(अ).—जबक संयु रा क सुरा परषद ने संयु रा के चाटर के अयाय VII के अंतगत संकप

2397 (2017) को 22 दस" बर, 2017 को अपनी 8151व$ बैठक (अनुसूची X) म' अंगीकृत कया िजनम' सभी रा+ से

कितपय उपाय करने क अपेा क गई है;

और जबक, क' / सरकार संयु रा के चाटर के अयाय VII के अनु0छेद 41 के अंतगत सुरा परषद 2ारा अंगीकृत उपयु

संकप को कायाि4वत करने के िलए संयु रा (सुरा परषद) अिधिनयम, 1947 (1947 का 43) के अंतगत एक आदेश

जारी करना आव8यक और समीचीन समझती है।

अतः अब, संयु रा (सुरा परषद) अिधिनयम, 1947 (1947 का 43) के खंड 2 2ारा ;द< शिय+ का उपयोग करते

=ए, क' /ीय सरकार का.आ. 1549 (ई), दनांक 15 मई, 2017 के तहत कोरया लोकतांि>क जनवादी गणरा@य के संबंध म'

सुरा परषद संकप काया4वयन आदेश 2017 दनांक 21 अ;ैल, 2017 म' एतGारा आगे िनHिलिखत संशोधन करती है,

नामतः-

(1) इस आदेश को कोरया लोकतांि>क जनवादी गणरा@य (संशोधन) आदेश, 2018 िवषयक सुरा परषद संकप का

काया4वयन कहा जाएगा।

(2) यह आदेश राजप> म' इसे ;कािशत कए जाने क तारीख से लागू होगा।

कोरया लोकतांि>क जनवादी गणरा@य आदेश, 2017 (िजसका इससे आगे उ आदेश के Nप म' उलेख कया गया) के संबंध

म' सुरा परषद संकप के काया4वयन म',-

(1) पैराOाफ 2 म', खंड (क) और उससे संबंिधत ;िविQ को, िनHिलिखत से ;ितRथािपत कया जाएगाः- '(क) "संकप+" से

आशय है संयु रा चाटर के अयाय VII के अंतगत कोरया लोकतांि>क जनवादी गणरा@य से संबंिधत संयु रा सुरा

परषद के संकप, नामतः 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321

(2016), 2356 (2017), 2317 (2017), 2375 (2017) और 2397 (2017)';

3 मममम,-

(i) उप पैराOाफ (घ) को िनHिलिखत से ;ितRथािपत कया जाएगा, नामतः

“(घ) अपने े> म' िRथत ऐसी िनिधय+, अ4य िव<ीय परसंपि<य+ और आVथक संसाधन+, िजनम' सिमित 2ारा नामोदW ट

जलयान शािमल हX, पर तYकाल रोक लगाई जाए जो, ;Yय या परो Nप से, ऐसे Zिय+ या िनकाय+ के RवािमYवाधीन हX

या उनके 2ारा िनयंि>त है िजनका उलेख,

एस/2009/364 के भाग 'क' और भाग 'ग' (इस आदेश का परिशQ III);

संकप 2087 (2013), अनुबंध I और II;

संकप 2094 (2013), अनुबंध I और II;

17 दसंबर, 2016 को सुरा परषद ;ेस िव[ि\ एससी/12636 2ारा यथा संशोिधत संकप 2270 (2016) का

अनुबंध I, II और III (इस आदेश का परिशQ VII);

संकप 2321 (2016), अनुबंध I और II;

संकप 2356 (2017), अनुबंध I और II;

संकप 2371 (2017), अनुबंध I और II म'

संकप 2375 (2017), अनुबंध I और II म'; और

संकप 2397 (2017), अनुबंध I और II म',

अ4य अवैध साधन+ सिहत कोरया लोकतांि>क जनवादी गणरा@य के परमाणु संबंधी Zापक िवनाश और बैिलिRटक िमसाइल

से संबंिधत काय]म+ म' शािमल होने या सहायता करने या उनके िनद^श पर उनक ओर से काय करने वाले िनकाय+ या

Zिय+ के Nप म' कया गया है, और यह सुिनि`त करना क उनके नागरक+ या अ4य Zिय+ या िनकाय+ 2ारा भारत के

भीतर कोई िनिध, िव<ीय परसंपि<यां या आVथक संसाधन ऐसे Zिय+ या िनकाय+ के लाभाथ उपलaध कराने पर रोक

लगे।

1: परसंपि< कलन कोरया लोकतांि>क जनवादी गणरा@य के बाहर ऐसी सभी िनिधय+, अ4य िव<ीय परसंपि<य+

तथा आVथक संसाधन+ के मामले म' लागू होगा जो ;Yय या परो Nप से कोरया लोकतांि>क जनवादी गणरा@य क सरकार

के िनकाय+ अथवा कोरया क वक स पाटb या उनक ओर से या उनके िनद^शानुसार काय करने वाले Zिय+ या िनकाय+ या

उनके RवािमYवाधीन या उनके 2ारा िनयंि>त ऐसे िनकाय+ के RवािमYव या िनयं>ण म' है िजनके बारे म' क' / सरकार यह

िनधारत करती है क वे कोरया लोकतांि>क जनवादी गणरा@य के परमाणु अथवा बैिलिRटक िमसाइल काय]म+ या संकप

के अंतगत ;ितबंिधत अ4य ]याकलाप+ से जुड़े =ए हX।

ऐसे Zिय+ तथा उनके परवार के सदRय+ का भारत म' ;वेश या पारगमन ;ितबंिधत करना िज4ह' कोरया लोकतांि>क

जनवादी गणरा@य के परमाणु, बैिलिRटक िमसाइल और अ4य Zापक िवनाश के आयुध से संबंिधत काय]म क नीितय+ का

समथन करने या उ4ह' बढ़ावा देने के िलए िज"मेवार माना जाता हो, परंतु उपयु कसी बात के आधार पर क'/ सरकार अपने

नागरक+ का अपने भू-भाग म' ;वेश करने से रोकने के िलए बाय नह$ होगी।

#ट%पणीः या>ा ;ितबंध संबंधी ये उपाय संकप 1718 (2006) के पैराOाफ 10 और संकप 2094 (2013) के पैराOाफ 10 म'

दी गई छूट के अयधीन हX;”

(iii). उप पैराOाफ (छ), के Rथान पर िनHिलिखत को ;ितRथािपत कया जाएगा, नामतः

“(छ)

उनके अिधकार े> के अयधीन नागरक+, Zिय+ और उनक सीमा म' या उनके अिधकार े> के अयधीन

समािवQ संRथाf को ऐसे जलयान+ को बीमा या पुनः बीमा सेवाएं उपलaध कराने से रोक लगाएगा, िजनके संबंध म' यह

मानने के िलए उनके पास ताgकक आधार हX क ये जलयान, संकप+ 2ारा िनिषd गितिविधय+ या सामOी के परवहन म'

शािमल थे और उ ;ावधान िबना कसी अपवाद के लागू ह+गे जब तक क सिमित संकप 2397 (2017) के पैराOाफ 11 म'

दए गए उjे8य+ के िलए मामला दर मामला आधार पर अनुमोदन नह$ करती है;”

(iv) उप-पैराOाफ (थ) के िलए िनHिलिखत को ;ितRथािपत कया जाएगा, नामतः

“(थ) कोरया लोकतांि>क जनवादी गणरा@य को ;Yय या अ;Yय आपूVत, िब] या हRतांतरण उसके े>+ 2ारा या उसके

रािक+ 2ारा या उनके झंडे वाले वाहन+ या वायुयान+ का उपयोग करते =ए, और उनके े>+ से ;वृ< होने वाले या नह$ होने

वाले, नए हेलीकॉmटर+ और क4ह$ नए या उपयोग कए गए वाहन+ से, िसवाय इसके िजसे सिमित 2ारा अिOम Nप से

मामला-दर-मामला आधार पर अनुमोदत कया गया है, क रोकथाम करना;”

(v) उप-पैराOाफ (ध) के िलए और उससे संबंिधत ;िविQ के िलए, िनHिलिखत को ;ितRथािपत कया जाएगा, नामतः

“(ध) ऐसे कसी जलयान का पंजीकरण रj करती है िजनके संबंध म' यह मानने के िलए उनके पास ताgकक आधार हX क ये

जलयान, संकप+ 2ारा िनिषd गितिविधय+ या सामOी के परवहन म' शािमल थे और उनके अिधकार े> के अयधीन

नागरक+, Zिय+ और उनक सीमा म' अथवा उनके अिधकार े> के अयधीन समािवQ संRथाf पर इसके बाद ऐसे

जलयान+ को वगbकरण सेवाएं उपलaध कराने से रोक लगाएगा और आगे सिमित 2ारा मामला-दर-मामला आधार पर अिOम

Nप से अनुमोदत मामल+ के िसवाय इस पैराOाफ के अनुसरण म' अ4य सदRय रा 2ारा पंजीकरण रj कए गए जलयान का

पंजीकरण नह$ कर'गे;”

(vi) उप-पैराOाफ (न ट) के िलए िनHिलिखत को ;ितRथािपत कया जाएगा, नामतः

“(नट) कोरया लोकतांि>क जनवादी गणरा@य को उसके े> या उनके नागरक+ 2ारा या उनके झंडे वाले वाहन+, वायुयान+,

पाइपलाइन+, रेल लाइन+ या वाहन+ 2ारा सभी ;कार के रफाइंड पेnोिलयम उYपाद+ क आपूVत, िब] या हRतांतरण और

चाहे इनक या>ा क शुoआत उनके े> से =ई हो या नह$, को ;ितबंिधत करना। यह उपाय संकप 2397 (2017) के

पैराOाफ 5 म' िनधारत क गई सीमाf, अपवाद+ और पdितय+ के अयधीन है;”

(vii) उप-पैराOाफ (न ठ) के िलए िनHिलिखत को ;ितRथािपत कया जाएगा, नामतः

“(नठ) कोरया लोकतांि>क जनवादी गणरा@य को उसके े> या उनके नागरक+ 2ारा या उनके झंडे वाले वाहन+, वायुयान+,

पाइपलाइन+, रेल लाइन+ या वाहन+ 2ारा सभी ;कार के कqे तेल क आपूVत, िब] या हRतांतरण और चाहे इनक या>ा क

शुoआत उनके े> से =ई हो या नह$, को ;ितबंिधत करना बशत^ क यह उपाय 2397 (2017) के पैराOाफ 4 संकप म'

िनधारत क गई सीमाf, अपवाद+ और पdितय+ के अयधीन हो;”

(viii) उप-पैराOाफ (न ड) और उससे संबंिधत ;िविQ के उपरांत िनHिलिखत उप-पैरा को अंतःRथािपत कया जाएगा, नामतः

“(नड) उसके बंदरगाह+ म' कसी जलयान क जaती, जाँच और रोक लगाना और उसके े>ािधकार या उसक समु/ी सीमा के

अंतगत आने वाले े> के अयधीन कसी वाहन क जaती, जाँच और रोक लगाना, यद यह िवsास करने का तकसंगत

आधार है क जलयान या यातायात क मद' ]याकलाप+ म' शािमल थ$ जो संकप+ 2ारा ;ितबंिधत है बशत^ क यह उपाय

संकप 2397 (2017) के पैराOाफ 9 म' िनधारत क गई पdितय+ के अयधीन हो;

(नढ) सभी डीपीआरके नागरक जो उसके े>ािधकार म' आय अVजत कर रहे थे और सभी कोरया लोकतांि>क जनवादी

गणरा@य के कामगार+ क देखरेख कर रहे कोरया लोकतांि>क जनवादी गणरा@य सरकारी सुरा के सभी अताश+ को तYकाल

कोरया लोकतांि>क जनवादी गणरा@य म' इस संकप के अंगीकार करने क ितिथ से चौबीस माह के भीतर देशवापसी कर दी

जाए बशत^ यह अिभिनधारण कया जाता है क कोरया लोकतांि>क जनवादी गणरा@य का नागरक उसके नागरक हX या

कोरया लोकतांि>क जनवादी गणरा@य के नागरक हX िजसक देशवापसी, राीय और अंतरराीय कानून+ के अयधीन,

िजसम' अंतरराीय शरणाथb कानून और अंतरराीय मानवािधकार कानून और संयु रा मुvयालय करार और संयु रा

के िवशेषािधकार और उ4मुिय+ पर अिभसमय शािमल है, ;ितबंिधत है;

(नञ) उसके भू-े> से अथवा उसके नागरक+ 2ारा अथवा उसके वजयु जलयान+ अथवा वायुयान+ का इRतेमाल करके

कोरया लोकतांि>क जनवादी गणरा@य से खाw एवं कृिष उYपाद+ (एचएस कोxस 12, 08,07), मशीनरी (एचएस कोxस

84), इलेिynकल उपकरण (एचएस कोड 85), मैगनेसाइट और मैगनीिसया सिहत िम{ी और पYथर (एचएस कोड 25),लकड़ी

(एचएस कोड 44) और जलयान+ (एचएस कोड 89) चाहे उनका उ|म कोरया लोकतांि>क जनवादी गणरा@य से हो रहा हो

अथवा नह$, ;Yय अथवा अ;Yय Nप से आपूVत, िब] अथवा हRतांतरण को रोका जाए बशत^ क इस संकप को अंगीकार

कए जाने से पूव अंितम Nप दी गई िलिखत संिवदाf के संबंध म' 2397 (2017) के पैरा 6 म' उिलिखत काय ;]याएं लागू

ह+गी;

(नप) उनके भू-े>+ से अथवा उनके नागरक+ 2ारा, अथवा उनके वजयु जलयान+, वायुयान+, पाइपलाइन+, रेल लाइन+

अथवा वाहन+, चाहे वे उनके भू-े> से चलाए जा रहे ह+ अथवा नह$, का इRतेमाल करके कोरया लोकतांि>क जनवादी

गणरा@य को सभी औwोिगक मशीनरय+ (एचएस कोxस 84 और 85), परवहन वाहन+ (एचएस कोxस 86 से 89 तक),

और लौह, इRपात एवं अ~य धातुf (एचएस कोxस 72 से 83 तक), ;Yयताः अथवा अ;Yयताः आपूVत, िब] अथवा

हRतांतरण को रोका जाए। तथािप यह ;ावधान कोरया लोकतांि>क जनवादी गणरा@य के कॉमVशयल िसिविलयन या>ी

िवमान+ (िजसम' इस समय िनHिलिखत वायुयान मॉडल और टाइmस शािमल हX एएन-24 आर/आरवी, एएन- 148- 100बी,

II-18 डी, II-62 एम, टीयू- 134बी- 3, टीयू154बी, टीयू- 204- 100 बी, और टीयू- 204-300) के सुरित ;चालन को

बनाए रखने के िलए आव8यक कल-पुज क ZवRथा के संबंध म' लागू नह$ होगा;”

(नफ) सुरा परषद ;ेस िव[ि\ एससी/13023 दनांक 10 अyटूबर, 2017 और एससी/13149 दनांक 28 दसंबर, 2017

(इस आदेश के परिशQ VIII और IX) म' सूचीबd, सिमित 2ारा िविनgदQ जलयान+ का अपने बंदरगाह+ पर ;वेश को रोका

जाए बशत^ क यह उपाय संकप 2371 (2017) और 2375 (2017) के पैरा 6 म' उिलिखत छूट+ और काय;]याf के

अयधीन हो।”

जनवादी गणरा@य अपनी जनता से बेहद जNरी संसाधन+ को ब=त बड़ी कमत पर परमाणु श…+ और बैिलिRटक िमसाइल+ के

िवकास के िलए िनरंतर लगाता जा रहा है जबक उसक जनता क ब=त-सी मांग' पूरी नह$ =ई हX,

इस बात को Rवीकार करते =ए क कोयले, लौह, लौह अयRक+, सीसा, सीसक अयRक+, व…+, समु/ी खाw पदाथ, Rवण,

चांदी, धऱती से िमलने वाले िवरल खिनज+ और अ~य ;ितबंिधत धातुf आद सिहत े>ीय वRतुf के कोरया लोकतांि>क

जनवादी गणरा@य के Zापार क आय तथा अ4य लोग+ के साथ िवदेश+ म' रहने वाले कोरया लोकतांि>क जनवादी गणरा@य

के कामगार+ से िमलने वाले राजRव से कोरया लोकतांि>क जनवादी गणरा@य के परमाणु श… एवं बैिलिRटक काय]म म'

योगदान िमलता है

इस बात पर गंभीरतम चता !" करते ए क कोरया लोकतांि>क जनवादी गणरा@य के मौजूदा परमाणु तथा

बैिलिRटक िमसाइल+ से संबंिधत कायकलाप+ ने इस े> तथा इससे बाहर के े> म' अिRथरता उYपƒ कर दी है और इस बात

को मानते ए क अंतरराीय शांित और सुरा के िलए RपQ तौर पर खतरा बना =आ है,

संयु रा के घोषणा प> के अयाय VII के अंतगत काय करते =ए और इसके अनु0छेद 41 के अंतगत उपाय करते ए,

1. सुरा परषद के संकप+ का उलंघन और घोर िनरादर करते =ए कोरया लोकतांि>क जनवादी गणरा@य 2ारा

28 नवंबर, 2017 को कए गए बैिलिRटक िमसाइल ;ेपण+ क कड़े से कड़े शaद+ म' भYसना करती है;

2. अपने िनणय+ क पुनः पुि करती है क कोरया लोकतांि>क जनवादी गणरा@य बैिलिRटक िमसाइल ;ौwौिगक का

उपयोग करके आगे और कोई ;ेपण, परमाणु परीण अथवा अ4य कोई भी उकसाने वाला काम नह$ करेगा; अपने बैिलिRटक

िमसाइल काय]म से संबंिधत सभी कायकलाप+ को तYकाल Rथिगत रखेगा और इस संदभ म' िमसाइल ;ेपण+ के Rथगन

संबंधी अपनी पहले क ;ितबdताf को पुनः Rवीकार करेगा; सभी परमाणु श…+ और मौजूदा परमाणु काय]म+ को पूरी तरह

से, ;मािणत तरीके से और Rथाई तरीके से तYकाल छोड़ देगा और सभी स"बd कायकलाप+ को तुरंत बंद करेगा; और Zापक

िवनाश के अ4य मौजूदा हिथयार+ एवं बैिलिRटक िमसाइल काय]म+ का परYयाग कर देगा;

3. िनण+य करती है क संकप 1718 (2006) के पैरा 8 (घ) म' उिलिखत उपाय इस संकप के अनुबंध I और II म'

सूचीबd Zिय+ और संगठन+ तथा उनक ओर से अथवा उनके िनद^शानुसार काम करने वाले कसी भी Zिय+ अथवा

संगठन+ और अवैध साधन+ के जरए सिहत उनके RवािमYव वाले अथवा िनयं>ण वाले संगठन+ पर भी लागू ह+गे और यह भी

िनण+य लेती है क संकप 1718 (2006) के पैरा 8 (ड़) म' उिलिखत उपाय इस संकप के अनुबंध I म' सूचीबd Zिय+ और

उनक ओर से अथवा उनके िनद^शानुसार काम करने वाले Zिय+ पर भी लागू ह+गे;

से सभी ;कार के कqे तेल क आपूVत, िब] या अंतरण पर रोक लगाएंगे, जब तक क सिमित अिOम Nप से मामला-दर-

मामला आधार पर कqे तेल के नौवहन क मंजूरी न ;दान करे जोक िवशेष तौर पर डीपीआरके के नागरक+ क आजीिवका

संबंधी जNरत+ के िलए होगा और संकप संvया 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270

(2016), 2321 (2016), 2356 (2017), 2371 (2017) 2375 (2017) अथवा इस संकप 2ारा िनिषd डीपीआरके के

परमाणु अथवा बैिलिRटक ;ेपा… काय]म+ अथवा अ4य कायकलाप+ से इनका कोई संबंध न हो; आगे यह भी िनणय लेती है

क यह रोक उस कqे तेल पर लागू नह$ होगा जो इस संकप को Rवीकार कए जाने क तारीख से 12 माह तथा उसके बाद

12 माह क अविध तक कुल 4 िमिलयन बैरल या 525000 टन से अिधक न हो और यह भी िनणय लेती है क डीपीआरके को

कqे तेल क आपूVत करने वाले सदRय रा+ को इस संकप को Rवीकार कए जाने क तारीख से ;Yयेक 90 दन+ के अंतराल

पर सिमित को इस बाबत रपोट सˆपनी होगी।

5. यह िनण+य लेती है क सभी सदRय रा डीपीआरके को अपने भूे> से होकर अथवा उनके नागरक+ 2ारा अथवा उनके

से सभी ;कार के कqे तेल िजसम' डीजल तथा केरोिसन तेल शािमल है, क आपूVत, िब] या अंतरण पर रोक लगाएंगे; िनणय

लेती है क डीपीआरके इस ;कार के उYपाद+ का ;ापण नह$ करेगा; िनणय लेती है क यह ;ावधान डीपीआरके 2ारा

सिमित को सूिचत करे िजसके साथ इस लेन-देने के बारे म' सभी पकार+ को भी सूिचत कया जाए (ख) इस ;कार के परW कृत

पेnोिलयम उY पाद+, िब] तथा अंतरण म' कोई भी ‰ यिy त अथवा कंपनी शािमल नह$ है जो डीपीआरके के परमाणु अथवा

‰ यिy त अथवा कंपिनयां, अथवा उनके R वािमY व वाली अथवा िनयंि>त कंपिनयां ;Y य अथवा परो Nप से, अथवा इन

;ितबंध+ का उ लंघन करने म' सहयोग करने वाले ‰ यिy त अथवा कंपिनयां शािमल हX, और (ग) पेnोिलयम उY पाद+ क आपूVत,

िब] अथवा अंतरण, िवशेष तौर पर डीपीआरके नागरक+ क आजीिवका के ;योजनाथ हX और यह डीपीआरके के परमाणु

अथवा बैिलिR टक ;ेपाR > काय]म+ अथवा संक प संv या 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013),

2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) अथवा इस संकल्प 2ारा िनिषd

कायकलाप+ के िलए राजR व सृजन के ;योजनाथ नह$ है; सिमित के सिचव को िनद^श देती है क वह सभी सदR य राW n+ को यह

सूिचत करे क कब 1 जनवरी, 2018 से ;ारंभ करते =ए कुल परW कृत पेnोिलयम उY पाद+ के 75 ;ितशत िहR से क कब

आपूVत, िब] क गई अथवा अंतरण कया गया और यह भी सभी सदR य राW n+ को सूिचत करे क कब कुल पेnोिलयम उY पाद+

का 90 ;ितशत तथा 95 ;ितशत िहR सा प=ंचाया गया है; सिमित सिचव को िनद^श देती है क 1 जनवरी, 2018 से शुN

करते =ए सभी सदR य राष् n+ को सूिचत कया जाए क कब डीपीआरके को वाVषक 75 ;ितशत कुल परW कृत पेnोिलयम

उY पाद+ क िब], आपूVत तथा अंतरण कया गया, और सिमित सिचव को यह भी िनद^श देती है क 1 जनवरी, 2018 से शुN

करते =ए सभी सदR य राW n+ को सूिचत कया जाए क कब डीपीआरके को वाVषक 90 ;ितशत कुल परW कृत पेnोिलयम

उY पाद+ क िब], आपूVत तथा अंतरण कब कया गया, और आगे यह भी सिमित सिचव को िनद^श देती है क वह सभी सदR य

राW n+ को यह सूिचत करे क डीपीआरके को दए जाने वाले 95 ;ितशत परW कृत पेnोिलयम उY पाद+ क िब], आपूVत अथवा

अंतरण कब कया गया और उ4 ह' यह सूिचत कया जाए क वे वष क शेष अविध के िलए डीपीआरके को परW कृत पेnोिलयम

उY पाद+ क आपूVत, िब] अथवा अंतरण पर तY काल रोक लगाए; सिमित को िनद^श देती है क वह अपनी वेबसाइट पर

डीपीआरके को ;Y येक माह बेचे गए, आपूVत कए गए अथवा अंतरत कए गए परW कृत पेnोिलयम उY पाद+ क कुल मा>ा

तथा यह लेन-देन करने वाले देश के नाम ;दVशत कर'; सिमित को िनद^श देती है क वह सदR य राW n+ से ;ाm त सूचनाf के

आधार पर इस जानकारी को वाR तिवक Nप से अwतन करे; सभी सदR य राW n+ से आŠवान करती है क वे इस वेबसाइट क

िनयिमत समीा करे ताक 1 जनवरी, 2018 से ;ारंभ करते =ए इस ;ावधान 2ारा िनधारत परW कृत पेnोिलयम उY पाद+

क वाVषक सीमा का अनुपालन कया जा सके; िवशेष[+ के पैनल को िनद^श देती है क वह सभी सदR य राW n+ 2ारा कए जा

रहे ]या4 वयन ;यास+ पर नजर रखे ताक सहायता दी जा सके तथा संपूण एवं वैि8 वक अनुपालन सुिनि8 चत कया जा सके;

और महासिचव से अनुरोध करती है क वह इस दशा म' अपेित ‰ यवR थाएं कर' तथा अितरy त संसाधन उपलa ध कराएं;

6. िनण+य लेती है क सभी सदRय रा डीपीआरके को अपने भूे> से होकर अथवा उनके नागरक+ 2ारा अथवा उनके वज

लगे जहाज+, अथवा हवाई जहाज+, पाइप लाइन+, रेलमाग अथवा वाहन+ का इRतेमाल करके ;Yय अथवा परो Nप से

खाw तथा कृिष उYपाद+ (एचएस कोड 12,08,07), मशीनरी (एचएस कोड 84), िवwुत उपकरण (एचएस कोड 85), मृदा

तथा पYथर िजनम' मैगनेशाइट तथा मैगनीिशया (एचएस कोड 25), लकड़ी (एचएस कोड 44) और जहाज+ (एचएस कोड 89)

क आपूVत, िब] अथवा अंतरण नह$ कर'गे; और यह क सभी सदRय रा डीपीआरके से उनके नागरक+ 2ारा उनके वज लगे

जहाज+ अथवा हवाई जहाज+, चाहे डीपीआरके के अपने भूे> से अथवा नह$, उपरोिलिखत वRतुf तथा उYपाद+ के ;ापण

पर रोक लगाएंगे, यह भी RपQ करती है क संकप संvया 2371 (2017) के पैरा 9 म' समु/ी खाw पदाथ पर लगाए गए

संपूण आंचिलक ;ितबंध के तहत डीपीआरके को मछली पकड़ने संबंधी अिधकार+ को ;Yय अथवा परो Nप से बेचने अथवा

अंतरत करने पर रोक लगाएगा और आगे यह भी िनणय लेती है क डीपीआरके से ऐसी सभी वRतुf तथा उYपाद+ क िब]

और लेन-देन डीपीआरके 2ारा िजनके अंतरण, आपूVत अथवा िब] इस पैरा के तहत िनिषd है और िजसके िलए इस संकप

को Rवीकार कए जाने से पूव िलिखत संिवदाf को अंितम Nप दया गया है, सभी रा अपने भूे> म' इनके आयात हेतु इनके

नौवहन के िलए इस संकप को Rवीकार कए जाने क ितिथ से केवल 30 दन+ तक अनुमित दे सकते हX िजसके साथ उ4ह'

सिमित को इस बाबत इनके िववरण सिहत इस संकप को Rवीकार कए जाने क ितिथ से 45 दन+ के प`ात् सूिचत करना

होगा;

7. िनण+य लेती है क सभी सदRय रा डीपीआरके को अपने भूे> से होकर अथवा उनके नागरक+ 2ारा अथवा उनके वज

8. इस बात पर चता !" करती है क डीपीआरके के नागरक िवदेशी िनयात संबंधी आय के ;योजनाथ अभी तक अ4य देश+

म' काम कर रहे हX और यह क डीपीआरके संकप संvया 2375 (2017) के पैरा 17 को Rवीकार करने के बावजूद अपने

िनिषd परमाणु तथा बैिलिRटक ;ेपा… काय]म+ को समथन देना जारी रखे =ए है; िनणय लेती है क सदRय रा उनके

े>ािधकार म' आय अVजत करने वाले डीपीआरके के सभी नागरक+ को और िवदेश+ म' डीपीआरके कामगार+ क मॉनीटरी

करने वाले डीपीआरके के सभी सुरा िनरीण अताशे को तYकाल परंतु इस संकप को Rवीकार कए जाने क तारीख से 24

माह के भीतर डीपीआरके म' देश ;YयावVतत कर'गे, जब तक क सदRय रा यह िनधारत न करे क वह नागरक उस सदRय

रा का नागरक है अथवा ऐसा डीपीआरके नागरक है िजसका देश ;Yयावतन ;यो@य राीय तथा अंतरराीय कानून िजनम'

अंतरराीय शरणाथb कानून तथा अंतरराीय मानवािधकार कानून और संयु रा मुvयालय करार तथा संयु रा

िवशेषािधकार एवं उ4मुि अिभसमय शािमल है, के अयधीन वVजत है; और आगे यह भी िनणय लेती है क सभी सदRय रा

उनके े>ािधकार म' आय अजन करने वाले डीपीआरके के सभी नागरक+ के संबंध म' इस संकप को Rवीकार कए जाने क

तारीख से 15 माह क अविध के भीतर एक मयाविधक रपोट ;Rतुत कर'गे िज4ह' इस संकप को Rवीकार कए जाने क

तारीख से 12 माह के भीतर ;YयावVतत कया गया, िजसके साथ यह RपQीकरण भी देना होगा क आधे से कम ऐसे

डीपीआरके नागरक+ को yय+ 12 माह के अंत तक, यद लागू हो, ;YयावVतत कया गया, और सभी सदRय रा इस संकप

को Rवीकार कए जाने क तारीख से 27 माह क अविध के भीतर अंितम रपोट ;Rतुत कर'गे।

9. गहरी चता के साथ यह नोट करती है क डीपीआरके Žामक समु/ी पdितय+ के 2ारा अवैध Nप से कोयला तथा अ4य

िनिषd सामOी का िनयात कर रहा है और जलयान से जलयान हRतांतरण करके अवैध Nप से पेnोल ;ा\ कर रहा है और यह

िनणय करती है क सदRय रा अपने बंदरगाह+ म' कसी भी जलयान को जaत कर'गे, उसका िनरीण कर'गे और उसके

इRतेमाल पर रोक लगाएंगे और अपनी समु/ी सीमा म' अपने अिधकार े> के अंतगत कसी भी जलयान को जaत, उसका

िनरीण कर सकते हX और उसका इRतेमाल रोक सकते हX यद सदRय रा के पास यह मानने के ताgकक आधार हX क वह

जलयान संकप 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356

(2017), 2371 (2017), 2375 (2017) या इस संकप 2ारा िनिषd कसी गितिविध या सामOी के परवहन म' शािमल

था, सदRय रा+ को ;ोYसािहत करती है क वे जलयान+ को जaत, उनके िनरीण और इRतेमाल पर रोक लगाने पर संबंिधत

जलयान+ के वजिचिŠनत रा+ से परामश कर' और आगे यह िनणय करती है क ऐसे जलयान+ को रोक देने क तारीख से छह

माह के प`ात् यह ;ावधान लागू नह$ होगा यद सिमित मामला-दर-मामला आधार पर और वजिचिŠनत रा के अनुरोध

पर यह िनणय लेती है क जलयान को भिवWय म' इन संकप+ का उलंघन करने से रोकने के िलए पया\ ZवRथाएं कर ली गई

हX।

10. यह िनण+य लेती है क यद कसी सदRय रा के पास ऐसी सूचना हो िजससे संदेह होता है क डीपीआरके ;Yय या

अ;Yय Nप से, अवैध माल क आपूVत, िब], हRतांतरण या उसे ;ा\ करने का ;यास कर रहा है तो वह सदRय रा अ4य

संगत सदRय रा+ से अितर समु/ी तथा नौवहन सूचना क मांग कर सकता है िजसम' यह [ात करना भी शािमल है क

yया संबंिधत मद, सामOी या उYपाद डीपीआरके से िनकले हX, आगे यह िनणय लेती है क ऐसी पूछताछ क जानकारी ;ा\

करने वाले सभी सदRय रा ऐसे अनुरोध+ पर एक उपयु तरीके से िजतना संभव हो सके, उतना शी कारवाई कर'गे, िनणय

लेती है क सिमित िवशेष[+ के पैनल के सहयोग से एक Yवरत ;]या 2ारा सूचना के ऐसे अनुरोध+ का समयबd सम4वय

करेगी और महासिचव से यह अनुरोध करती है क इस आशय के िलए आव8यक ZवRथा कर' और इस संबंध म' सिमित तथा

िवशेष[+ के पैनल को अितर संसाधन उपलaध कराएं।

11. संकप 2321 (2016) के पैरा 22 क पुनः पुि करती है और िनण+य करती है क ;Yयेक सदRय रा उनके अिधकार े>

के अयधीन नागरक+, Zिय+ और उनक सीमा म' या उनके अिधकार े> के अयधीन समािवQ संRथाf को ऐसे जलयान+

को बीमा या पुनः बीमा सेवाएं उपलaध कराने से रोक लगाएगा, िजनके संबंध म' यह मानने के िलए उनके पास ताgकक आधार

हX क ये जलयान संकप 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016),

2356 (2017), 2371 (2017), 2375 (2017) या इस संकप 2ारा िनिषd गितिविधय+ या सामOी के परवहन म' शािमल

थे, जब तक क सिमित मामला दर मामला आधार पर यह िनधारत नह$ करती है क यह जहाज पूण Nप से केवल

आजीिवका उjे8य+ िजनका ;योग डीपीआरके Zिय+ या संRथाf 2ारा राजRव सृजन के िलए नह$ कया जाएगा, या जो

मानवतावादी उjे8य+ से संबंिधत गितिविधय+ म' संल है।

2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) या इस संकप 2ारा

िनिषd गितिविधय+ या सामOी के परवहन म' शािमल थे और उनके अिधकार े> के अयधीन नागरक+, Zिय+ और

उनक सीमा म' अथवा उनके अिधकार े> के अयधीन समािवQ संRथाf को इसके बाद ऐसे जलयान+ को वगbकरण सेवाएं

उपलaध कराने से रोक लगाएगा और आगे यह िनणय लेती है क सदRय रा सिमित 2ारा मामला-दर-मामला आधार पर

अिOम Nप से अनुमोदत मामल+ के िसवाय इस पैराOाफ के अनुसरण म' अ4य सदRय रा 2ारा पंजीकरण रj कए गए

जलयान का पंजीकरण नह$ कर'गे।

13. इस बात पर चता !" करते ए क डीपीआरके वजिचिŠनत, िनयंि>त, ;ािधकृत या ;चािलत जलयान अपने पूण

गितिविध िववरण को िछपाने के िलए Rवचािलत पहचान ;णािलय+ को चलाए रखने क आव8यकताf क जानबूझकर

अव[ा करते हX और सदRय रा+ से यह आवाŠन कया क वे संकप 1718 (2006), 1874 (2009), 2087 (2013), 2094

(2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) या इस संकप 2ारा िनिषd

गितिविधयाँ करने वाले ऐस जहाज+ के संबंध म' सतक ता बढ़ाएं।

14. संकप 2321 (2016) के पैरा 30 का मरण करती है और यह िनण+य लेती है क सभी सदRय रा सिमित 2ारा मामला-

दर-मामला आधार पर अिOम म' अनुमोदत मामल+ के िसवाय उनक सीमा से या उनके नागरक+ 2ारा, अथवा उनके

वजिचिŠनत जलयान+ या वायुयान+ का ;योग करके, और कसी भी नए अथवा पुराने जलयान+ से, चाहे वे उनके अिधकार

े> से चलते ह+ या नह$, डीपीआरके को कोई भी ;Yय अथवा अ;Yय आपूVत, िब] या हRतांतरण करने से रोक' गे।

15. िनण+य करती है क यद कसी सदRय रा के पास उनक सीमा म' या गहरे समु/ म' देखे गए ऐसे कसी जलयान क

संvया, नाम और रिजRnी संबंधी सूचना है िजसे संकप 1718 (2006) के पैरा 8 (घ) 2ारा अिधरोिपत परसंपि<याँ रोकने,

संकप 2321 (2016) के पैरा 12 2ारा अिधरोिपत बंदरगाह ;वेश ;ितबंध, या इस संकप म' संगत उपाय+ के अयधीन

सुरा परषद 2ारा या सिमित 2ारा नामोदQ कया गया है, तो सदRय रा सिमित को इस सूचना के संबंध म' और ऐसे

जलयान+ का िनरीण करने, परसंपि<याँ रोकने और जaत करने या संकप 1718 (2006), 1874 (2009), 2087

(2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) या इस संकप

के संगत ;ावधान+ 2ारा ;ािधकृत कोई अ4य उपयु कारवाई के िलए कए गए उपाय+ के संबंध म' सूिचत कर'गे।

16. िनण+य लेती है क इस संकप के ;ावधान केवल Nस-डीपीआरके के रिजन-खासन बंदरगाह और रेल परयोजना के

मायम से अ4य देश+ को Nस से िनकलने वाले कोयले को पोत से ले जाने के संबंध म' लागू नह$ ह+गे, जैसा क संकप 2371

(2017) के पैरा 8 और संकप 2375 (2017) के पैरा 18 2ारा अनुमत है।

ितबंध9 का काया=वयन

17. यह फैसला करता है क सदRय देश इस संकप का अंगीकरण कए जाने के नaबे दन+ के भीतर सुरा परषद् को इसक

रपोट कर'गे, और उसके प`ात् सिमित के अनुरोध पर, इस संकप के ;ावधान+ का ;भावी Nप से काया4वयन करने के ]म म'

कए गए ठोस उपाय+ पर अ4य संयु रा अनुवीण दल के सहयोग से िवशेष[+ के पैनल से ऐसे रपोट को समयबd तरीके

से तैयार करने और ;Rतुत करने म' सदRय देश+ को सहायता करने के अपने ;यास जारी रखने के िलए अनुरोध करते हX:

18. संकप+ 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356

(2017), 2371 (2017), 2375 (2017) तथा इस संकप म' यु उपाय+ को पूरी तरह कायाि4वत के ;यास+ को पुनः दोगुना

करने और ऐसा करने म' एक-दूसरे का सहयोग करने के िलए सभी सदRय देश+ से आवाŠन करता है, िवशेष तौर पर उन मद+ के

िनरीण, जाँच और जaत कए जाने के संबंध म' जो इन संकप+ 2ारा ;ितबंिधत हX:

19. यह फैसला करता है क संकप 1718 (2006) के पैराOाफ 12 म' िनधारत सिमित के अिधदेश इस संकप म' शािमल

उपाय+ के संबंध म' लागू ह+गे और आगे यह फैसला करता है क संकप 1874 (2009) के पैराOाफ 26 म' िनgदQ और संकप

2345 (2017) के पैराOाफ 1 म' परवVतत िवशेष[+ के पैनल के अिधदेश भी इस संकप म' शािमल उपाय+ के संबंध म' लागू

ह+गे;

20. सभी सदRय देश+ को ;ािधकृत करने का और यह फैसला करता है क सभी सदRय देश संकप+ 1718 (2006), 1874

(2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375

गया हो के कहने पर कोई दावा न हो;

संबंध+ पर िवयना अिभसमय के अनुसरण म' राजनियक या क+सुली िमशन+ के कायकलाप+ को कसी भी ;कार से बािधत नह$

राजनीितक

23.

डीपीआरके क जनता 2ारा झेली जा रही गंभीर परेशािनय+ पर अपनी गहरी ’चता को दोहराती है, डीपीआरके के

2ारा अपने लोग+ के कयाण के बजाय परमाणु हिथयार+ और बैिलिRटक िमसाइल+ को आगे बढ़ाए जाने क ’नदा करती है

yय+क डीपीआरके क जनता क आव8यकताएं अधूरी हX और इस बात पर बल देती है क डीपीआरके क जनता का कयाण

और उनक अंतVनिहत गरमा का स"मान सुिनि`त कया जाना @यादा आव8यक है; और यह मांग करती है क डीपीआरके

अपनी जनता को दाव पर लगाकर अपने दुलभ संसाधन+ को परमाणु हिथयार तथा बैिलिRटक िमसाइल+ के िवकास म' लगाना

बंद करे।

डीपीआरके 2ारा उनके अपया\ संसाधन+ को बड़े तौर पर परमाणु हिथयार+ के िवकास और कई मंहगी बैिलिRटक

िमसाइल काय]म+ क ओर खच कए जाने पर खेद !" करती है, मानवीय सहायता के सम4वय के िलए संयु रा

कायालय के िनWकष को नोट करती है क डीपीआरके क आधी से अिधक आबादी बड़ी संvया म' गभवती मिहलाएं, Rतनपान

कराती मिहलाएं और पांच वष से कम उ“ के बqे िज4ह' कुपोषण का िशकार होने का खतरा रहता है सिहत खाw तथा

िचकYसा देखरेख म' बड़ी असुराf से जूझ रही है और कुल आबादी का 41% कुपोषण से जूझ रहा है और इस संदभ म'

डीपीआरके क जनता 2ारा झेली जा रही गंभीर कठनाइय+ पर अपनी गहरी ’चता Z करती है;

इस बात क पुनः पुि करती है क संक प 1718 (2006), 1874(2009), 2087(2013), 2094(2013),

2270(2016), 2321(2016), 2356(2017), 2371 (2017) 2375(2017) और इस संक प के 2ारा लगाए गए उपाय+

का उjे8 य डी पी आर के क नागरक आबादी के िलए ;ितकूल ;भाव डालना अथवा उन पर नकाराY मक Nप से ;भाव डालना

अथवा ऐेसे कायकलाप+, िजनम' आVथक कायकलाप उन गितिविधय+ को ;ितबंिधत करना नह$ है, िज4 ह' संक प+

1718(2006), 1874(2009), 2087(2013), 2094(2013), 2270(2016), 2321(2016), 2356(2017), 2371

(2017) और इस संक प के 2ारा ;ितबंिधत नह$ कया गया है और डी पी आर के के नागरक+ के लाभाथ अंतराW nीय और

गैर-सरकारी संगठन+ 2ारा डी पी आर के म' चलाई जा रही सहायता एवं राहत गितिविधय+ को भी ;ितबंिधत नह$ कया गया

है और यह िनणय करता है क यद सिमित यह िनधारत करती है क डी पी आर के म' ऐसे संगठन+ के काय को आगे बढ़ाने के

िलए ऐसे छूट आव8 यक हX अथवा इन संक प+ के उjे8 य+ के साथ कसी अ4 य ;योजनाथ इसे उपयुy त पाती हX तो सिमित

मामला दर मामला आधार पर इन संक प+ 2ारा लागू उपाय+ से कसी भी गितिविध को छूट ;दान कर सकती हX।

S.O. 975(E).—Whereas the Security Council of the United Nations adopted Resolution, 2397 (2017)

on 22^nd December, 2017 at its 8151^st meeting (Schedule X) under Chapter VII of the Charter of the United

Nations requiring all States to take certain measures;

And whereas, the Central Government considers it necessary and expedient to issue an Order under the United

Nations (Security Council) Act, 1947 (43 of 1947) to implement the said Resolution of the Security Council

adopted under Article 41 of Chapter VII of the Charter of the United Nations.

Now, therefore, in exercise of the powers conferred by section 2 of the United Nations (Security Council) Act,

1947 (43 of 1947), the Central Government hereby makes the following further amendments in the

Implementation of Security Council Resolution on Democratic People’s Republic of Korea Order, 2017, dated

the 21^st April 2017 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide

number S.O. 1549(E), dated the 15 May 2017, namely:-

Short title and commencement.-

(1) This Order may be called the Implementation of Security Council Resolution on Democratic Peo-

ple’s Republic of Korea (Amendment) Order, 2018.

(2) It shall come into force on the date of its publication in the Official Gazette.

In the Implementation of Security Council Resolution on Democratic People’s Republic of Korea Order,

2017( herein after referred to as the said Order)in paragraph 2, for clause (a) and the entry relating thereto, the

following shall be substituted namely:-

‘(a) “Resolutions” mean the United Nations Security Council Resolutions under Chapter VII of the Charter of

the United Nations on Democratic People’s Republic of Korea, namely, 1718 (2006), 1874 (2009), 2087

(2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) and 2397(2017)’ ;

In the said order, in paragraph 3,-

(i)

for sub-paragraph (d), the following shall be substituted, namely:-

“(d) freeze immediately the funds, other financial assets and economic resources, including vessels

designated by the Committee, which are on its territories, that are owned or controlled, directly or indirectly,

by the individuals or entities set out in,

1. Part A and Part C of S/2009/364 (Appendix III to this Order);

2. Annex I and II of Resolution 2087 (2013);

3. Annex I and II of Resolution 2094 (2013);

4. Annex I, II and III of Resolution 2270 (2016), as amended by Security

Council Press Release SC/12636 of 17 December 2016 (Appendix VII

to this Order);

5. Annex I and II of Resolution 2321 (2016);

6. Annex I and II of Resolution 2356 (2017);

7. Annex I and II of Resolution 2371 (2017);

8. Annex I and II of Resolution 2375 (2017; and

9. Annex I and II of Resolution 2397 (2017),

as being engaged in or providing support for, including through other illicit means, Democratic People’s

Republic of Korea’s nuclear-related, other weapons of mass destruction-related and ballistic missile-related

programmes, or by persons or entities acting on their behalf or at their direction, and ensure that any funds,

financial assets or economic resources are prevented from being made available by its nationals or by any

persons or entities within India, to or for the benefit of such persons or entities.

Note 1: The asset freeze shall apply to all the funds, other financial assets and economic resources outside of

the Democratic People’s Republic of Korea that are owned or controlled, directly or indirectly, by entities of

the Government of the Democratic People’s Republic of Korea or the Worker’s Party of Korea, or by

individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them,

that the Central Government determines are associated with the Democratic People’s Republic of Korea’s

nuclear or ballistic missile programs or other activities prohibited by the Resolutions .

Note 2: These measures are subject to the exemptions set out in paragraph 9 of Resolution 1718 (2006) and

paragraph 32 of Resolution 2270 (2016);”

(ii)

for sub-paragraph (e), the following shall be substituted, namely:-

“(e) prevent the entry into or transit through India of the persons listed in,

1. Part C of S/2009/364 (Appendix III to this Order);

2. Annex I of Resolution 2087 (2013);

3. Annex I of Resolution 2094 (2013);

4. Annex I of Resolution 2270 (2016);

5. Annex I of Resolution 2321 (2016);

6. Annex I of Resolution 2356 (2017);

7. Annex I of Resolution 2371 (2017);

8. Annex I of Resolution 2375 (2017); and

9. Annex I of Resolution 2397(2017),

as being responsible for, including through supporting or promoting, Democratic People’s Republic of Korea

policies in relation to the Democratic People’s Republic of Korea’s nuclear-related, ballistic missile-related

and other weapons of mass destruction-related programmes, together with their family members, provided that

nothing contained above shall oblige the Central Government to refuse its own nationals entry into its

territory.

Note: The travel ban measures are subject to the exemptions set out in paragraph 10 of Resolution 1718

(2006) and paragraph 10 of Resolution 2094 (2013).”

(iii)

for sub-paragraph (g), the following shall be substituted, namely:-

“(g) prohibit its nationals, persons subject to its jurisdiction and entities incorporated in its territory or subject

to its jurisdiction from providing insurance or re-insurance services to vessels it has reasonable grounds to

believe were involved in activities, or the transport of items, prohibited by the Resolutions andthe said

provisions would apply without exceptions, unless the Committee approves on a case by case basis for the

purposes set out in paragraph 11 of Resolution 2397(2017);”

(iv)

for sub-paragraph (q), the following shall be substituted, namely:-

“(q)

prevent the direct or indirect supply, sale or transfer to the DPRK, through their territories or by their

nationals, or using their flag vessels or aircraft, and whether or not originating in their territories, of new

helicopters and any new or used vessels, except as approved in advance by the Committee on a caseby-case

basis;”

(v)

for sub-paragraph (s), and the entry relating thereto, the following shall be substituted, namely:-

“(s) de-register any vessel it has reasonable grounds to believe was involved in activities, or the transport of

items, prohibited by the Resolutions; and prohibit its nationals, persons subject to its jurisdiction and entities

incorporated in its territory or subject to its jurisdiction from thereafter providing classification services to

such a vessel and further not to register any such vessel that has been de-registered by another Member State

pursuant to this paragraph except as approved in advance by the Committee on a case by-case basis;”

(vi)

for sub-paragraph (zk), the following shall be substituted, namely:-

“(zk) Prohibit the supply, sale or transfer to the DPRK, through its territories or by its nationals, or using its

flag vessels, aircraft, pipelines, rail lines, or vehicles, and whether or not originating in its territories, of all

refined petroleum products provided this measure is subject to the limits, exceptions and procedures set out in

paragraph 5 of Resolution 2397 (2017);”

(vii)

for sub-paragraph (zl), the following shall be substituted, namely:-

“(zl) prohibit the supply, sale or transfer through its territories or by its nationals, or using its flag vessels,

aircraft, pipelines, rail lines, or vehicles and whether or not originating in its territories, of all crude oil to the

Democratic People’s Republic of Korea provided this measure is subject to the limits, exceptions and

procedures set out in paragraph 4 of Resolution 2397 (2017);”

(viii) after sub-paragraph (zm), and the entry relating thereto, the following sub-paragraph shall be

inserted, namely:-

“(zn) seize, inspect, and freeze (impound) any vessel in its ports, and may seize, inspect, and freeze

(impound) any vessel subject to its jurisdiction in its territorial waters, if it has reasonable grounds to believe

that the vessel was involved in activities, or the transport of items, prohibited by the Resolutions provided this

measure is subject to the procedure set out in paragraph 9 of resolution 2397(2017);

(zo) repatriate to the Democratic People’s Republic of Korea all Democratic People’s Republic of Korea

nationals earning income in its jurisdiction and all Democratic People’s Republic of Korea government safety

oversight attachés monitoring Democratic People’s Republic of Korea workers immediately but not later than

twenty four months from the date of adoption of this resolution unless it determines that a Democratic

People’s Republic of Korea national is its national or a Democratic People’s Republic of Korea national

whose repatriation is prohibited, subject to applicable national and international law, including international

refugee law and international human rights law, and the United Nations Headquarters Agreement and the

Convention on the Privileges and Immunities of the United Nations;

(zp) prohibit the supply, sale or transfer, directly or indirectly, from its territory or by its nationals or using its

flag vessels or aircraft, food and agricultural products (HS codes 12, 08, 07), machinery (HS code 84),

electrical equipment (HS code 85), earth and stone including magnesite and magnesia (HS code 25), wood

(HS code 44), and vessels (HS code 89) from the DPRK whether or not originating in the territory of the

DPRK provided with regard to written contracts finalised prior to the adoption of this resolution, the

procedures set out in paragraph 6 of 2397(2017) would apply;

(zq) prohibit the direct or indirect supply, sale or transfer to the Democratic People’s Republic of Korea,

through their territories or by their nationals, or using their flag vessels, aircraft, pipelines, rail lines, or vehi-

cles and whether or not originating in their territories, of all industrial machinery (HS codes 84 and 85),

transportation vehicles (HS codes 86 through 89), and iron, steel, and other metals (HS codes 72 through 83)

however this provision shall not apply with respect to the provision of spare parts needed to maintain the safe

operation of Democratic People’s Republic of Korea commercial civilian passenger aircraft (currently

consisting of the following aircraft models and types: An-24R/RV, An-148-100B, Il-18D, Il-62M, Tu-134B-3,

Tu-154B, Tu-204-100B, and Tu-204-300);

(zr) prohibit the entry into its ports, vessels designated by the Committee, listed in Security Council Press

Releases SC/13023 of 10 October 2017 and SC/13149 of 28 December 2017(Appendices VIII and IX of this

Order) provided this measure is subject to the exemptions and procedures set out in paragraphs 6 of

Resolutions 2371(2017) and 2375(2017).”

The Security Council,

Recalling its previous relevant resolutions, including resolution 825 (1993), resolution 1695 (2006),

resolution 1718 (2006), resolution 1874 (2009), resolution 1887 (2009), resolution 2087 (2013),

resolution 2094 (2013), resolution 2270 (2016), resolution 2321 (2016), resolution 2356 (2017),

resolution 2371 (2017), resolution 2375 (2017), as well as the statements of its President of 6 Octo-

ber 2006 (S/PRST/2006/41), 13 April 2009 (S/PRST/2009/7), 16 April 2012 (S/PRST/2012/13), and

29 August 2017 (S/PRST/2017/16),

Reaffirming that proliferation of nuclear, chemical and biological weapons, as well as their means of

delivery, constitutes a threat to international peace and security,

Expressing its gravest concern at the ballistic missile launch by the Democratic People’s Republic of

Korea (“the DPRK”) on 28 November 2017 in violation of resolutions 1718 (2006), 1874 (2009),

2087 (2013), 2094 (2013), 2270 (2016) 2321 (2016), 2356 (2017), 2371 (2017), and 2375 (2017) and

at the challenge such a test constitutes to the Treaty on Non-Proliferation of Nuclear Weapons (“the

NPT”) and to international efforts aimed at strengthening the global regime of non-proliferation of

nuclear weapons, and the danger it poses to peace and stability in the region and beyond,

Underlining once again the importance that the DPRK respond to other security and humanitarian

concerns of the international community including the necessity of the DPRK respecting and ensur-

ing the welfare, inherent dignity, and rights of people in the DPRK, and expressing great concern

that the DPRK continues to develop nuclear weapons and ballistic missiles by diverting critically

needed resources away from the people in the DPRK at tremendous cost when they have great unmet

needs,

Acknowledging that the proceeds of the DPRK’s trade in sectoral goods, including but not limited to

coal, iron, iron ore, lead, lead ore, textiles, seafood, gold, silver, rare earth minerals, and other pro-

hibited metals, as well as the revenue generated from DPRK workers overseas, among others, con-

tribute to the DPRK’s nuclear weapons and ballistic missile programs,

Expressing its gravest concern that the DPRK’s ongoing nuclear- and ballistic missile-related activi-

ties have destabilized the region and beyond, and determining that there continues to exist a clear

threat to international peace and security

Acting under Chapter VII of the Charter of the United Nations, and taking measures under Article 41,

Condemns in the strongest terms the ballistic missile launch conducted by the DPRK on 28 November

2017 in violation and flagrant disregard of the Security Council’s resolutions;

Reaffirms its decisions that the DPRK shall not conduct any further launches that use ballistic missile

technology, nuclear tests, or any other provocation; shall immediately suspend all activities related to its bal-

listic missile program and in this context re-establish its pre-existing commitments to a moratorium on all

missile launches; shall immediately abandon all nuclear weapons and existing nuclear programs in a complete,

verifiable and irreversible manner, and immediately cease all related activities; and shall abandon any other

existing weapons of mass destruction and ballistic missile programs in a complete, verifiable and irreversible

manner;

Designations

Decides that the measures specified in paragraph 8(d) of resolution 1718 (2006) shall apply also to the

individuals and entities listed in Annex I and II of this resolution and to any individuals or entities acting on

their behalf or at their direction, and to entities owned or controlled by them, including through illicit means,

and decides further that the measures specified in paragraph 8(e) of resolution 1718 (2006) shall also apply to

the individuals listed in Annex I of this resolution and to individuals acting on their behalf or at their direction;

Sectoral

Decides that all Member States shall prohibit the direct or indirect supply, sale or transfer to the

DPRK, through their territories or by their nationals, or using their flag vessels, aircraft, pipelines, rail lines, or

vehicles and whether or not originating in their territories, of all crude oil, unless the Committee approves in

advance on a case-by-case basis a shipment of crude oil which is exclusively for livelihood purposes of DPRK

nationals and unrelated to the DPRK’s nuclear or ballistic missile programmes or other activities prohibited by

resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017),

2371 (2017), 2375 (2017) or this resolution, further decides that this prohibition shall not apply with respect to

crude oil that, for a period of twelve months after the date of adoption of this resolution, and for twelve

months periods thereafter, does not exceed 4 million barrels or 525,000 tons in the aggregate per twelve

month period, and decides that all Member States providing crude oil shall provide a report to the Committee

every 90 days from the date of adoption of this resolution of the amount of crude oil provided to the DPRK;

5. Decides that all Member States shall prohibit the direct or indirect supply, sale or transfer to the DPRK,

through their territories or by their nationals, or using their flag vessels, aircraft, pipelines, rail lines, or

vehicles, and whether or not originating in their territories, of all refined petroleum products, decides that the

DPRK shall not procure such products, further decides that this provision shall not apply with respect to pro-

curement by the DPRK or the direct or indirect supply, sale, or transfer to the DPRK, through their territories

or by their nationals, or using their flag vessels, aircraft, pipelines, rail lines, or vehicles, and whether or not

originating in their territories, of refined petroleum products, including diesel and kerosene, in the aggregate

amount of up to 500,000 barrels during a period of twelve months beginning on January 1, 2018, and for

twelve month periods thereafter, provided that (a) the Member State notifies the Committee every thirty days

of the amount of such supply, sale, or transfer to the DPRK of refined petroleum products along with infor-

mation about all the parties to the transaction, (b) the supply, sale, or transfer of refined petroleum products

involve no individuals or entities that are associated with the DPRK’s nuclear or ballistic missile programmes

or other activities prohibited by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270

(2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017), or this resolution, including designated individ-

uals or entities, or individuals or entities acting on their behalf or at their direction, or entities owned or con-

trolled by them, directly or indirectly, or individuals or entities assisting in the evasion of sanctions, and (c)

the supply, sale, or transfer of refined petroleum products are exclusively for livelihood purposes of DPRK

nationals and unrelated to generating revenue for the DPRK’s nuclear or ballistic missile programmes or other

activities prohibited by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321

(2016), 2356 (2017), 2371 (2017), 2375 (2017) or this resolution, directs the Committee Secretary beginning

on 1 January 2018 to notify all Member States when an aggregate amount of refined petroleum products sold,

supplied, or transferred to the DPRK of 75 per cent of the aggregate yearly amounts have been reached, also

directs the Committee Secretary beginning on 1 January 2018 to notify all Member States when an aggregate

amount of refined petroleum products sold, supplied, or transferred to the DPRK of 90 per cent of the aggre-

gate yearly amounts have been reached, and further directs the Committee Secretary beginning on 1 January

2018 to notify all Member States when an aggregate amount of refined petroleum products sold, supplied, or

transferred to the DPRK of 95 per cent of the aggregate yearly amounts have been reached and to inform them

that they must immediately cease selling, supplying, or transferring refined petroleum products to the DPRK

for the remainder of the year, directs the Committee to make publicly available on its website the total amount

of refined petroleum products sold, supplied, or transferred to the DPRK by month and by source country,

directs the Committee to update this information on a real-time basis as it receives notifications from Member

States, calls upon all Member States to regularly review this website to comply with the annual limits for re-

fined petroleum products established by this provision beginning on 1 January 2018, directs the Panel of Ex-

perts to closely monitor the implementation efforts of all Member States to provide assistance and ensure full

and global compliance, and requests the Secretary-General to make the necessary arrangements to this effect

and provide additional resources in this regard;

6. Decides that the DPRK shall not supply, sell or transfer, directly or indirectly, from its territory or by its

nationals or using its flag vessels or aircraft, food and agricultural products (HS codes 12, 08, 07), machinery

(HS code 84), electrical equipment (HS code 85), earth and stone including magnesite and magnesia (HS code

25), wood (HS code 44), and vessels (HS code 89), and that all States shall prohibit the procurement of the

above-mentioned commodities and products from the DPRK by their nationals, or using their flag vessels or

aircraft, whether or not originating in the territory of the DPRK, clarifies that the full sectoral ban on seafood

in paragraph 9 of resolution 2371 (2017) prohibits the DPRK from selling or transferring, directly or indirect-

ly, fishing rights, and further decides that for sales of and transactions involving all commodities and products

from the DPRK whose transfer, supply, or sale by the DPRK are prohibited by this paragraph and for which

written contracts have been finalized prior to the adoption of this resolution, all States may only allow those

shipments to be imported into their territories up to 30 days from the date of adoption of this resolution with

notification provided to the Committee containing details on those imports by no later than 45 days after the

date of adoption of this resolution;

Decides that all Member States shall prohibit the direct or indirect supply, sale or transfer to the DPRK,

through their territories or by their nationals, or using their flag vessels, aircraft, pipelines, rail lines, or

vehicles and whether or not originating in their territories, of all industrial machinery (HS codes 84 and 85),

transportation vehicles (HS codes 86 through 89), and iron, steel, and other metals (HS codes 72 through 83)

and further decides that this provision shall not apply with respect to the provision of spare parts needed to

maintain the safe operation of DPRK commercial civilian passenger aircraft (currently consisting of the

following aircraft models and types: An-24R/RV, An-148-100B, Il-18D, Il-62M, Tu-134B-3, Tu-154B,

Tu-204-100B, and Tu-204-300);

Expresses concern that DPRK nationals continue to work in other States for the purpose of generating

foreign export earnings that the DPRK uses to support its prohibited nuclear and ballistic missile programs

despite the adoption of paragraph 17 of resolution 2375 (2017), decides that Member States shall repatriate to

the DPRK all DPRK nationals earning income in that Member State’s jurisdiction and all DPRK government

safety oversight attachés monitoring DPRK workers abroad immediately but no later than 24 months from the

date of adoption of this resolution unless the Member State determines that a DPRK national is a national of

that Member State or a DPRK national whose repatriation is prohibited, subject to applicable national and

international law, including international refugee law and international human rights law, and the United

Nations Headquarters Agreement and the Convention on the Privileges and Immunities of the United Nations,

and further decides that all Member States shall provide a midterm report by 15 months from the date of

adoption of this resolution of all DPRK nationals earning income in that Member State’s jurisdiction that were

repatriated over the 12 month period starting from the date of adoption of this resolution, including an

explanation of why less than half of such DPRK nationals were repatriated by the end of that 12 month period

if applicable, and all Member States shall provide final reports by 27 months from the date of adoption of this

resolution;

Maritime Interdiction of Cargo Vessels

9. Notes with great concern that the DPRK is illicitly exporting coal and other prohibited items through

deceptive maritime practices and obtaining petroleum illegally through ship-to-ship transfers and decides that

Member States shall seize, inspect, and freeze (impound) any vessel in their ports, and may seize, inspect, and

freeze (impound) any vessel subject to its jurisdiction in its territorial waters, if the Member State has

reasonable grounds to believe that the vessel was involved in activities, or the transport of items, prohibited by

resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017),

2371

(2017), 2375 (2017), or this resolution, encourages Member States to consult with the flag States of relevant

vessels once they are seized, inspected, and frozen (impounded), and further decides that, after six months

from the date such vessels were frozen (impounded), this provision shall not apply if the Committee decides,

on a case-by-case basis and upon request of a flag State, that adequate arrangements have been made to

prevent the vessel from contributing to future violations of these resolutions;

10. Decides that when a Member State has information to suspect that the DPRK is attempting to supply, sell,

transfer or procure, directly or indirectly, illicit cargo, that Member State may request additional maritime and

shipping information from other relevant Member States, including to determine whether the item, com-

modity, or product in question originated from the DPRK, further decides that all Member States receiving

such inquiries shall respond as promptly as possible to such requests in an appropriate manner, decides that

the Committee, with the support of its Panel of Experts, shall facilitate timely coordination of such

information requests through an expedited process, and requests the Secretary-General to make the necessary

arrangements to this effect and provide additional resources to the Committee and the Panel of Experts in this

regard;

11. Reaffirms paragraph 22 of resolution 2321 (2016) and decides that each Member State shall prohibit its

nationals, persons subject to its jurisdiction and entities incorporated in its territory or subject to its

jurisdiction from providing insurance or re-insurance services to vessels it has reasonable grounds to believe

were involved in activities, or the transport of items, prohibited by resolutions 1718 (2006), 1874 (2009), 2087

(2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017), or this resolution,

unless the Committee determines on a case-by-case basis that the vessel is engaged in activities exclusively

for livelihood purposes which will not be used by DPRK individuals or entities to generate revenue or

exclusively for humanitarian purposes;

12.

Reaffirms paragraph 24 of resolution 2321 (2016) and decides that each Member State shall de-register

any vessel it has reasonable grounds to believe was involved in activities, or the transport of items, prohibited

by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017),

2371 (2017), 2375 (2017), or this resolution and prohibit its nationals, persons subject to its jurisdiction and

entities incorporated in its territory or subject to its jurisdiction from thereafter providing classification

services to such a vessel except as approved in advance by the Committee on a case-by-case basis, and further

decides that Member States shall not register any such vessel that has been de-registered by another Member

State pursuant to this paragraph except as approved in advance by the Committee on a case-by-case basis;

13.

Expresses concern that DPRK-flagged, controlled, chartered, or operated vessels intentionally

disregard requirements to operate their automatic identification systems (AIS) to evade UNSCR sanctions

monitoring by turning off such systems to mask their full movement history and calls upon Member States to

exercise enhanced vigilance with regards to such vessels conducting activities prohibited by resolutions 1718

(2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375

(2017), or this resolution;

14.

Recalls paragraph 30 of resolution 2321 (2016) and decides that all Member States shall prevent the

direct or indirect supply, sale or transfer to the DPRK, through their territories or by their nationals, or using

their flag vessels or aircraft, and whether or not originating in their territories, of any new or used vessels,

except as approved in advance by the Committee on a case-by-case basis;

15.

Decides that, if a Member State has information regarding the number, name, and registry of vessels

encountered in its territory or on the high seas that are designated by the Security Council or by the

Committee as subject to the asset freeze imposed by paragraph 8(d) of resolution 1718 (2006), the various

measures imposed by paragraph 12 of resolution 2321 (2016), the port entry ban imposed by paragraph 6 of

resolution 2371 (2017), or relevant measures in this resolution, then the Member State shall notify the

Committee of this information and what measures were taken to carry out an inspection, an asset freeze and

impoundment or other appropriate action as authorized by the relevant provisions of resolutions 1718 (2006),

1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017), or

this resolution;

16.

Decides that the provisions of this resolution shall not apply with respect solely to the trans-shipment of

Russia-origin coal to other countries through the Russia-DPRK Rajin-Khasan port and rail project, as

permitted by paragraph 8 of resolution 2371 (2017) and paragraph 18 of resolution 2375 (2017);

Sanctions Implementation

17.

Decides that Member States shall report to the Security Council within ninety days of the adoption of

this resolution, and thereafter upon request by the Committee, on concrete measures they have taken in order

to implement effectively the provisions of this resolution, requests the Panel of Experts, in cooperation with

other UN sanctions monitoring groups, to continue its efforts to assist Member States in preparing and

submitting such reports in a timely manner;

18.

Calls upon all Member States to redouble efforts to implement in full the measures in resolutions 1718

(2006), 1874 (2009), 2087 (2013), 2094 (2013) 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375

(2017) and this resolution and to cooperate with each other in doing so, particularly with respect to inspecting,

detecting and seizing items the transfer of which is prohibited by these resolutions;

19.

Decides that the mandate of the Committee, as set out in paragraph 12 of resolution 1718 (2006), shall

apply with respect to the measures imposed in this resolution and further decides that the mandate of the Panel

of Experts, as specified in paragraph 26 of resolution 1874 (2009) and modified in paragraph 1 of resolution

2345 (2017), shall also apply with respect to the measures imposed in this resolution;

20.

Decides to authorize all Member States to, and that all Member States shall, seize and dispose (such as

through destruction, rendering inoperable or unusable, storage, or transferring to a State other than the

originating or destination States for disposal) of items the supply, sale, transfer, or export of which is

prohibited by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270 (2016), 2321 (2016),

2356 (2017), 2371 (2017), 2375 (2017) or this resolution that are identified in inspections, in a manner that is

not inconsistent with their obligations under applicable Security Council resolutions, including resolution

1540 (2004), as well as any obligations of parties to the NPT, the Convention on the Prohibition of the

Development, Production, Stockpiling and Use of Chemical Weapons and on Their Development of 29 April

1997, and the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriologi-

cal (Biological) and Toxin Weapons and on Their Destruction of 10 April 1972;

21.

Emphasizes the importance of all States, including the DPRK, taking the necessary measures to ensure

that no claim shall lie at the instance of the DPRK, or of any person or entity in the DPRK, or of persons or

entities designated for measures set forth in resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013),

2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) or this resolution, or any person claiming

through or for the benefit of any such person or entity, in connection with any contract or other transaction

where its performance was prevented by reason of the measures imposed by this resolution or previous

resolutions;

22.

Emphasizes that the measures set forth in resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094

(2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371(2017), 2375 (2017) and this resolution shall in no way

impede the activities of diplomatic or consular missions in the DPRK pursuant to the Vienna Conventions on

Diplomatic and Consular Relations;

Political

23. Reiterates its deep concern at the grave hardship that the people in the DPRK are subjected to, condemns

the DPRK for pursuing nuclear weapons and ballistic missiles instead of the welfare of its people while people

in the DPRK have great unmet needs, emphasizes the necessity of the DPRK respecting and ensuring the

welfare and inherent dignity of people in the DPRK, and demands that the DPRK stop diverting its scarce

resources toward its development of nuclear weapons and ballistic missiles at the cost of the people in the

DPRK;

24. Regrets the DPRK’s massive diversion of its scarce resources toward its development of nuclear weapons

and a number of expensive ballistic missile programs, notes the findings of the United Nations Office for the

Coordination of Humanitarian Assistance that well over half of the people in the DPRK suffer from major

insecurities in food and medical care, including a very large number of pregnant and lactating women and

under-five children who are at risk of malnutrition and 41% of its total population who are undernourished,

and, in this context, expresses deep concern at the grave hardship to which the people in the DPRK are

subjected;

25. Reaffirms that the measures imposed by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094

(2013), 2270 (2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) and this resolution are not intend-

ed to have adverse humanitarian consequences for the civilian population of the DPRK or to affect negatively

or restrict those activities, including economic activities and cooperation, food aid and humanitarian assis-

tance, that are not prohibited by resolutions 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013), 2270

(2016), 2321 (2016), 2356 (2017), 2371 (2017), 2375 (2017) and this resolution, and the work of internation-

al and non-governmental organizations carrying out assistance and relief activities in the DPRK for the benefit

of the civilian population of the DPRK, stresses the DPRK’s primary responsibility and need to fully provide

for the livelihood needs of people in the DPRK, and decides that the Committee may, on a case-by-case basis,

exempt any activity from the measures imposed by these resolutions if the committee determines that such an

exemption is necessary to facilitate the work of such organizations in the DPRK or for any other purpose con-

sistent with the objectives of these resolutions;

26. Reaffirms its support for the Six Party Talks, calls for their resumption, and reiterates its support for the

commitments set forth in the Joint Statement of 19 September 2005 issued by China, the DPRK, Japan, the

Republic of Korea, the Russian Federation, and the United States, including that the goal of the Six-Party

Talks is the verifiable denuclearization of the Korean Peninsula in a peaceful manner and the return of the

DPRK to the Non-proliferation Treaty (NPT) and International Atomic Energy Agency safeguards at an early

date, bearing in mind the rights and obligations of States parties to the NPT and underlining the need for all

States parties to the NPT to continue to comply with their Treaty obligations, that the United States and the

DPRK undertook to respect each other’s sovereignty and exist peacefully together, that the Six Parties

undertook to promote economic cooperation, and all other relevant commitments;

27. Reiterates the importance of maintaining peace and stability on the Korean Peninsula and in north-east

Asia at large, and expresses its commitment to a peaceful, diplomatic, and political solution to the situation

and welcomes efforts by the Council members as well as other States to facilitate a peaceful and

comprehensive solution through dialogue and stresses the importance of working to reduce tensions in the

Korean Peninsula and beyond;

28. Affirms that it shall keep the DPRK’s actions under continuous review and is prepared to strengthen,

modify, suspend or lift the measures as may be needed in light of the DPRK’s compliance, and, in this regard,

expresses its determination to take further significant measures in the event of a further DPRK nuclear test or

launch, and decides that, if the DPRK conducts a further nuclear test or a launch of a ballistic missile system

capable of reaching intercontinental ranges or contributing to the development of a ballistic missile system

capable of such ranges, then the Security Council will take action to restrict further the export to the DPRK of

petroleum;

29. Decides to remain seized of the matter.

Description: Ch’oe So’k-min is an overseas Foreign Trade Bank representative. In 2016, Ch’oe
