सा.का.िन. 102(अ).—vkSषिध और ᮧसाधन सामᮕी िनयम, 1945 का और संशोधन करने के िलए कितपय
िनयमᲂ का िन᳜िलिखत ᮧाᱨप, िजसे के᭠ᮤीय सरकार का, vkSषिध और ᮧसाधन सामᮕी अिधिनयम,1940 (1940
का 23) कᳱ धारा 12 और धारा 33 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, vkSषिध तकनीकᳱ सलाहकार बोडᭅ से
परामशᭅ करने के प᳟ात्, बनाने का ᮧ᭭ताव है, उन सभी ᳞िᲦयᲂ कᳱ जानकारी के िलए ᮧकािशत ᳰकया जाता है,
िजनके उनसे ᮧभािवत होने कᳱ संभावना है और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप िनयमᲂ पर उस तारीख से,
िजसको इन ᮧाᱨप िनयमᲂ वाले भारत के राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी जाती हᱹ, पᱹतालीस ᳰदन
कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार ᳰकया जाएगा;
के᭠ᮤीय सरकार ᳇ारा ऐसे आᭃेपᲂ और सुझावᲂ पर, जो उᲦ ᮧाᱨप िनयमᲂ के संबंध मᱶ ऊपर िविन᳸द᳥
अविध के भीतर ᳰकसी ᳞िᲦ से ᮧा᳙ हᲂ, िवचार ᳰकया जाएगा ।
ऐसे आᭃेप और सुझाव, य़ᳰद कोई हᲂ, अवर सिचव (ओषिध), ᭭वा᭭᭝य और पᳯरवार क᭨याण मंᮢालय,
भारत सरकार 414-ए, डी ᳲवग, िनमाᭅण भवन, नई ᳰद᭨ली-110011 को भेजे जा सकते हᱹ या

ᮧाᱨप िनयम
1. (1) इन िनयमᲂ का संिᭃ᳙ नाम vkSषिध और ᮧसाधन सामᮕी(संशोधन) िनयम, 2017 है ।
(2) ये राजपᮢ मᱶ उनके अंितम ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे ।

vkSषिध और ᮧसाधन सामᮕी िनयम, 1945 (िज᭠हᱶ इसमᱶ इसके प᳟ात् उᲦ िनयम कहा गया है) के िनयम
2 मᱶ, खंड (क) के प᳟ात् िन᳜िलिखत खंड अंतः᭭थािपत ᳰकया जाएगा, अथाᭅत्:-
“(कक) “जैवभेषज वगᱮकरण ᮧणाली” से ऐसी ᮧणाली अिभᮧेत है जो ᮧवगᭅ 1– उᲬ िवलेयता और उᲬ
पारग᭥यता, ᮧवगᭅ 2 – िन᳜ िवलेयता और उᲬ पारग᭥यता, ᮧवगᭅ 3 – उᲬ िवलेयता और िन᳜ पारग᭥यता
और ᮧवगᭅ 4-िन᳜ िवलेयता और िन᳜ पारग᭥यता के ᱨप मᱶ वगᱮकृत ओषिधयᲂ को िवलेयता और पारग᭥यता
के आधार पर वगᱮकृत करने के िलए ᮧयोग मᱶ लाई जाती है ।”;

उᲦ िनयमᲂ के िनयम 74 मᱶ, खंड (त) के प᳟ात् िन᳜िलिखत खंड अंतः᭭थािपत ᳰकया जाएगा, अथाᭅत्:-
“(थ) आवेदक, जैवभेषज वगᱮकरण ᮧणाली के ᮧवगᭅ 2 और ᮧवगᭅ 4 के अधीन िविन᳸द᳥ मुखी खुराक ᱨप कᳱ
vkSषिधयᲂ कᳱ अनु᭄ि᳙ के अनुदान के िलए आवेदन के साथ अनुसूची म मᱶ िन᳸द᳥ जैवसमतु᭨यता अ᭟ययन के
पᳯरणाम ᮧ᭭तुत करेगा ।”।
4.
उᲦ िनयमᲂ के िनयम 74ख मᱶ, खंड (7) के प᳟ात् िन᳜िलिखत खंड अंतः᭭थािपत ᳰकया जाएगा, अथाᭅत्:-
“(8) आवेदक, जैवभेषज वगᱮकरण ᮧणाली के ᮧवगᭅ 2 और ᮧवगᭅ 4 के अधीन िविन᳸द᳥ मुखी खुराक ᱨप कᳱ
vkSषिधयᲂ कᳱ अनु᭄ि᳙ के अनुदान के िलए आवेदन के साथ अनुसूची म मᱶ िन᳸द᳥ जैवसमतु᭨यता अ᭟ययन के
पᳯरणाम ᮧ᭭तुत करेगा ।”।
5.
उᲦ िनयमᲂ के िनयम 76 मᱶ, खंड (9) के प᳟ात् िन᳜िलिखत खंड अंतः᭭थािपत ᳰकया जाएगा, अथाᭅत्:-
“(10) आवेदक, जैवभेषज वगᱮकरण ᮧणाली के ᮧवगᭅ 2 और ᮧवगᭅ 4 के अधीन िविन᳸द᳥ मुखी खुराक ᱨप
कᳱ vkSषिधयᲂ कᳱ अनु᭄ि᳙ के अनुदान के िलए आवेदन के साथ अनुसूची म मᱶ िन᳸द᳥ जैवसमतु᭨यता
अ᭟ययन के पᳯरणाम ᮧ᭭तुत करेगा ।”।
6.
उᲦ िनयमᲂ के िनयम 78 मᱶ, खंड (थ) के प᳟ात् िन᳜िलिखत खंड अंतः᭭थािपत ᳰकया जाएगा, अथाᭅत्:-
“(द) आवेदक, जैवभेषज वगᱮकरण ᮧणाली के ᮧवगᭅ 2 और ᮧवगᭅ 4 के अधीन िविन᳸द᳥ मुखी खुराक ᱨप कᳱ
vkSषिधयᲂ कᳱ अनु᭄ि᳙ के अनुदान के िलए आवेदन के साथ अनुसूची म मᱶ िन᳸द᳥ जैवसमतु᭨यता अ᭟ययन के
पᳯरणाम ᮧ᭭तुत करेगा ।”।
7.
उᲦ िनयमᲂ के िनयम 78क मᱶ, खंड (8) के प᳟ात् िन᳜िलिखत खंड अंतः᭭थािपत ᳰकया जाएगा, अथाᭅत्:-
“(9) आवेदक, जैवभेषज वगᱮकरण ᮧणाली के ᮧवगᭅ 2 और ᮧवगᭅ 4 के अधीन िविन᳸द᳥ मुखी खुराक ᱨप कᳱ
vkSषिधयᲂ कᳱ अनु᭄ि᳙ के अनुदान के िलए आवेदन के साथ अनुसूची म मᱶ िन᳸द᳥ जैवसमतु᭨यता अ᭟ययन के
पᳯरणाम ᮧ᭭तुत करेगा ।”।

᳇ारा ᮧकािशत ᳰकए गए थे और उनमᱶ अंितम संशोधन अिधसूचना सं. सा.का.िन. 76(अ), तारीख 31 जनवरी,
2017, ᳇ारा ᳰकया गया था ।

NOTIFICATION
New Delhi, the 2nd February, 2017
G.S.R. 102(E).—The following draft of certain rules further to amend the Drugs and Cosmetics Rules, 1945
which the Central Government proposes to make in exercise of the powers conferred by section 12 and section 33 of the
Drugs and Cosmetics Act, 1940 (23 of 1940), after consultation with the Drugs Technical Advisory Board, is hereby
published for information of all persons likely to be affected thereby and notice is hereby given that said draft rules will
be taken into consideration on or after the expiry of a period of forty-five days from the date on which copies of the
Gazette of India containing these draft rules are made available to the public.
Objections and suggestions which may be received from any person within the period specified above will be
considered by the Central Government.
Objections and suggestions, if any, may be addressed to the Under Secretary (Drugs), Ministry of Health and
Family Welfare, Government of India, Room No. 414 A, D Wing, Nirman Bhavan, New Delhi – 110011 or sent on email
Draft rules
1. (1) These rules may be called the Drugs and Cosmetics (____________Amendment) Rules, 2017.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Drugs and Cosmetics Rules, 1945 (hereinafter referred to as the said rules), in rule 2, after clause (a),
following shall be inserted, namely,-
(aa) “biopharmaceutical classification system” means a system used to classify drugs on the basis of solubility
and permeability, classified as category I- high solubility and high permeability, category II- low
solubility and high permeability, category III- high solubility and low permeability, and category IV- low
solubility and low permeability.”;
3. In the said rules, in rule 74, after clause (p), the following clause shall be inserted, namely.-
“(q) the applicant shall submit the result of bioequivalence study referred to in Schedule Y, along with the
application for grant of a licence of oral dosage form of drugs specified under category II and category IV
of the biopharmaceutical classification system.”.
4. In the said rules, in rule 74B, after clause (7), the following clause shall be inserted, namely.-
“(8) the applicant shall submit the result of bioequivalence study referred to in Schedule Y, along with the
application for grant of a licence of oral dosage form of drugs specified under category II and category IV
of the biopharmaceutical classification system.”.
5. In the said rules, in rule 76, after clause (9), the following clause shall be inserted, namely.-
“(10) the applicant shall submit the result of bioequivalence study referred to in Schedule Y, along with the
application for grant of a licence of oral dosage form of drugs specified under category II and category IV
of the biopharmaceutical classification system.”.
6. In the said rules, in rule 78, after clause (q), the following clause shall be inserted, namely.-
“(r) the applicant shall submit the result of bioequivalence study referred to in Schedule Y, along with
the application for grant of a licence of oral dosage form of drugs specified under category II and
category IV of the biopharmaceutical classification system.”.

7. In the said rules, in rule 78A, after clause (8), the following clause shall be inserted, namely.-
“(9) the applicant shall submit the result of bioequivalence study referred to in Schedule Y, along with
the application for grant of a licence of oral dosage form of drugs specified under category II and
category IV of the biopharmaceutical classification system.”.
