का.आ. 2003(अ).—केन्द्रीय सरकार ने पेट्रोलियम और खलनज पाइपिाइन (भूलम में उपयोग के अलिकार का अजजन) अलिलनयम,

1962 (1962 का 50)(लजसे इसमें इसके पश्चाि उक्त अलिलनयम कहा गया है की िारा 3 की उपिारा (1) के अिीन जारी की गयी भारि

सरकार के पेट्रोलियम और प्राकृलिक गैस मंत्रािय की अलिसूचना संख्या का.आ. 2854(अ), िारीख 30 अगस्ि 2016, जो भारि के

राजपत्र िारीख 02 लसिम्बर 2016, में प्रकालिि की गयी थी द्वारा उस अलिसूचना से संिग्न अनुसूची मे लिलनर्िजष्ट भूलम में उत्तर प्रिेि

राज्य मे भारिीय रेििे के डी.एफ.सी. के लिये बी.के.पी.एि. के मुगिसराय और कानपुर के बीच खंड लिफ्टंग हेिु क्षेत्र -ए (प्रस्थालपि

पाइपिाईन चैनेज 316.037 से 335.478 िक लजिा

–

लमजाजपुर) में पेट्रोलियम पररिहन के लिये इंलडयन ऑयि कापोरेिन लिलमटेड

द्वारा पाइपिाइन लबछाने के प्रायोजन के लिये उपयोग के अलिकार के अजजन के अपने आिय की घोषणा की थी ;

और उक्त राजपत्र अलिसूचना की प्रलियां जनिा को िारीख 15 निम्बर ; 2016 िक उपिब्ि करा िी गयी थी;

और सक्षम प्रालिकारी ने उक्त अलिलनयम की िारा 6 की उपिारा(1) के अिीन केन्द्रीय सरकार को ररपोटज िे िी है ;

और केंरीय सरकार ने, उक्त ररपोटज पर लिचार करने के पश्चाि और यह समािान हो जाने पर दक उक्त भूलम पाइपिाइन लबछाने

के लिये अपेलक्षि है, उसमें उपयोग के अलिकार का अजजन करने का लिलनश्चय दकया हैं ;

अि: अब केंरीय सरकार उक्त अलिलनयम की िारा 6 की उपिारा (1) द्वारा प्रित्त िलक्तयों का प्रयोग करिे हुये यह घोषणा करिी

है दक इस अलिसूचना से संिग्न अनुसूची में लिलनर्िजष्ट भूलम में पाइप िाइन लबछाने के लिये उपयोग के अलिकार का अजजन दकया जाये ;

और केंरीय सरकार उक्त अलिलनयम की िारा 6 की उप-िारा (4) द्वारा प्रित्त िलक्तयों का प्रयोग करिे हुए ,यह लनिेि िेिी है

दक उक्त भूलम मे उपयोग का अलिकार इस घोषणा के प्रकािन की िारीख से केंरीय सरकार मे लनलहि होने के बजाए, सभी लिल्िंगमों से

मुक्त होकर इंलडयन ऑयि कापोरेिन लिलमटेड मे लनलहि होगी ।

पेट्रोलियम और खलनज पाइपिाइन अलिलनयम, 1962 की िारा 10 के अिीन दकसी भी क्षलिपूर्िज के लिये इंलडयन ऑयि

कापोरेिन लिलमटेड पूणजिया उत्तरिायी होगी और पाइपिाइन से सम्बंलिि दकसी भी मामिे पर केंरीय सरकार के लिरुद्ध कोई िाि िािा

या कानूनी कायजिाही नही हो सकेगी ।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi, the 20th June, 2017

S.O. 2003(E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and

Natural Gas S.O No. 2854(E), dated the 30^th August ,2016 ,issued under sub–section (1) of section 3 of the Petroleum

and Minerals Pipelines (Acquisition of Right of User in Land ) Act, 1962 (50 of 1962) (hereinafter referred to as the said

Act) , published in the Gazette of India dated the 2nd September; 2016 ,the Central Government declared its intention to

acquire the right of user in the land specified in the schedule appended to that notification for the purpose of laying

pipeline for the “ Shifting of Barauni –Kanpur pipeline between Mugalsarai and Kanpur for DFCCIL of Indian Railway

in Part A (from Existing P/L Ch. 316.037 to 335.478 Km. In District- Mirzapur)” by Indian oil corporation limited for the

transportation of petroleum products ;

And whereas copies of said Gazette notification were made available to the public up to 15 November, 2016;

And whereas the competent Authority has under sub-section (1) of section 6 of the said act submitted report to

the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the said land

is required for laying the pipeline, has decided to acquire right of user therein;

Now therefore in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central

Government hereby declares that the right of user in the land specified in the schedule appended to this notification is

hereby acquired for laying the pipeline ;

(ii)

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central

Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the

Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation limited, free from all

encumbrances.

Indian Oil Corporation limited shall be exclusively liable for any compensation in terms of section 10 of the

P&MP Act, 1962 and no suit, claim or legal proceedings would lie against the Central Government on any matter

relating to the pipeline.

अनुसूची में िर्णजि है, उपयोग का अजजन दकया जाए;

अपने आिय की घोषणा करिी है;

कोई व्यलक्त, जो उक्त अनुसूची में िर्णजि भूलम में लहिबध्ि है, उस िारीख से लजसको, भारि के राजपत्र में यथा प्रकालिि इस

अलिसूचना की प्रलियां सािारण जनिा को उपिब्ि करा िी जािी है, इक्कीस दिन के अन्द्िर, भूलम के भीिर पाइपिाइन लबछाए जाने हेिु

उपयोग के अलिकार के अजजन के लिए, श्री बसंि अग्रिाि, सक्षम प्रालिकारी, इंलडयन ऑयि कॉपोरेिन लिलमटेड, पाइपिाइंस लडिीजन

सूबेिारगंज, लजिा इिाहाबाि, पो. पीपिगााँि, राज् य उ्‍ िरप्रिेि लपन 211 012 को लिलखि रूप में आक्षेप भेज सकेगा ।

S.O. 2004(E).—Whereas, it appears to the Central Government that it is necessary in the public interest that a

pipeline should be laid by the Indian Oil Corporation Limited in Dist. Mirzapur in the State of Uttar Pradesh for carrying

out ‘Detailed Survey For Shifting of Barauni Kanpur Pipeline Between Mughalsarai And Kanpur For DFCCIL of Indian

Railway in Part-A (From Existing P/L Ch. 316.037 to 335.478 Km. In District- Mirzapur)’ for the transportation of

Petroleum Product;

And, whereas, it appears to the Central Government that for the purpose of laying the said pipeline, it is

necessary to acquire the right of user in the land under which the said pipeline is proposed to be laid, and which is

described in the Schedule annexed to this notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and

Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby

declares its intention to acquire the right of user therein;

Any person interested in the land described in the said Schedule may, within twenty one days from the date on

which the copies of the notification issued under sub-section (1) of Section 3 of the said Act, as published in the Extra

Ordinary Gazette of India are made available to the general public, object in writing to the acquisition of the right of user

therein for laying of the pipeline under the land, to Shri Basant Agrawal, Competent Authority, Indian Oil Corporation

Limited. (Pipelines Division), Barauni Kanpur Pipelines, Subedarganj P.O. Pipalgaon Dist. Allahabad

(Uttar Pradesh) – 211 012.
