नई िदल् ली, 28 जून, 2017

का. आ. 2033(अ).—जबिक, केन् ᮤीय सरकार ने, राष् ᮝीय अन् वेषण अिभकरण अिधिनयम, 2008 (2008

का 34) (िजसे इसके बाद उक् त अिधिनयम के रूप मᱶ संदिभर्त िकया गया है) की धारा 11 की उप-धारा (6) के

अंतगर्त ᮧदत् त शिᲦयᲂ का ᮧयोग करते हुए, भारत के राजपᮢ, असाधारण, भाग-II, खण् ड-3, उप-खण् ड (ii) मᱶ

ᮧकािशत िदनांक 31 िदसम् बर, 2012 की अिधसूचना संख् या का. आ. 78(अ) के तहत XLIX अपर िसटी िसिवल

एवं सᮢ न् यायाधीश, बᱶगलुरु िसटी को उक् त अिधिनयम की धारा 11 के उप-खण् ड (1) के अंतगर्त अनुसूिचत अपराध

के िवचारण हेतु िवशेष न् यायालय के तौर पर िनयुक् त िकया था िजसका क्षेᮢािधकार संपूणर् कनार्टक राज् य था;

और जबिक, ᮰ी महावरकार गुलजारलाल, LI अपर िसटी िसिवल एवं सᮢ न् यायाधीश, बᱶगलुरु िसटी िजन् हᱶ

भारत के राजपᮢ, असाधारण, भाग-II खण् ड-3, उप-खण् ड (ii) मᱶ ᮧकािशत िदनांक 2 फरवरी, 2017 की अिधसूचना

सं. का. आ. 339(अ) (िजसे िदनांक 1 मई, 2017 की अिधसूचना सं. का. आ. 1371(अ) के तहत आंिशक संशोधन

िकया गया था) के तहत उक् त न् यायालय की अ ध् यक्षता हेतु न् यायाधीश के तौर पर िनयुक् त िकया गया था, का

स् थानांतरण हो गया है;

अत: अब, केन् ᮤीय सरकार, उक् त अिधिनयम की धारा-11 की उप-धारा (3) के अंतगर्त ᮧदत् त की गई

शिᲦयᲂ का ᮧयोग करते हुए तथा िदनांक 2 फरवरी, 2017 की अिधसूचना संख् या का. आ. 339(अ) एवं िदनांक

1 मई, 2017 के का. आ. 1371(अ) का अिधᮓमण करते हुए, िसवाय उन कायᲄ के िजन् हᱶ ऐसे अिधᮓमण के पूवर्

सम् पािदत कर िलया गया था अथवा करने से लोप कर िदया गया था, बᱶगलुरु, कनार्टक उच् च न् यायालय के माननीय

मुख् य न् यायाधीश की िसफािरश पर ᮰ी िस᳍ािलंगा ᮧभु, XLIV अपर िसटी एवं सᮢ न् यायाधीश, बᱶगलुरु िसटी को

एतद᳇ारा, उक् त िवशेष न् यायालय की अध् यक्षता हेतु न् यायाधीश के तौर पर िनयुक् त करती है।

NOTIFICATION

New Delhi, the 28th June, 2017

S.O. 2033(E).—Whereas in exercise of the powers conferred by sub-section (6) of section 11 of the

National Investigation Agency Act, 2008 (34 of 2008) (hereinafter referred to as the said Act), the Central

Government had, vide notification number S.O. 78(E), dated the 31^st December, 2012, published in the

Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), notified the Court of XLIX Additional City

Civil & Sessions Judge, Bengaluru City as the Special Court for the purpose of sub-section (1) of section 11

of the said Act having jurisdiction throughout the State of Karnataka for the trial of Scheduled Offences;

And whereas, Shri Mahavarkar Gulzarlal, LI Additional City Civil and Sessions Judge, Bengaluru

City, who was appointed as Judge to preside over the said Special Court vide notification number S.O. 339(E),

dated the 2^nd February, 2017 (which was slightly amended vide notification number S.O. 1371(E), dated the

1^st May, 2017), published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), has been

transferred;

Now, therefore, in exercise of the powers conferred by Sub-section (3) of Section 11 of the said Act

and in supersession of the notifications number S.O. 339(E), dated the 2^nd February, 2017 and S.O. 1371(E),

dated the 1^st May, 2017 and except as respects things done or omitted to be done before such supersession, the

Central Government, on the recommendation of the Hon’ble Chief Justice of the High Court of Karnataka,

Bengaluru City, hereby appoints Sri Siddalinga Prabhu, XLIV Additional City Civil and Sessions Judge,

Bengaluru City as the Judge to preside over the said Special Court.
