सा.का.िन. 1124(अ).—पेटᱶट अिधिनयम, 1970 कᳱ धारा 159 ᳇ारा ᮧद᭜ त शिᲦयᲂ का उपयोग करते ᱟए पेटᱶट

िनयमावली, 2003 मᱶ और संशोधन हेतु कᱶᮤीय सरकार ᳇ारा ᮧ᭭ तािवत िन᭥ निलिखत ᮧाᱨप िनयमᲂ को उ᭍ त धारा कᳱ उप-

धारा (3) कᳱ यथा अपेᭃा के अनुसार एत᳏ारा संशोधन से संभािवत ᮧभािवत सभी ᭪ यिᲦयᲂ के सूचनाथᭅ ᮧकािशत ᳰकया जाता

है तथा एत᳏ारा यह नोᳯटस ᳰदया जाता है ᳰक उ᭍ त ᮧाᱨप िनयमावली पर, आम जनता के िलए संबंिधत भारत के राजपᮢ

िजसमᱶ, इस अिधसूचना को ᮧकािशत ᳰकया गया है, कᳱ ᮧितयां उपल᭣ ध हो जाने कᳱ तारीख से 30 ᳰदनᲂ कᳱ अविध के बाद,

िवचार ᳰकया जाएगा।

अविध अथवा िविश᭬ ट अविध के समा᭡ त होने से पहले उ᭍ त ᮧाᱨप िनयमᲂ के संबंध मᱶ ᳰकसी ᭪ यिᲦ से ᮧा᭡ त

ᮧाᱨप िनयम

1. (1) इन िनयमᲂ को पेटᱶट (संशोधन) िनयमावली, 2017 कहा जाएगा।

(2) वे सरकारी राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख से ᮧभावी हᲂगे।

2. पेटᱶट िनयमावली, 2003 के िनयम 2 के तहत उप-िनयम(एफबी) (आगे इसे ᮧधान िनयमावली कहा जाएगा) मᱶ

᭭ टाटᭅअप कᳱ पᳯरभाषा िन᭥ नवत ᮧित᭭ थािपत है:—

(i) “᭭ टाटᭅअप” का अथᭅ है

(क) ᭭ टाटᭅअप इंिडया पहल (इिनिशएᳯटव) के अंतगᭅत सᭃम ᮧािधकारी ᳇ारा एक ᭭ टाटᭅअप के ᱨप मᱶ भारत मᱶ

पंजीकृत कोई सं᭭ था;

(ख) िवदेशी सं᭭ था के मामले मᱶ, ᭭ टाटᭅअप इंिडया इिनिशएᳯटव के अनुसार कारोबार तथा िनगमन/पंजीकरण कᳱ

अविध संबंध मानदंडᲂ को पूरा करने वाली तथा इस आशय से संबंिधत घोषणा-पᮢ ᮧ᭭ तुत करने वाली सं᭭ था,

NOTIFICATION

New Delhi, the, 30th August, 2017

G.S.R. 1124(E).—The following draft rules to further amend the Patents Rules 2003 which the Central Government

proposes to make in exercise of the powers conferred by section 159 of the Patent Act, 1970, are hereby published as

required by sub-section (3) of the said section for the information of all persons likely to be affected thereby, and notice

is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from

the date on which copies of the Gazette of India, in which this notification is published, are made available to the public;

Objection or suggestion, if any, may be addressed to the Secretary, Department of Industrial Policy and

Promotion, Ministry of Commerce and Industry, Government of India, Udyog Bhawan, New Delhi-110011 or by e-mail

at [email protected].

The objections and suggestions, which may be received from any person with respect to the said draft rules

before the expiry of the period or specified, shall be considered by the Central Government.

DRAFT RULES

(1) These rules may be called the Patents (Amendment) Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

In Sub rule(fb) under rule 2 of the Patents Rules, 2003 (hereinafter referred to as the principal rules) the

definition of Startup is substituted as,—

(i) “Startup” means

(a)

an entity in India recognised as a startup by the competent authority under Startup India initiative,

(b)

In case of a foreign entity, an entity fulfilling the criteria for turnover and period of incorporation/

registration as per Startup India Initiative and submitting declaration to that effect.

Explanation: In calculating the turnover, reference rates of foreign currency of Reserve Bank of India shall prevail.
