असाधारण, भाग (I) खंड 3, उपखंड (i) म दनांक 20 अगत 2019 को सा.का.िन. 132 (अ), दनांक 23 अगत 2019

को कृिष उपज (ेणीकरण और िच नांकन) अिधिनयम, 1937 (1937 का 1) क धारा 3 ारा द शि य" का योग

करते $ए; कािशत कया गया था, िजनके उनसे भािवत होने क संभावना थी, उस तारीख से प(तालीस दन" के भीतर

आ+ेप और सुझाव आमंित कए गए थे।और उ अिधसूचना क ितयां जनता को 23 अगत, 2019 को आम जनता

को उपल-ध करा दी गई थ0;

और उ ाप िनयम" पर आम जनता ारा िविन1द2 समय म ा3 आ+ेप" और सुझाव" पर क6ीय सरकार

ारा स7यक प से िवचार कर िलया गया है;

अतः अब, के86ीय सरकार कृिष उपज (ेणीकरण और िच नांकन) अिधिनयम,1937 (1937 का 1) क धारा 3

ारा द शि य" का योग करते $ए िन9िलिखत िनयम बनाती है, अथा;त.-

(3) ये राजप म उनके अंितम काशन क तारीख को वृF त ह"गे ।

परभाषाएं

परभाषाएं.—(1) इन िनयम" म जब तक संदभ; से अ8यथा अपेि+त न हो. -

(क) ‘’कृिष िवपणऩ सलाहकार’’ से भारत सरकार का कृिष िवपणन सलाहकार अिभेत है;

(ख) ‘’ािधकृत पैकर’’ से ऐसा कोई G यि या G यि य" का िनकाय अिभेत है िजसे इन िनयम" के अधीन िविहत

ेणी मानक" और Hया के अनुसार खजूर का ेणीकरण करने और उसे िच>नांकत करने के िलए ािधकार

माण-प अनुदF त कया गया हो;

(ग) ‘’ािधकार माण प’’ से साधारण ेणीकरण और िच>नांकन िनयम, 1988 के उपबंध" के अधीन जारी

माण प अिभेत है, जो कसी Jि या Jि य" के िनकाय को ेणी अिभधान िच>न ारा खजूर के ेणीकरण

और िच>नांकन का ािधकार देता है;

(घ) “साधारण ेणीकरण और िच>नांकन िनयम” से कृिष उपज (ेणीकरण और िच>नांकन) अिधिनयम 1937

(1937 का 1) क धारा 3 के अधीन बनाए गए साधारण ेणीकरण और िच>नांकन िनयम, 1988 अिभेत है;

(ड) ेणी अिभधान िच>न से िनयम 3 म िन1द2 “एगमाक; तीक” अिभेत है;

(च) िविधक माप िवKान (पैक क गई वतुएँ) िनयम, िविधक माप िवKान अिधिनयम, 2009 (2010 का 1) के

अंतग;त बनाए गए िविधक माप िवKान (पैक क गई वतुएँ) िनयम, 2011 अिभेत है; तथा

(छ) “अनुसूची” से इन िनयम" के साथ संलM अनुसूची अिभेत है ।

(2) इन िनयम" म युA त श- द और पद, जो पNरभािषत नह0 ह( लेकन िज8ह कृिष उपज (ेणीकरण और

िच>नांकण) अिधिनयम, 1937 (1937 का 1) और साधारण ेणीकरण और िच>नांकन िनयम, 1988 म

पNरभािषत कया गया है, के वही अथ; ह"गे जो उA त अिधिनयम या िनयम म ह(।

कया गया है।

गुणव$ा.—इन िनयम" के योजन के िलए गुठली रिहत खजूर और गुठली सिहत खजूर क गुणवा अनुसूची-II और

अनुसूची-III Hमश: म दए गए अनुसार होगी ।

िविध.—(क) खजूर क पैUकग नए, वVछ और शुXक जूट के थैल" या कपड़े के थैल" या पॉलीवोवन

थैल" िजनक आंतNरक लाइZनग फूड [ेड साम[ी क होगी या बायोिड[डेबल पेकZजग साम[ी, या फूड [ेड के

पॉलीपैक" या अ8य ऐसी कसी पैUकग साम[ी म पैक कया जाएगा जो कृिष िवपणऩ सलाहकार या साधारण

ेणीकरण और िच>नांकन िनयम, के िनयम 11 के तहत ािधकृत कसी अिधकारी ारा स7यक प से अनुमोदत

हो;

(ख) पैकेZजग साम[ी कट और फफूंदी के भाव से मु होगी और इससे उFपाद म कसी िवषा पदाथ;, अवांिछत

गंध अथवा वाद का असर अथवा रंग नह0 आना चािहए;

(ग) खजूर क पैUकग िविधक माप िवKान (पैकेज क गई व तुएं) िनयम के ावधान" के अनुसार िनधा;Nरत पैक

आकार" म या कृिष िवपणन सलाहकार के ारा अनुमोदत साधारण ेणीकरण और िच>नांकन िनयम 11 के

ावधान के अनुसार क जाएगी;

(घ) समान लॉट/ बैच और [ेड के छोटे पैक आकार" क ेणीकृत साम[ी क पैUकग एक माटर कंटेनर म क जाएगी

और उस पर ेणी अिभधान िच>न सिहत पूरा -यौरा अंकत कया जाएगा;

(ड) F येक पैकेज म समान कार का और समान ेणी अिभधान का खजूर होगा;

(च) F येक पैकेज उिचत और सुरि+त प से बंद और मुहरबंद कया जाएगा, ताक उसक साम[ी बाहर न फैल

सके।

िच>नांकन क प]ित और लेबल लगाना.—(1) ेणी अिभधान िच>न F येक पैकेज पर कृिष िवपणन सलाहकार या

इस िनिमत उसके ारा ािधकृत कसी अिधकारी ारा अनुमोदत रीित से साधारण ेणीकरण और िच>नांकन

िनयम, के िनयम 11 के अनुसार सुरि+त प से िचपकाया या मु6त कया जाएगा।

ेणी अिभधान िच>न के अितNरA त Fयेक पैकेज पर िनम् निलिखत िववरण प2 प से और अिमट प से

अंकत कया जाएगा, अथा;त:-

(क) व तु का नाम;

(ख) ेणी;

(ग) कम (वैकिपक);

(घ) लॉट नबंर;

(ड.) पैUकग क तारीख;

(च) शु] भार;

(छ) पैकर का नाम और पता;

(ज) अिधकतम खुदरा मूय (सभी कर" सिहत);

(झ) ...............माह..............वष; के पूव; उपयोग हेतु सव_म;

(ञ) कोई अ8य िववरण जो िविधक माप िवKान (पैकेज क गई व तुएं) िनयम, या खा` सुर+ा और मानक

अिधिनयम, 2006 (2006 का 34) के तहत या अ8य कोई िनयम जो उस समय पर लागू हो या अिधिनयम के तहत

जारी कए गए अ8य अनुदेश;

(3) पैकेज" पर िच>नांकन के िलए योग क गई याही से खजूर को संदूिषत न करे;

(4) ािधकृत पैकर कृिष िवपणन सलाहकार या इस िनिम उसके ारा ािधकृत कसी अिधकारी का पूव; अनुमोदन

अिभा< त करने के पR चात ेणीकृत पैकेज" पर अपना ाइवेट G यापार िच>न या G यापार aांड िच>नांकत

करेगा परंतु वह इन िनयम" के अनुसार ेणीकृत पैकेज" पर लगाए गए ेणी अिभधान िच>न ारा उपदSशत

शत(.- (i) साधारण ेणीकरण और िच>नांकन िनयम, के िनयम 3 के उपिनयम (8) म

िविन1द2 शतb के अितNर Fयेक ािधकृत पैकर, अिधिनयम के तहत जारी कए गए अ8य अनुदेश का पालन करेगा।

(ii) खजूर क गुणवता का परी+ण करने के िलए ािधकृत पैकर िनधा;Nरत मापदंड" के अनुसार या तो अपनी वयं क

योगशाला थािपत करेगा या कसी अनुमोदत राcय ेणीकरण योगशाला या सहकारी अथवा एसोिसएशन

योगशाला या ऐसी ाइवेट वािणcय योगशाला के साथ संपक; करेगा िजसका बंधन सामा8य ेणीकरण िच>नांकन

िनयम, के िनयम 9 के अनुसार कृिष िवपणन सलाहकार या इस िनिम उसके ारा ािधकृत कसी अिधकारी ारा

अनुमोदत योdय रसायनK ारा कया जा रहा हो;

(iii)

पNरसर" को समुिचत संवातन और काश सिहत वाeयद और वVछ िथितयो म रखा जाएगा। इन कायb म

लगे $ए काSमक" का अVछा वाeय होगा और वे कसी संचारी, संसगf या संHामक रोग से मु ह"गे;

(iv)

ािधकृत पैकर पNरसर म पA के फश; सिहत पया;< त भंडारण सुिवधाएं ह"गी और वह नमी, कसी तरह के कृंतक"

और कट" के उF पीड़न से मुA त होगा;

(v)

ािधकृत पैकर और अनुमोदत रसायनK, परी+ण, ेणीकरण, पैUकग, िच>नांकन, सीZलग और अिभलेख" के

अनुर+ण से संबंिधत ऐसे सभी अनुदेश" का पालन करेगा जो अिधिनयम के तहत जारी कए जाएंगे ।

के फल" से होगी िजसे मानव खपत हेतु उपयु प से उपचाNरत, धोया $आ, पाiयुराइcड अथवा संकृत कया

गया हो।

8 यूनतम अपे+ाएं :

(i) गुठली रिहत खजूर म िन9िलिखत िवशेषताएँ ह"गी:-

(क) यह अVछी तरह साफ कया $आ होगा;

(ख) इसका रंग एक समान होगा और पूरी तरह से पNरपk अवथा म होगा ;

(ग) वाद और जायका खजूर क कम क िवशेषताl के अनुप होगा ;

(घ) कसी िवजातीय वाद, गंध और खमीरीकरण के भाव से मु होगा;

(ड.) जीिवत, मृत कट", कट" के टुकड़", कट अंड", कृंतक", भुकिड़य" तथा संदूषण से मु होगा; तथा

(च) कसी भी तरह के योिजत रंजक पदाथ; से मु होगा;

(ii) घरेलू Jापार के मामले म यह धातु संदूषण, कट नाशी जीव" और नाशकजीवमार", संदूषण सूnम अपे+ाl, फसल

संदूषक", ाकृितक प से पैदा होने वाले िवषैले पदाथb के अविश2 तर के संबंध म िनबoधन" और खा` सुर+ा और

मानक (संदूषक, जीव-िवष और अपिश2) िविनयम 2011, खा` सुर+ा और मानक (खा` उFपाद मानक तथा खा`

िमण) िविनयम, 2011 और खा` सुर+ा और मानक अिधिनयम, 2006 के अधीन घरेलू Jापार हेतू अिधसूिचत अ8य

िविनयम" के अधीन यथा िविन1द2 अ8य खा` सुर+ा अपे+ाl का अनुपालन करेगा।

(iii) िनया;त Jापार के मामले म यह भारी धातुl, कटनाशी जीव" क अपिश2 सीमाl और कोडेAस एिलमेटेNरयस

आयोग ारा अिधकिथत अ8य खा` सुर+ा मापदंड" िनया;त Jापार के िलए या आयातकता; देश क अपे+ाl का

अनुपालन करेगा।

प2ीकरण.- इस तािलका के िलए,-

(क) “िवजातीय पदाथ;” का अिभाय, तन", खोल के टुकड़", गुठिलय", रेश" और िछलक" आद से है ।

(ख) “ध-बेदार खजूर” का अिभाय, सूय; क झुलसाहट, बदरंगता, सतह पर गहरे दाग" से भािवत खजूर से है।

(ग) “+ित[त खजूर” का अिभाय, मसलने और/अथवा यांिक चोट के कारण गूदे के फटने िजसम गुठली दखाई

पड़ने लगती है, के कारण भािवत खजूर से है। इसके कारण खजूर क बनावट, खा` और अनुर+ण गुणवा बुरी

तरह भािवत होती है अथवा इसके बाx वप म ब$त अिधक पNरवत;न हो जाता है ।

4. अ8य अपे+ाएँ : (i) गुठली रिहत खजूर क दशा ऐसी होगी क वह .-

(क) यातायात और ह(डZलग आद क िथित का सामना कर सके;

(ख) िजसे अपने गंतJ थान पर संतोषजनक ढंग से प$ंचाया जा सके।

(ii) गुठली रिहत खजूर को ठंडे और शुXक थान पर भंडाNरत कया जाएगा तथा वVछ और वाeयजनक िथित म रखा

जाएगा ।

(iii) गुठली रिहत खजूर का वगfकरण उनके आकार के आधार पर िन9िलिखत तािलका के अनुसार कया जाए .-

(ग) “+ित[त खजूर” का अिभाय, मसलने और/अथवा यांिक चोट के कारण गूदे के फटने िजसम गुठली दखाई पड़ने

लगती है, के कारण भािवत खजूर से है । इसके कारण खजूर क बनाबट, खा` और अनुर+ण गुणवा बुरी तरह

भािवत होती है अथवा इसके बाx वप म ब$त अिधक पNरवत;न हो जाता है ।

4. अ8य अपे+ाएँ :- (i) गुठली सिहत खजूर क दशा ऐसी होगी क वह.-

(क) यातायात और ह(डZलग आद क िथित का सामना कर सके;

(ख) िजसे अपने गंतJ थान पर संतोषजनक ढंग से प$ंचाया जा सके ।

(ii) गुठली सिहत खजूर को ठंडे और शुXक थान पर भंडाNरत कया जाएगा तथा वVछ और वाeयजनक िथित म रखा

जाएगा ।

G.S.R. 23(E).—Whereas, the draft of the Dates Grading and Marking Rules, 2019 was published as

required under sub-section (i) of section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937)

vide notification number G.S.R. 594(E), dated the 20^th August, 2019 in the Gazette of India, Extraordinary, Part II,

Section 3, Sub-section (i), dated the 23^rd August, 2019, inviting objections and suggestions from all persons likely

to be affected thereby within forty-five days from the date on which copies of the Gazette of India containing the

said notification were made available to the public;

And, whereas, copies of the said Gazette were made available to the public on 23^rd August, 2019;

And, whereas, the objections and suggestions received from the public in respect of the said draft rules

within the specified period have been considered by the Central Government;

Now, therefore, in the exercise of the powers conferred by the section 3 of the Agricultural Produce

(Grading and Marking) Act, 1937 (1 of 1937), the Central Government hereby makes the following rules, namely:-

1. Short title, application and commencement.—(1) These rules may be called the Dates Grading and Marking

Rules, 2020.

(2) They shall apply to Pitted Dates and Unpitted Dates obtained from Phoenix dactylifera Linn.

(3) They shall come into force from the date of their final publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,-

(a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India;

(b) "authorised packer" means a person or a body of persons who has been granted a certificate of

authorisation to grade and mark Dates in accordance with the grade standards and procedure prescribed

under these rules;

Marking Rules, 1988 authorising a person or a body of persons to grade and mark Dates with the grade

designation mark;

(d) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under

section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937);

(e) "grade designation mark" means the "AGMARK Insignia" referred to in rule 3;

(f) “Legal Metrology (Packed Commodities) Rules” means the Legal Metrology (Packaged Commodities)

Rules, 2011, made under the Legal Metrology Act, 2009 (1 of 2010); and

(g) "Schedule" means a Schedule appended to these rules.

(2) Words and expressions used in these rules and not defined, but defined in the Agricultural Produce (Grading and

Marking) Act, 1937 or the General Grading and Marking Rules, shall have the same meaning as are assigned to

them under that Act or the rules.

3. Grade designation mark.—The grade designation mark shall consist of "AGMARK Insignia" consisting of

a design incorporating the certificate of authorisation number, the word "AGMARK", name of commodity

and grade designation resembling the design as set out in Schedule- I.

4. Grade designations.—The grade designations to indicate the quality of Pitted Dates and Unpitted Dates shall be

as set out in column (1) of the Table in Schedule-II and Schedule-III respectively.

5. Quality.—For the purposes of these rules, the quality of Pitted Dates and Unpitted Dates shall be as specified in

Schedule-II and Schedule-III respectively.

6. Method of packing.—(1) Dates shall be packed in new clean and dry jute bags or cloth bags or poly woven bags

with inner lining of food grade material or any bio-degradable packaging materials or poly packs of food grade

material or any other packaging material as approved by the Agricultural Marketing Adviser or the officer

authorised by him under rule 11 of the General Grading and Marking Rules.

(2) The packaging material shall be free from insect and fungal infestation and should not impart any toxic

substance or undesirable odour or flavour or colour to the product.

(3) Dates shall be packed in pack sizes in accordance with the provisions of the Legal Metrology (Packaged

Commodities) Rules or as may be allowed by the Agricultural Marketing Adviser under rule 11 of the General

Grading Marking Rules.

(4) Graded material of small pack sizes of the same lot or batch and grade may be packed in a master container with

complete details thereon along with grade designation mark.

(5) Each package shall contain Dates of the same type and of the same grade designation.

(6) Each package shall be properly and securely closed and sealed so as to disallow spilling.

7. Method of Marking and Labeling.—(1) The grade designation mark shall be securely affixed to or printed

on each package in the manner approved by the Agricultural Marketing Adviser or the officer authorized by

under rule 11 of the General Grading and Marking Rules.

(2) In addition to the grade designation mark, following particulars shall be clearly and indelibly marked on each

package, namely:-

(a) name of the commodity;

(b) grade;

(d) lot number;

(e) date of packing;

(f) net weight;

(g) name and address of the packer;

(h) maximum retail price (inclusive of all taxes);

(i) BEST BEFORE__________MONTH______YEAR; and

(j) any other particulars as may be specified under the Legal Metrology (Packaged Commodities) Rules, or under

the Food Safety and Standards Act, 2006 ( 34 of 2006 ) or any other law for the time being in force or any

instructions issued under the provisions of the Act.

(3) The ink used for marking on packages shall not contaminate the Dates.

(4) The authorised packer may after obtaining prior approval of the Agricultural Marketing Adviser or the officer

authorized by him under rule 11 of the General Grading and Marking Rules, mark his private trade mark or

trade brand on the graded packages provided it does not indicate quality other than that indicated by the grade

designation mark affixed to the graded packages in accordance with these rules.

8. Special conditions of Certificate of Authorization.-(1) In addition to the conditions specified in sub-rule (8) of

rule 3 of the General Grading and Marking Rules every authorised packer shall follow all instructions issued

under the provisions of the Act.

(2) The authorised packer shall either set up his own laboratory as per prescribed norms or have access to an

approved state grading laboratory or cooperative or association laboratory or a Private Commercial laboratory

manned by a qualified chemist approved by the Agricultural Marketing Adviser or the officer authorized by him

under rule 9 of the General Grading and Marking Rules, for testing the quality of Dates.

(3) The premises of authorized packer shall be maintained in hygienic and sanitary conditions with proper

ventilations and well lighted arrangement and the personnel engaged in these operations shall be in sound health

and free from any infectious, contagious or communicable diseases.

(4) The premises of the authorised packer shall have adequate storage facilities with pucca floor and free from

dampness, any kind of cracks and crevices, rodent and insect infestation.

(5) The authorised packer and the approved chemist shall observe all instructions regarding testing, grading,

packing, marking, sealing and maintenance of records which may be issued under the provisions of the Act.

Grade designation and quality of Pitted Dates

1. Pitted Dates shall be obtained by drying sound, clean fruits of date tree Phoenix dactylifera Linn. varieties

conforming to the characteristics and maturity of such varieties which may have been suitably treated, washed,

pasteurized or processed for human consumption. It is commonly known as Khajoor.

2. Minimum Requirements:

(i)

Pitted Dates shall,-

(a)

be properly cleaned;

(b)

have uniform colour and achieved appropriate stage of maturity;

(c)

have pleasant taste and flavour characteristic to the variety;

(d)

be free from any foreign taste, odour and evidence of fermentation;

(e)

be free from living insects, dead insects, insect fragments, insect eggs, mites, rodent contamination

and mould growth; and

(f)

be free from any added coloring matter;

(ii)

for domestic trade, it shall comply with the restrictions in regard to residual levels of metal contaminants,

insecticides and pesticides residues, microbial requirements, crop contaminants, naturally occurring toxic

substances and other food safety requirements as specified under the Food Safety and Standards

(Contaminants, Toxins and Residues) Regulations, 2011, the Food Safety and Standards (Food Product

Standards and Food Additives) Regulations, 2011 and other regulations made for domestic trade under the

Food Safety and Standards Act, 2006.

(iii) for export trade, it shall comply with the residual limits of heavy metals, pesticides and other food safety

requirements as laid down by the Codex Alimentarius Commission, or importing countries requirements

for export trade.

changing the appearance.

4. Other requirements.- (i) The condition of the Pitted Dates shall be such as to enable it to-

(a) withstand transport and handling;

(b) arrive in satisfactory condition at the place of destination.

(ii) Pitted Dates shall be stored in cool and dry place, maintained in a clean and hygienic condition;

(iii) Pitted Dates may be classified on the basis of their size in accordance with the following table, namely:-

dextrose, dried glucose syrup, flour, vegetable oil and honey, as may be appropriate to the product.

Grade designation and quality of Unpitted Dates

Unpitted Dates shall be obtained by drying sound, clean fruits of date tree Phoenix dactylifera Linn.

varieties conforming to the characteristics of which may have been suitably treated, washed, pasteurized or

Minimum Requirements.-

(i) Unpitted Dates with seed shall,-

(a)
