का.आ. 4632(अ).—भारत सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का

अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश् चातउ उ‍ त अजधजनयम काा गया ाै) की धारा 3 की

उपधारा (1) के अधीन िारी भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजध सूचना संख् या का.आ. 1927 (अ)

तारीख 10.06.2020 एवं का.आ. 2196 (अ) तारीख 22.06.2020 िो क्रमि भारत के असाधारण रािपत्र तारीख

18.06.2020 एवं 03.07.2020 में प्रकाजित की गई थी, द्वारा उस अजधसूचनाओ से संलग् न अनसूची में जवजन्िज्‍ भूजम

में गेल (इजण् डया) जलजम ेड द्वारा ओजडिा राज् य में िगिीिपसर-ाजल्िया एवं बोकारो-धामरा पाइपलाइन (िे एच बी डी पी

एल) एवं स्ट्पर पाइपलाइन के माध्यम से प्राकृजतक गैस के पररवान के जलए पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग

के अजधकार का अिजन करने के अपने आिय की घोषणा की थी;

और उ‍ त रािपत्र अजधसूचना की प्रजतयां िनता को उपल्‍ ध करा िी गई थी;

और सक्षम प्राजधकारी ने िनता से प्राप्त आक्षेपों को परीक्षण के उपरांत जनप ान कर दिया ाै;

और सक्षम प्राजधकारी ने, उ‍ त अजधजनयम की धारा 6 की उपधारा (1) के अधीन भारत सरकार को अपनी ररपो ज

िे िी ाै;

और भारत सरकार ने, उ‍ त ररपो ज पर जवचार करने के पश् चातउ और या संतसष्ट ाो िाने पर दक उ‍ त भूजम

पाइपलाइन जबछाने के जलए अपेजक्षत ाै, उस में उपयोग के अजधकार का अिजन करने का जवनश् चय दकया ाै;

अत: अब, भारत सरकार, उ‍ त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित् त िज‍ तयों का प्रयोग करते

हुए, या घोषणा करती ाै दक इस अजधसूचना से संलग् न अनसूची में जवजन्िज्‍ भूजम में पाइपलाइन जबछाने के जलए उपयोग

के अजधकार का अिजन दकया िाता ाै;

और, भारत सरकार, उ‍ त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित् त िज‍ तयों का प्रयोग करते हुए,

जनिेि िेती ाै दक पाइपलाइन जबछाने के जलए भूजम में उपयोग का अजधकार, इस घोषणा के प्रकािन की तारीख से, भारत

सरकार में जनजात ाोने के बिाए, सभी जवल् लंगमों से मस‍ त ाोकर, गेल (इजण् डया) जलजम ेड में जनजात ाोगा।

NOTIFICATION

New Delhi, the 18th December, 2020

S.O. 4632(E).—Whereas by notification of Government of India in the Ministry of Petroleum and Natural

Gas S.O. No. 1927 (E) dated 10.06.2020 and S.O. 2196 (E) dated 22.06.2020 issued under sub-section (1) of Section 3

of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter

referred to as the said Act), published in the Extra Ordinary Gazette of India dated 18.06.2020 and dated 03.07.2020

respectively, the Government of India declared its intention to acquire the Right of User in the land specified in the

Schedule appended to that notification for the purpose of laying pipeline for transportation of natural gas through

Jagdishpur-Haldia & Bokaro-Dhamra Pipeline (JHBDPL) & Spur Pipeline in the State of Odisha by GAIL (India)

Limited;

And whereas copies of the said Gazette notification were made available to the public;

And whereas the objections received from the public to the laying the pipeline have been considered and

disposed off by the Competent Authority;

And whereas the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted its

report to Government of India;

And whereas Government of India after considering the said report and on being satisfied that the said land is

required for laying the pipeline, has decided to acquire the Right of User therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act,

Government of India hereby declares that the Right of User in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline;

And, further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government

of India hereby directs that the Right of User in the land for laying the pipeline shall, instead of vesting in Government

of India, vest, on this date of the publication of the declaration, in the GAIL (India) Limited, free from all

encumbrances.
