(1986 का 29) क धारा 3 क उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठत उपधारा (1) ारा

द शिय का योग करते #ए, जारी करने का %ताव करती है, पयावरण (संरण) अिधिनयम, 1986 के िनयम 5 के

उपिनयम (3) क अपेानुसार, जनसाधारण क जानकारी के िलए, कािशत (कया जाता है; िजनके उससे भािवत होने क

संभावना है, और यह सूिचत (कया जाता है (क उ ा प अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना को

अंत+व, ट करने वाले भारत के राजप0 क ितयां जनसाधारण को उपल1ध करा दी जाती ह4, साठ (दन क अविध क समाि6

पर या उसके प7 चात् िवचार (कया जाएगा ;

कावल बाघ आरिती तेलंगाना के सबसे पुराने संरित े0 म: से एक है। यह आ(दलाबाद िजले म: गोदावरी नदी के

(कनारे हैदराबाद से 180 (कलोमीटर दूर ि%थत है। अभयारDय के दिणी भाग म: गोदावरी नदी बहती है। यह जैव-िविवधता

क चुरता के िलए जाना जाता है। यहां िविवध वन%पितयाँ (673 जाितयां) और उनसे संबंिधत जीवजतु (677 जाितयां)

पाये जाते ह4। यहां िविवध पी-जीव तथा शाकाहारी और मांसाहारी दोन तरह के जीव क चुरता है।

और, कावल बाघ आरिती क वन%पित दिणी उ,णकटबंधीय शु,क पणपाती वन का उम उदाहरण है जहां

मुGयतः सागौन और उससे संबंिधत वन पाए जाते ह4। यह आ(दलाबाद िजले के अंतगत दिणी पठार क िविश; पु,प एवं

जीवजतु िविवधता का ितिनिधIव करता है और घने वन , घासभूिम, खुले े0 , न(दय , धाराJ और जल िनकाय के प

म: वयजीव पयावास का उIकृ; मोज़ेक है। यह रॉयल बंगाल टाईगर (प4थेरा टाइगरस), गौर (बोस गौरास), जंगली कुा

(कुओन अAपाइनस) और रीछ (मेल स युरिसनस) इIया(द का आवास है िजसम: चौMसंगा (एंटेलोकाा %प.) और िहरण

(से+वडे %प.) जैसे कुछ शाकाहारी भी रहते ह4। इस अभयारDय का उO पारि%थितक महIव है, Pय (क यह गोदावरी नदी क

सहायक कदम नदी का जलQह े0 है। कावल बाघ आरिती पारि%थितक-णाली अRययन के िविभS िवषय कृित के

संवधन और वयजीव संरण पर अRययन (कया जा सकता है। यह अभयारDय सां%कृितक िवरासत के साथ-साथ आ(दवासी

जनजाितयां जैसे (क ग ड, नायकपोड और कोलाम और उनक सं%कृित से भी समृU है।

और, अभयारDय का े0फल लगभग 892.23 वग (कलोमीटर है और यह आ(दलाबाद िजले के दो संभाग जSाराम

(आंिशक प से) और िनमल (आंिशक प से) के जSारम, कWाम (आंिशक), उISूर (आंिशक), िसरपुर (यू) (आंिशक) मंडल म:

फैला #आ है। यह अभयारDय तडलपेट, जSारम, इंदानपीली, िबरसाईपेट, कWाम (भाग) और पेYबी (अंशतः) र:ज म: फैला #आ

है। यह दंडेपAली, कWाम (अंशतः), खानापुर (अंशतः), उISूर, इं ावली, अिसफाबाद, केरमेरी (अंशतः) और ितरयानी मंडल

मRयवतZ े0 के आ(दलाबाद, िनमल, जSारम और बेलमपAली संभाग म: 1123.2127 वग (कलोमीटर के े0 म: फैला है।

यह अभयारDय अ>छी तरह से उस गिलयारे के साथ भी जुड़ा है जो मRयवतZ े0 के िनकट कागाजनगर (अंशतः) और

बेAलमपाAली (अंशतः) म: फैला है।

और, इस अभयारDय म: जीवजतुJ क मुख जाितयां ह4 िजनम: बाघ (प:थेरा टगरस), त:दुआ (प:थेरा पाडस), जंगल

िबAली (फेिलस ब:गाल:िसस), सामाय लंगुर (ेि%बटीस इटेलस), भेिड़या (कैिनस Aयूपस), भारतीय लोमड़ी (वुलपस

ब:गल:िसस), जंगली कुा (कुआन एलपाइनस), रीछ (मेल स अरिसनस), साही (िह%टेरPस इंिडका), खरगोश (लेपस

िनिQकोिलस), गौर (बोस गौरस), नीलगाय (बोसेलाफस [ेगोकैमलस), चौस]गा मृग (टे^ेसेजरस _ाि[का+नस), Mचंकारा

Pलोरस अपूण, एं[ोपोगोन माqटनी और %कमा नवmसम शािमल ह4।

और, कावल बाघ आरिती के चार ओर के े0 को पारि%थितक और पयावरण क दृि; से पारि%थितक संवेदी

जोन के प म: संरित और सुरित करना आव7यक है। बाघ क िबखरी #ई संGया को सहेजने के िलए भी इस अभयारDय

के चार ओर के ाकृितक पयावास का संरण ज री है। कोर े0 म: बाघ क िबखरी #ई संGया को सहेजने और इह: िशकार

से बचाने के िलए %थल-िविश; पयावास क 9व%था करने हेतु भी इसका पारि%थितक संवेदी जोन होना ज री है।

महIवपूण %थान क गैर वन भूिम को भी पारि%थितक संवेदी जोन म: शािमल (कया जाता है Pय (क वह वयजीव क

आवाजाही के िलए अ>छा गिलयारा होती है;

अतः, अब, के ीय सरकार, पयावरण (संरण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पठत

पयावरण (संरण) अिधिनयम, 1986 (1986 का 29) क उपधारा (1) तथा धारा 3 क उपधारा (2) एवं उपधारा (3) के

खंड (v) और खंड (xiv) ारा द शिय का योग करते #ए, तेलंगाना राxय म: कावल बाघ आरिती क सीमा के चार

ओर 0.25 (कलोमीटर से 1 (कलोमीटर तक िव% तारत े0 को कावल बाघ आरिती पारि%थितक संवेदी जोन (िजसे इसम:

इसके प7 चात् पारि%थितक संवेदी जोन कहा गया है) के प म: अिधसूिचत करती है, िजसका िववरण िनानुसार है,

आरिती के चार ओर 0.25 (कलोमीटर से 1 (कलोमीटर तक िव%तारत है। पारि%थितक संवेदी जोन का िव%तार कावल

वयजीव अभयारDय के कोर के चार ओर के पूरे बफर े0 म: है, िजसम: कुछ ऐसी गैर-वन भूिम (बफर े0 के बाहर) शािमल

है, जो वयजीव और पारि%थितक क दृि; से महIवपूण है। कोर या बफर े0 क िनकटवतZ गैर वन भूिम के मामले म:,

इसक सीमाएं बफर े0 क संबंिधत सीमाJ से 1 (कलोमीटर क दूरी तक िव%तारत ह4। कWाम जलाशय के िनकटवतZ े0

के मामले म:, पारि%थितक संवेदी जोन का िव%तार अभयारDय क सीमा से 0.25 (कलोमीटर तक है। पारि%थितक संवेदी

जोन का े0फल 730 वग (कलोमीटर है।

(2) पारि%थितक संवेदी जोन क सीमा को दशाने वाला संरित े0 का मानिच0 उपाबंध I पर है और Qाम क

सूची को दशाने वाला मानिच0 उपाबंध I (क) पर है। संरित े0 और पारि%थितक संवेदी जोन क सीमा के भू-िनदzशांक

क सूची `मशः उपाबंध I (ख) और (ग) पर है ।

(3) पारि%थितक संवेदी जोन क सीमा का वणन उपाबंध II के प म: संल{ है ।

(4) मुGय MबंदुJ पर उनके भू-िनदzशांक के साथ पारि%थितक संवेदी जोन के अंतगत आने वाले 77 Qाम क सूची

उपाबंध III के प म: संल{ है ।

(1) राxय सरकार, पारि%थितक संवेदी जोन के

योजन के िलए, राजप0 म: अंितम अिधसूचना के काशन क तारीख से दो वष क अविध के भीतर, %थानीय 9िय के

परामश से और इस अिधसूचना म: (दए गए अनुबंध का पालन करते #ए, राxय सरकार के सम ािधकारी के अनुमोदनाथ

एक आंचिलक महायोजना तैयार करेगी।

(2) पारि%थितक संवेदी जोन के िलए आचंिलक महायोजना, इस अिधसूचना म: िविन@द, ट रीित से राx य सरकार

ारा ासंिगक क: ीय और राx य िविधय तथा क: ीय सरकार ारा जारी मागिनदzश , य(द कोई ह , के अनु प तैयार क

जाएगी ।

(3) आंचिलक महायोजना, पारि%थितक और पयावरणीय संबंधी सरोकार को समाकिलत करने के िलए, राx य

सरकार के िनिलिखत िवभाग के परामश से तैयार क जाएगी, अथात्:--

नगरपािलका और शहरी िवकास ;

पंचायती राज; और

xi.

लोक िन माण िव भाग।

(4) जब तक इस अिधसूचना म: िविन@द; न हो, आंचिलक महायोजना म: वतमान म: अनुमो(दत

भू-उपयोग, अवसंरचना और (`याकलाप पर कोई ितबंध नह] लगाया जाएगा तथा आचंिलक महायोजना म: सभी कार क

अवसंरचनाJ और (`याकलाप क बेहतरी क 9व%था क जाएगी िजससे (क वे अिधक द और पारि%थितक अनुकूल

बन सक: ।

(5) आंचिलक महायोजना म: अना>छा(दत े0 के जीणmUार, िव|मान जल िनकाय के संरण, आवाह े0 के

बंधन, जल-संभर के बंधन, भू-जल के बंधन, मृदा और नमी के संरण, %थानीय जनता क आव7यकताJ तथा

पारि%थितक एवं पयावरण के ऐसे अय पहलुJ, िजन पर Rयान देना आव7यक है, क 9व%था क जाएगी ।

(6) आंचिलक महायोजना म: सभी िव|मान पूजा % थल , Qाम और शहरी बि%तय , वन के कार और (क% म ,

आ(दवासी े0 , कृिष े0 , ऊपजाऊ भूिम, उ|ान एवं उ|ान क तरह के हरत े0 , बागवानी े0 , बगीच , झील ,

नमभूिमय और अय जल िनकाय क सीमा का िनधारण (कया जाएगा तथा सहायक मानिच0 भी (दया जाएगा। इस महा-

योजना से संबंिधत सहायक मानिच0 म: िव|मान और %तािवत भूिम के उपयोग क िवशेषताJ का 1यौरा (दया जाएगा।

(7) आंचिलक महायोजना के अंतगत पारि%थितक संवेदी जोन म: िवकास को िविनयिमत (कया जाएगा और सारणी

म: सूचीबU ितिषU, िविनयिमत (`याकलाप का पालन (कया जाएगा तथा % थानीय समुदाय क आजीिवका सुरा के

िलए, पारि%थितक अनुकूल िवकास सुिनि7 चत तथा संव+धत (कया जाएगा।

(8) आंचिलक महायोजना े0ीय िवकास योजना क सह-कािलक होगी ।

(9) इस कार अनुमो(दत आंचिलक महायोजना इस अिधसूचना के उपबंध के अनुसार मानीटरी के अपने कृIय को

करने क दृि; से मानीटरी सिमित के िलए एक संदभ द%तावेज होगी ।

(1) भू-उपयोग - (क) पारि%थितक संवेदी जोन म: वन , उ|ान-कृिष े0 , कृिष े0 , आमोद-मोद के योजन के

िलए िचि~नत (कए गए पाक और खुले %थान का वृहद वािणिxयक या वृहद आवासीय काYपलैPस या औ|ोिगक

(`याकलाप के े0 के bप म: उपयोग या संपरवतन नह] होगा:

(ख) परंतु पारि%थितक संवेदी जोन के भीतर भाग (क) म: िविन@द; योजन से िभS योजन के िलए कृिष और

अय भूिम का संपरवतन, मानीटरी सिमित क िसफारश पर और यथा लागू े0ीय नगर योजना अिधिनयम तथा

के ीय/राxय सरकार के अय िनयम तथा िविनयम के अधीन सम ािधकारी के पूव अनुमोदन से तथा इस अिधसूचना के

उपबंध ारा %थानीय िनवािसय क िनिलिखत आवासीय ज रत को पूरा करने के िलए अनुात (कया जाएगा, जैसे (क:-

(i)

िव|मान सड़क को चौड़ा करना, उह: सुदृढ करना और नई सड़क का संिनमाण;

(ii) बुिनयादी ढांच और नागरक सुिवधाJ का संिनमाण और नवीकरण;

(iii) दूषण उIपS न करने वाले लघु उ|ोग;

(iv) कुटीर उ|ोग, िजसके अंतगत Qामीण उ|ोग ह4; सुिवधा भDडार और %थानीय सुख-सुिवधाJ, जो पारि%थितक

पयटन म: सहायक ह4 िजसम: Qह वास सिYमिलत है; और

(v) संव+धत (`याकलाप और पैरा 4 म: (दए गए (`याकलाप।

(ग) परंतु यह भी (क े0ीय शहरी िनयोजन अिधिनयम के अधीन सम ािधकारी के पूव अनुमोदन के िबना तथा

राxय सरकार के अय िनयम एवं िविनयम का अनुपालन (कए िबना तथा संिवधान के अनु>छेद 244 के उपबंध तथा

तIसमय वृ िविध, िजसके अंतगत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकार क मायता)

अिधिनयम, 2006 (2007 का 2) भी है, के अनुपालन के िबना वािणिxयक या औ|ोिगक िवकास (`याकलाप के िलए

जनजातीय भूिम का योग अनुात नह] होगा।

(घ) परंतु यह भी (क पारि% थितक संवेदी जोन के भीतर क भूिम के अिभलेख म: उIपS (कसी 0ुट क, िनगरानी

सिमित के िवचार ा6 करने के प„ात्, राxय सरकार ारा Iयेक मामले म: एक बार शुिU क जाएगी और उ 0ुट के

शुिUकरण क सूचना क: ीय सरकार के पयावरण, वन और जलवायु परवतन मं0ालय को दी जाएगी ।

(ड.) परंतु यह भी (क उपयु 0ुट के शुिUकरण म:, इस उप-पैरा म: यथा उपबंिधत के िसवाय, (कसी भी दशा म: भू-

उपयोग का परवतन सिYमिलत नह] होगा ।

(च) अनुयुक् त या अनुI पादक कृिष े0 म: पुन: वनीकरण के तथा पयावास और जैव- िविवधता क बहाली के यास

(कए जाएंगे ।

(2) ाकृितक जल …ोत- आंचंिलक महायोजना म: सभी ाकृितक जल …ोत /न(दय /जलमागm क पहचान क जाएगी

और उसम: उनके संरण और बहाली क योजना सिY मिलत क जाएगी ।

(3) पयटन/पारि%थितक पयटन – (क) पारि%थितक संवेदी जोन के भीतर सभी नए पारि%थितक पयटन

(`याकलाप या िव|मान पयटन (`याकलाप का िव%तार पारि%थितक संवेदी जोन सYबंधी पयटन महायोजना के अनुसार

होगा ।

(ख) पारि%थितक पयटन महायोजना पयटन िवभाग ारा राxय सरकार के पयावरण और वन िवभाग के परामश से

तैयार क जाएगी ।

(ग) पयटन महायोजना आंचिलक महायोजना का एक घटक होगी ।

(घ) पयटन संबंधी (`याकलाप िनY नानुसार िविनयिमत (कए जाएंगे, अथात् :-

(i) वयजीव अभयारDय क सीमा से एक (कलोमीटर के भीतर या पारि%थितक संवेदी जोन क सीमा तक, इनम:

जो भी अिधक िनकट हो, (कसी होटल या रजॉट का नया सिSमाण अनुात नह] (कया जाएगा। तथािप, नए होटल

और रजॉट क %थापना, पारि%थितक पयटन सुिवधाJ के िलए वयजीव अभयारDय क सीमा से एक (कलोमीटर

क दूरी से परे पारि%थितक संवेदी जोन क सीमा तक पयटन महायोजना के अनुसार, पूव परभािषत और अभीिहत

े0 म: अनुात क जाएगी।

(ii) पारि%थितक संवेदी जोन के अदर सभी नए पयटन (`या-कलाप या िव|मान पयटन (`याकलाप का िव%तार

के ीय सरकार, पयावरण, वन और जलवायु परवतन मं0ालय ारा जारी मागदशZ िसUांत तथा पारि%थितक

पयटन पर बल देते #ए रा†ीय 9ा‡ संरण ािधकरण ारा जारी पारि%थितक पयटन संबंधी मागदशZ िसUांत

(समय-समय पर यथा संशोिधत) के अनुसार होगा ।

(iii) आंचिलक महायोजना का अनुमोदन (कए जाने तक, पयटन के िलए िवकास और िव|मान पयटन (`याकलाप

के िव%तार को वा%तिवक %थल िविन@द; संवीा तथा िनगरानी सिमित क िसफारश के आधार पर संबंिधत

िविनयामक ािधकरण ारा अनुात (कया जाएगा और पारि%थितक संवेदी जोन म: (कसी नए होटल/रसाट या

वािणिxयक ितˆान का संिSमाण अनुात नह] होगा ।

(4) ाकृितक िवरासत – पारि%थितक संवेदी जोन म: ब#मूAय ाकृितक िवरासत के सभी %थल जैसे (क सभी जीन

कलाIमक और सां%कृितक महIव के े0 क पहचान क जाएगी और उनके संरण क योजनाएं तैयार क जाएंगी तथा उहे

आंचिलक महायोजना म: शािमल (कया जाएगा।

(6) R विन दूषण– तेलंगाना राx य सरकार का पयावरण िवभाग या राx य दूषण िनयं0ण बोड, पयावरण (संरण)

अिधिनयम, 1986 के अधीन बने Rविन दूषण (िविनयमन और िनयं0ण) िनयम, 2000 के उपबंध के अनुसार पारि%थतक

संवेदी जोन म: R विन दूषण के िनयं0ण संबंधी िविनयम को लागू करेगा ।

(7) वायु दूषण-- पारि%थितक संवेदी जोन म:, वायु दूषण क रोकथाम और िनयं0ण वायु (दूषण िनवारण और

िनयं0ण) अिधिनयम, 1981 (1981 का 14) के उपबंध और उसके अधीन बनाए गए िनयम और उनम: (कए गए संशोधन

के अनुसार (कया जाएगा।

(8) बिह…ाव का िन%सारण - पारि%थितक संवेदी जोन म: उपचारत बिह…ाव का िन%सारण, पयावरण (संरण)

अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम के अतगत शािमल (कए गए पयावरणीय दूषण के िन%सारण संबंधी

साधारण मानक या राxय सरकार ारा िनयत मानक , जो भी अिधक कठोर हो, के अनुसार (कया जाएगा।

(9) ठोस अपिश; - ठोस अपिश; का िनपटान िनानुसार (कया जाएगा: -

(क) पारि%थितक संवेदी जोन म: ठोस अपिश; का िनपटान और बंधन भारत सरकार के पयावरण, वन और जलवायु

परवतन मं0ालय क समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), (दनांक 8 अैल, 2016 के

तहत कािशत ठोस अपिश; बंधन िनयम, 2016 के उपबंध के अनुसार (कया जाएगा। गैर-जैिवक पदाथm का

िनपटान पारि%थितक संवेदी जोन से बाहर िचि~नत (कए गए %थान पर पयावरण-अनुकूल रीित से (कया जाएगा;

(ii) जब तक इस अिधसूचना म: िविन(द; न हो, पारि%थितक संवेदी जोन म: क: ीय दूषण िनयं0ण बोड ारा

फरवरी, 2016 म: जारी (दशािनदzश म: (कए गए उ|ोग के वगZकरण के अनुसार केवल गैर- दूषणकारी उ|ोग क

12.

संिनमाण याकलाप ।

(क) संरिRत RेH क सीमा से एक कलोमीटर के भीतर या पा+रिथितक

संवेदी जोन क सीमा तक, इनम जो भी अिधक िनकट हो, कसी भी #कार

का नया वािणियक संिनमाण अनुOात नह; कया जाएगा:

परंतु थानीय िनवािसय क आवास सबधी िन^िलिखत आवयकता

को पूरा करने के िलए थानीय लोग को, पैरा 3 के उप पैरा (1) म सूचीब&

याकलाप सिहत अपने #योग के िलए, अपनी भूिम म भवन उप-िविधय

के अनुसार संिनमाण करने क अनुमित दी जाएगी जैसे क :-

(i) िव5मान सड़क को चौड़ा करना और उह सुदृढ करना और नई सड़क

का संिनमाण;

(ii) बुिनयादी ढांच और नाग+रक सुिवधा का संिनमाण और नवीकरण;

(iii) फरवरी, 2016 म कGीय #दूषण िनयंHण बोड Jारा कए गए वगMकरण

के अनुसार गैर- #दूषणकारी लघु उ5ोग;

(iv) `ामीण उ5ोग सिहत कुटीर उ5ोग, सुिवधा भaडार और `ह वास

सिहत पा+रिथितक पयटन म सहायक थानीय सुिवधाएं ; और

(v) इस अिधसूचना म सूचीब& बढ़ावा दए गए याकलाप ।

(ख) परतु लागू िनयम और िविनयम , यद कोई ह , के अनुसार सRम

#ािधकारी क पूव अनुमित से ऐसे लघु उ5ोग , जो #दूषण उ"पc नह; करते

हd, से संबंिधत संिनमाण याकलाप िविनयिमत कए जाएंगे और वे यूनतम

ह गे ।

(ग)एक कलोमीटर से आगे ये आंचिलक महायोजना के अनुसार िविनयिमत

ह गे ।

13.

गैर #दूषणकारी लघु उ5ोग ।

फरवरी, 2016 म केGीय #दूषण िनयंHण बोड Jारा जारी उ5ोग के

वगMकरण के अनुसार गैर-#दूषणकारी उ5ोग तथा अप+रसंकटमय लघु और

सेवा उ5ोग, कृिष, पुeप कृिष, बागबानी या कृिष आधा+रत उ5ोग, जो

पा+रिथितक संवेदी जोन से देशी सामि`य से उ"पाद बनाते हd, सRम

#ािधकारी Jारा अनुOात ह गे।

14.

फमf, कारपोरेट, कंपिनय Jारा बड़े पैमाने

पर वािणियक पशुधन संपदा और कुgकुट

फामf क थापना ।

लागू िविधय के अधीन िविनयिमत ह गे ।

15.

वृR क कटाई ।

(क) राय सरकार के सRम #ािधकारी क पूव अनुमित के िबना वन भूिम या

सरकारी या राजव या िनजी भूिम पर वृR क कटाई नह; होगी ।

(ख) वृR क कटाई कGीय या संबंिधत राय के अिधिनयम या उसके अधीन

बनाए गए िनयम के उपबंध के अनुसार िविनयिमत होगी ।

सिमित गठत करती है, जो िनिलिखत से िमलकर बनेगी:--

NOTIFICATION

New Delhi, the 12th March, 2018

S.O. 1122(E).— The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-

section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected

thereby and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry

of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to

the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification

WHEREAS, the Kawal Tiger Reserve is one of the oldest protected areas of Telangana. It is located in

Adilabad District at a distance of 180 kms from Hyderabad along the banks of river Godavari. The river Godavari runs in

the Southern side of the Sanctuary. It is well known for its richness in bio-diversity. It is an abode for a variety of flora

(673 species) and its associated fauna (677 species). It is well known for the abundance of both herbivorous and

carnivorous fauna besides being a home to a variety of avifauna.

AND WHEREAS, the vegetation of Kawal Tiger Reserve exhibits a classical example of southern tropical dry

deciduous forests with predominately teak and its associates. It represents the typical floral and faunal diversity of

Deccan Plateau falling in Adilabad district and forms excellent mosaic of wildlife habitat in the form of dense forests,

grasslands, open areas, rivers, streams and water bodies. The Royal Bengal Tiger (Panthera tigris), Gaur (Bos gaurus),

Wild dog (Cuon alpinus) and Sloth bear (Melursus ursinus), etc are present in the sanctuary with some herbivores

represented by Antelopes (Antelocapra sp.) and Deer (Cervidae sp.). The sanctuary has a high ecological value being the

catchment of River Kadam, a tributary of River Godavari. The Kawal Tiger Reserve offers varied subjects for ecosystem

studies and promotion of nature and wildlife conservation. The sanctuary is also rich in cultural heritage with aboriginal

tribes like Gonds, Naikpods and Kolams and their culture.

AND WHEREAS, the sanctuary covers an area of about 892.23 square kilometres and is spread over two

divisions Jannaram (Partly) & Nirmal (Partly) of Adilabad district covering Jannaram, Kaddam (Partly), Utnoor (Partly),

Sirpur (U) (Partly) mandals. The sanctuary extends over Tadlapet, Jannaram, Indanpally, Birsaipet, Kaddam (Part) &

Pembi (Part) Ranges. The Buffer area extends over the parts of Adilabad, Nirmal, Jannaram & Bellampally Divisions

over an area of 1123.2127 square kilometres covering the mandals of Dandepally, Kaddam (Part), Khanapur (Part),

Utnoor, Indervally, Asifabad, Kerameri (Part) and Tiryani. The sanctuary is also well connected with corridor which is

adjacent to Buffer area extending over the Kagaznagar (Part) and Bellampally (Part).

AND WHEREAS, the sanctuary has principal categories of fauna which includes Tiger (Panthera tigris),

Leopard (Panthera pardus), Jungle Cat (Felis bengalensis), Common Langur (Presbytis entellus), Wolf (Canis lupus),

Indian Fox (Vulpus bengalensis), Wild dog (Cuan alpinus), Sloth Bear (Melursus ursines), Porcupine (Hysterix indica),

Hare (Lepus nigricollis), Gaur (Bos gaurus), Nilgai (Boselaphus dragocamulus), Fourhorned Antelope (Tetraczerus

quadricornis), Chinkara (Gazelle gazelle), Sambar (Cervus unicolour), Spotted Deer (Axis axis), Wild Boar (Sus

cropha), Monitor Lizard (Veranus bengalensis), Python (Python molurus), Common Crait (Bungarus caeruleus), Rat

Snake (Pytyas mucosus), Little Cormorant (Phalacrocorax niger), Grey Heron (Ardea cinerea), Black Ibis (Pseudibis

papillosa), Lesser Whistling Teal (Dendrocygna javanica), Redcrested Pochard (Netta rufina), Brahminy Kite (Haliastur

Indus), Grey Junglefowl (Gallus sonneratii) and Indian Peafowl (Pavo cristatus).

AND WHEREAS, the sanctuary has also the principal species of southern tropical dry deciduous forest which

includes Tectona grandis, Pterocarpus marsupium, Terminalia alata, Stephygyne parvifolia, Anogeissus latifolia,

Chloroxylon swietenia, Dalbergia latifolia, Adina cordifolia, Lagerstroemia parviflora, Sterculia urens, Bombax ceiba,

Albizzia, odoratissima, Terminalia bellerica, Bridelia retusa, Dalbergia paniculata, Diospyros melanoxylon, Emblica

officinalis, Ficus infectoria, Madhuca latifolia, Lannea coromandelica, Terminalia arjuna, Terminalia chebula, Acacia

sundra, Cleistanthus collinus, Acacia leucophloea, Aegle marmelos, Buchanania lanzan, Buchanania lanzan, Cassia

fistula, Feronia elephantum, Acacia nilotica, Bauhinia racemosa, Dolichandrone falcata, Butea monosperma, Careya

arborea, Cochlospermum religiosum, Morinda tinctoria, Holarrhena antidysenterica, Semecarpus anacarduim,

Soymida febrifuga, Wrightia tinctoria, Schleichera oleosa, Strychnos potatorum, Zizyphus mauriatiana, Zizyphus

xylopyrus, Dendrocalamus strictus.The principle shrub species are Annona squamosa, Calotropis gigantea, Cassia

auriculata, Dodonea viscosa, Gardenia gummifera, Gymnosporia montana, Helecteris isora, Ixora parviflora, Randia

dumetorum, Nyctanthes arbortristis, Bridelia hamiltoniana. The principle grass species are Heteropogon contortus,

Ischaemum pilosum, Aristida adscensionis, Cynodon dactylon, Eragrostis unioloides, Chloris incompleta, Andropogon

martini and Schima nervosum.

AND WHEREAS, it is necessary to conserve and protect the area around the protected area of Kawal Wildlife

Sanctuary as Eco Sensitive Zone from ecological and environmental point of view. It is necessary to conserve the natural

habitat around the sanctuary to supplement the spillover population of tigers. Eco Sensitive Zone is necessary to provide

site specific habitat supplement to the spillover population of the tiger and its prey from core area. The non forest lands at

important locations are also included in the Eco Sensitive Zone as they provide good corridor for movement of Wildlife.

NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section

(2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule

5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying

from 0.25 kilometre to 1 kilometre around the boundary of Kawal Tiger Reserve in the State of Telangana as the Kawal

Tiger Reserve Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under,

namely:-

Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone varies from 0.25

kilometre to 1 kilometre around the Kawal Tiger Reserve. The extent of Eco Sensitive Zone is the entire Buffer area

surrounding the Core of Kawal Wildlife Sanctuary including some of the non forest lands (outside the Buffer area) which

are important from wildlife and ecological point of view. In case of non forest lands adjoining the Core or Buffer areas it

extends to a distance of 1 kilometre from the respective boundaries of the buffer. In case of areas adjoining the Kaddam

reservoir, the Eco Sensitive Zone extends to 0.25 kilometre from the boundary of the sanctuary. The area of the Eco-

Sensitive Zone is 730 square kilometers.

(2) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure I and map showing the

list of villages is appended at Annexure I (A). The list of geo co-ordinates of the boundary of the Protected Area and the

Eco-Sensitive Zone is at Annexure I (B) and (C) respectively.

(3) The boundary description of the Eco Sensitive Zone is appended at Annexure II.

(4) The list of 77 villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is

appended as Annexure III.

Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is

specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by

the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the

ecological and environmental considerations into the said plan:

Environment,

ii.

Forest and Wildlife,

iii.

Agriculture and Horticulture,

iv.

Revenue,

Urban Development,

vi.

Tourism including eco-tourism,

vii.

Rural Development,

viii.

Irrigation and Flood Control,

ix.

Municipal and Urban Development,

Panchayati Raj, and

xi.

Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and

activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all

infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water

bodies, management of catchment areas, watershed management, groundwater management, soil and moisture

conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and

kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards,

lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of

existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities

listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out

its functions of monitoring in accordance with the provisions of this notification.

Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Landuse.-

(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-

sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or

industrial activities.

(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a),

within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the

prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of

Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the

local residents such as:

Widening and strengthening of existing roads and construction of new roads;

ii.

Construction and renovation of infrastructure and civic amenities;

iii.

Small scale industries not causing pollution;

iv.

Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism

including home stay; and

Promoted activities and given under para 4.

without the prior approval of the competent authority under Regional Town Planning Act and other rules and

regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the

law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition

of Forest Rights) Act, 2006 (2 of 2007):

(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the

State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

(e) Provided also that the above correction of error shall not include change of land use in any case except as provided

under this sub-paragraph.

(f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and

biodiversity restoration activities.

(2) Natural Springs.- The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their

conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

(3) Tourism/Eco-Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-

Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of

Environment and Forests.

(d) The activities of eco-tourism shall be regulated as under, namely:-

(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary

or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the

Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be

allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time)

with emphasis on eco-tourism;

(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall

be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the

Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a

heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,

and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their

conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Telangana State Pollution Control Board

shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions

stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance

with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder

and amendments thereto.

(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental

(Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more

stringent.

(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid

Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and

Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the

inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive

Zone;

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and

regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste.- Bio medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical

Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and

Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.

(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules

and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per

the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of

Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as

amended from time to time.

(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the

Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management

Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide

notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-

Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and

Climate Change and as amended from time to time.

(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is

prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with

applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting

industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued

by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting

cottage industries shall be promoted.

(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:

(a)

The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b)

No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers

necessary, in giving effect to the provisions of this notification.

List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All

activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29

of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental

Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980

undertake construction in their land for their use

including the activities listed in sub paragraph (1) of

paragraph 3 as per building byelaws to meet the

residential needs of the local residents such as:

(i)

Widening and strengthening of existing roads

and construction of new roads;

(ii) Construction and renovation of infrastructure

and civic amenities;

(iii) Small scale industries not causing pollution

termed as per Classification done by Central

Pollution Control Board of February 2016;

(iv) Cottage industries including village industries;

5. Monitoring Committee.- In exercise of the powers conferred by sub-section (3) of section 3 (1) of the

Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes the first Monitoring

Committee, for effective monitoring of the Eco Sensitive Zone, which shall comprise of, namely:-

6. Terms of Reference.-

(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by

the State Government and subsequently the Monitoring Committee would be constituted by the State Government.

(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the

Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment,

2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E)

dated 6^th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the

prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be

considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533(E), dated the 14^th September, 2006 and S.O. 19 (E) dated 6^th

January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table

under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions

and referred to the concerned Regulatory Authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file

complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who

contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from

Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to

issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of every

year by 30^th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per

proforma appended at Annexure IV.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it

deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.
