नई िदल् ली, 21 जून, 2017

सा.का.िन. 614(अ).—राष् ᮝपित, संिवधान के अनुच् छेद 309 के परन् तुक ᳇ारा ᮧदत् त शिक् तयᲂ का ᮧयोग करते हुए,

और िवत् त मंᮢालय, राजस् व िवभाग, ᮧवतर्न िनदेशालय, अधीक्षक, समूह ‘ख’ पद भतᱮ िनयम, 2011 को, अिधᮓांत करते हुए,

िवत् त मंᮢालय, राजस् व िवभाग, ᮧवतर्न िनदेशालय मᱶ अधीक्षक के पद पर भतᱮ की प᳍ित का िविनयमन करने के िलए

िनम् निलिखत िनयम बनाते हᱹ, अथार्त्:—

संिक्षप् त नाम और ᮧारंभ – (1) इन िनयमᲂ का संिक्षप् त नाम िवत् त मंᮢालय, राजस् व िवभाग, ᮧवतर्न िनदेशालय,

अधीक्षक, समूह ‘ख’ पद भतᱮ िनयम, 2017 है।

(2) ये राजपᮢ मᱶ ᮧकाशन की तारीख को ᮧवृत् त हᲂगे ।

पद संख् या, वगᱮकरण और वेतन मैिᮝक् स मᱶ स् तर – उक् त पद की संख् या, उसका वगᱮकरण और वेतन मैिᮝक् स मᱶ उसका

स् तर वह होगा जो इन िनयमᲂ से उपाब᳍ अनुसूची के स् तंभ (2) से स् तंभ (4) मᱶ िविन᳸दर्ष् ट है।

भतᱮ की प᳍ित, आयु-सीमा, अहर्ताएं आिद – पद पर भतᱮ की प᳍ित, आयु-सीमा, अहर्ताएं और उससे संबंिधत अन् य

बातᱶ वे हᲂगी जो पूवᲃक् त अनुसूची के स् तंभ (5) से स् तंभ (13) मᱶ िविन᳸दर्ष् ट हᱹ ।

िनरहर्ता : वह व् यिक् त -

(क) िजसने ऐसे व् यिक् त से, िजसका पित या िजसकी पत् नी जीिवत है, िववाह िकया है या िववाह की संिवदा की है; या

(ख) िजसने अपने पित या अपनी पत् नी के जीिवत रहते हुए िकसी व् यिक् त से िववाह िकया है, या िववाह की संिवदा

की है; उक् त पदᲂ पर िनयुिक् त का पाᮢ नहᱭ होगा।

परन् तु यिद केन् ᮤीय सरकार का यह समाधान हो जाता है िक ऐसा िववाह ऐसे व् यिक् त और िववाह के अन् य पक्षकार को

लागू स् वीय िविध के अधीन अनुज्ञेय है और ऐसा करने के िलए अन् य आधार हᱹ, तो वह िकसी व् यिक् त को इस िनयम के ᮧवतर्न से

छूट दे सकेगी ।

5. िशिथल करने की शिक् त - जहां केन् ᮤीय सरकार की यह राय है िक ऐसा करना आवश् यक या समीचीन है, वहां वह उसके

िलए जो कारण हᱹ, उन् हᱶ लेखब᳍ करके तथा संघ लोक सेवा आयोग से परामशर् करके, इन िनयमᲂ के िकसी उपबंध को िकसी

वगर् या ᮧवगर् के व् यिक् तयᲂ की बाबत, आदेश ᳇ारा िशिथल कर सकेगी ।

6. व् यावृित् त - इन िनयमᲂ की कोई बात, ऐसे आरक्षण, आयु-सीमा मᱶ छूट और अन् य िरयायतᲂ पर ᮧभाव नहᱭ डालेगी,

िजनका केन् ᮤीय सरकार ᳇ारा इस संबंध मᱶ समय-समय पर िनकाले गए आदेशᲂ के अनुसार अनुसूिचत जाितयᲂ, अनुसूिचत

जनजाितयᲂ, भूतपूवर् सैिनकᲂ और अन् य िवशेष ᮧवगर् के व् यिक् तयᲂ के िलए उपबंध करना अपेिक्षत है ।

िनयिमत आधार पर िनयुिᲦ के पश् चात उस ᮰ेणी

मᱶ पांच वषर् सेवा की है और िजन् हᲂने सिचवालय

ᮧिशक्षण और ᮧबंध संस् थान ᳇ारा संचािलत

स् थापना िनयमᲂ के संबंध मᱶ ‘ए क सप् ताह’ का

ᮧिशक्षण सफलतापूवर्क पूरा िकया है।

िटप् पण : जहां ऐसे किनष् ठ व् यिक् तयᲂ के संबंध मᱶ,

िजन् हᲂने अपनी अहर्क/पाᮢता सेवा पूरी कर ली है,

ᮧोन् नित के िलए िवचार िकया जा रहा हो, जहां

उनसे ज् येष् ठ व् यिक् तयᲂ के संबंध मᱶ भी िवचार

िकया जाएगा परन् तु यह तब जब िक उनके ᳇ारा

की गई ऐसी अहर्क या पाᮢता सेवा, अपेिक्षत

अहर्क या पाᮢता सेवा के आधे से अिधक से या दो

वषर् से, इनमᱶ से जो भी कम हो, कम न हो और

उन् हᲂने अपने ऐसे किनष् ठ व् यिक् तयᲂ सिहत,

िजन् हᲂने ऐसी अहर्क या पाᮢता सेवा पहले ही

पूरी कर ली है, अगली उच् चतर ᮰ेणी मᱶ ᮧोन् नित

के िलए अपनी पिरवीक्षा की अविध सफलतापूवर्क

पूरी कर ली हो ।

समूह ‘ख’ िवभागीय ᮧोन् नित सिमित (ᮧोन् नित के

संबंध मᱶ िवचार करने के िलए) जो िनम् निलिखत से

िमल कर बनᱶगी:-

(1) ᮧवतर्न िनदेशक —अध् यक्ष

NOTIFICATION

New Delhi, the 21st June, 2017

G.S.R. 614(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution

and in supersession of the Ministry of Finance, Department of Revenue, Directorate of Enforcement,

Superintendent, Group ‘B’ posts, Recruitment Rules, 2011, the president hereby makes the following rules

regulating the method of recruitment to the post of Superintendent in the Ministry of Finance, Department of

Revenue Directorate of Enforcement, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Finance,

Department of Revenue, Directorate of Enforcement, Superintendent, Group ‘B’ Post, Recruitment Rules,

2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix.—The number of said post, its

classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the

Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit,

qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid

Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the

personal law applicable to such person and the other party to the marriage and that there are other grounds for

so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or

expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union

Public Service Commission, relax any of the provisions of these rules with respect to any class or category of

persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other

concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other

special categories of persons in accordance with the orders issued by the Central Government from time to

time.

Promotion: Assistant in level-6 (Rs. 35400-112400) in the

pay matrix in the Directorate of Enforcement with five

years service in the grade rendered after appointment

thereto on regular basis and having successfully completed

‘one week’ training on establishment rules conducted by

Institute of Secretariat Training and Management.

Note: Where juniors who have completed their qualifying

or eligibility service are being considered for promotion,

their seniors shall also be considered provided they are not

short of the requisite qualifying or eligibility service by

more than half of such qualifying or eligibility service, or

two years, whichever is less, and have successfully

completed their probation period for promotion to the next

higher grade along with their juniors who have already

completed such qualifying or eligibility service.
