अिधसूचना सं. का. आ. 3688 (अ), तारीख 27 जुलाई, 2018, ारा एक ाप अिधसूचना कािशत क गई थी िजसम ऐसे सभी

(ि)य* से, िजनके उससे भािवत होने क संभावना थी, उस तारीख से, िजसको उ) अिधसूचना से यु) राजप क ितयां जनता

को उपल/ध करा दी गई थ1, साठ 3दन क अविध के भीतर आ5ेप और सुझाव आमंि त 3कए गए थे;

क है, िजसम वष 1986 म रामानाथापुरम और तूतीकोरन के तटीय िजल* सिहत 21 अपतटीय ीप* (2 जलम[ सिहत) और बंगाल

क खाड़ी म आसपास के कोरल चRान णाली शािमल हS। ग;फ ऑफ म>ार मरन रा?ीय उ@ान क Bथापना का ाथिमक उKेLय

संर5ण और बंधन के मा\यम से म>ार 5े क खाड़ी क समृ^ समुOी जैव िविवधता को संरि5त करना है;

और

और, ग;फ ऑफ म>ार म मरन वनBपितय* और जीवजHतु_ क समृ^ िविवधता है इनम कोरल चRान, चRानी समुO तट,

बलुआ समुO तट, िमRी क सपाट भूिम, नदी मुहाने, मSTोव वन, समुOी शैवाल और समुOी घास के 5े जैसी पारिBथितक णाली

शािमल हS। इस पारिBथितक णाली म िविवध जीवजHतु_ और वनBपितय* क िविवधता का आaय है िजसम दुलभ चSb, झ1गा,

समुOी झ1गा, पल ऑयBटर, cहेल, डुगeग, कछुए, सीहासfस, समुOी सांप, समुOी ककड़ी, आ3द शािमल हS। ग;फ ऑफ म>ार म

पारिBथितक णाली क िविवध कृित अनेक महFवपूण जाितय* क िवBतृत िविवधता को आaय दान करती है िजसम कोरल

क 117 जाितयां, समुOी घास क 13 जाितयां, gBटेिसयन क 641 जाितयां, मोलBक क 731 जाितयां, 3फन मछिलय* क

441 जाितयां और ऋतु वास मरन Bतनधारय* जैसे cहेल, डॉि;फ़न, सूंस और कछु_ के अलावा सीवीड क 147 जाितयां

शािमल है;

और,

और, मSTोव पयावास* म वनBपितय* क 9 िविभ> जाितयां हS जो समुOी प5ी और समुOी सांप सिहत िविभ> समुOी

जीवजHतु_ को आaय दान करता है। ग;फ ऑफ म>ार म सेgेड चंक, टबनेलायूरम चंक और पल ऑयटर बेड भी पाए जाते हS।

यहां लगभग दस पल बSक है। पीनटाडा फूकटा पल ऑयBटर क मुnय जाित है। ग;फ ऑफ म>ार को वनBपित और जीवजHतु क

4200 से अिधक जाितय* के साथ "जीविवpानी Bवग" के 8प म माना जाता था;

और, यह 5े भारतीय तट से अलग महFवपूण आिखरी आaय-Bथान है जहां अिधकांश लु9ाय Bतनधारी, डुग*ग (डुगग

डुगन) पाए जाते हS। 5े म दुलभ और अितीय बलानोqलोसस भी है जो अकशेक और कशेक के बीच एक rलक है। यह 5े

उ@ान तट के साथ लगभग 47 मFBय पालन Tाम हS िजनम रामानाथापुरम िजला म 38 और तूतीकोरन िजला म 9 Tाम हS। इन

Tाम* के मछुआरे पूरी तरह से अपनी आजीिवका के िलए मFBय पालन पर िनभर हS। कुल िमलाकर इन Tाम* म 150,000 से अिधक

मछुआरे रहते हS, िजनम 40% से अिधक स3gय मछुआरे हS। स3दय* से ग;फ ऑफ म>ार के तट पर रहने वाले कई हजार परवार* के

िलए तटवत€ जल म मFBय संसाधन* का उपयोग एकमा (वसाय रहा है । वह तटीय और समुOी पयावरण के साथ इस तरह क

घिनता म रहे हS 3क उनके जीवन-शैली, संBकृित और सामािजक जीवन सभी समुO के चार* ओर क3Oत है;

और,

और, मछुआरन ताजी मछली िवपणन, सूखी मछली और शु^ िमaण जैसे संब^ 3gयकलाप* म लगी :ई हS। तट के साथ

मFBयपालन से संबंिधत (वसाय* के अलावा, नमक िनsकषण म रोजगार के अवसर हS, खासतौर पर तूतीकोरन के पास खाड़ी के

पिƒमी भाग म, और पा;मराह (टाडी) टैrपग और कृिष aम म भी है। रामानाथापुरम िजला म आमतौर पर चटाई बनाने के साथ

राजप म इस अिधसूचना के काशन क तारीख से दो वष क अविध के भीतर, Bथानीय (ि)य* के परामश से और रा‰य के स5म

ािधकारी के अनुमोदन के िलए इस अिधसूचना म 3दए गए अनुबंध* का पालन करते :ए आंचिलक महायोजना तैयार करेगी।

(2) रा‰य सरकार ारा पारिBथितक संवेदी जोन के िलए आचंिलक महायोजना ऐसी रीित से जो इस अिधसूचना म िविन…दs ट 3कए

गए हS के अनुसार तथा सुसंगत कOीय और रा‰ य िविधय* के अनुप और कOीय सरकार ारा जारी मागिनदfश*, य3द कोई ह*, ारा

तैयार होगी ।

(3) आंचिलक महायोजना, उ) योजना म पारिBथितक और पयावरणीय बात* को समाकिलत करने के िलए रा‰ य सरकार के

िनŠिलिखत िवभाग* के परामश से तैयार होगी:-

(4) आंचिलक महायोजना अनुमो3दत िव@मान भू-उपयोग, अवसंरचना और 3gयाकलाप* पर कोई िनब‹धन अिधरोिपत नह1 करेगी

जब तक 3क इस अिधसूचना म इस कार िविन…दs ट न हो और आचंिलक महायोजना सभी अवसंरचना और 3gयाकलाप* म जो

अिधक द5ता और पारिBथितक अनुकूल ह* का संवधन करेगी ।

(5) आंचिलक महायोजना म अनाŒछा3दत 5े * के जीण^ार, िव@मान जल िनकाय* के संर5ण, आवाह 5े * के बंधन, जल-

संभर* के बंधन, जल संभर बंधन, मृदा और नमी संर5ण, Bथानीय समुदाय* क आवLयकता_ तथा पारिBथितक और पयावरण

से संबंिधत ऐसे अHय पहलु_, िजन पर \यान देना आवLयक है, के िलए उपबंध ह*गे ।

(6) आंचिलक महायोजना िव@मान और Bतािवत भूिम उपयोग िवशेषता_ के /यौर* से अनुसमŽथत मानिच के साथ सभी

िव@मान पूजा B थल*, Tाम* और नगरीय बिBतय*, वन* के कार और 3कB म*, कृिष 5े *, ऊपजाऊ भूिम, हरत 5े जैसे उ@ान और

उसी कार के B थान, उ@ान कृिष 5े , फलोउ@ान, झील* और अHय जल िनकाय* का अयकंन करेगी।

(7) आंचिलक महायोजना पारिBथितक संवेदी जोन म िवकास को िविनयिमत करेगी और सारणी म सूचीब^ पैरा-4 म ितिष^

और िविनयिमत 3gयाकलाप* का अनुपालन करेगी और B थानीय समुदाय* क जीिवका को सुरि5त करने के िलए पारिBथितक

अनुकूल िवकास को सुिनिƒत और उसक अिभवृि^ भी करेगी।

(8) आंचिलक महायोजना ादेिशक िवकास योजना क सह-िवBतारी होगी ।

(9) इस कार अनुमो3दत आंचिलक महायोजना इस अिधसूचना के उपबंध* के अनुसार िनगरानी के अपने काय‡ को करने के िलए

िनगरानी सिमित के िलए एक संदभ दBतावेज तैयार करेगी ।

संपरवतन िनगरानी सिमित क िसफारश पर और यथा लागू और 5े ीय नगर योजना अिधिनयम और केHOीय सरकार या रा‰य

सरकार के अHय िनयम* तथा िविनयम* के अधीन स5म ािधकारी के पूव अनुमोदन से, और इस अिधसूचना के उपबंध* ारा

Bथानीय िनवािसय* क िनŠिलिखत आवासीय आवLयकता_ को पूरा करने के िलए अनुpात 3कया जाएगा, जैसे:-

(i) िव@मान सड़क* को चौड़ा करना और उHह सुदृढ़ करना तथा नई सड़क* का संिनमाण;

(ii) बुिनयादी ढांच* और नागरक सुिवधा_ का संिनमाण और नवीकरण;

(iii) दूषण उFप> न करने वाले लघु उ@ोग;

(iv) कुटीर उ@ोग* िजनके अंतगत Tामीण उ@ोग भी हS; सुिवधाजनक भvडार और Bथानीय सुिवधाएं सहायक पारिBथितक पयटन

िजसके अHतगत Tह वास सिGमिलत है; और

(v) पैरा 4 के अधीन 3दए गए संवŽधत 3gयाकलाप:

परंतु यह और 3क ादेिशक नगर योजना अिधिनयम और रा‰य सरकार के अHय िनयम* और िविनयम* के अधीन स5म

ािधकारी के पूव अनुमोदन और संिवधान के अनुŒछेद 244 के उपबंध* या तFसमय वृU िविध के उपबंध* के अनुपालन के िबना,

िजसके अHतगत अनुसूिचत जनजाित और अHय परंपरागत वन िनवासी (वन अिधकार* क माHयता) अिधिनयम, 2006 (2007 का

2) भी है, वािणि‰यक या औ@ोिगक िवकास 3gयाकलाप* के िलए जनजातीय भूिम का उपयोग अनुpात नह1 होगा:

परंतु यह और भी 3क पारिBथितक संवेदी जोन के भीतर भू-अिभलेख* म उपसंजात कोई गलती, िनगरानी सिमित के िवचार ा9

करने के पƒात् रा‰य सरकार ारा Fयेक मामले म एक बार ठीक होगी और उ) गलती के सुधार क सूचना कOीय सरकार के

पयावरण, वन और जलवायु परवतन मं ालय को दी जाएगी:

परंतु यह और भी 3क गलती के संशोधन म इस उप पैरा के अधीन यथा उपबंिधत के िसवाय 3कसी भी दशा म भू-उपयोग का

परवतन सिGमिलत नह1 होगा।

(ख) वनीकरण तथा वास जीण^ार 3gयाकलाप* सिहत अनयुy त या अनुF पादक कृिष 5े * म पुन: वनीकरण करने के यास 3कए

जाएंगे।

उनके िनकट िवकास 3gयाकलाप ितिष^ करने के बारे म जो ऐसे 5े * के िलए अिहतकर हो ऐसी रीित से मागदशक िस^ांत तैयार

3कए जाएंगे ।

पारिथितक पयटन.- (क) पारिBथितक संवेदी जोन के भीतर सभी नए पारिBथितक पयटन 3gयाकलाप या

िव@मान पयटन 3gयाकलाप* का िवBतार पयटन महायोजना के अनुसार पारिBथितक संवेदी जोन के िलए होगा।

(ख) पयटन महायोजना रा‰य पयटन िवभाग ारा रा‰य पयावरण और वन िवभाग के परामश से तैयार होगी।

(ग) पयटन महायोजना आंचिलक महायोजना के एक घटक के 8प म होगी।

(घ) पयटन महायोजना पारिBथितक संवेदी जोन क वहन 5मता के आधार पर तैयार क जाएगी।

(ङ) पारिBथितक पयटन संबंधी 3gयाकलाप िनŠानुसार िविनयिमत ह*गे:-

(i) संरि5त 5े क सीमा से एक 3कलोमीटर के भीतर या पारिBथितक संवेदी जोन के िवBतार तक, इनम जो भी िनकट है, नये

वािणि‰यक होटल और सैरगाह के सि>माण अनुpात नह1 ह*गे:

परंतु, संरि5त 5े क सीमा से एक 3कलोमीटर क दूरी से परे पारिBथितक संवेदी जोन के िवBतार तक होटल* और

िनबंधन.- (1) िनगरानी सिमित इस अिधसूचना के उपबंध* के अनुपालन क िनगरानी करेगी।

(2) िनगरानी सिमित का कायकाल तीन वष तक या रा‰य सरकार ारा नई सिमित का पुनगठन 3कए जाने तक होगा और इसके बाद

िविन…द† ितिष^ गितिविधय* के िसवाय आने वाले ऐसे 3gयाकलाप* क दशा म वाBतिवक िविन…द† Bथलीय दशा_ पर आधारत

िनगरानी सिमित ारा संवी5ा क जाएगी और उ) अिधसूचना के उपबंध* के अधीन पूव पयावरण अनापिU के िलए केHOीय सरकार

के पयावरण, वन और जलवायु परवतन मं ालय को िन…द† क जाएगी।

(4) इस अिधसूचना के पैरा 4 के अधीन सारणी म यथा िविन…द† ितिष^ 3gयाकलाप* के िसवाय, भारत सरकार के तF कालीन

पयावरण और वन मं ालय क अिधसूचना संnया का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 क अिधसूचना के अनुसूची के अधीन

ऐसे 3gयाकलाप*, िजHह सिGमिलत नह1 3कया गया है, परंतु पारिBथितक संवेदी जोन म आते हS, ऐसे 3gयाकलाप* क वाBतिवक

िविन…द† Bथलीय दशा_ पर आधारत मानीटरी सिमित ारा संवी5ा क जाएगी और उसे संब^ िविनयामक ािधकरण* को

िन…द† 3कया जाएगा।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 1st January, 2020

S.O. 08(E).—WHEREAS, a draft notification was published in the Gazette of India, Extraordinary, vide

notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O.

3688(E), dated the 27^th July, 2018, inviting objections and suggestions from all persons likely to be affected thereby

within the period of sixty days from the date on which copies of the Gazette containing the said notification were

made available to the public;

AND WHEREAS, copies of the Gazette containing the said draft notification were made available to the

public on the 27^th July, 2018;

AND WHEREAS, no objections and suggestions were received from persons and stakeholders in response

to the draft notification;

AND WHEREAS, the Gulf of Mannar Marine National Park lies Latitude 8⁰49'00"N and 9⁰15'00"N and

Longitude 78⁰11'30"E and 79⁰10'5"E in the Ramanathapuram and Tuticorin District of Tamil Nadu and extends over

an area of 560.00 square kilometres. The Government of Tamil Nadu vide G.O. Ms. No. 962, Forests and Fisheries

Department dated the 10^th September, 1986 notified the intention to declare the Marine National Park in Gulf of

Mannar area in Tamil Nadu for the purpose of protecting Wildlife there in and its environments, including 3.5

fathom depth of sea on the Bay side and 5 fathom depth on the seaward side under the sub-section (1) of section 35

of the Wildlife (Protection) Act, 1972 (53 of 1972);

AND WHEREAS, the 21 islands which are fringed by coral reefs and bear mangroves vegetation are in

the Gulf of Mannar Marine National Park, off the coasts of Ramnad and Tuticorin district to the south east;

AND WHEREAS, the Gulf of Mannar is one of the four major reef ecosystems in India. The Government

of Tamil Nadu has established the Gulf of Mannar Marine National Park (GOMMNP) under the provision of the

Wildlife (Protection) Act, 1972 (53 of 1972), encompassing the 21 off-shore islands (including 2 submerged) and

surrounding coral reef system in the Bay of Bengal, along the coastal districts of Ramanathapuram and Tuticorin in

the year 1986. The primary objective of the establishment of the GOMMNP is to conserve the rich marine

biodiversity of the Gulf of Mannar region by providing protection and through management;

AND WHEREAS, the Gulf of Mannar is endowed with a rich variety of marine flora and fauna as it

includes ecosystems like coral reefs, rocky shores, sandy beaches, mud flats, estuaries, mangrove forests, seaweed

stretches and sea grass beds. These ecosystems support a wide variety of fauna and flora including rare chanks,

shrimps, lobsters, pearl oysters, whales, dugongs, turtles, seahorses, sea snakes, sea cucumbers, etc. The diverse

nature of ecosystems in the Gulf of Mannar supports a wide variety of significant species including 117 species of

corals, 13 species of sea grasses, 641 species of crustaceans, 731 species of molluscs, 441 species of fin fishes and

147 species of seaweeds apart from the seasonally migrating marine mammals like whales, dolphins, porpoises and

turtles;

AND WHEREAS, the mangrove habitats have 9 different species of vegetation supporting a variety of

marine fauna including seabirds and sea snakes. The sacred chank, a Turbinella pyrum, Chank and pearl oyster bed

also occurs in the Gulf of Mannar. There are about ten pearl banks. The most preferred species of pearl oyster is

Pinctada fucata. The Gulf of Mannar was considered as “Biologists’ paradise” with over 4200 species of flora and

fauna;

AND WHEREAS, the area is the last refuge of the most endangered mammal, Dugong (Dugong dugon)

occurs at the Indian coast. The area also contains the rare and unique Balanoglossus which is a link between

invertebrates and vertebrates. The area is also very richly endowed with unique coral formations, marine shells,

molluscs and tropical fish associated with coral islands. The playful Dolphins are also seen in this area;

AND WHEREAS, the National Park is basically for the conservation of marine flora and fauna. Examples

of flora are rosary pea (Abrus precatorius), wattles (Acacia norrida), umbrella thorn (Acacia planifrons), nettle

(Acalypha indica), prickly chaff flower (Achyranthes aspera), etc.; examples of fauna are sea cow (Dugong dugon),

rissos dolphin (Grampus griseus), bottle nosed dolphin (Tursiops truncates), chinese white dolphin (Sausa

chinensis), etc. The National Park has a variety of birds e.g. great egret (Ardea alba), grey heron (Ardea cinerea),

pond heron (Ardea grayii), western reef heron (Egretta gularis), Ardeola striatus, greater flamingo (Phoneicopterns

rosens), northern pintail (Anas acuta), etc.;

AND WHEREAS, the National park has endemic, rare, endangered and threatened species. The endemic

species in Gulf of Mannar includes namely, Balanoglossus, Enhalus acaroides and Pempis acidula. The endangered

species present in the Sanctuary are sea cucumbers (Holothurians), green turtle (Chelonia mydas), hawksbill turtle

(Eretmochelys imbricate), olive ridley turtle (Lepidochelys olivacea), loggerhead turtle (Caretta caretta), leather

back turtle (Dermochelys coriacea), sea horses (Sygnathidae), etc. Examples of rare species are short finned pilot

whale (Globicephala macrorhyncha), rissos dolphin (Grampus griseus), bottle nosed dolphin (Tursiops truncates),

Chinese white dolphin (Sausa chinensis), false killer whale (Pseudoarca crassidens), Bryde’s whale (Baleonoptera

edeni), etc. sea cow (Dugong dugon) is threatened species recorded in the Sanctuary;

AND WHEREAS, there is no habitation within the Marine National Park and Eco-sensitive Zone. There

are about 47 fishing villages along the Gulf of Mannar Marine National Park coast, of which 38 are in

Ramanathapuram District and 9 villages are in Tuticorin District. The fishermen from these villages depend solely

on fishing for their livelihood. There are altogethers about over 150,000 fisher-folk living in these villages of which

more than 40% are active fishermen. Exploitation of fishery resources in the inshore waters had been the sole

occupation for several thousand families living along the coast of Gulf of Mannar for centuries. They have been in

such close intimacy with the coastal and marine environment that their life-style, culture and social life all centres

around the sea;

AND WHEREAS, the fisherwomen are engaged in allied activities such as fresh fish marketing, dry fish

and net mending. In addition to fisheries-related occupations along the coast, there are opportunities for employment

in salt extraction, particularly in the western side of the Gulf near Tuticorin, and also in Palmyrah (toddy) tapping

and agricultural labour. Skilled work is also undertaken, with mat weaving common in Ramanathapuram district.

Moving inland from the coast toddy tapping and agriculture are the predominant occupations with small business-

related opportunities prevalent near Rameswaram in connection with the tourism in this area;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Gulf of

Mannar Marine National Park which are specified in paragraph 1 as Eco-sensitive Zone from ecological,

environmental and biodiversity point of view and to prohibit industries or class of industries and their operations

and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of

sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area

with an extent varying from 0.73 kilometre to 5.57 kilometre around the boundary of Gulf of Mannar Marine

National Park in the State of Tamil Nadu as the Gulf of Mannar Marine National Park Eco-sensitive Zone (hereafter

in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from 0.73

kilometer to 5.57 kilometer around the Gulf of Mannar Marine National Park. The area of the Eco-sensitive

Zone is 720.89 square kilometers.

(2) The boundary description of the Eco-sensitive Zone is appended at Annexure-I.

(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure IIA-E.

(4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-sensitive Zone is appended as Table

A and Table B of Annexure-III.

(5) There is no village falling within the Eco-sensitive Zone.

2. Zonal Master Plan for the Eco-sensitive Zone. - (1) The State Government shall, for the purposes of effective

management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of

publication of this notification in the Official Gazette, in consultation with local people and adhering to the

stipulations given in this Notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines

issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State

Government, for integrating environmental and ecological considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development ;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department;

(xii) Highways; and

(xiii) Tamil Nadu State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and

activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all

infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing

water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture

conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types

and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,

orchards, lakes and other water bodies and also with supporting maps giving details of existing and proposed land

use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated

activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of

local communities livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying

out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land use. –(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or residential

or industrial activities:

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part

(a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with

the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of

Central Government or State Government as applicable and vide provisions of this Notification, to meet the

residential needs of the local residents, such as:-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-

tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the competent authority under Regional Town Planning Act and other rules

and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution

or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers

(Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected

by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction

of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate

Change:

Provided also that the correction of error shall not include change of land use in any case except as provided

under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat

restoration activities.

(2) Natural water bodies. - The catchment areas of all natural springs/rivers/channels shall be identified and plans

for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be

drawn up by the State Government in such a manner as to prohibit development activities at or near these areas

which are detrimental to such areas.

(3)Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within

the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b)The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with

State Departments of Environment and Forests.

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone.

(e) The activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary

of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the

extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in

pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone

shall be in accordance with the guidelines issued by the Central Government in the Ministry of

Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger

Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-

education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism

activities shall be permitted by the concerned regulatory authorities based on the actual site specific

scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial

establishment construction is permitted within Eco-sensitive Zone area.

(4) Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified

and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal

Master Plan.

(5) Man-made heritage sites.-Buildings, structures, artifacts, areas and precincts of historical, architectural,

aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for

their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution.-The Environment Department of the State Government or Tamil Nadu State Pollution Control

Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the

provisions stipulated of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment

(Protection) Act, 1986.

(7) Air pollution.-Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in

accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules

made thereunder.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental

(Protection) Act, 1986 and the rules made thereunder or standards stipulated by the State Government whichever is

more stringent.

(9) Solid wastes.-Disposal and Management of solid wastes shall be as under:-

(a) The solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid

Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest

and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time;

the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-

sensitive Zone.

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and

regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-Medical Waste.-Bio-Medical Waste Management shall be as under:-

(a) The Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-

Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment,

Forest and Climate Change vide Notification Number G.S.R. 343 (E), dated the 28^th March,2016 as amended from

time to time.

(b) Safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and

regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic Waste Management.-The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as

per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the

Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18^th March,

2016, as amended from time to time.

(12) Construction and Demolition Waste Management.-The Construction and Demolition Waste Management in

the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste

Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate

Change vide notification number G.S.R. 317(E), dated the 29^th March, 2016, as amended from time to time.

(13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of

the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest

and Climate Change and as amended from time to time.

(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal

Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring

Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations

made thereunder.

(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be compliance with applicable laws

and efforts to be made for use of cleaner fuel CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting

industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in

the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this

notification and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of Hill Slopes.-The protection of hill slopes shall be as under:-

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) Construction shall not be permitted on existing steep hill slopes or slopes with a high degree of erosion.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-

sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the

rules made thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment

Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian

Forest Act, 1927 (16 of 1927) the Wildlife(Protection) Act, 1972 (53 of 1972) and amendments made thereto and be

regulated in the manner specified in the Table below, namely:-

Provided that, beyond one kilometre from the boundary of

the protected Area or up to the extent of Eco-sensitive Zone

whichever is nearer, all new tourist activities or expansion

of existing activities shall be in conformity with the

Tourism Master Plan and guidelines as applicable.

Construction activities.

(a)

New commercial construction of any kind shall not be

permitted within one kilometre from the boundary of

the Protected Area or upto extent of the Eco-sensitive

Zone whichever is nearer:

Provided that, local people shall be permitted to

undertake construction in their land for their use

including the activities listed in sub -paragraph (1) of

paragraph 3 as per building bye-laws to meet the

residential needs of the local residents.

Provided that the construction activity related to

small scale industries not causing pollution shall be

regulated and kept at the minimum, with the prior

permission from the competent authority as per

applicable rules and regulations, if any.

(b)

Beyond one kilometre it shall be regulated as per the

Zonal Master Plan.

10.

Small scale non polluting industries.

Non polluting industries as per classification of industries

issued by the central Pollution Control Board in February,

2016 and non-hazardous, small scale and service industry,

agriculture, floriculture, horticulture or agro-based industry

producing products from indigenous materials from the

Eco-sensitive Zone shall be permitted by the competent

authority.

11.

Felling of trees.

(a)

There shall be no felling of trees in the forest or

permission of the Competent Authority in the State

with the provisions of the concerned Central or State

notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee

by the State Government and subsequently the Monitoring Committee would be constituted by the State

Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006, and are falling in the

Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be

scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central

Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under

the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006 and are

falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4

thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred

to the concerned regulatory authorities.

(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be

competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any

person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on

issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31^st March of

every year by the 30^th June of that year to the Chief Wildlife Warden in the State as per Performa given in

Annexure IV.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions,

as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme

Court of India or the High Court or the National Green Tribunal.

BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA

Boundary description for Eco-sensitive zone of Gulf of Mannar Marine National Park is as described for

individual Island Groups as below;

Tuticorin Group:

North

The boundary of the Eco-sensitive Zone starts at a distance of around 2.90 kilometre from

the northern boundary National Park boundary on a point on HTL north of Keelavaippar

Village.

North East

At a distance of 2.0 kilometre. from the northern boundary (north east of Karaichalli Island)

National Park boundary

East

The boundary runs at distance of 2.0 kilometres in south eastern direction from the boundary

of National Park. Then proceeds in south western direction at a distance of 2.0 kilometre.

from the eastern boundary of the National Park near east of Vilanguchalli Island.

South East

At a distance of 2.0 kilometre. from the South eastern tip of the National Park boundary

which is south east of Vaan Island.

South

At a distance of 2.0 kilometres south of Vaan Island.

South West

At a distance of 4.16 in south eastern direction from the south western tip of the boundary of

National Park Southwest of Vaan Island on a point on HTL near the Old Harbour, Tuticorin

West

The boundary proceeds north wards along the HTL from the point near Old Harbour till it

touches the point on HTL north of Keelavaippar village.

North West

The boundary travels along the HTL till it touches the point on HTL north of Keelavaippar

village.

Vembar Island Group:

North

The boundary of the Eco-sensitive Zone starts at a distance of around 3.10 Kilometre from

the northern boundary National Park boundary north of Uppu tanni Island near Mookaiyur.

Thence the boundary proceeds eastwards along the High Tide Line.

North East

At a point on High Tide Line east of Periakulam village sea shore at a distance of around

2.0 Kilometre from the northern boundary of the National Park north of Nallatanni Island.

East

Thence the boundary runs at distance of 2.0 Kilometre in south eastern direction from the

boundary of National Park.

South East

At a distance of 2.0 kilometre. from the South eastern tip of the National Park boundary

which is south east of Nallatanni Island.

South

At a distance of 2.0 kilometre south of southern boundary of the National Park south of

Nallatanni. Thence the boundary proceeds at distance of 2.0 Kilometre westwards.

South West

At a distance of 2.0 Kilometre in south eastern direction from the south western tip of the

boundary of National Park Southwest of Upputanni Island.

West

The boundary proceeds north wards along at a distance of 2.0 Kilometre. from the boundary

of the National Park till it touches a point on HTL.

North West

The boundary starts at a point on HTL east of Naripaiyyur village at a distance of 4.0

Kilometre. from the north western boundary of the National Park, north west of Upputanni

Island.

Keelakarai and Mandapam Island Groups:

North

The boundary of the Eco-sensitive Zone starts at a distance of around 2.50 Kilometre from

the northern boundary National Park boundary north of Anaipar Island on a point on HTL

south of Chinna Erwadi Village. Thence the boundary proceeds eastwards along the High

Tide Line till it touches a point east of Kundugal village in Rameshwaram.

North East

At a distance of 2.0 kilometre. from the northern eastern boundary on the north east of Shingle

Island of National Park boundary.

East

The boundary runs at distance of 2.0 kilometre in southward direction from the boundary of

National Park.

South East

At a distance of 2.0 Kilometre. from the South eastern tip of the National Park boundary

which is south east of Shingle Island.

South

At a distance of 2.0 Kilometre south of boundary of the National Park of Mandapam and

Keelakarai Group of Island.

South West

At a distance of 2.0 Kilometre in south western direction from the south western tip of the

boundary of National Park, Southwest of Anaipar Island.

West

The boundary proceeds north wards at a distance of 2.0 Kilometre from the boundary of

National Park on the west of Anaipar island till it touches a point on High Tide Line near

Valinokkam village.

North West

The boundary starts at a point on the Northwestern point on the HTL northwest of Anaipar
