सा.का.गन. 842(अ).—केन्द रीय सरकार, भारतीय िूरसंचार गिगनयामक प्रागिकरण अगिगनयम, 1997 की िारा 35 की उप
िारा (2) के खंड (ख,ि) द्वारा प्रित् त शग तयों का प्रयोि करते हुए और िूरसंचार गििाि समािान और अपील अगिकरण, समूह ‘ि
‘और समूह ‘ घ ‘ पि भती गनयम, 2003 को उन बातों के गसिाए अगिक्ांत करते हुए गजन्द हें ऐसे अगिक्मण से पहले दकया िया है या
करने का लोप दकया िया है, िूरसंचार गििाि समािान और अपील अगिकरण के समूह ‘ ि ’ पिों पर भती की पद्धगत का गिगनयमन
करने के गलए गनम् नगलगखत गनयम बनाती हैं, अर्ाात:-
1. संगिप् त नाम और प्रारंभ: (1) इन गनयमों का संगिप् त नाम िूरसंचार गििाि समािान और अपील अगिकरण समूह “ि” पि भती
गनयम, 2017 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रिृत् त होंिे ।
2. लािू होना-ये गनयम इन गनयमों से उपाबद्ध अनुसूची के स् तंभ (।) में गिगनर्िाष् ट पिों को लािू होंिे ।
3.
पि-संख् या, ििीकरण, और िेतन मैट्रि स में स् तर: - पि की संख् या, उसका ििीकरण और िेतन मैट्रि स में स् तर िह होिा, जो
इन गनयमों से उपाबद्ध अनुसूची के स् तंभ (2) से स् तंभ (4) में गिगनर्िाष् ट हैं ।
4. गनयुग त- उ त अनुसूची में गिगनर्िाष् ट पिों के संबंि में गनयुग त प्रागिकारी रगजस् िार, िूरसंचार गििाि समािान अपील
अगिकरण होंिे ।
5.
भती की पद्धगत, आयु-सीमा, अहाताएं आदि - भती की पद्धगत, आयु-सीमा, अहाताएं और उससे संबंगित अन्द य बातें िह होंिी
जो उ त/पूिोक त अनुसूची के स् तंभ (5) से (13) में गिगनर्िाष् ट हैं ।
6.
गनहाताएं- िह व् यग त--
(क) गजसने ऐसे व् यग त से, गजसका पगत या गजसकी पत् नी जीगित है, गििाह दकया है, या गििाह की संगििा की है; या
(ख) गजसने अपने पगत या अपनी पत् नी के जीगित रहते हुए दकसी व् यग त से गििाह दकया है या गििाह की संगििा की है ।

उ त पि पर गनयुग त का पात्र नहीं होिा :
परंतु यदि केन्द रीय सरकार का यह समािान हो जाता है दक ऐसा गििाह उस व् यग त और गििाह के अन्द य पिकार को लािू
स् िीय गिगि के अिीन अनुज्ञेय है और ऐसा करने के गलए अन्द य आिार हैं तो िह दकसी व् यग त को इस गनयम के प्रितान से छूट िे
सकेिी ।

गशगर्ल करने की शग त- जहां केन्द रीय सरकार की यह राय है दक ऐसा करना आिश् यक या समीचीन है, िहां िह उसके गलए
जो कारण हैं, उन्द हें लेखबद्ध करके, इन गनयमों के दकसी उपबंि को दकसी ििा या प्रििा के व् यग तयों की बाबत, आिेश द्वारा गशगर्ल कर
सकेिी ।

व् यािृगत् त- इन गनयमों की कोई बात, ऐसे आरिण, आयु सीमा में छूट और अन्द य ट्ररयायतों पर प्रभाि नहीं डालेिी, गजनका
केन्द रीय सरकार द्वारा इस संबंि में समय-समय पर जारी दकए िए आिेशों के अनुसार अनुसूगचत जागतयों, अनुसूगचत जनजागतयों, अन्द य
गपछडे ििों, भूतपूिा सैगनकों और अन्द य गिशेष प्रििा के व् यग तयों के गलए उपबंि करना अपेगित है ।

प्रगतगनयुग त के आिार पर भरी जा सकेिी ।
प्रोन्द नगत या प्रगतगनयुग त या आमेलन द्वारा भती की िशा में िे श्रेगणयां गजनसे प्रोन्द नगत या प्रगतगनयुग त या आमेलन दकया जाएिा ।

प्रगतगनयुग त पर:- केन्द रीय सरकार या राज् य सरकारों, न्द यायलयों, अगिकरण, पगब् लक से टर उपक्म और स् िायत् त गनकाय से पििारी-
क. (।) मूल संििा या गिभाि में गनयगमत आिार पर सिृश पि िारण कर रहे हों, या
(।।) मूल संििा या गिभाि में गनयगमत आिार पर इसकी गनयुक गत के पश चात िेतन मैट्रिक स (19900-56900 रु.) में
स तर-2 में आठ िषा गनयगमत सेिा की हो, और
ख. स तंभ (7) के अिीन सीिी भती के गलए शैगिक अहाताएं अनुभि रखते हों ।
यदि गिभािीय प्रोन्द नगत सगमगत है, तो उसकी संरचना
भती करने में दकन पट्ररगस् र्गतयों में
संघ लोक सेिा आयोि से परामशा
दकया जाएिा।

प्रोन्द नगत:- ऐसा अिर श्रेणी गलगपक या रोकगडया गजसने श्रेणी में आठ िषा गनयगमत सेिा की हो ।
ट्रटप् पण-1 : जहां ऐसे कगनष् ठ व् यग तयों के संबंि में, गजन्द होंने अपनी अहाक/पात्रता सेिा पूरी कर ली है, प्रोन्द नगत के गलए गिचार दकया
जा रहा हो, िहां उनके ज् येष् ठ व् यग तयों के संबंि में भी गिचार दकया जाएिा परंतु यह तब जब दक उसके द्वारा की िई ऐसी
अहाक/पात्रता सेिा, अपेगित अहाक/पात्रता सेिा के आिे से अगिक से या िो िषा से, इनमें से जो भी कम हो, कम न हो और उन्द होंने अपने
ऐसे कगनष् ठ व् यग तयों सगहत , गजन्द होने ऐसी अहाक/पात्रता सेिा पहले ही पूरी कर ली है, अिली उच् चतर श्रेणी में प्रोन्द नगत के गलए
अपनी पट्ररिीिा की अिगि सफलतापूिाक पूरी कर ली हो ।
ट्रटप् पण-2 : प्रोन्द नगत के गलए न्द यूनतम अहाक सेिा की संिणना करने के प्रयोजन के गलए दकसी अगिकारी द्वारा, 01 जनिरी, 2016 से
पहले या उस तारीख से गजससे सातिें केंरीय िेतन आयोि की गसफाट्ररशों पर आिाट्ररत पुनरीगित िेतन संरचना का गिस् तार दकया
िया है, िेतन आयोि की गसफाट्ररशों पर आिाट्ररत गिस् ताट्ररत तत् स् र्ानी ग्रेड िेतन या िेतनमान पर की िई सेिा समझी जाएिी ।
प्रगतगनयुग त: केन्द रीय सरकार या राज् य सरकार, पगब् लक से टर उपक्मों, स् िायत् त गनकायों, न्द यायालयों या अगिकरणों के अगिकारी-
क)
(।) मूल संििा या गिभाि में गनयगमत आिार पर सिृश पि िारण कर रहे हों, या
(।।) मूल संििा या गिभाि में िेतन मैट्रि स में (19,900-63200 रू.) में स् तर -2 में आठ िषा गनयगमत सेिा में गनयगमत सेिा
की हो और पहले ही िेतन मैट्रि स में स् तर-2 (19900-63200 रू.) हो, 12िीं किा अिश् य उत् तीणा करना चागहए ।
ख)
(।) मान्द यता प्राप् त बोडा या गिश् िगिद्यालय से अहाता 12 िीं किा उतीणा या समतुल् य ।
(।।) अंग्रेजी में प्रगत गमनट 35 शब् िों की िगत में टंकण या कम् प् यूटर पर हहंिी में प्रगत गमनट 30 शब् ि
(औसत 5 कुंजी िबाि पर 10500 के डी पी एच / 9000 के डी पी एच के गलए तत्स् र्ानी प्रगत गमनट 35 शब् ि और 30 शब् ि
प्रगतगमनट)
पोषक प्रििा के ऐसे गिभािीय अगिकारी, जो प्रोन्द नगत की सीिी पंग त में है, प्रगतगनयुग त पर गनयुग त के गलए गिचार दकए जाने
के पात्र नहीं होंिे । इसी प्रकार प्रगतगनयुग त व् यग त प्रोन्द नगत द्वारा गनयुग त के गलए गिचार दकए जाने के पात्र नहीं होंिे ।
प्रगतगनयुग त की अिगि, गजसके अंतिात केन्द रीय सरकार के उसी या दकसी अन्द य संिठन या गिभाि में इस गनयुग त से ठीक पहले
िाट्ररत दकसी अन्द य काडर बाह्य पि पर प्रगतगनयुग त की अिगि है सािारणतया 3 िषा से अगिक नहीं होिी ।
प्रगतगनयुग त द्वारा गनयुग त के गलए अगिकतम आयु सीमा आिेिन प्राप् त करने की अंगतम तारीख को 56 िषा से अगिक नहीं होिी ।
प्रगतगनयुग त के आिार पर गनयुग त के प्रयोजन के गलए दकसी अगिकारी द्वारा, 01 जनिरी, 2016 से पहले या उस तारीख से
गजससे छठिें केन्द रीय िेतन आयोि की गसफाट्ररशों पर आिाट्ररत पुनरीगित िेतन संरचना का गिस् तार दकया िया है, गनयगमत
आिार पर की िई सेिा को, उ त िेतन आयोि की गसफाट्ररशों पर आिाट्ररत गिस् ताट्ररत तत् स् र्ानी िेतन मैट्रि स में स् तर में की िई
सेिा समझी जाएिी, गसिाय उस िशा के, जहां एक से अगिक पूिा पुनरीगित ग्रेड िेतन या िेतनमान के स् तर में गिलय हो िया है
और िहां यह लाभ केिल उन पिों पर गिस् ताट्ररत होिा गजसके गलए ग्रेड िेतन या िेतनमान गबना दकसी उन्द नयन का सािारण
प्रगतस् र्ापन ग्रेड है ।

NOTIFICATION
New Delhi, the 5th July, 2017
G.S.R. 842(E).—In exercise of the powers conferred by clause (dc) of sub-section (2) of section 35 of the
Telecom Regulatory Authority of India Act, 1997 (24 of 1997) and in supersession of the Telecom Disputes
Settlement and Appellate Tribunal Group ‘C’ and Group ‘D’ Posts Recruitment Rules, 2003, except as respects things
done or omitted to be done before such supersession, the Central Government hereby makes the following rules
regulating the method of recruitment to Group ‘C’ posts in the Telecom Disputes Settlement and Appellate Tribunal,
namely:-
1.
Short title and commencement. — (1) These rules may be called the Telecom Disputes Settlement and
Appellate Tribunal Group ‘C’ posts Recruitment Rules, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2.
Application. — These rules shall apply to the posts specified in column (1) of the Schedule annexed to these
rules.
3.
Number of post, classification and the level in pay matrix. —The number of the posts, their classification
and the level in pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
4.
Appointment. — The appointing authority in respect of posts specified in the said schedule shall be the
Registrar, Telecom Disputes Settlement and Appellate Tribunal.
5.
Method of recruitment, age-limit, qualifications, etc. — The method of recruitment to the said post, age-
limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said
Schedule.
6.
Disqualification. — No person,–
(a)
who has entered into or contracted a marriage with a person having a spouse living, or
(b)
who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal
law applicable to such person and the other party to the marriage and that there are other grounds for so
doing, exempt any person from the operation of this rule.
7.
Power to relax . —Where the Central Government is of the opinion that it is necessary or expedient so to do,
it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with
respect to any class or category of persons.
8.
Saving. —Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions
required to be provided for the Schedules Castes, the Scheduled Tribes, Other Backward Classes, ex-
Servicemen and other special categories of persons, in accordance with the orders issued by the Central
Government from time to time in this regard.

Telecom Disputes Settlement and Appellate Tribunal who
possess a valid Driving Licence of Motor Cars on the
basis of a Driving Test to assess the competence to drive
motor cars failing which from amongst officials holding
the post of Dispatch Rider on regular basis or regular
Group ‘C’ employees in Level 1 in the pay matrix (Rs.
18000-56900) in other offices of the Central Government
or State Government or Supreme Court or High Court or
Tribunals who fulfill the necessary qualification as
mentioned in column (7).
Re-employment for Armed Forces Personnel:
The Armed Forces Personnel due to retire or who are to
be transferred to reserve within a period of one year and
having the requisite experience and qualifications
prescribed shall also be considered. Such persons would
be given deputation terms upto the date on which they are
due for release from the Armed Forces and thereafter they
may be continued on re-employment.
Note: The period of deputation including the period of
deputation in another ex-cadre post held immediately
preceding this appointment in the same or some other
organization and department of the Central Government
shall ordinarily not exceed three years. The maximum age
limit for appointment by deputation shall be ‘Not
exceeding 56 years’ as on the closing date of receipt of
applications.
