तकनीक.—भाडागारण (िवकास और िविनयमन) अिधिनयम, 2007 (2007 का 37) क

धारा 35 क उप-धारा (2) के खंड (ज) एवं (त) और भाडागारण (िवकास और िविनयमन) भाडागार पंजीकरण िनयम, 2017 के

िनयम 19 के उप-िनयम (1) ारा द शिय का योग करते ए भाडागारण िवकास एवं िविनयामक ािधकरण (िजसे यहाँ इसके

बाद ािधकरण कहा गया है) एतद ारा ािधकरण के साथ भाडागार के पंजीकरण के िलए आवयक ितभूित जमा हेतु िन िलिखत

#$या अिधसूिचत करता है :

भाडागारण िवकास एवं िविनयामक ािधकरण (ड%लूडीआरए) के साथ भाडागार(र) के पंजीकरण का अनुरोध करने वाले

आवेदक भाडागार/भाडागार सेवा दाता (ड%लूएसपी) ारा, पंजीकरण माणप( जारी #कए जाने से पूव) ािधकरण को ितभूित

जमा *तुत करनी होगी। इस संबंध म0 ािधकरण से सूचना जारी होने के 21 काय) #दवस के भीतर ितभूित जमा *तुत करनी होगी।

य#द आवेदक उपयु)ानुसार िन4द5 अविध के भीतर ितभूित जमा *तुत करने म0 िवफल रहता है तो, आवेदन को िनर*त

माना जाएगा बशत6 ािधकरण संतु5 हो जाए #क आवेदक ारा 21 काय) #दवस क उ अविध के भीतर ितभूित जमा *तुत न करने

हेतु पया)7 कारण मौजूद था | उस ि*थित म0 आवेदक को ािधकरण के िनण)यानुसार िव*ता9रत अविध के भीतर ितभूित जमा *तुत

करने क अनुमित होगी |

य#द आवेदक नीचे िन4द5 ा<प और तरीके से ितभूित जमा *तुत करता है तो, ािधकरण भाडागारण (िवकास और

िविनयमन) भाडागार पंजीकरण िनयम, 2017 क चौथी अनुसूची म0 िन4द5 ा<प म0 5 काय) #दवस के भीतर आवेदक को भाडागार के

संबंध म0 पंजीकरण माणप( जारी करेगा।

आवेदक या भाडागारपाल ारा *तुत क जाने वाली ितभूित जमा क रािश तथा तरीके का %यौरा िन वत है:

(i)

भाडागारपाल भाडागार के पंजीकरण क अविध के दौरान ािधकरण ारा धा9रत ितभूित जमा को बनाए रखेगा।

ितभूित जमा का मू>य नीचे दी गई तािलका म0 उि>लिखत कॉलम क, ख तथा ग क कुल रािश होगी (यहां भाडागारपाल के सभी

पंजीकृत भाडागार हेतु िपछली ितमाही म0 ज़ारी कुल पर$ा?य भाडागार रसीद का उ@तम मू>य ‘टी’ के <प म0 संदAभत #कया गया

(ii)

ितभूित जमा Cयेक ितमाही के अंत म0 अDतन कर इसे ािधकरण को *तुत #कया जाएगा िजसक ािधकरण ारा िविधवत

पावती दी जाएगी।

(iii)

ािधकरण अपने िववेकानुसार भाडागारपाल ारा पहले से जमा ितभूित को वत)मान ितभूित जमा के <प म0 *तुत क

जाने वाली अपेिEत रािश के िवBF समायोिजत कर सकता है।

(iv)

जहां आवेदक/भाडागारपाल कोई #कसान उCपादक संगठन या कोई सहका9रता है, तो कुल ितभूित जमा 50,000 Bपए

(िनधा)9रत) ित भाडागार होगी।

(v)

ितभूित जमा पंजीकरण क समाि7 से 6 माह तक पहली अनुसूची म0 #दए गए ा<प के अनुसार ड%लूडीआरए के पE म0 बGक

साविध जमा या बGक गारंटी के <प म0 होगी।

(vi)

ािधकरण संसद के #कसी अिधिनयम या #कसी राHय िवधानसभा के अंतग)त बनाए गए िनकाय को दूसरी अनुसूची म0 #दए गए

ा<प के अनुसार ितभूित जमा के <प म0 अपेिEत रािश हेतु एक EितपूAत बंधप( उपल%ध करवाने क अनुमित दे सकता है।

(vii)

ािधकरण ारा EितपूAत बंधप( *तुत करने के िलए अनुमित ा7 कोई िनकाय पंजीकरण हेतु अपने आवेदन के साथ ऐसे

EितपूAत बंधप( को *तुत करने के िलए अपने िनदेशक मंडल से एक संक>प *तुत करेगा।

(viii)

ितभूित जमा को भाडागार के पंजीकरण क समाि7, िनर*तीकरण अथवा अIयप)ण के पJात 6 माह तक अथवा ितभूित

जमा के ित Cयेक दावे क संतुि5 होने तक, जो भी बाद म0 ह, जारी नहK #कया जाएगा।

(ix)

ािधकरण #कसी भडागार क ितभूित जमा वापस करेगा, य#द:

क. भाडागार के पंजीकरण के नवीकरण हेतु #कसी आवेदन को िनर*त कर #दया गया है और य#द ािधकरण इससे संतु5 है #क

भाडागारपाल ने अपने दाियCव को इन िनयम के अनुसार िनLपा#दत #कया है;

ख. कोई भाडागारपाल अपने पंजीकरण माणप( का अIयप)ण करता है और ािधकरण ऐसे अIयप)ण को *वीकार कर लेता

है; अथवा

ग. #कसी भाडागार के पंजीकरण के माणप( को िनर*त कर #दया गया है और ािधकरण इससे संतु5 है #क भाडागारपाल

ने अपने दाियCव का िनव)हन इन िनयम के अनुसार #कया है।

(x)

उपयु) (1) तथा (2) म0 िन4द5 #कए अनुसार ितभूित जमा के ऐसे #कसी संशोधन के बावजूद, य#द कोई है, भाडागारपाल

उMह0 जारी पर$ा?य भाडागार रसीद क वैध अविध म0 जमाकता)N को देय भार म0 वृिF नहK करेगा।

हम ड%लूडीआरए को इस कार मांग क गई कोई भी रािश अदा करने का वचन देते हG, बावजूद इसके #क भाडागारपाल ने

#कसी Mयायालय अथवा अिभकरण के समE तCसंबंधी #कसी वाद या काय)वाही म0 #कसी िववाद अथवा िववाद को उठाया आ है, इसके

अंतग)त हमारी देयता पूण) तथा *प5 है। इस बंधप( के अंतग)त हमारे ारा #कया गया भुगतान अथवा तCसंबंधी भुगतान हेतु देयता के

िलए एक वैध िनव)हन होगा और ऐसा भुगतान करने पर भाडागारपाल का हमारे ित कोई दावा नहK होगा।

ड%लूडीआरए क ओर से कोई रोक, कृCय या चूक अथवा भाडागारपाल के साथ ड%लूडीआरए के #कसी कृCय म0 शािमल होने अथवा #कसी

भी अMय मामले या घटना से, िजसके अंतग)त जमानत देने वाल से संबंिधत कानून का भाव हम0 मु करेगा, बशत6 यह ावधान न हो।

यह गारंटी बGक या भाडागारपाल के गठन म0 प9रवत)न के कारण िनर*त नहK होगी।

उZेय से क गई है। पर$ा?य रसीद को जारी करके #कसी भाडगार के रखरखाव के Tवसाय को ारंभ करने या जारी रखने के इ[छुक

Cयेक Tि को पंजीकृत होना अपेिEत होता है और इस योजन हेतु "अिधिनयम, 2007 " के अंतग)त ड%लूडीआरए (ािधकरण) को

आवेदन #दया जाना होता है।

अपने भाडागार का पंजीकरण करवाने के इ[छुक Cयेक आवेदक/भाडागार सेवा दाता (ड%>यूएसपी) से ािधकरण से

सूचना ा7 होने के 21 #दवस के भीतर ािधकरण को ितभूित जमा *तुत करना अपेिEत होगा।

ग)

भाडागारपाल ारा ितभूित जमा (ड%लूडीआरए के पE म0 बGक गारंटी के <प म0) के <प म0 जमा करवाई जाने और पंजीकरण

घ) ािधकरण अपने िववेकानुसार भाडागारपाल ारा पहले से जमा ितभूित को वत)मान ितभूित जमा के <प म0 *तुत क जाने

वाली अपेिEत रािश के िवBF समायोिजत कर सकता है। ितभूित जमा को भाडागार के पंजीकरण क समाि7, िनर*तीकरण अथवा

अIयप)ण के 6 माह बाद तक अथवा Cयेक दावे क संतुि5 तक, जो भी बाद म0 ह, जारी नहK #कया जाएगा। ािधकरण के पास ितभूित

जमा क रािश को संशोिधत करने का अिधकार सुरिEत है।

ङ) चूं#क ािधकरण संसद के #कसी अिधिनयम या #कसी राHय िवधानसभा के अंतग)त बनाए गए िनकाय को जो भाडागार के रखरखाव

और पर$ा?य भाडागार रसीद को जारी करने का Tवसाय कर रहा है, ितभूित जमा के <प म0 अपेिEत रािश हेतु एक EितपूAत बंधप(

*तुत करने क अनुमित दे सकता है और ािधकरण ारा EितपूAत बंधप( *तुत करने के िलए अनुमेय #कया गया ऐसा कोई िनकाय

पंजीकरण हेतु अपने आवेदन के साथ ऐसे EितपूAत बंधप( को *तुत करने के िलए अपने िनदेशक मंडल का एक संक>प *तुत करेगा।

अतः अब __________________ अिधिनयम के तहत *थािपत मैसस) _____________________ (िनकाय का नाम), इस EितपूAत

बंधप( क नीचे दी गई शतS के अनुसार उ पैरा "ग" के अंतग)त िविहत सीमाN क सीमा तक क रािश, चाहे कुछ भी हो, हेतु हर समय

ािधकरण अथा)त ड%>यूडीआरए को सभी कारवाई, वाद, काय)वाही, लेखे, दावे तथा मांग, जो कोई भी हो, के ित बचाने, बचाव करने

तथा EितपूAत करने के िलए सहमत होता है तथा इसके िलए वचन देता है #क :-

1) ािधकरण के िनयम तथा िविनयम के अंतग)त उसक ओर से िनLपा#दत क जाने वाली सभी बा_यताN का अनुपालन करेगा।

2) पंजीकरण क समाि7, िनर*तीकरण अथवा अIयप)ण के पJात 6 माह तक अथवा ितभूित जमा के ित Cयेक दावे क संतुि5

होने तक, जो भी बाद म0 ह, ािधकरण को EितपूAत करने (उ पैरा "ग" म0 तािलका म0 उि>लिखत रािश हेतु) का वचन देता

है।

3) #कसी भाडागार के संबंध म0 EितपूAत बंधप( के अंतग)त अपने दाियCव से मु तब माना जाएगा, य#द -

क. भाडागार के पंजीकरण के नवीकरण हेतु #कसी आवेदन को िनर*त कर #दया गया है और य#द ािधकरण इससे संतु5 है

#क भाडागारपाल ने अपनी दाियCव को इन िनयम के अनुसार िनLपा#दत #कया है;

ख. य#द भाडागारपाल अपने पंजीकरण माणप( का अIयप)ण करता है और ािधकरण ऐसे अIयप)ण को *वीकार कर लेता

है; अथवा

ग. य#द #कसी भाडागार के पंजीकरण के माणप( को िनर*त कर #दया गया है और ािधकरण इससे संतु5 है #क

भाडागारपाल ने अपने दाियCव का िनव)हन इन िनयम के अनुसार #कया है।

4) िनकाय, पर$ा?य भाडागार रसीद क अविध के भीतर जमाकता)N ारा देय दर म0 वृिF न करने का वचन देता है।

िनकाय एत`ारा सहमत है #क ािधकरण को होने वाली हािन/ Eित (उ पैरा "ग" क सीमा तक) क उसके ारा EितपूAत क

जाएगी।

Requirement of Security Deposit for registration of warehouse (s) with the Warehousing Development and

Regulatory Authority

No. WDRA/2017/1-1(1)/Tech.—In exercise of the powers conferred by clauses (h) and (p) of sub-section (2)

of section 35 of the Warehousing (Development and Regulation) Act, 2007 (37 of 2007) and sub rule (1) of rule 19 of

the Warehousing (Development and Regulation) Registration of Warehouses Rules, 2017, the Warehousing

Development and Regulatory Authority (hereinafter referred as the Authority), hereby notifies the following procedure

for requirement of Security Deposit for registration of warehouses with the Authority:

The applicant warehouse/ Warehouse Service Provider (WSP) seeking registration of their warehouse(s) with

the Warehousing Development and Regulatory Authority (WDRA) shall submit a Security Deposit to the Authority

before issue of a registration certificate. The Security Deposit shall be required to be submitted within 21 working days

after issue of a communication by the Authority to this effect.

If the applicant fails to submit the Security Deposit within the period specified as above, the application shall

be deemed to have been rejected, provided that the Authority may, if it is satisfied that the applicant was prevented by

sufficient cause from submitting the security deposit within the said period of twenty-one working days, allow it to

submit the security deposit within such extended time as may be decided by the Authority.

If the applicant submits the Security Deposit in the form and manner specified below, the Authority shall issue

a certificate of registration to the applicant in respect of the warehouse to the applicant within five working days in the

form specified in the Fourth Schedule of the Warehousing (Development and Regulation) Registration of Warehouses

Rules, 2017.

Details of the amount and manner of Security Deposit to be furnished by the applicant or the warehouseman

are given as under:

The warehouseman shall maintain a Security Deposit to be held by the Authority during period of registration

of the warehouse. Value of the Security Deposit shall be a sum total of columns A, B & C mentioned in the table given

below (here the highest value of total outstanding negotiable warehouse receipts over the preceding quarter for all the

registered warehouses of the warehouseman is referred as T):

ii.

The Security Deposit shall be updated at the end of each quarter and submitted to the Authority which shall be

duly acknowledged.

iii.

The Authority may, at its discretion, adjust the Security Deposit already furnished by the warehouseman

against the amount required to be furnished as Security Deposit.

iv.

Where the applicant/ warehouseman is a Farmer Producer Organisation or a Co-operative, the total Security

Deposit would be Rs. 50,000 (fixed) per warehouse.

The Security Deposit shall be in the form of Bank Fixed Deposits or in form of Bank Guarantee, favouring

WDRA as per the format given in First Schedule for a period of six months beyond the expiry of Registration.

vi.

The Authority may allow any entity created under an Act of Parliament or of State legislature to provide, an

Indemnity Bond for the amount required as Security Deposit, as per format given in the Second Schedule.

vii.

An entity allowed by the Authority to submit an Indemnity Bond shall submit, along with its application for

registration, a resolution from its Board of Directors authorising to furnish of such Indemnity Bond.

viii.

The Security Deposit shall not be released until six months after expiry, cancellation or surrender of the

registration of the warehouse or until after satisfaction of every claim against the Security Deposit, whichever is later.

ix.

The Authority shall refund the security deposit in respect of a warehouse, if –

an application for renewal of registration of the warehouse has been rejected and if the Authority is satisfied

that the warehouseman has discharged his obligations as per the requirements of these rules;

b. a warehouseman surrenders his certificate of registration, and the Authority accepts such surrender; or

the certificate of registration of a warehouse is cancelled, and the Authority is satisfied that the warehouseman

has discharged his obligations as per the requirements of these rules.

Notwithstanding such revision of the Security Deposit as specified at (i) & (ii) above, if any, the

warehouseman shall not increase the charges payable by the depositors within the period validity of negotiable

warehouse receipts issued to them.

administrators and executors) and having considered granting/ granted registration of the warehouses (as per list

Warehouseman” which expression unless repugnant to the content or meaning thereof, shall include all the successors,

administrators, and executors).

2. WHEREAS the Warehouseman having unequivocally accepted to conduct business of warehousing as per terms and

conditions given in the Warehousing (Development and Regulation) Registration of Warehouses Rules, 2017

(hereinafter referred as the Rules) and having agreed to furnish to WDRA a Security Deposit in the form of a Bank

Guarantee for Rs......... (Rupees................ only) for the faithful performance of the entire registration with the WDRA,

under this guarantee without any demur merely on a demand from the WDRA stating that the amount claimed is due by

way of loss or damage caused to or suffered by the holder of the negotiable warehouse receipt due to breach by the

on the bank shall be conclusive as regards the amount due and payable by the Bank under this guarantee. However, our

warehouseman in any suit or proceeding pending before any court or Tribunal relating thereto, our liability under this

liability for payment thereunder and the warehouseman shall have no claim against us for making such payment.

warehouseman and to forbear or enforce any of the terms and conditions relating to the said Agreement and we shall

not be relieved from our liability under terms and conditions relating to the said Agreement and we shall not be relieved

from our liability by reason of any such variation, or extension being granted to the warehouseman or for any

forbearance, act or omission on the part of the WDRA or any indulgence by the WDRA to the warehouseman or by any

such matter or thing whatsoever which under the law relating to sureties would, but for this provision, have effect of so

relieving us.

6. This guarantee will not be discharged due to the change in the constitution of the Bank or the warehouseman

INDEMNITY BOND

This indemnity is executed by deed on the day of ________ 201 by _________________

________________________________ (an entity created under the Act of the Parliament or of the State Legislative)

here in after called “ENTITY” in favour of the Warehousing Development and Regulatory Authority (WDRA) here in

after called “AUTHORITY”

WHEREAS:

The Warehousing Development and Regulatory Authority (hereinafter referred as Authority) is established

under the Warehousing (Development and Regulation) Act, 2007 (Act, 2007) with the objective to regulate

and ensure implementation of the provisions of Act, 2007 for development of warehouses, regulations of

negotiability of Warehouse Receipts and promote orderly growth of warehousing business. Every person

desirous of commencing or carrying business of maintaining a warehouse issuing negotiable warehouse

receipts is required to be registered and for that purpose an application has to be made to the Authority under

the Act, 2007.

Every applicant warehouse/Warehouse Service Provider (WSP) seeking registration of their warehouse shall

be required to submit security deposit to the Authority within 21 days of the communication by the

Authority.

claim against security deposit whichever is later. The Authority reserves its rights to revise the amount of

security deposit.

As the Authority may allow any entity created under an Act of the Parliament or State Legislative and

carrying business of maintaining warehouse (s) and issuing Negotiable Warehouse Receipt, to submit

Indemnity Bond in lieu of security deposit and the Entity allowed by the Authority to submit an Indemnity

Bond shall submit, along with its application for registration, a resolution from its Board of Directors

authorising the furnishing of such Indemnity Bond.

Act, agrees and undertakes at all times to save, defend, and indemnify and keep indemnified the Authority from and

against all actions ,suits, proceedings, accounts, claims and demands whatsoever for an amount to the extent of limits to
