(अ).—के᭠ ᮤीय सरकार, िविधक मापिव᭄ान अिधिनयम, 2009 (2010 का 1) कᳱ धारा 52 कᳱ उपधारा (1)

और उपधारा (2) ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए िविधक माप िव᭄ान (पैकेज मᱶ रखी ᱟई व᭭ तुएं) िनयम, 2011 का और

संशोधन करने के िलए िन᭥ निलिखत िनयम बनाती है, अथाᭅत:-

संिᭃ᭡ त नाम और ᮧारंभ - (1) इन िनयमᲂ का संिᭃ᭡ त नाम िविधक माप िव᭄ान (पैकेज मᱶ रखी व᭭ तुएं) (संशोधन) िनयम, 2017

है।

ये 1 जनवरी, 2018 से ᮧवृ᭜ त हᲂगे।

िविधक माप िव᭄ान (पैकेज मᱶ रखी ᱟई व᭭ तुएं) िनयम, 2011(िजसे इसमᱶ इसके प᭫ चात् उ᭍ त िनयम कहा गया है) के िनयम 2

मᱶ,-

(i)

खंड (क) के प᭫ चात् िन᭥ निलिखत खंड अ᭠ त: ᭭ थािपत ᳰकया जाएगा, अथाᭅत:-

(कक) “उपभो᭍ ता” का वही अथᭅ होगा जो उपभो᭍ ता संरᭃण अिधिनयम, 1986 (1986 का 68) कᳱ धारा 2 कᳱ उपधारा (1) के

खंड (घ) मᱶ उसका है;

(ii)

खंड (खग) के ᭭ थान पर िन᭥ निलिखत खंड रखा जाएगा, अथाᭅत्:-

‘(खग) “सं᭭ थागत उपभो᭍ ता” से ऐसी सं᭭ था अिभᮧेत है जो उस सं᭭ थान ᳇ारा उपयोग के िलए और न ᳰक वािणि᭔यक अथवा

᭪ यापाᳯरक ᮧयोजनᲂ के िलए सीधे ही िविनमाᭅता से या ᳰकसी आयातकताᭅ से या थोक ᭪ यौहारी से पैकेज मᱶ रखी ऐसी व᭭ तुएं

खरीदता है िजन पर ‘खुदरा िबᮓᳱ के िलए नहᱭ’ कᳱ घोषणा होगी’;

(iii)

खंड (खग) के प᭫ चात् िन᭥ निलिखत खंड अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

(खघ) “ई-कामसᭅ” से, िडजीटल और इलै᭍ ᮝािनक नेटवकᭅ पर िडजीटल उ᭜ पादᲂ सिहत माल और सेवाᲐ का ᮓय और िवᮓय

अिभᮧेत है;

(खड़) “ई-कामसᭅ अि᭭त᭜ व” से, क᭥ पनी अिधिनयम, 1956 या क᭥ पनी अिधिनयम 2013 के अधीन िनगिमत ऐसी कोई क᭥ पनी या

क᭥ पनी अिधिनयम, 2013 कᳱ धारा 2 के खंड (42) के अंतगᭅत आने वाली कोई िवदेशी क᭥ पनी, या िवदेशी मुᮤा ᮧबंध

अिधिनयम, 1999 (1999 का 42) कᳱ धारा 2 के खंड (v) के उप-खंड (ii) के अंतगᭅत आने वाला, भारत मᱶ ि᭭थत कोई कायाᭅलय,

शाखा अथवा अिभकरण अिभᮧेत है, जो भारत से बाहर रहने वाले ᳰकसी ᭪ यिᲦ के ᭭ वािम᭜ वाधीन या िनयंᮢणाधीन हो और जो

ई-कामसᭅ ᭪ यापार करता हो।

(खच) “ई-कामसᭅ का बाज़ार आधाᳯरत मॉडल” से, ᳰकसी ई-कामसᭅ अि᭭त᭜ व ᳇ारा ᮓेता और िवᮓेता के बीच सुिवधाᮧदाता के ᱨप

मᱶ कायᭅ करने के िलए िडजीटल और इलै᭍ ᮝािनक नेटवकᭅ पर सूचना ᮧौ᳒ोिगकᳱ मंच उपल᭣ ध कराना अिभᮧेत है।

(iv)

खंड (ड) के ᭭ थान पर िन᭥ निलिखत खंड रखा जाएगा, अथाᭅत्:-

‘(ड) “खुदरा िवᮓय मू᭨ य” से, ऐसी अिधकतम कᳱमत अिभᮧेत है, िजस पर पैकबंद ᱨप मᱶ व᭭ तुᲐ का उपभो᭍ ता को िवᮓय ᳰकया

जा सकेगा इसके अंतगᭅत सभी कर भी हᲂगे;

उ᭍ त िनयमᲂ के िनयम 3 के ᭭ थान पर िन᭥ निलिखत िनयम रखा जाएगा, अथाᭅत्:-

“3 अ᭟ याय का लागू होना- इस अ᭟ याय के उपबंध िन᭥ निलिखत को लागू नहᱭ हᲂगे, -

25 ᳰकलोᮕाम या 25 लीटर से अिधक माᮢा मᱶ व᭭ तुᲐ के पैकेट;

(क) सीमे᭠ ट, उवᭅरक, और 50 ᳰकलोᮕाम से अिधक के बैगᲂ मᱶ बेचे जाने वाले कृिष फामᭅ उ᭜ पाद; और

(ख) औ᳒ोिगक उपभो᭍ ताᲐ या सं᭭ थागत उपभो᭍ ताᲐ के िलए िविनᳶमत पैकबंद व᭭ तुएं”।

उ᭍ त िनयमᲂ के िनयम 6 मᱶ,-

(i)

उप-िनयम (1) मᱶ-

(क)

खंड (क) मᱶ ᭭ प᭬ टीकरण III के ᭭ थान पर िन᭥ निलिखत ᭭ प᭬ टीकरण रखा जाएगा, अथाᭅत्,-

“᭭ प᭬ टीकरण III – पैकबंद खा᳒ व᭭ तुᲐ के संबंध मᱶ, इस खंड के उपबंध लागू नहᱭ हᲂगे, ᳴कतु, खा᳒ सुरᭃा और मानक

अिधिनयम, 2006 (2006 का 34) और उसके अधीन बनाए गए िनयमᲂ मᱶ िविन᳸द᭬ ट अपेᭃाएं लागू हᲂगी”।

(ख)

खंड (क) के प᭫ चात्, िन᭥ निलिखत खंड अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“(कक) आयाितत उ᭜ पादᲂ कᳱ दशा मᱶ पैकेज पर उ᳄म देश या िविनमाᭅता या जोड़ने वाले देश के नाम का उ᭨ लेख ᳰकया जाएगा”।

(ग)

खंड (घ) के प᭫ चात्, िन᭥ निलिखत खंड अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

‘(घक) यᳰद ᳰकसी पैकेट मᱶ ऐसी कोई व᭭ तु है जो एक समयाविध के प᭫ चात् मानव उपभोग के िलए उपयोगी नहᱭ रह सकेगी तो

लेबल पर “से पूवᭅ अथवा तारीख, माह, वषᭅ तक उपयोग करᱶ” का भी उ᭨ लेख होगा;’

परंतु इस खंड कᳱ कोई बात तक लागू नहᱭ होगी यᳰद इस संबंध मᱶ ᳰकसी अ᭠ य िविध मᱶ कोई उपबंध बनाया गया है।

᭭ प᭬ टीकरण -1 इस उप-िनयम के ᮧयोजनᲂ के िलए, –

(क) “से पूवᭅ” से वह तारीख अिभᮧेत है जो ᳰक᭠ ही उि᭨लिखत भंडारण पᳯरि᭭थितयᲂ के अधीन उस अविध कᳱ समाि᳙ को

सं᭄ािपत करती है, िजनके दौरान उ᭜ पाद पूणᭅत: िवपणनयो᭏ य रहेगा और उसमᱶ वह गुणवᱫा ᮧितधाᳯरत रहेगी िजसका दावा

ᳰकया गया है और उस तारीख के प᭫ चात् भी वह व᭭ तु उपभोग के िलए सुरिᭃत रह सकेगी;

(ख) “तक उपयोग करᱶ” से वह तारीख अिभᮧेत है जो ᳰक᭠ ही उि᭨लिखत भंडारण पᳯरि᭭थितयᲂ ऐसी ᮧा᭍ कलन अविध कᳱ समाि᳙

को सं᭄ाि᳙ करती हᱹ, िजनके प᭫ चात् उ᭜ पाद मᱶ उपभो᭍ ता ᳇ारा सामा᭠ यतया ᮧ᭜ यािशत गुणवᱫा नहᱭ रहेगी और इस तारीख के

प᭫ चात् वह व᭭ तु िवपणनयो᭏ य नहᱭ रहेगी;’

(घ) खंड (ड़) मᱶ, ‘पैकेज के खुदरा िवᮓय मू᭨ य’ श᭣ दᲂ के ᭭ थान पर िन᭥ निलिखत रखा जाएगा, अथाᭅत्-

“पैकेज कᳱ खुदरा िवᮓय कᳱमत मᱶ ᭭ प᭬ टत: उपदᳶशत होगा ᳰक यह सभी कर सिहत है; और ᱨपयᲂ अथवा पैसᲂ मᱶ कᳱमत कᳱ

गणना िनकटवतᱮ ᱨपये अथवा 50 पैसे तक कᳱ गई है

दृ᭬ टा᭠ त- खुदरा िवᮓय कᳱमत कᳱ घोषणा के िलए :

(क) अिधकतम खुदरा कᳱमत ᱨपये xx.xx (सभी करᲂ सिहत), या

(ख) सभी करᲂ सिहत अिधकतम खुदरा कᳱमत xx.xx ᱨपये, या

(ग) सभी करᲂ सिहत एम0आर0पी0 xx.xx ᱨपये या

(घ)

एम0आर0पी0 ᱨपये xx.xx (सभी करᲂ सिहत)’

(ii)

उप-िनयम (4) के प᭫ चात् िन᭥ निलिखत िनयम अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“(4क) इस िनयम कᳱ कोई भी बात, ᳰकसी िविनमाᭅता या पैककताᭅ या आयातकताᭅ को पैकेज पर अिनवायᭅ घोषणाᲐ के

अितᳯर᭍ त, िन᭥ निलिखत कᳱ घोषणा करने के िलए िनवाᳯरत नहᱭ करेगी-

(क) बारकोड या जीटीआईएन या ᭍ यूआर कोड;

(ख) व᭭ तु के माᮢा आ᭫ वासन के िलए ‘ई-कोड’और अ᭠ य अपेिᭃत घोषणाएं, के᭠ ᮤीय सरकार ᳇ारा यथािविन᳸द᭬ ट रीित

मᱶ उसे अिभᮧा᭡ त करने के प᭫ चात्;

(ग) सरकारी ᭭कᳱमᲂ जैसे ᭭ व᭒ छ भारत िमशन, के लोगो, जहां के᭠ ᮤीय सरकार ᳇ारा इसका उपयोग ᮧािधकृत ᳰकया

गया हो”;

(iii)

उप-िनयम (9) के प᭫ चात् िन᭥ निलिखत िनयम अ᭠ त:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“(10) कोई ई-कामसᭅ अि᭭त᭜ व यह सुिनि᳟त करेगा ᳰक ई-कामसᭅ सं᭪ यवहार के िलए ᮧयोग ᳰकए जाने वाले िडजीटल और

इलै᭍ ᮝािनक नेटवकᭅ पर, व᭭ तु के िविनमाᭅण अथवा पै᳴कग के मास और वषᭅ के िसवाय, उप-िनयम (1) मᱶ यथािविन᳸द᭬ ट अिनवायᭅ

घोषणाएं कᳱ जाएं;

पर᭠ तु ई-कामसᭅ के बाज़ार मॉडल कᳱ दशा मᱶ घोषणाᲐ के सही होने का उᱫरदािय᭜ व िविनमाᭅता या िवᮓेता या ᭪ यौहारी या

आयातकताᭅ का होगा यᳰद,-

(क) ई-कामसᭅ अि᭭त᭜ व के कृ᭜ य ऐसी संचार ᮧणाली तक पᱟंच उपल᭣ ध कराने तक सीिमत है िजस पर िविनमाᭅता या िवᮓेता या

᭪ यौहारी या आयातकताᭅ ᳇ारा जानकारी उपल᭣ ध कराई गई हो या उसे अ᭭ थाई ᱨप से भंडाᳯरत ᳰकया गया या रखा गया

हो; या

(ख) अि᭭त᭜ व -

(i) संᮧेषण आर᭥ भ नहᱭ करेगा,

(ii) संᮧेषण के ᮧा᭡ तकताᭅ का चयन नहᱭ करेगा, और

(iii) संᮧेषण मᱶ अ᭠ तᳶव᭬ ट जानकारी का चयन या संशोधन नहᱭ करेगा;

(ग) अि᭭त᭜ व, सूचना ᮧौ᳒ोिगकᳱ अिधिनयम, 2000 के अधीन अपने कतᭅ᭪ य का िनवᭅहन करते समय स᭥ यक त᭜ परता का पालन

करेगा और ऐसे अ᭠ य मागᭅदशᭅक िस᳍ा᭠ तᲂ का भी पालन करेगा जो के᭠ ᮤीय सरकार ᳇ारा इस िनिमᱫ िविहत ᳰकए जाएं;

पर᭠ तु यह और ᳰक बाज़ार ई-कामसᭅ अि᭭त᭜ व के िलए कोई संरᭃण नहᱭ होगा यᳰद,-

(क) अि᭭त᭜ व ने, िविध िवᱨ᳍ कायᭅ करने मᱶ धमकᳱ ᳇ारा या अ᭠ यथा वचनब᳍ता ᳇ारा षडयंᮢ या दु᭬ ᮧेरण ᳰकया हो या

सहायता कᳱ हो या उकसाया हो;

(ख) वा᭭ तिवक जानकारी ᮧा᭡ त होने पर या समुिचत सरकार या उसके अिभकरण ᳇ारा यह अिधसूिचत ᳰकए जाने पर ᳰक कोई

ऐसी जानकारी, आंकड़े अथवा संसूचना अि᭭त᭜ व ᳇ारा िनयि᭠ᮢत क᭥ ᭡ यूटर संसाधन मᱶ रखी गई है अथवा उससे जुड़ी ᱟई है

िजनका उपयोग िविध िवᱨ᳍ कृ᭜ य के िलए ᳰकया जा रहा है और अि᭭त᭜ व, उस संसाधन से उस सामᮕी को सा᭯ य से ᳰकसी

ᮧकार कᳱ छेड़छाड़ ᳰकए िबना त᭜ काल हटाने या उस तक पᱟंच को िनि᭬ᮓय करने मᱶ असफल रहा है;

᭭ प᭬ टीकरण –शंकाᲐ को दूर करने के िलए यह ᭭ प᭬ ट ᳰकया जाता है ᳰक इस उप-िनयम के उपबंधᲂ मᱶ, उपभो᭍ ताᲐ को

पᳯरदᱫ कᳱ जाने वाली पूवᭅ-पैकबंद व᭭ तुᲐ पर इन िनयमᲂ के अधीन अपेिᭃत घोषणाᲐ से ᳰकसी ᮧकार कᳱ छूट ᮧदान नहᱭ

करᱶगे”।

उ᭍ त िनयमᲂ के िनयम 7 मᱶ,-

(i)

उप-िनयम (2) के ᭭ थान पर िन᭥ निलिखत उप-िनयम रखा जाएगा, अथाᭅत्,-

“(2) इन िनयमᲂ के अधीन अपेिᭃत घोषणा मᱶ ᳰकसी अंक और अᭃर कᳱ ऊंचाई सारणी-I के अनुसार होगी।”;

(ii)

उपिनयम (3) के ᭭ थान पर िन᭥ निलिखत उपिनयम रखा जाएगा, अथाᭅत्:-

“(3) अंकᲂ कᳱ दशा मᱶ “1” और अᭃरᲂ मᱶ (i), (I) तथा (l) को छोड़कर अᭃरᲂ या अंकᲂ कᳱ चौड़ाई उनकᳱ ऊंचाई के एक-ितहाई से

कम नहᱭ होगी; ”

(III) सारणी-I के ᭭ थान पर िन᭥ निलिखत सारणी रखी जाएगी, अथाᭅत्:-

(iv) सारणी-II का लोप ᳰकया जाएगा;

(v) उपिनयम (4) और उपिनयम (5) के ᭭ थान पर ᮓमश: िन᭥ निलिखत उपिनयम रखे जाएंगे, अथाᭅत्: -

“(4) ᭃेᮢ िजसमᱶ शीषᭅ भाग, अधोभाग, कैन के शीषᭅ और अधोभाग का उभरा ᱟआ ᳰकनारा और बोतल एवं जार कᳱ ᮕीवा और

᭭ क᭠ ध सि᭥मिलत नहᱭ हᱹ, का अवधारण िन᭥ निलिखत रीित से ᳰकया जाएगा, अथाᭅत्:-

(क) आयताकार पैकेज कᳱ दशा मᱶ, जहां स᭥ पूणᭅ पᭃ को मु᭎ य ᮧदशᭅ पैनल पᭃ समझा जा सकता है, उस पᭃ कᳱ

ल᭥ बाई और चौड़ाई का गुणनफल;

(ख) बेलनाकार या इस ᮧकार के पैकेज कᳱ दशा मᱶ पैकेज कᳱ ऊंचाई और उसके दायरे के गुणनफल का 40 ᮧितशत;

(ग) अ᭠ य ᳰकसी आकार के पैकेज कᳱ दशा मᱶ पैकेज कᳱ सतह का 40 ᮧितशत या पैकेज का मु᭎ य ᮧदशᭅ पैनल समझा

जाने वाला ᭃेᮢ।

(5) शु᳍ भार, खुदरा िवᮓय कᳱमत तथा अवसान कᳱ तारीख या तारीख के पहले या तारीख तक उपयोग (जहां कही

लागू हो) और ᮕाहक सेवा संबंधी िववरण कᳱ घोषणा करने वाले अंकᲂ और अᭃरᲂ के आकार को छोड़कर, उपिनयम

(1) से उपिनयम (4) के उपबंध ऐसे पैकेज को लागू नहᱭ हᲂगे यᳰद इस िनयम के अधीन ऐसे पैकेज पर िविन᳸द᭬ ट कᳱ

जाने वाली जानकारी त᭜ समय ᮧवृ᭜ त ᳰकसी अ᭠ य िविध ᳇ारा या उसके अधीन दी जानी अपेिᭃत है।

उ᭍ त िनयमᲂ के िनयम 9 के उपिनयम (3) मᱶ िन᭥ निलिखत परंतुक अ᭠ त:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“परंतु, यᳰद बाहरी पैकेज पर इन िनयमᲂ के अधीन अपेिᭃत सभी घोषणाएं अंतᳶव᭬ ट है तो अंदᱨनी पैकेज पर ऐसी कोई घोषणा अपेिᭃत

नहᱭ होगी”।

उ᭍ त िनयमᲂ के िनयम 10 के उपिनयम (1) मᱶ -

(i)

पिहले परंतुक मᱶ “5 ᭍ यूिबक से.मी. या उससे कम” अंकᲂ, श᭣ दᲂ तथा अᭃरᲂ के ᭭ थान पर “10 ᭍ यूिबक सᱶटीमीटर या

उससे कम” अंक, श᭣ द तथा अᭃर रखे जाएंगे;

(ii)

᭭ प᭬ टीकरण को ᭭ प᭬ टीकरण 1 के ᱨप मᱶ सं᭎ यांᳰकत ᳰकया जाएगा और इस ᮧकार सं᭎ यांᳰकत ᭭ प᭬ टीकरण के प᭫ चात्

िन᭥ निलिखत ᭭ प᭬ टीकरण को ᮧित᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“᭭ प᭬ टीकरण 1 - इस उपिनयम मᱶ ‘पूरा पता’ से ऐसा डाक पता अिभᮧेत से है िजस पर कारखाना अवि᭭थत है या कंपनी या

फमᭅ रिज᭭ ᮝीकृत है, तथा, ᳰकसी अ᭠ य दशा मᱶ िविनमाᭅता या पैककताᭅ या आयातकताᭅ के पᳯरसर कᳱ गली का नाम, सं᭎ या (यᳰद

कोई है), और शहर और रा᭔ य का नाम जहां िविनमाᭅता या पैककताᭅ या आयातकताᭅ ᳇ारा ᭪ यापार ᳰकया जा रहा है और इसके

साथ-साथ पो᭭ टल इंडे᭍ स नंबर (िपन) कोड, िजससे उपभो᭍ ता ᳇ारा िविनमाᭅता या पैककताᭅ या आयातकताᭅ कᳱ पहचान कᳱ जा

सके और उसकᳱ अवि᭭थित का पता लगाया जा सके। ”

उ᭍ त िनयमᲂ के िनयम 18 मᱶ -

(i)

उपिनयम (1) के प᭫ चात् िन᭥ निलिखत उपिनयम अ᭠ त:᭭ थािपत ᳰकया जाएगा, अथाᭅत्:-

“(1क) थोक ᭪ यौहारी को पूवᭅ-पैकबंद व᭭ तुᲐ को औ᳒ोिगक और सं᭭ थागत उपभो᭍ ताᲐ को सीधे ही बेचने कᳱ अनु᭄ा होगी”

(ii)

उपिनयम (2) के प᭫ चात् िन᭥ निलिखत उपिनयम अन् त:᭭ थािपत ᳰकया जाएगा, अथाᭅत्: -

“(2क) जब तक ᳰकसी अ᭠ य िविध के अधीन िविन᳸द᭬ ट ᱨप से अ᭠ यथा उपबंिधत न हो कोई िविनमाᭅता या पैककताᭅ या

आयातकताᭅ, उपभो᭍ ता संरᭃण अिधिनयम 1986 (1986 का 68) कᳱ धारा 2 कᳱ उप-धारा (1) के खंड (ग) के अधीन यथा

उ᭍ त िनयमᲂ के िनयम 19 मᱶ, -

(क)

उपिनयम (4) मᱶ -

(i)

ख᭛ ड (क) मᱶ “सांि᭎यकᳱय औसत” श᭣ दᲂ के ᭭ थान पर “सही औसत” श᭣ द रखे जाएंगे;

(ii)

खंड (ख) के ᭭ थान पर िन᭥ निलिखत खंड रखा जाएगा, अथाᭅत्:- :-

“(ख)

उन पैकेजᲂ कᳱ सं᭎ या िजनमᱶ कमी मᱶ ᮢुᳯट, पांचवी अनुसूची मᱶ दी गई सारणी के ᭭ तंभ 4 मᱶ िविन᳸द᭬ ट अिधकतम

अनु᭄ेय ᮢुᳯट से अिधक पाई जाती है; या

(ग)

ᳰकसी पैकेज मᱶ कमी कᳱ ᮢुᳯट अिधकतम अनु᭄ेय ᮢुᳯट के दोगुने से अिधक है;

(घ)

िनदेशक, िनय᭠ ᮢक या िविधक माप िव᭄ान अिधकारी िविनमाᭅता या पैककताᭅ से लॉट मᱶ रखे गए पैकेजᲂ कᳱ शत-

ᮧितशत जांच करने कᳱ अपेᭃा करेगा और केवल ऐसे पैकेजᲂ के िवᮓय, िवतरण या िडलीवरी को ᮧािधकृत करेगा

िजनकᳱ शु᳍ माᮢा मᱶ कमी कᳱ ᮢुᳯट अिधकतम अनु᭄ेय ᮢुᳯट से कम है और िविनमाᭅता या पैककताᭅ को शेष पैकेजᲂ के

िवᮓय, िवतरण या िडलीवरी तभी अनु᭄ापत कᳱ जाएगी जब उ᭠ हᱶ यथाि᭭थित पुन: पैक या पुन लेबल, भी कर ᳰदया

जाएगा िजससे अिधिनयम और इन िनयमᲂ के उपबंधᲂ का अनुपालन हो सके”।

(ख)

उप-िनयम (5) का लोप ᳰकया जाएगा।

(ग)

उप-िनयम (6) के ᭭ थान पर िन᭥ निलिखत उप-िनयम रखा जाएगा, अथाᭅत्:-

“(6) पैकेजᲂ के ᳰकसी लॉट का िवᮓय के िलए तभी अनुमोदन ᳰकया जाएगा, यᳰद इस िनयम के अधीन कᳱ गई परीᭃा मᱶ यह

पाया जाता है ᳰक –

(क)

ᮧितदशᭅ पैकेजᲂ कᳱ सही औसत शु᳍ माᮢा, घोिषत कᳱ गई शु᳍ माᮢा के बराबर या उससे अिधक है;

(ख)

अिधकतम अनु᭄ेय ᮢुᳯट से कमी मᱶ अिधक ᮢुᳯट को दशाᭅने वाले पैकेजᲂ कᳱ सं᭎ या पांचवᱭ अनुसूची मᱶ दी गई सारणी के

᭭ तंभ 4 मᱶ दᳶशत सं᭎ या से अिधक नहᱭ है;

(ग)

ᳰकसी पैकेज मᱶ कमी कᳱ ᮢुᳯट अिधकतम अनु᭄ेय ᮢुᳯट के दोगुने से अिधक दᳶशत न हो;

(घ)

ᮧ᭜ येक पैकेज पर या उस पर लागाए गए लेबल पर इन िनयमᲂ के अधीन अपेिᭃत घोषणाएं होनी चािहए”।

10.

उ᭍ त िनयमᲂ मᱶ िनयम 20 के ᭭ थान पर िन᭥ निलिखत िनयम रखा जाएगा, अथाᭅत्:-

“20. िविनमाᭅता या पैककताᭅ के पᳯरसर मᱶ पैकेजᲂ का िनरीᭃण पूरा होने पर कारᭅवाई,- (1) यᳰद िनयम 19 के उप-िनयम (3) मᱶ िन᳸द᭬ ट

ᳯरपोटᭅ से यह ᮧतीत होता है ᳰक,-

(क)

नमूनᲂ के ᱨप मᱶ िलए गए पैकेजᲂ मᱶ सही औसत शु᳍ माᮢा, पैकेज पर या उस पर लगाए गए लेबल पर घोिषत कᳱ गई

माᮢा से कम है; या

(ख)

यᳰद ᳰकसी पैकेज पर कमी मᱶ ᮢुᳯट, पांचवी अनुसूची कᳱ सारणी के ᭭ तंभ 4 मᱶ िविन᳸द᭬ ट अिधकतम अनु᭄ेय ᮢुᳯट कᳱ

सं᭎ या से अिधक है; या

(ग)

ᳰकसी पैकेज मᱶ कमी कᳱ ᮢुᳯट अिधकतम अनु᭄ेय ᮢुᳯट के दोगुने से अिधक है; या

(घ)

यᳰद ᳰकसी पैकेज पर या उस पर लगाए गए लेबल पर इन िनयमᲂ के अधीन कᳱ जाने वाली घोषणाएं नहᱭ हᱹ;

तो िनदेशक, िनय᭠ ᮢक या िविधक माप िव᭄ान अिधकारी िन᭥ निलिखत कारᭅवाई करेगा, अथाᭅत्:-

(i)

उसके ᳇ारा नमूने के ᱨप मᱶ िलए गए पैकेजᲂ का अिभᮕहण करेगा और जब तक उ᭠ हᱶ उपयु᭍ त ᭠ यायालय मᱶ सा᭯ य के

ᱨप मᱶ ᮧ᭭ तुत नहᱭ ᳰकया जाता तब तक उन अिभᮕहण ᳰकए गए पैकेजᲂ को सुरिᭃत अिभरᭃा मᱶ रखने के िलए पयाᭅ᭡ त

उपाय करेगा;

(ii)

अिधिनयम और इन िनयमᲂ के उपबंधᲂ के अनुसार, सा᭯ य के आधार पर उ᭨ लंघनᲂ के स᭥ ब᭠ ध मᱶ कारᭅवाई आरंभ

करेगा।

(2)

अिभᮕहण ᳰकए गए पैकेजᲂ का ᭪ ययन दंड ᮧᳰᮓया संिहता, 1973 (1974का 2) के उपबंधᲂ के अनुसार ᳰकया जाएगा।

11.

उ᭍ त िनयमᲂ के िनयम 26 मᱶ,-

(i)

खंड (ग) के ᭭ थान पर िन᭥ निलिखत खंड रखा जाएगा, अथाᭅत्:-

“(“(“(“(ग) ) ) ) इसमᱶ आव᭫ यक व᭭ तु अिधिनयम, 1955 (1955 का 10) कᳱ धारा 3 के अधीन बनाए गए औषिध (कᳱमत िनय᭠ ᮢण)

आदेश, 2013 के अ᭠ तगᭅत आने वाली अनुसूिचत िविनᳶमितयां और गैर अनुसूिचत िविनᳶमितयां अ᭠ तᳶव᭬ ट हᲂगी:

पर᭠ तु औषिध के ᱨप मᱶ घोिषत कᳱ गई िचᳰक᭜ सा संबंधी युिᲦᲐ को ᳰकसी ᮧकार कᳱ छूट लागू नहᱭ होगी।

NOTIFICATION

New Delhi, the 23rd June, 2017

G.S.R. 629(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 52 of the Legal

Metrology Act, 2009 (1 of 2010), the Central Government hereby makes the following rules further to amend the Legal

Metrology (Packaged Commodities) Rules, 2011, namely:-

1. (1) Short title and commencement.- These rules may be called as the Legal Metrology (Packaged Commodities)

Amendment Rules, 2017.

(2) They shall come into force on the 1^st day of January, 2018.

2. In the Legal Metrology (Packaged Commodities) Rules, 2011 (hereinafter referred to as the said rules), in rule 2,-

(i) after clause (a), the following clause shall be inserted, namely:-

‘(aa) “Consumer” shall have the same meaning as assigned to it in clause (d) of sub-section (1) of section 2 of the

Consumer Protection Act, 1986 (68 of 1986);’;

(ii) for clause (bc), the following clause shall be substituted, namely:-

‘(bc) “institutional consumer” means the institution which buys packaged commodities bearing a declaration ‘not for

retail sale’, directly from the manufacturer or from an importer or from wholesale dealer for use by that institution and

not for commercial or trade purposes;’;

(iii)

after clause (bc), the following clauses shall be inserted, namely:-

‘(bd) “E-commerce” means buying and selling of goods and services including digital products over digital and

electronic network;

(be) “E-commerce entity” means a company incorporated under the Companies Act, 1956 or the companies Act, 2013 or

a foreign company covered under clause (42) of section 2 of the Companies Act, 2013, or an office, branch or agency in

India covered under sub-clause (ii) of clause (v) of section 2 of the foreign Exchange Management Act, 1999 (42 of

1999) owned or controlled by a person resident outside India and conducting e-commerce business;

(bf) “marketplace based model of e-commerce” means providing of an information technology platform by an e-

commerce entity on a digital and electronic network to act as a facilitator between buyer and seller;’;

(iv) for clause (m), the following clause shall be substituted, namely:-

‘(m) “retail sale price” means the maximum price at which the commodity in packaged form may be sold to the

consumer inclusive of all taxes;’;

3. In the said rules, for rule 3, the following rule shall be substituted, namely:-

“3. Application of Chapter.- The provisions of this chapter shall not apply to-

(a) packages of commodities containing quantity of more than 25 kilogram or 25 litre;

(b) cement, fertilizer and agricultural farm produce sold in bags above 50 kilogram; and

4. In the said rules, in rule 6,-

(i) in sub-rule (1).-

(a) in clause (a), for Explanation III, the following Explanation shall be substituted, namely:-

“Explanation III. - In respect of packages containing food articles, the provisions of this clause shall not apply, but the

provisions of, and the requirements specified in the Food Safety and Standards Act, 2006 (34 of 2006) and the rules

made thereunder shall apply;”;

(b) after clause (a), the following clause shall be inserted, namely:-

“(aa) The name of the country of origin or manufacture or assembly in case of imported products shall be mentioned on

the package;”;

‘(da) If a package contains a commodity which may become unfit for human consumption after a period of time, the

‘best before or use by the date, month and year’ shall also be mentioned on the label:

Provided that nothing in this clause shall apply if a provision in this regard is made in any other law.

Explanation.- 1. For the purposes of this sub-rule,-

(a) the expression “best before” means the date which signifies the end of the period under any stated storage conditions

during which the product shall remain fully marketable and shall retain any specific qualities for which tacit or express

claims have been made and beyond the date commodity may still be safe for consumption;

(b) the expression “Use by Date” means the date which signifies the end of the estimated period under any stated storage

conditions after which the product shall not have the quality attributes normally expected by the consumers and after this

date, the commodity should not be regarded as marketable.’;

(d) in clause (e), after the words “the retail sale price of the package;”, the following words and figures shall be inserted,

namely:-

“shall clearly indicate that it is the maximum retail price inclusive of all taxes and the price in rupees and paise be

rounded off to the nearest rupee or 50 paise;

Illustrations.- for declaration of retail sale price:

(a) Maximum or Max. retail price Rs. or

xx.xx (inclusive of all taxes), or

(b) Maximum or Max. retail price Rs. or

xx.xx inclusive of all taxes, or

xx.xx incl. of all taxes, or

(d) MRP Rs. or

xx.xx (incl. of all taxes):”

(ii) after sub-rule (4), the following sub-rule shall be inserted, namely:-

“(4A) Nothing in this rule shall preclude a manufacturer or packer or importer to declare the following on the package, in

addition to the mandatory declarations-

(a) Barcode or GTIN or QR Code;

(b) ‘e-code’ for net quantity assurance of the commodity and other required declarations, after obtaining the same in the

manner as specified by the Central Government;

(iii) after sub-rule (9), the following sub-rule shall be inserted, namely:-

“(10) An E-Commerce entity shall ensure that the mandatory declarations as specified in sub-rule (1), except the month

and year in which the commodity is manufactured or packed, shall be displayed on the digital and electronic network

used for e-commerce transactions:

Provided that in case of market place model of e-commerce, responsibility of the correctness of declarations

shall lie with the manufacturer or seller or dealer or importer if,-

(a) the function of the e-commerce entity is limited to providing access to a communication system over which

information made available by the manufacturer or seller or dealer or importer is transmitted or temporarily stored or

hosted; or

(b) the entity does not-

(i) initiate the transmission;

(ii) select the receiver of the transmission; and

(iii) select or modify the information contained in the transmission;

Act, 2000 and also observes such other guidelines as the Central Government may prescribe in this behalf:

Provided further that there shall not be any protection to the market place e-commerce entity if,-

(a) the entity has conspired or abetted or aided or induced, whether by threats or promise of otherwise in the commission

of the unlawful act;

(b) upon receiving actual knowledge, or on being notified by the appropriate Government or its agency that any

information, data or communication link residing in or connected to a computer resource controlled by the entity is being

used to commit the unlawful act, the entity fails to expeditiously remove or disable access to that material on that

resource without vitiating the evidence in any manner.

Explanation.- For the removal of doubts it is hereby clarified that the provision of this sub -rule shall not provide

exemption from the declarations required to be made under these rules on pre-packaged commodities delivered to the

consumers.”.

5. In the said rules, in rule 7,-

(i) for sub-rule (2), the following sub-rule shall be substituted, namely:-

“(2) The height of any numeral and letter in the declaration required under these rules shall be as per Table-I.”;

(ii) for sub-rule (3) , the following sub-rule shall be substituted, namely:-

“(3) The width of the letter or numeral shall not be less than one third of its height ,except in the case of numeral “1” and

letters (i), ( I) and (

);”.

(iii) For the Table-I, the following table shall be substituted, namely:-

(iv) Table II shall be omitted;

(v) for sub-rules (4) and (5), the following sub-rules shall respectively, be substituted, namely.-

“(4) The area not including the top, bottom, flange at top and bottom of cans, and shoulders and neck of bottle and jars

shall be determined in the following manner, namely:-

(a)

in the case of a rectangular package, where one entire side can properly be considered to be the principal display

panel side, the product of the height multiplied by the width of that side;

(b) in case of a cylindrical or nearly cylindrical package, 40 per cent. of the product of the height of the package

multiplied by the circumference;

(c) in case of any other shaped package , 40 per cent. of the total surface of the package, or an area considered to be a

principal display panel of the package.

(5) Except size of the numbers and letters for declaring net weight, retail sale price, date of expiry or best before or use

by date (wherever and as applicable) and consumer care details, the provisions under sub-rules (1) to (4) shall not apply

to a package if the information to be specified on such package under this rule is also required to be given by or under

any other law for the time being in force.”.

6. In the said rules, in rule 9, in sub-rule (3), the following proviso shall be inserted, namely,-

“Provided that no such declarations on the inner package is required, if the outer package contains all declarations

required under these rules.”.

7. In the said rules, in rule 10, in the sub-rule 1,-

(i) in the first proviso for the figures, words and letters “5 cubic cm or less”, the figures, words and letters “10 cubic cm

or less” shall be substituted;

(ii) the explanation shall be numbered as Explanation 1 thereof, and after the Explanation, as so numbered the following

Explanation shall be substituted, namely:-

“Explanation 1.- In this sub-rule, 'complete address' means, the postal address at which the factory is situated or company

or firm is registered, and, in any other case, the name of the street, number (if any) assigned to the premises of the

manufacturer or packer or importer and the name of the city and State where the business is carried on by the

manufacturer or packer or importer and the Postal Index Number [PIN] Code so that a consumer can identify and locate

the manufacturer or packer or importer, as the case may be.”.

8. In the said rules, in rule 18,-

(i) after sub-rule (1), the following sub-rule shall be inserted, namely:-

“(1A) The wholesale dealer shall be allowed to sell the pre-packaged commodities directly to the industrial and

institutional consumers.”.

(i) after sub-rule (2), the following sub-rule shall be inserted, namely:-

“(2A) Unless otherwise specifically provided under any other law, no manufacturer or packer or importer shall declare

different maximum retail prices on an identical pre-packaged commodity by adopting restrictive trade practices or unfair

trade practices as defined under clause (c) of sub-section (1) of section 2 of the Consumer Protection Act, 1986 (68 of

1986).

9. In the said rules, in rule 19,-

(a) in sub rule (4),-

(i) in clause (a), for the words “the statistical average”, the words “the corrected average” shall be substituted;

(ii) for clause (b), the following clauses shall be substituted, namely:-

“(b) the number of packages that show an error in deficiency exceeding the maximum permissible error is greater than

that shown in column 4 of Table under Fifth Schedule; or

(d) the Director, Controller or the Legal Metrology Officer shall require the manufacturer or packer to make a cent per

cent check of the packages contained in the lot and authorise sale, distribution or delivery of only such packages with

error in deficiency in the net quantity less than the maximum permissible error and the remaining packages shall be

allowed to be sold distributed or delivered by the manufacturer or packer after it has been repacked or relabeled, as the

case may be, so as to comply with the provisions of the Act and these Rules.”

(b) sub-rule (5) shall be omitted.

“(6) A lot of packages shall be approved for sale if as a result of the test carried out under this rule, it is found that-

(a) the corrected average net quantity of the sample packages is equal to or more than the declared net quantity;

(b) the number of packages that show an error in deficiency exceeding the maximum permissible error is not more than

that shown in column 4 of the Table under Fifth Schedule;

(d) every package bears thereon or on a label affixed thereto the declarations required to be made under these rules.”.

10. In the said rules, for rule 20, the following rule shall be substituted, namely:-

“20. Action to be taken on completion of inspection of packages at the premises of the manufacturers or the packer.- (1)

If it appears from the report referred to in sub-rule (3) of rule 19 that,-

(a) the corrected average net quantity contained in the packages drawn as samples is lesser than the quantity declared on

the package or the label affixed thereto; or

(b) any such packages showing an error in deficiency exceeding the maximum permissible error is greater than the

number specified in column 4 of the Table in the Fifth schedule; or

(d) any such package does not bear thereon or on label affixed thereto the declarations to be made under these Rules;

the Director, Controller, or the Legal Metrology Officer shall take following action, namely:-

(i) seize the packages drawn by him as samples and take adequate steps for the safe custody of the seized packages until

they are produced in the appropriate court as evidence;

(ii) based on the evidence initiate action for violations as per the provisions of the Act and these rules.

(2) The disposal of the seized packages shall be done in accordance with the provisions of the Code of Criminal

Procedure, 1973(2 of 1974).”.

11. In the said rules, in rule 26,-

(i) for clause (c), the following clause shall be substituted, namely:-

“(c) it contains scheduled formulations and non-scheduled formulations covered under the Drugs (Price Control) Order,

2013 made under section 3 of the Essential Commodities Act, 1955 (10 of 1955):

Provided that no exemption shall be applicable to medical devices declared as drugs.”.

(ii) clause (d) shall be omitted.

12. In the said rules, for rule 32, the following rules shall be substituted, namely:-

“32. Fine for contravention of rules.-

Whoever contravenes any provisions of these rules, for which no punishment is provided, shall be punished with fine of

five thousand rupees.

32A. Sum of compounding of offences.- The sum of compounding of offences committed under the Act shall be as

specified in the following Table, namely:—

13. In the said rules, in the Second Schedule, in column (3), against serial number 10, after figures and letter, “500g”, the

figures and letters “550 g, 600 g, 650 g” and after figures and letters, “500ml”, the figures and letters “550 ml, 600 ml,

650 ml” shall respectively, be inserted.

15. In the said rules, in the Sixth Schedule, in Part-II, after item no 7, the following items shall be inserted, namely:-

“8. Determination of mean or average net quantity or net volume.-

After determining the individual values of net quantity or net volume or length or number of the commodity contained in

the package, as per the procedure outlined in item numbers 3 to 6 of this Part, the mean or average value shall be

calculated by summing up the individual values (xi) and dividing it by the number of sample packages (n) taken for

testing, by the formula-

Average Net value (

) = ∑ xi / n .

9. Determination of Standard deviation of values.-

The standard deviation (σ) of individual values [xi] is determined by the formula -

10. Corrected average net quantity or net volume.-

The corrected average net quantity Xc is determined from the value of average net quantity [

16. In the said rules, in the Seventh Schedule,-

(a) in Form A, in row B, relating to the commodity Classification, for the existing entries in column (2), the following

(b) in Form B, in row B relating to the commodity Classification, for the existing entries in column (2), the following

entries be substituted, namely:-
