सा.का.िन. 593(अ).—रा᳦पित, संिवधान के अनुच्छेद 309 के परन्तुक ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते हुए और

महािनयंᮢक, पेटेन्ट, िडजाइन एवं ᳞ापार िचन्ह (िहन्दी अिधकारी समूह ‘ख’ पद) भतᱮ िनयम, 1984 और महािनयंᮢक,

पेटेन्ट, िडजाइन एवं ᳞ापार िचन्ह, महािनयंᮢक का कायार्लय (किन᳧ िहन्दी अनुवादक) िनयम 1994 को उन बातᲂ के िसवाए

अिधᮓांत करते हुए िजन्हᱶ ऐसे अिधᮓमण से पहले िकया गया है या करने का लोप िकया गया है, वािणज्य एवं उ᳒ोग मंᮢालय,

औ᳒ोिगक नीित एवं संवधर्न िवभाग, पेटेन्ट, अिभकल्प और ᳞ापार िचन्ह महािनयंᮢक के कायार्लय के अधीन पेटेन्ट कायार्लय

मᱶ सहायक िनदेशक (राजभाषा) और किन᳧ अनुवादक के पदᲂ पर भतᱮ की प᳍ित का िविनयमन करने के िलए िन᳜िलिखत

िनयम बनाते हᱹ, अथार्त् :-

संिक्ष᳙ नाम और ᮧारम्भ :

(क) इन िनयमᲂ का संिक्ष᳙ नाम वािणज्य एवं उ᳒ोग मंᮢालय, औ᳒ोिगक नीित एवं संवधर्न िवभाग, पेटेन्ट, अिभकल्प

और ᳞ापार िचन्ह, महािनयंᮢक के कायार्लय के अधीन पेटेन्ट कायार्लय मᱶ (सहायक िनदेशक राजभाषा) समूह ‘क’

पद और किन᳧ अनुवादक, समूह ‘ख’ पद भतᱮ िनयम, 2017 है।

(ख) ये राजपᮢ मᱶ उनके ᮧकाशन की तारीख को ᮧवृᱫ हᲂगे।

पद संख्या, वगᱮकरण और वेतन मैिᮝक्स के स्तर – पद की संख्या, उनका वगᱮकरण और वेतन मैिᮝक्स मᱶ स्तर वह होगा,

जो इन िनयमᲂ से उपाब᳍ अनुसूची के स्तम्भ (2) से स्तम्भ (4) मᱶ िविन᳸दर᳥् हᱹ।

भतᱮ की प᳍ित, आयु सीमा, अहतार्एँ आिद – पद पर भतᱮ की प᳍ित, आयु सीमा, अहतार्एँ और उससे संबंिधत अन्य

बातᱶ वे हᲂगी, जो उᲦ/पूवᲃᲦ अनुसूची के स्तम्भ (5) से स्तम्भ (13) मᱶ िविन᳸दर᳥् हᱹ।

िनरहतार् : वह ᳞िᲦ –

(क) िजसने ऐसे ᳞िᲦ से िजसका पित या िजसकी प᳀ी जीिवत है, िववाह िकया है या िववाह की संिवदा की है

(ख) िजसने अपने पित या अपनी प᳀ी के जीिवत रहते हुए िकसी ᳞िᲦ से िववाह िकया है, या िववाह की संिवदा की है,

उᲦ पद पर िनयुिᲦ का पाᮢ नहᱭ होगा।

परन्तु यिद केन्ᮤीय सरकार का यह समाधान हो जाता है िक ऐसा िववाह उस ᳞िᲦ और िववाह के अन्य पक्षकार को

लागू स्वीय िविध के अधीन अनुज्ञेय है और ऐसा करने के िलए अन्य आधार हᱹ तो वह िकसी ᳞िᲦ को इस िनयम के ᮧवतर्न से

छूट दे सकेगी।

िशिथल करने की शिᲦ : जहाँ केन्ᮤीय सरकार की यह राय है िक ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके

िलए जो कारण हᱹ, उन्हᱶ लेखब᳍ करके तथा संघ लोक सेवा आयोग से परामशर् करके, इन िनयमᲂ के िकसी उपबन्ध को

िकसी वगर् या ᮧवगर् के ᳞िᲦयᲂ की बाबत, आदेश ᳇ारा िशिथल कर सकेगी।

᳞ावृिᱫ : इन िनयमᲂ की कोई बात, ऐसे आरक्षण, आयु सीमा मᱶ छूट और अन्य िरयायतᲂ पर ᮧभाव नहᱭ डालेगी, िजसका

केन्ᮤीय सरकार ᳇ारा इस संबंध मᱶ समय-समय पर जारी िकए गए आदेशᲂ के अनुसार अनुसूिचत जाितयᲂ, अनुसूिचत

जनजाितयᲂ, अन्य िपछड़े वगᲄ, भूतपूवर् सैिनकᲂ और अन्य िवशेष ᮧवगर् के ᳞िᲦयᲂ के िलए उपबन्ध करना अपेिक्षत है।

अनुसार दो या चार स᳙ाहᲂ मᱶ ᮧिशक्षण सफलतापूवर्क िकया गया हो।

िटप्पणः जहाँ ऐसे किन᳧ ᳞िᲦयᲂ के सम्बन्ध मᱶ, िजन्हᲂने अपनी अहर्क या पाᮢता सेवा पूरी कर ली है, ᮧो᳖ित के िलए िवचार

िकया जा रहा हो, वहाँ उनके ज्ये᳧ ᳞िᲦयᲂ के सम्बन्ध मᱶ भी िवचार िकया जाएगा परन्तु यह तब जब िक उसके ᳇ारा की गई

ऐसी अहर्क या पाᮢता सेवा, अपेिक्षत अहर्क या पाᮢता सेवा के आधे से अिधक से या दो वषर् से, इनमᱶ से जो भी कम हो, कम न

हो और उन्हᲂने अपने ऐसे किन᳧ ᳞िᲦयᲂ सिहत, िजन्हᲂने ऐसी अहर्क या पाᮢता सेवा पहले ही पूरी कर ली है, अगली उᲬतर

NOTIFICATION

New Delhi, the 13th June, 2017

G.S.R. 593(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in

supersession of the Office of the Controller General, Patents, Designs and Trade Marks (Hindi Officer, Group ‘B’ post)

Recruitment Rules, 1984 and the Office of the Controller General, Patents, Designs and Trade Marks (Junior Hindi

Translator) Recruitment Rules, 1994, except as respects things done or omitted to be done before such supersession, the

President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Director

(Official Language) and Junior Translator in the Patent Office under the Office of the Controller General of Patents,

Designs and Trade Marks, Department of Industrial Policy and Promotion, Ministry of Commerce and Industry, namely:-

Short title and commencement.− (1) These rules may be called the Patent Office, under the Office of the

Controller General of Patents, Designs and Trade Marks, Department of Industrial Policy and Promotion,

Ministry of Commerce and Industry, Assistant Director (Official Language), Group ‘A’ post and Junior

Translator, Group ‘B’ post, Recruitment Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

Number of posts, classification, level in the pay matrix or pay scale.− The number of posts, their

classification and the level in the pay matrix or pay scale attached thereto shall be as specified in columns (2)

to(4) of the Schedule annexed to these rules.

Method of recruitment, age limit, qualifications, etc.− The method of recruitment to the said posts, age limit,

qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the

aforesaid Schedule.

Disqualification.− No person, -

(a)

who has entered into or contracted a marriage with a person having a spouse living, or

(b)

who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the

personal law applicable to such person and other party to the marriage and that there are other grounds for so

doing, exempt any person from the operation of this rule.

Power to relax.− Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing and in consultation with Union Public Service

Commission , relax any of the provisions of these rules, with respect of any class or category of persons.

Saving.− Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to

be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of

persons in accordance with the orders issued by the Central Government from time to time in this regard.

Master’s degree of a recognised University in English

with Hindi as a compulsory or elective subject or as the

medium of examination at the degree level; or

Master’s degree of a recognised University in any subject

other than Hindi or English, with Hindi medium and

English as a compulsory or elective subject or as the

medium of examination at the degree level; or

Master’s degree of a recognised University in any subject

other than Hindi or English, with English medium and

Hindi as a compulsory or elective subject or as a medium

of a examination at the degree level; or

Master’s degree of a recognised University in any subject

other than Hindi or English, with Hindi and English as

compulsory or elective subjects or either of the two as a

medium of examination and the other as a compulsory or

recognised Diploma or certificate course in translation

from Hindi to English and vice versa or two years’

experience of translation work from Hindi to English and

vice versa in Central Government or State Government

office, including Government of India undertaking
