सं. 1533(अ) दनांक 14 िसत" बर, 2006 (इसम% इसके प& चात उ( त अिधसूचना के )प म% उि*लिखत) का और

संशोधन करने के िलए अिधसूचना, िजसे क%1ीय सरकार, पयावरण (संर2ण) अिधिनयम, 1986 (1986 का 29) क

धारा 3 क उपधारा (1) और उपधारा (2) के खंड (v) :ारा ;द त शि<य= का ;योग करते ?ए, जारी करने का

;@ ताव करती है, का िन" निलिखत ;ा)प, पयावरण (संर2ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) क

अपे2ानुसार, जनसाधारण िजनके उसके :ारा ;भािवत होने क संभावना है, क जानकारी के िलए, एतEारा

;कािशत कया जाता है; और एतEारा सूचना दी जाती है क उ( त ;ा)प अिधसूचना पर, उस तारीख से, िजसको

भारत के राजप क ;ितयां, िजसम% यह अिधसूचना अंतFवG ट हI, जनसाधारण को उपलJ ध करा दी जाती हI, साठ

दन क अविध क समािK पर या उसके प& चात् िवचार कया जाएगा; और

ऐसा कोई O यि<, जो ;ा)प अिधसूचना म% अं तFवG ट ;@ ताव= पर कोई आ2ेप या सुझाव देने म% िहतबQ है,

इस ;कार िविनRदG ट अविध के भीतर, क%1ीय सरकार :ारा िवचार कए जाने के िलए, आ2ेप या सुझाव सिचव,

पयावरण, वन और जलवायु पSरवतन मंालय, इं दरा पयावरण भवन, जोर बाग रोड, नई द* ली-110003 को

यत:, केW 1ीय सरकार भवन= तथा संिनमाण 2े के िलए अनुमितय= को सरल बना रही है और उसके साथ-

साथ और अिधक व@ तुिनG ठता तथा पारदFशता बरतते ?ए पयावरण म% सुधार करने के िलए सुदृढ़ ;यास कर रही है;

यत:, शहरी 2े= म% कमजोर वग\ के िलए वहनीय खच] म% आवास उपलJ ध कराने के उ^े& य से 2022 तक

सभी को आवास के ल_ य को ;ा` त करने के िलए ; aया को सु;वाही बनाना मह वपूण है;

यत:, बड़ी संc या म% भवन= तथा संिनमाण ;@ ताव= क पयावरणीय @ वीकृित के आकलन के आधार पर

पयावरणीय @ वीकृितयां ;दान करने के िलए व@ तुपरक मानदd ड िनधाSरत कये जा सकते हI;

और यत: वतमान पयावरणीय O यव@ था म% िनFमत 2े के 20,000 वग मीटर से अिधक के भवन= तथा

संिनमाण= को शािमल कया गया है, व@ तुिनG ठ िसQाW त= और पयावरण को संरि2त करने क आव& यकता के

आधार पर इस ;ारंिभक सीमा को िनFमत 2े के 50,000 वग मीटर तक बढ़ाने का ;@ ताव है;

अत: अब , पयावरण (संर2ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के खंड (घ) के साथ पSठत उ( त

पयावरण (संर2ण)अिधिनयम, 1986 (1986 का 29) क धारा 3 क उपधारा (1) और उपखंड (2) के खंड (v)

:ारा ;द त शि<य= का ;योग करते ?ए केW 1ीय सरकार एतद:ारा उ( त अिधसूचना म% िन" निलिखत संशोधन

करती है जो राजप म% अिWतम ;काशन क तारीख से लागू ह=गे, अथात् :-

पैरा 14 के @ थान पर िनgिलिखत ;ित@ थािपत कया जाएगा :-

“14. भवन िनमाण क अनुमित म% पयावरणीय शत\ को शािमल कया जाना

पSरयोजना ;@ तावक :ारा > 5000 वग मीटर और < 50,000 वग मीटर क िनमाण तथा संिनमाण

पSरयोजनाi के िलए िनमाण क अनुमित हेतु @ थानीय ;ािधकरण को आवेदन के अितSर( त पSरिशG ट XIV म%

िविनRदG ट पयावरणीय शत\ के अनुपालन के िलए @ वघोषणा ;प आन लाइन ;@ तुत कया जाएगा। त प& चात

@ थानीय ;ािधकरण पSरिशG ट XIV म% िविनRदG ट पयावरणीय शत\ को समािवG ट करते ?ए भवन िनमाण क

अनुमित जारी कर सकता है और उन शत\ के आधार पर पSरयोजना शु) करने क अनुमित दे सकता है। @ थानीय

;ािधकरण िवkमान तं के माl यम से पयावरणीय शत\ के अनुपालन को सुिनिmत करेगा । तथािप, पSरिशG ट

XIV म% िविनRदG ट पयावरणीय शत\ म% कसी ;कार के पSरवतन क अनुमित नहn दी जाएगी।

(II) अनुसूची म%, मद 8 तथा उससे संबंिधत ;िविG टय= के िलए िन" निलिखत मद तथा ;िविG टयां ;ित@ थािपत

वषा जल संचयन क एक योजना बनाए जाने क आव&यकता है िजसम% Sरचाज बोर

(; येक 5,000 वग मीटर िनFमत 2े पर Wयूनतम एक Sरचाज) क िसफाSरश क

जाती है। संिचत वषा जल के भंडार तथा पुनः;योग को बढ़ावा दया जाना चािहए।

ऐसे 2े= म% जहां भू-जल @ तर को बढ़ाना yवहाय न हो, वषा जल का भंडारण और

पुनः;योग कया जाना चािहए। स2म ;ािधकारी क अनुमित के िबना भू-जल नहn

िनकाला जाएगा। सभी Sरचाज को उथले जलभृत तक सीिमत रखा जाना चािहए।

2 (क)

@थानीय भवन उपिनयम= म% यथा अपेि2त कम से कम 20% खुला @थान ;भावनीय

होगा। कम से कम 50% ओप|नंग के साथ पेवर, पेवर Jलौक= लIड@केप इ या द को

;भावनीय तल समझा जाएगा।

;णािलयां सं@थािपत क जानी चािहए। लIड@केप से एककृत होने वाली ;कृितक

शोधन ;णािलय= को बढ़ावा दया जाएगा। जहां तक संभाव हो शोिधत बिह : €ाव

का पुनः;योग कया जाना चािहए। अितSर< शोिधत बिह:ाव को सीपीसीबी

;ितमान= के अनुपालन म% िन@ताSरत कया जाएगा। सेि`टक टIक= सिहत ऑनसाइट

सीवेज शोधन से िनकले गाद को शहरी िवकास मंालय, क%1ीय लोक @वा@ƒय और

पयावरण अिभयांिक संगठन (सीपीएचईईओ) के सीवरेज तथा सीवेज शोधन

;णाली मैनुअल, 2013 के अनुसार एकित, भेजना और िन@ताSरत कया जाएगा।

ठोस अपिश~ (;बंधन) िनयम, 2016 तथा ई-अपिश~ (;बंधन) िनयम, 2016 और

`लाि@टक अपिश~ (;बंधन) िनयम, 2016 का अनुपलन कया जाएगा।

ऊजा

ऊजा द2ता Jयूरो के ऊजा संर2ण भवन कोड (ईसीबीसी) का अनुपालन सुिनिmत

कया जाएगा। रा…य= म% ऐसे भवन िजनम% उनके अपने ईसीबीसी अिधसुिचत हI,

उनम% रा…य ईसीबीसी का अनुपालन कया जाएगा।

आउटडोर तथा साझा 2े क ;काश yव@था म% ला†ट एिम‡टंग डायोड (एलईडी)

का ;योग होगा।

िडमांड लोड के 1% समतु*य अथवा रा…य @तरीय/@थानीय भवन उपिनयम= क

अपे2ा अनुसार िबजली उ पादन क पूFत करने हेतु सौर, पवन अथवा नवीकरणीय

ऊजा, जो भी अिधक हो, क सं@थापना क जाएगी।

वािणि…यक तथा सं@थागत भवन= क गम जल क मांग को पूरा करने के िलए

अथवा @थानीय भवन उपिनयम= क आव&यकतानुसार, जो भी अिधक हो, सोलर

वाटर ही‡टंग क yव@था क जाएगी। आवासीय भवन= के िलए भी यथासंभव

अपनी गम जल मांग क पूFत हेतु सोलर वाटर हीटर= क िसफाSरश क जाती है।

भवन िडजाइन= म% पैिसव सोलर िडजाइन क संक*पना शािमल क जाएगी िजसम%

िडजाइन के त व= जैसे भवन अिभमुखीकरण, लIड@के|पंग, द2 भवन एनवेलप,

समुिचत िखड़ कय= क yव@था, दन म% अिधक ;काश करने क yव@था म% सुधार

और थमल मास इ या द का ;योग करके भवन= म% ऊजा खपत को Wयूनतम कया

जाता है। दीवार%, िखड़ कयां और छत के यू-वॅा*व ईसीबीसी िविशि~य= के अनुसार

ह=गे।

वायु गुणव‰ा

तथा शोर

भवन और साथ ही @थल के िलए धूल, धुआं एवं अWय वायु ;दूषण िनवारण के

उपाय कए जाएंगे। इन उपाय= म% िनमाणाधीन भवन, @थल के चार= ओर धूल/धूल

रोकने वाली दीवार= का िनमाण (कम से कम 3 मीटर क ऊंचाई तक) के िलए

आवरण म% शािमल हो सक%गे। `लाSटक/तारपोलीन @थल से कचरा उठाने के साथ-

साथ बालू, सीम%ट मुरम म% चलती ?ई गािडयाँ तथा अWय िनमाण समि‹यां धूल

;दूषण का कारण हो सकती हI।

साइट पर बालू, मुरम िबखरी िमŒी, सीम%ट भंडार को उिचत तरीके से ढक कर रखा

जाएगा िजससे क धूल ;दूषण को रोका जा सके।

िपसाई तथा प थर कटाई के िलए वेट जेट का ;बंध कया जाएगा। धूल को दबाने के

िलए िबना पटरी िबछा ?आ धरातल तथा िबखरी िमटटी पर उिचत तरीके से पानी

का िछडकाव कया जायेगा l

िनमाण तथा िवlवंस सारे मलबे को उिचत तरीके से िनपटान से पहले साइट के पास

इकट्ठा कया जायेगा (तथा सड़क के कनारे ढेर या बाहर खुली जगह म% इकट्ठा

नहn) सभी िवlवंस तथा िनमाण अपिश~ िनयम, 2016 के उपबंध= के अनुसार

;बंिधत होगा l िनमाण @थल पर काय करने वाले सभी कामगार= तथा िनमाण

साम‹ी क लो|डंग अनलो|डंग म% शािमल, िनमाण क ढुलाई तथा िनमाण के कचरे

या धुल ;दूषण के कसी भी 2े म% काय कर रहे yि< को ड@ट मा@क उपलJध

कराया जाएगा l आंतSरक वायु गुणव‰ा के िलए भारत के राŽीय भवन कोड के

अनुसार वातायन के ;ावधान तैयार कये जाएंगे l

5(क)

डीजी सेट का @थान िनधारण तथा िनकास पाइप क ऊँचाई सीपीसीबी मानदंड= के

;ावधान= के अनुसार होगा l

;ित 80 वग मीटर क भूिम के िलए कम से कम एक पेड़ लगाकर उसक देखभाल

जायेगा l कम से कम कटाई तथा भराई होनी चािहए l

भवन उप िनयम, 2016 के अनुसार भंडारण तथा Sरचाज के िलए पयाK ;ावधान=

का पालन कया जाना चािहए l

वषा जल संचयन योजना का िडजाईन बनाने क आव&यकता है जहाँ 5000 वग

मीटर के िनFमत 2े म% कम से कम एक Sरचाज बोर हो तथा कम से कम कुल एक

दन के शुQ जल के ;बंधन क भंडारण 2मता क आव&यकता होगी l उन 2े=,

जहाँ भूिमगत जल को Sरचाज करना संभव नहn है, म% वषा जल संचयन चािहए तथा

पुनः उपयोग के िलए भंडारण कया जायेगा l भूिमगत जल को स2म ;ािधकारी क

अनुमोदन के िबना नहn िनकाला जाएगा l सभी Sरचाज सिमित उथले जलभृत तक

सीिमत होनी चािहए l

2(क)

@थानीय भवन उप-िनयम= :ारा यथाअपेि2त खुले @थान= का कम से कम 20%

भाग भेk होगा। Wयूनतम 50% खाली जगह , भूदृ&य आ द सिहत खंडज=, खंड ;खंड

के उपयोग सिहत यथा ;वे&य धरातल के )प म% िवचार कया जाएगा l

ठोस अपिश~: ; येक इकाई म% और भू तल पर पृथक-पृथक गीले और सूखे कचरे के

िडJबे, अपिश~ के पृथरण को सुिवधाजनक बनाने के िलए ;दान कये जाय%गेl

मलजल: अपिश~ 100% अपिश~ जल के शोधन क @थल पर मलजल शोधन

2मता सं@थािपत क जानी है। शोिधत अपिशG ट जल को @ थल पर भूदृ& य, फल|शंग,

कू|लंग टावर और अW य ;योजनाथ पुन: ;योग कया जाएगा। अितSर( त शोिधत

जल को सीपीसीबी मानक= के अनुसार छोड़ा जाएगा। ;ाकृितक शोधन ;णािलय=

को बढ़ावा दया जाएगा।

सेि`टक टIको सिहत @ थल पर (ऑन साईट) शोधन से अवमल का मल-िनयास और

मलजल शोधन ;णाली, 2013 पर शहरी िवकास मंालय, क%1ीय लोक @ वा@ ƒ य

और पयावरणीय इंजीिनय‡रंग संगठन (सीपीएचईईओ), के मैनुअल के अनुसार

सं‹हण, ढुलाई और िनपटान कया जाएगा। ठोस अपिशG ट (;बंधन) िनयम,2016

और ई- अपिशG ट (;बंधन) िनयम, 2016 और ` लाि@टक अपिशG ट (;बंधन)

िनयम,2016 के ;ावधान= का अनुपालन कया जाएगा।

S.O. 1132(E)—The following draft of the notification, further to amend the notification of the Government of

India in the erstwhile Ministry of Environment and Forests number S.O.1533 (E), dated the 14^th September, 2006

(hereinafter referred to as the said notification) which the Central Government proposes to issue in exercise of the powers

conferred by sub-section (1), and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29

of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the

information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be

taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette

containing this notification are made available to the Public;

Any person interested in making any objections or suggestions on the proposal contained in the draft

notification may forward the same in writing for consideration of the Central Government within the period so specified

Draft Notification

Whereas, the Central Government is streamlining the permissions for buildings and construction sector while

simultaneously strengthening efforts to improve environment through greater objectivity and transparency;

Whereas, it is important to streamline the process to achieve housing for all by 2022 with the objective of

making available affordable housing to weaker section in urban areas;

Whereas, on the basis of assessment of large number of cases of Environmental Clearances of building and

construction proposals, objective criteria can be laid down for grant of Environmental Clearances;

And whereas, the current environmental regime covers buildings and constructions of above 20,000 square

meter of built up area, it is proposed to increase the threshold value to 50, 0000 square meter of built up area based on

objective principles and need for protecting the environment;

Now, therefore, in exercise of powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3

of the said Environment (Protection) Act, 1986 (29 of 1986), read with clause (d) of sub-rule (3) of rule 5 of the

Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the

said notification which shall come into force on the date of its final publication in the Official Gazette, namely:-

(I)

The paragraph 14 shall be substituted with following: -

“14 . Integration of environmental condition in building permissions

A Self Declaration Form to comply with the environmental conditions as given at Appendix XIV shall be

submitted online by the project proponent besides application for building permission to the local authorityfor building

permission to the local authority for the Building and Construction projects ≥5,000 sq. mtrs and.<50,000 sq. mtrs.

Thereafter, the local authority may issue the building permission incorporating the environmental conditions specified in

Appendix XIV and allow the project to commence based on the conditions. The local authority shall ensure the

compliance of the environmental conditions through existing mechanism. However, no changes in the environmental

conditions specified in Appendix XIV shall be permitted.

(II) In the Schedule, for item 8 and the entries relating thereto, the following item and entries shall be

substituted, namely: -

water. No construction shall be allowed to obstruct the natural drainage through the

site. No construction is allowed on wetland and water bodies. Check dams,

bioswales, landscape, and other sustainable urban drainage systems (SUDS) are

allowed for maintaining the drainage pattern and to harvest rain water.

Use of water efficient appliances shall be promoted. The local bye-law provisions on

rain water harvesting should be followed.

If local bye-law provision is not available, adequate provision for storage and

A rain water harvesting plan needs to be designed where the recharge bores

(minimum one recharge bore per 5,000 square meters of built up area) is

recommended. Storage and reuse of the rain water harvested should be promoted. In

and stored for reuse. The ground water shall not be withdrawn without approval from

2(a)

At least 20% of the open spaces as required by the local building bye-laws shall be

pervious. Use of Grass pavers, paver blocks with at least 50% opening, landscape

etc. would be considered as pervious surface.

Waste

Management

Solid waste: Separate wet and dry bins must be provided in each unit and at the

ground level for facilitating segregation of waste.

Sewage: In areas where there is no municipal sewage network, onsite treatment

systems should be installed. Natural treatment systems which integrate with the

landscape shall be promoted. As far as possible treated effluent should be reused.

The excess treated effluent shall be discharged following the statutory norms notified

by Ministry of Environment, Forest and Climate Change.

Sludge from the onsite sewage treatment, including septic tanks, shall be collected,

conveyed and disposed as per theMinistry of Urban Development, Central Public

Health and Environmental Engineering Organisation(CPHEEO)Manual on Sewerage

and Sewage Treatment Systems, 2013.

The provisions of the Solid Waste (Management) Rules 2016 and the e-waste

(Management) Rules 2016, and the Plastics Waste (Management) Rules 2016 shall

be followed.

Energy

Compliance with the Energy Conservation Building Code (ECBC) of Bureau of

Energy Efficiency shall be ensured. Buildings in the States which have notified their

own ECBC, shall comply with the State ECBC.

Outdoor and common area lighting shall be Light Emitting Diode (LED).

Solar, wind or other Renewable Energy shall be installed to meet electricity

generation equivalent to 1% of the demand load or as per the state level/ local

building bye-laws requirement, whichever is higher.

Solar water heating shall be provided to meet 20% of the hot water demand of the

commercial and institutional building or as per the requirement of the local building

bye-laws, whichever is higher. Residential buildings are also recommended to meet

its hot water demand from solar water heaters, as far as possible.

Concept of passive solar design that minimize energy consumption in buildings by

using design elements, such as building orientation, landscaping, efficient building

envelope, appropriate fenestration, increased day lighting design and thermal mass

etc. shall be incorporated in the building design.

Wall, window, and roof u-values shall be as per ECBC specifications.

Air Quality and Noise

Dust, smoke & other air pollution prevention measures shall be provided for the

building as well as the site. These measures shall include screens for the building

under construction, continuous dust/ wind breaking walls all around the site (at least

3 meter height). Plastic/tarpaulin sheet covers shall be provided for vehicles bringing

in sand, cement, murram and other construction materials prone to causing dust

pollution at the site as well as taking out debris from the site.

Sand, murram, loose soil, cement, stored on site shall be covered adequately so as to

prevent dust pollution.

Wet jet shall be provided for grinding and stone cutting. Unpaved surfaces and loose

soil shall be adequately sprinkled with water to suppress dust.

All construction and demolition debris shall be stored at the site (and not dumped on

the roads or open spaces outside) before they are properly disposed. All demolition

and construction waste shall be managed as per the provisions of the Construction

and Demolition Waste Rules 2016. All workers working at the construction site and

involved in loading, unloading, carriage of construction material and construction

debris or working in any area with dust pollution shall be provided with dust mask.

For indoor air quality the ventilation provisions as per National Building Code of

India shall be made.

5 (a)

The location of the DG set and exhaust pipe height shall be as per the provisions of

the statutory norms notified by Ministry of Environment, Forest and Climate Change.

Green Cover

A minimum of 1 tree for every 80 square meters of land should be planted and

Fly ash should be used as building material in the construction as per the provisions

of the Fly Ash Notification of September, 1999 as amended from time to time.

A comprehensive mobility plan, as per Ministry of Housing and Urban Affairs best

practices guidelines (URDPFI), shall be prepared to include motorized, non-

motorized, public, and private networks.

Road should be designed with due consideration for environment, and safety of

users. The road system can be designed with these basic criteria.

1. Hierarchy of roads with proper segregation of vehicular and pedestrian

traffic.

2. Traffic calming measures.

3. Proper design of entry and exit points.

4. Parking norms as per local regulation.
