सा.का.जन. 783(अ).—केंद्रीय सरकार, राष्ट्रीय अल्पसंख्यक आयोग अजधजनयम, 1992 (1992 का 19) की धारा
15 के उप-धारा (2) के खंड (क) द्वारा प्रित्त िजियों का प्रयोग करते हुए और राष्ट्रीय अल्पसंख्यक आयोग (अजधकाररयों
और अन्य कमयचाररयों की सेवा के ितें और जनबंधन और ितें) जनयम, 1994 का िहां तक उनका संबंध प्रिासजनक
अजधकारी, अनुसंधान अजधकारी, अनुभाग अजधकारी, जनिी सजचव और पुस्ट्तकालयाध्यक्ष के पिों से हैं, उन बातों के
जसवाय, अजधक्ांत करते हुए जिन्हें ऐसे अजधक्मण से पूवय दकया गया है या करने का लोप दकया गया है, राष्ट्रीय अल्पसंख्यक
आयोग के कजतपय पिों पर भती की जवजध को जवजनयजमत करने के जलए जनम्नजलजखत जनयम बनाती है, अर्ायत:-
1. संजक्षप्त नाम और प्रारंभ - (1) इन जनयमों का संजक्षप्त नाम राष्ट्रीय अल्पसंख्यक आयोग (अजधकाररयों और अन्य
कमयचाररयों की सेवा की ितें एवं जनबंधन और जनयम) जनयम, 2020 है ।
(2) ये िासकीय रािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे।
2. लागू होना - ये जनयम, इन जनयमों से उपाबद्ध अनुसूची के स्ट्तम्भ (1) में उजल्लजखत पिों पर लागू होंगे।
3. पिों की संख्या, वगीकरण और वेतन मैररक्स में स्ट्तर - उि पिों की संख्या, उनका वर्गयकरण और उनका वेतन मैररक्स
में स्ट्तर वे होंगे िो इन जनयमों से उपाबद्ध अनुसूची के स्ट्तम्भ (2) से स्ट्तम्भ (4) में जवजनर्ियष्ट है।

4. भती की पद्धजत, आयु सीमा, अहयताएँ आदि - उि पि पर भती की पद्धजत, आयु-सीमा, अहयताएँ और इससे संबजन्धत
अन्य बातें वें होंगी िो उि अनुसूची के स्ट्तभ (5) से (13) में जवजनर्ियष्ट हैं।
5. प्रारंजभक गठन - राष्ट्रीय अल्पसंख्यक आयोग में जनयजमत आधार पर प्रधान जनिी सजचव के पि पर काययरत वह पिधारी,
इन जनयमों के प्रारम्भ होने की तारीख से, अनुसूची में उजल्लजखत सिृश्य पिों के जनयमों के अधीन जनयुि माना िाएगा और
उि पि पर उनके द्वारा िी गयी सेवाओं को पररवीक्षा, प्रोन्नजत हेतु अहयक सेवाएँ, पुजष्टकरण और पेंिन के प्रयोिनार्य ध्यान
में रखा िाएगा।
6. जनरहयता - वह व्यजि –
(क) जिसने ऐसे व्यजि से जिसका पजत या पत्नी िीजवत है, के सार् जववाह दकया हो या –जववाह की संजविा की है, या
(ख) जिसने अपने पजत या पत्नी के िीजवत रहते हुए दकसी व्यजि से जववाह दकया है, या जववाह की संजविा की है उि पि
पर जनयुजि का पात्र नहीं होगा;
परंतु यदि केंद्रीय सरकार का यह समाधान हो िाता है दक ऐसा जववाह ऐसे व्यजि और जववाह के अन्य पक्षकार को लागू
स्ट्वीय जवजध के अधीन अनुज्ञेय है और ऐसा करने के जलए अन्य आधार हैं तो वह दकसी व्यजि को इस जनयम के प्रवतयन से छूट
िे सकेगी।
7. जिजर्ल करने की िजि - िहाँ केंद्रीय सरकार की यह राय है दक ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके
जलए िो कारण है उन्हें लेखबद्ध करके इन जनयमों के दकसी उपबंध को दकसी वगय या प्रवगय के व्यजियों की बाबत, आिेि
द्वारा जिजर्ल कर सकेगी।
8. व्यावृजत - इन जनयमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य ररयायतों पर प्रभाव नहीं डालेगी,
जिनका केंद्रीय सरकार द्वारा इस संबंध में समय-समय पर जनकाले गए आिेिों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत
िनिाजतयों, भूत पूवय सैजनकों और अन्य जविेष प्रवगय के व्यजियों के जलए उपबंध करना अपेजक्षत है।

रटप्पण: िहां ऐसे कजनष्ठ व्यजियों
के संबंध में, जिन्होंने अपनी अहयक/
पात्रता सेवा पूरी कर ली है, प्रोन्नजत
के जलए जवचार दकया िा रहा है,
वहाँ उनसे ज्येष्ठ व्यजियों के संबंध
में भी जवचार दकया िाएगा परंतु
यह तब िबदक उसके द्वारा की गयी
ऐसी अहयक या पात्रता सेवा,
अपेजक्षत अहयक या पात्रता सेवा के
आधे से अजधक या िो वषय, इनमें से
िो भी कम हो, से कम न हो और

रटप्पण 1: पोषक प्रवगय के ऐसे
जवभागीय अजधकारी, िो प्रोन्नजत
की सीधी पंजि में है, वे प्रजतजनयुजि
के आधार पर जनयुजि के जलए
जवचार के पात्र नहीं होंगे। इसी
प्रकार प्रजतजनयुजि द्वारा जनयुि
व्यजि प्रोन्नजत द्वारा जनयुजि के जलए
जवचार दकए िाने के पात्र नहीं होंगे।
रटप्पण 2: प्रजतजनयुजि की अवजध
(जिसके अंतगयत अल्पकाजलक संजविा
भी है) जिसके अंतगयत केंद्रीय
सरकार के उसी या दकसी अन्य
संगठन या जवभाग में इस जनयुजि से
ठीक पहले धाररत दकसी अन्य काडर
वाह्य पि पर प्रजतजनयुजि की अवजध
है, साधारणतया तीन वषय से अजधक
नहीं होगी।

की जडग्री और जवजध मामलों में छह वषय का अनुभव; या
(ii) दकसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्र्ान से जवजध में
मास्ट्टर जडग्री और जवजध मामलों में पांच वषय का अनुभव।
रटप्पण 1: प्रजतजनयुजि की अवजध (जिसके अंतगयत अल्पकाजलक
संजविा भी है) जिसके अंतगयत केंद्रीय सरकार के उसी या दकसी अन्य
संगठन/जवभाग में इस जनयुजि से ठीक पहले धाररत दकसी अन्य संवगय
वाह्य पि पर प्रजतजनयुजि की अवजध है, साधारणतया तीन वषय से

अपनी अहयक/ पात्रता सेवा पूरी कर ली है, प्रोन्नजत के
जलए जवचार दकया िा रहा है, वहाँ उनसे ज्येष्ठ व्यजियों
के संबंध में भी जवचार दकया िाएगा। परंतु यह तब
िबदक उसके द्वारा की गयी अपेजक्षत अहयक या पात्रता
सेवा ऐसी अहयक या पात्रता सेवा के आधे से अजधक या िो
वषय, इनमें से िो भी कम हो से, कम न हो और उन्होने
अपने ऐसे कजनष्ठ व्यजियों सजहत, जिन्होंने ऐसी
अहयक/पात्रता सेवा पहले पूरी कर ली है, अगली उच्चतर
ग्रेड में प्रोन्नजत के जलए अपनी पररवीक्षा अवजध को

जवश्वजवद्यालयों या मान्यता प्राप्त अनुसंधान संस्ट्र्ानों या
अधय-सरकारी या स्ट्वायत्त जनकायों या सांजवजधक संगठनों
के ऐसे अजधकारी जिन्होंने,-
(क) (i) िो मूल संवगय या जवभाग में जनयजमत आधार
पर सिृि पि धाररत दकए हुए हैं; या
(ii) जिन्होंने मूल संवगय या जवभाग में वेतन मैररक्स में
स्ट्तर - 7 (रु. 44900-142400/-) या समतुल्य में
जनयुजि के बाि जनयजमत आधार पर इस श्रेणी में तीन
वषय की जनयजमत सेवा की है; तर्ा
(ख) िो जनम्नजलजखत िैजक्षक अहयताएँ और अनुभव रखते
हों:
(i) दकसी मान्यता प्राप्त जवश्वजवद्यालय या संस्ट्र्ान से
स्नातक की जडग्री; और
(ii)
सरकारी
कायायलय/सावयिजनक
क्षेत्र
के
उपक्म/स्ट्वायत्त जनकाय / सांजवजधक जनकाय में लेखा,
प्रिासन, स्ट्र्ापना कायय में तीन वषय का अनुभव।
रटप्पण 1: पोषक प्रवगय के ऐसे जवभागीय अजधकारी, िो
प्रोन्नजत की सीधी पंजि में है, वे प्रजतजनयुजि पर जनयुजि
के जलए जवचार के योग्य नहीं होंगे और इसी प्रकार
प्रजतजनयुजि पर जनयुि व्यजि प्रोन्नजत द्वारा जनयुजि के
जलए जवचार दकए िाने के पात्र नहीं होंगे।
रटप्पण 2: प्रजतजनयुजि की अवजध (जिसके अंतगयत
अल्पकाजलक संजविा भी है) जिसके अंतगयत केंद्रीय
सरकार के उसी या दकसी अन्य संगठन/ जवभाग में इस

ज्येष्ठ व्यजियों के संबंध में भी जवचार
दकया िाएगा। परंतु यह तब िबदक
उसके द्वारा की गयी अपेजक्षत अहयक या
पात्रता सेवा के ऐसी अहयक या पात्रता
सेवा के आधे से अजधक या िो वषय,
इनमें से िो भी कम हो से, कम न हो
और उन्होने अपने ऐसे कजनष्ठ व्यजियों
सजहत जिन्होंने ऐसी अहयक/पात्रता सेवा
पहले पूरी कर ली है, अगली उच्चतर ग्रेड
में प्रोन्नजत के जलए अपनी पररवीक्षा
अवजध को सफलतापूवयक पूरा कर जलया
हो।

112400/-) या समतुल्य के वेतनमान
में जनयुजि के बाि जनयजमत आधार पर
इस श्रेणी में आठ वषय की जनयजमत सेवा
की है; तर्ा
(ख) जनम्नजलजखत िैजक्षक अहयताएँ और
अनुभव रखता हो:
(i) दकसी मान्यता प्राप्त जवश्वजवद्यालय
या
संस्ट्र्ान

समाििास्त्र
या
सामाजिक कायय या जवजध या सांजख्यकी
जनम्नजलजखत िाजमल होंगे:

G.S.R. 783(E).—In exercise of the powers conferred by clause (a) of sub-section (2) of section 15 of
National Commission for Minorities Act, 1992 (19 of 1992) and in supersession of the National Commission for
Minorities (Terms and Conditions of Service of the Officers and Other Employees) Rules, 1994, in so far as they
relate to the posts of Administrative Officer, Research Officer, Section Officer, Private Secretary and Librarian,
except as respect things done or omitted to be done before such supersession, the Central Government hereby makes
the following rules regulating the method of recruitment to certain posts in National Commission for Minorities,
namely:-
1. Short title and commencement. - (1) These rules may be called the National Commission for Minorities (Terms
and Conditions of Service of Officers and other Employees) Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application. - These rules shall apply to the posts mentioned in column (1) of the Schedule annexed to these
rules.
3. Number of posts, classification and level in pay matrix. - The number of said posts, their classification and
level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
4. Method of recruitment, age-limit, qualifications, etc. - The method of recruitment, age-limit, qualifications and
other matters shall be as specified in columns (5) to (13) of the aforesaid Schedule.
5. Initial Constitution. - The incumbent holding the post of Principal Private Secretary in the National Commission
for Minorities on regular basis, on the date of commencement of these rules, shall be deemed to have been appointed
under these rules to the corresponding posts mentioned in the Schedule and the services rendered by him in the said
post shall be taken into account for the purpose of probation, qualifying service for promotion, confirmation and
pension.
6. Disqualification. - No person, –
(a) who, has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person shall be eligible
for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal
law applicable to such person and the other party to the marriage and that there are other grounds for so
doing, exempt any person from the operation of this rule.
7. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient to do so, it
may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules in respect of any
class or category of persons.
8. Saving. - Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to
be provided to the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in
accordance with the orders issued by the Central Government from time to time in this regard.
