(अ).— के᭠ᮤीय सरकार ने पेᮝोिलयम और खिनज पाईपलाईन (भूिम मᱶ उपयोग के अिधकार का

अजᭅन) अिधिनयम 1962 (1962 का 50) (िजसे इसमᱶ इसके प᳟ात उᲦ अिधिनयम कहा गया है) कᳱ धारा 3 कᳱ

उपधारा (1) के अधीन जारी कᳱ गई भारत सरकार के पेᮝोिलयम और ᮧाकृितक गैस मंᮢालय कᳱ अिधसूचना सं᭎या

का.आ. 242(अ) तारीख 22 जनवरी 2015, जो भारत के राजपᮢ तारीख 27 जनवरी 2015, मᱶ ᮧकािशत कᳱ गई

थी ᳇ारा उस अिधसूचना से संलᲨ अनुसूची मᱶ िविनᳰदॅ᳥ भूिम मᱶ उᱫर ᮧदेश रा᭔य मᱶ भारतीय रेलवे के डी.एफ.सी.

के िलये बी.के.पी.एल. कᳱ मुगलसराय और कानपुर के बीच खंड िशᳲ᭢टग हेतु ᭃेᮢ-एफ (ᮧ᭭थािपत पाइपलाइन

चैनेज 414.423 से 420.376 तक िजला इलाहाबाद) मᱶ पेᮝोिलयम पᳯरवहन के िलए इंिडयन ऑयल कॉपᲃरेशन

िलिमटेड ᳇ारा पाइपलाइन िबछाने के ᮧयोजन के िलए उपयोग के अिधकारs के अजᭅन के अपने आशय कᳱ घोषणा

कᳱ थी;

और उᲦ राजपᮢ अिधसूचना कᳱ ᮧितयां जनता को तारीख 20 फरवरी 2015 तक उपल᭣ध करा दी गई

थी ;

और सᭃम ᮧािधकारी ने उᲦ अिधिनयम कᳱ धारा 6 कᳱ उपधारा (1) के अधीन के᭠ᮤीय सरकार को ᳯरपोटᭅ

दे दी है ;

ओर के᭠ᮤीय सरकार ने, उᲦ ᳯरपोटᭅ पर िवचार करने के प᳟ात और यह समाधान हो जाने पर ᳰक उᲦ भूिम

पाइपलाइन िबछाने के िलए अपेिᭃत है, उसमᱶ उपयोग के अिधकार का अजᭅन करने का िविन᳟य ᳰकया है ;

अतः अब, के᭠ᮤीय सरकार उᲦ अिधिनयम कᳱ धारा 6 कᳱ उपधारा (1) ᳇ारा ᮧ᭞ᱫ शिᲦयᲂ का ᮧयोग करते

ᱟए यह घोषणा करती है ᳰक इस अिधसूचना से संलᲨ अनुसूची मᱶ िविन᳸द᳥ भूिम मᱶ पाइपलाइन िबछाने के िलए

उपयोग के अिधकार का अजᭅन ᳰकया जाए ;

और के᭠ᮤीय सरकार उᲦ अिधिनयम कᳱ धारा 6 कᳱ उपधारा (4) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए,

यह िनदᱷश देती है ᳰक उᲦ भूिम मᱶ उपयोग का अिधकार इस घोषणा के ᮧकाशन कᳱ तारीख से के᭠ᮤीय सरकार मᱶ

िनिहत होने के बजाए, सभी िव᭨लंगमᲂ से मुᲦ होकर इंिडयन ऑयल कॉपᲃरेशन िलिमटेड मᱶ िनिहत होगी।

पेᮝोिलयम और खिनज पाइपलाइन अिधिनयम, 1962 कᳱ धारा 10 के अधीन ᳰकसी भी ᭃितपूᳶत के िलए

इंिडयन ऑयल कॉपᲃरेशन िलिमटेड पूणᭅतया उᱫरदायी होगी और पाइपलाइन से स᭥बि᭠धत ᳰकसी भी मामले पर

के᭠ᮤीय सरकार के िवᱧ᳍ कोई वाद दावा या कानूनी कायᭅवाही नहᱭ हो सकेगी ।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi, the 3rd July, 2017

S.O. 2165(E).—Whereas by the notification of the Government of India in the Ministry of

Petroleum and Natural Gas S.O. No. 242(E) dated the 22^nd January, 2015, issued under sub-section (1) of

section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of

1962), (hereinafter referred to as the said Act), published in the Gazette of India dated the 27 January, 2015,

the Central Government declared its intention to acquire the right of user in the land specified in the Schedule

appended to that notification for the purpose of laying pipeline for the "Shifting of Barauni-Kanpur pipeline

between Mughalsarai and Kanpur for DFCCIL of Indian Railway in Part-F (from Existing P/L Ch.-414.423

To 420.376 km. in District-Allahabad) by Indian Oil Corporation Limited for the transportation of petroleum

products;

And whereas copies of the said Gazette notification were made available to the public up to

20^th February 2015;

And whereas the competent authority has under sub-section (1) of Section 6 of the said Act submitted

report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the

said land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, the

Central Government hereby declares that the right of user in the land specified in the Schedule appended to

this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, the

Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead

of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil

Corporation Limited, free from all encumbrances.

Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section

10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government

on any matter relating to the pipeline.
