायक/ और सलाहकार/ क#

िनयुि.) िविनयमन, 2017 है।

(2) ये राजप? म@ ,काशन क# तारीख से ,वृ- ह/गे।

2. प+रभाषाएं.

(1) इन िविनयमन/ म@, जब तक क संदभ5 से अBयथा अपेित न हो,-

(क) “संिहता” से दवाला और शोधन अमता संिहता, 2016 (2016 का 31) अिभ,ेत है;

(ख) “अCय” से बोड5 का अCय अिभ,ेत है;

(ग) “बोड5” से संिहता क# धारा 188(1) के तहत ग)ठत भारतीय दवाला और शोधन अमता बोड5 अिभ,ेत

है;

(घ) “काय5कारी िनदेशक” से बोड5 के इस तरह िनयु. वह अिधकारी िजसके पास बोड5 के मानव संसाधन/ के

,बंधन क# िजEमेदारी है और बोड5 का वह अिधकारी भी, जो काय5कारी िनदेशक (मानव संसाधन) के

Fप म@ काय5 करने के िलए अCय +ारा ,ािधकृत कया गया है, अिभ,ेत है;

(2) उन शHद/ और पद/ के, जो इन िविनयमन/ म@ ,यु. है Iकतु प)रभािषत नहK है उनके वही अथ5 ह/गे जो Lमश:

इस संिहता म@ उनके हM।

3. अनुसंधान सहायक और सलाहकार.

(1) बोड5 िनयु. कए जाने वाले अनुसंधान सहायक/ और सलाहकार/ क# संNया समय-समय पर िनधा5)रत कर

सकता है।

(2) बोड5 ऐसी संNया म@ अनुसंधान सहायक/ और सलाहकार/ क# िनयुि. कर सकता है, जैसा क वह उिचत समझे।

4. अनुसंधान सहायक और सलाहकार के काय.

बोड5 +ारा िनयु. अनुसंधान सहायक और सलाहकार वे काय5 कर@गे जो बोड5 +ारा उBह@ दया जाएगा।

5. अहताएं, अनुभव और पा+र1िमक.

(1) िविभR संकाय/ के िलए अनुसंधान सहायक/ और सलाहकार/ हेतु अह5ताएं अनुसूची-I पर दए गए अनुसार

होगीः

परंतु क बोड5 अBय कसी संकाय से अनुसंधान सहायक और सलाहकार भी िनयु. कर सकता है जो क

संिहता के तहत उसके काय5िनTपादन म@ बोड5 क# सहायता हेतु आवVयक ,तीत ह/।

(2) संबंिधत संकाय म@ अनुभव के आधार पर, कोई Wि. अनुसूची-II म@ दए अनुसार पांच Xतर/ म@ से कसी एक

Xतर म@ अनुसंधान सहायक या सलाहकार के Fप म@ िनयु. कया जाएगा।

(3) िविभR Xतर/ के अनुसंधान सहायक/ और सलाहकार/ को अनुसूची-II के अनुसरण म@ एक समेकत पा)रZिमक

का भुगतान कया जाएगा।

(4) कोई अनुसंधान सहायक या सलाहकार को 12 दन के वा[षक अवकाश के अित)र. कसी भी Fप म@ कसी

अBय पा)रतोिषक या सुिवधा का पा? नहK होगा।

6. काय िन3पादन का मू5यांकन.

(1) ,\येक अनुसंधान सहायक या सलाहकार के काय5 िनTपादन क# समीा स]पे गए काय^ और उसके +ारा दए

गए प)रणाम/ के अनुसरण म@ ,\येक 6 माह से क# जाएगी।

(2) यद काय5 िनTपादन संतोष,द नहK है तो अनुसंधान सहायक या सलाहकार, जैसा भी मामला हो, क# िनयुि.

को आगे से समा_ कर दया जाएगा।

7. अनुसंधान सहायक और सलाहकार का चयन.

(1) काय5कारी िनदेशक/ बोड5 क# वेबसाइट पर िनयु. कए जाने वाले अनुसंधान सहायक/ और सलाहकार/ क#

संकाय-वार और Xतर-वार संNया अपेित अह5ता और अनुभव के िववरण तथा देय पा)रZिमक सिहत ,कािशत

करेगा तथा एक िनधा5)रत तारीख तक ,\येक संकाय और Xतर के िलए आवेदन आमंि?त करेगा:

परंतु क काय5कारी िनदेशक योaय साव5जिनक सूचना +ारा भी अनुसंधान सहायक/ और सलाहकार/ के

,\येक संकाय तथा Xतर के आवेदन आमंि?त कर सकता है।

(2) उप-िविनयमन (1) के तहत आवेदन क# पावती क# अंितम तारीख समा_ होने के बाद काय5कार िनदेशक इन

िविनयमन/ के अनुसरहण म@ आवेदन/ क# जांच करेगा और साा\कार हेतु ,\येक संकाय और Xतर के पा?

उEमीदवार/ क# सूची तैयार करेगा।

(3) यद उप-िविनयमन (2) के तहत तैयार क# गई पा? उEमीदवार/ क# कसी सूची म@ उEमीदवार/ क# संNया उस

संकाय और Xतर म@ िनयु. कए जाने वाले अनुसंधान सहायक/ या सलाहकार/ क# संNया के चार गुणा से अिधक है

तो अिधका)रय/ क# एक सिमित अह5ता के उbतर मानक/ पर आधा)रत उEमीदावार/ क# एक लघु सूची, जैसा क

बोड5 +ारा अनुमोदत हो, साा\कार के िलए तैयार कर@ग@।

(4) ,\येक संकाय और अनुसंधान सहायक/ और सलाहकार/ के चयन हेतु, बोड5 एक चयन सिमित का गठन करेगी,

िजसम@ िन6िलिखत शािमल ह/गे-

क) अCय या पूण5कािलक सदXय;

ख) काय5कारी िनदेशक या यद काय5कारी िनदेशक का पद )र. है तो बोड5 का एक व)रd अिधकारी और

ग) एक बाहरी िवशेषe

(5) उप िविनयमन (4) म@ उिलिखत चयन सिमित उप िविनयमन (2) के तहत तैयार क# गई पा? उEमीदवार/ क#

सूची म@ या उपिविनयमन (3) के तहत तैयार क# गई उEमीदवार/ क# लघु सूची म@ उिलिखत उEमीदवार/, जैसा भी

मामला हो, का साा\कार लेगी।

(6) बोड5 +ारा उEमीदवार/ के पैनल को अनुमोदत करने पर काय5कारी िनदेशक ,\येक उEमीदवार को िनयुि. का

,Xताव प? िलिखत म@ भेजेगा िजसम@ िनयुि. के ,Xताव को 10 दन/ के भीतर Xवीकार करने का समय दया

जाएगा।

(7) चयिनत उEमीदवार/ से Xवीकृित क# पावती के बाद उपिविनयमन (7) के अनुसार काय5कारी िनदेशक ,\येक

उEमीदवार को काय5भार fहण करने के िलए तीस दन/ का समय देते 1ए िनयुि. प? जारी करेगा:

परंतु क काय5कारी िनदेशक +ारा काय5भार fहण करने का समय इस संतुिg के साथ बढाया जा सकता है क समय

बढाने क# मांग उEमीदवार के िनयं?ण से परे प)रिXथितय/ के कारण हM।

8. िनयुि क िनबंधन और शत8

(1) एक चयिनत उEमीदवार 6 माह से अBयून और 2 वष5 से अनािधक समय के िलए संवीदा आधार पर अनुसंधान

सहायक या सलाहकार के Fप म@ िनयु. कया जाएगा।

(2) िनयु. कए गए कसी अनुसंधान सहायक या सलाहकार को अBय प +ारा एक माह क# सूचना देते 1ए या

सूचना के साथ एक माह के वेतन देते 1ए पद छोड़ने को कहा जा सकता है।

(3) बोड5 म@ िनयुि. के समय चयिनत उEमीदवार बोड5 क# ओर से काय5 कर रहे काय5कारी िनदेशक के साथ एक

संिवदा करेगा जो गोपनीयता सिहत िनयुि. क# िनबंधन एवं शत^ के Hयौरे से संबंिधत होगी।

(4) कसी िवशेष मामले म@ िनयुि. क# िनबंधन एवं शत^ म@ संशोधन कया जा सकता है, यद बोड5 को यह

अिनवाय5 ,तीत होता है।

(5) ,ितकूल ,भाव रिहत और बोड5 क# उपलHध कानून उपाय/ के अित)र. कसी भी अनुसंधान सहायक या

सलाहकार +ार या उसक# ओर से उप-िविनमय (2) के तहत कए गए समझौते को तोड़ा जाता है तो वह

संिवदा के तहत क# गई िनयुि. को समा_ करने का एक पया5_ कारण समझा जाएगा और बोड5 +ारा ऐसे

Wि. को भिवTय म@ िनयु. कए जाने से वंिचत कया जा सकता है।

लता का अिधकार

बोड5 संिहता के तहत अपनी काय5,णाली को करने के िलए यद आवVयक ,तीत होता है तो इनम@ से िविनयमन/ म@

इनका कारण बताते 1ए िशिथलता दे सकता है।

INSOLVENCY AND BANKRUPTCY BOARD OF INDIA

NOTIFICATION

New Delhi, the 30th January, 2017

Insolvency and Bankruptcy Board of India (Engagement of Research Associates and Consultants)

Regulations, 2017

IBBI/2016-17/GN/REG006.—In exercise of the powers conferred by section 240 read with section 194 of the

Insolvency and Bankruptcy Board of India Code, 2016 (No. 31 of 2016), the Insolvency and Bankruptcy Board of India

hereby makes the following regulations, namely: –

Short title and commencement.

(1) These regulations may be called the Insolvency and Bankruptcy Board of India (Engagement of Research

Associates and Consultants) Regulations, 2017.

(2) They shall come into force on the date of their publication in the OfficialGazette.

Definitions.

(1) In these regulations, unless the context otherwise requires, –

(a)

“Code” means theInsolvency and Bankruptcy Code, 2016 (31 of 2016);

(b)

“Chairperson” means the Chairperson of the Board;

(c)

“Board” means the Insolvency and Bankruptcy Board of India established under section 188(1)

of the Code;

(d)

“Executive Director” means an officer of the Board appointed as such and having the responsibility

to manage human resources of the Board and includes an officer of the Board authorized by the

Chairperson to function as Executive Director (Human Resources);

(2) Words and expressions used but not defined in these regulations shall have the same meanings respectively

assigned to them in the Code.

Research Associates and Consultants.

(1) The Board may decide, from time to time, the number of the Research Associates and Consultants to be

engaged.

(2) The Board may engage such number of Research Associates and Consultants, as it may deem fit.

Functions of Research Associates and Consultants.

The Research Associates and Consultantsengaged by the Board shall discharge such functions, as may be

assigned to them by theBoard.

Qualifications, experience and remuneration.

(1) The eligibility for Research Associates and Consultantsfor different disciplines shall be as given in Schedule I:

Provided that the Board may also engage Research Associates and Consultantsfrom any other discipline as

deemed necessary to assist the Board in the discharge of its functions under the Code.

(2) Depending upon the experience in respective discipline, a person shall be engaged as Research Associate or

Consultantin one of five levels given in Schedule II.

(3) The Research Associates and Consultants of different levels shall be paid a consolidated remuneration in

accordance with Schedule II.

(4) A Research Associate or Consultant shall not be entitled to any other compensation or facility in any form

except an annual leave of 12 days.

6. Evaluation of performance.

(1) The performance of each Research Associate and Consultant shall be reviewed every six months with reference

to tasks assigned and output delivered.

(2) If performance is unsatisfactory, the engagement of the Research Associate or Consultant, as the case may be,

shall be discontinued forthwith.

Selection of Research Associates and Consultants.

(1) The Executive Director shall publish discipline-wise and level-wise number of the Research Associates and

Consultants to be engaged with details of qualifications and experience required and the remuneration payable

on the website of the Board and invite applications for each discipline and level by a stipulated date:

Provided that the Executive Director may also invite the applications by suitable public notice, for each

discipline and level of Research Associates and Consultants.

(2) On expiry of the last date for receipt of applications under sub-regulation (1), the Executive Director shall

scrutinise the applications in accordance with these regulations and prepare lists of eligible candidates for each

discipline and level to be called for interview.

(3) In case the number of candidates in a list of eligible candidates prepared under sub-regulation (2) is more than

four times the number of Research Associates or Consultants to be engaged in that discipline and or level, a

committee of officers will prepare a short list of candidates based on higher standards of eligibility, as may be

approved by the Board, for interview.

(4) For selecting Research Associates and Consultants for each discipline and level, the Board shall constitute a

selection committee comprising:

a) Chairperson or Whole Time Member,

b) Executive Director or a Senior Officer of the Board, if the position of Executive Director is vacant, and

c) An External expert.

(5) The selection committee mentioned in sub-regulation (4) shall interview the candidates in the list of eligible

candidates prepared under sub-regulation (2) or in the short list of candidates prepared under sub-regulation (3),

as the case may be, and based on the interview, submit to the Board a panel of candidates for engagement as

Research Associates and Consultants.

(6) On approval of the panel of candidates by the Board, the Executive Director shall inform each candidate in

writing by an offer letter of engagement giving not less than ten days’ time to accept the offer of engagement.

(7) After receipt of acceptance from the selected candidates as per sub-regulation (7), the Executive Director shall

issue a letter of engagement to each candidate giving not less than thirty days’ time to join:

Provided that the joining time may be extended by the Executive Director on being satisfied that extension is

sought on circumstances beyond the control of the candidate.

8. Terms and condition of engagement.

(1) A selected candidate shall be engaged as Research Associates or Consultants on contractual basis for not less

than six months and not more two years.

(2) The engagement of a Research Associate or a Consultant may be discontinued by giving one months’ notice or

one month’s salary in lieu of the notice, to the other party.

(3) A selected candidate at the time of joining the Board shall enter into a contract which details the terms and

conditions of engagement, including the confidentiality, with the Executive Director acting on behalf of

theBoard.

(4) The terms and conditions of engagement may be modified, in a specific case, where the Board deems it

necessary.

(5) Without prejudice and in addition to the legal remedies available to theBoard, the breach of agreement executed

under sub-regulation (2) by or on behalf of any Research Associate or Consultant shall be considered a

sufficient ground for termination of the engagement made under the contract and may further debar such person

from future engagement by theBoard.

Power to relax.

The Board may relax any of these regulations as may be deemed necessary, after recording the reasons for the

same, in the discharge of its functions under the Code.
