का.आ. 4686(अ).—केन्द्रीय सरकार ने कोयला धारक क्षेत्र (अजजन और जिकास) अजधजनयम, 1957 (1957

का 20) ( जजसे इसमें इसके पश् चात् उ‍ त अजधजनयम कहा गया ह ) की धारा 4 की उपधारा (1) के अधीन भारत

सरकार ने कोयला मंत्रालय द्वारा जारी की गई अजधसूचना संख यांक का. आ. 687, तारीख 18 अगस्ट्त, 2020, जो

भारत के राजपत्र, भाग ।।, खण् ड 3, उप-खण् ड (ii), तारीख 22 अगस्ट्त, 2020 में प्रकाजित की गई थी, उस अजधसूचना

से उपाबद्ध अनुसूची में जिजनर्ददष् ट पिरक्षेत्र की भूजम में जजसका माप 712.072 हे‍टेयर (लगभग) या 1759.530 एकड़

(लगभग) ह , कोयले का पूिेक्षण करने के अपने आिय की सूचना दी थी ;

और केन्द् रीय सरकार का यह समाधान हो गया ह दक इस अजधसूचना से संलग् न अनुसूची में जिजहत उ‍ त भूजम के

भाग में कोयला अजभप्राप्य ह ;

अत:, अब, केन्द् रीय सरकार उ‍ त अजधजनयम की धारा 7 की उप-धारा (1) द्वारा प्रदत् त िज‍ तयक का प्रयोग करते

हुए, इससे संलग् न अनुसूची में ि्णत 712.072 हे‍टेयर (लगभग) या 1759.530 एकड़ (लगभग) माप िाली भूजम में

या उस पर के सभी अजधकार का अजजन करने के अपने आिय की सूचना देती ह ।

िटप् पण 2 : उ‍ त अजधजनयम की उपधारा 8 के उपबंधक की ओर ध् यान आकृष् ट दकया जाता ह , जजसमें जनम् नजलजखत

उपबंध ह :-

‘’8. अजजन की बाबत् आपजत् तयॉ.- (1) कोई व् यज‍ त जो दकसी भूजम में, जजसकी बाबत् धारा 7 के अधीन अजधसूचना

जारी की गई ह , जहतबद्ध ह , अजधसूचना के जारी दकए जाने से तीस ददन के भीतर सम् पूणज भूजम या उसके दकसी भाग या

ऐसी भूजम में या उस पर के दकन्द् हीं अजधकारक का अजजन दकए जाने के बारे में आपजत् त कर सकेगा ।

स्ट् पष् टीकरण.- इस धारा के अधीन यह आपजत्त नहीं मानी जाएगी, दक कोई व् यज‍ त दकसी भूजम में कोयला उत् पादन के जलए

स्ट् ियं खनन संदरिययाएं करना चाहता ह और ऐसी संदरिययाएं केन्द् रीय सरकार या दकसी अन् य व् यज‍ त को नहीं करनी चाजहए।

(2)

उप-धारा (1) के अधीन प्रत् येक आपजत् त सक्षम अजधकारी को जलजखत रूप में की जाएगी और सक्षम अजधकारी,

आपजत् तकताज को स्ट् ियं सुने जाने, जिजध व् यिसायी द्वारा सुनिाई का अिसर देगा और ऐसी सभी आपजत् तयक को सुनने के

पश् चात् और ऐसी अजतिर‍ त जांच, यदद कोई हो, करने के पश् चात् जो िह आिश् यक समझता ह , िह या तो धारा 7 की

उप-धारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम में या उस पर के अजधकारक के संबंध में एक िरपोटज या ऐसी

भूजम के जिजभन्द् न टुकड़क या ऐसी भूजम में या उस पर के अजधकारक के संबंध में आपजत् तयक पर अपनी जसफािरिक और

उसके द्वारा की गई कायजिाही के अजभलेख सजहत जिजभन्द् न िरपोटज केन्द् रीय सरकार को उसके जिजनश् चय के जलए देगा ।

इस धारा के प्रयोजनक के जलए िह व् यज‍ त दकसी भूजम में जहतबद्ध समझा जाएगा जो प्रजतकर में जहत का दािा

करने का हकदार हो, यदद भूजम या दकसी ऐसी भूजम में या उस पर के अजधकार इस अजधजनयम के अधीन अर्जजत कर

जलए जाते ह । ‘’

सीमा-िणजन:

इस कोयला ब्लॉक की सीमा कोरबा जजले के मदनपुर साउथ कोयला ब्लॉक के संरजक्षत िन मोरगा और केतमा ग्रामक से

होकर गुजरती ह ।

(1) रेखा जबन्द्दु संखया 6 से 8: रेखा जबन्द्दु संखया 6 से प्रारंभ होती ह , कोयला ब्लॉक के उत्तर-दजक्षण छोर से और

जबसरार नाला में सजम्मजलत होते हुए पहुंचती ह और रेखा जबन्द्दु संखया 8 (जोदक ब्लॉक का उत्तर-पूिज छोर ह ) और

इसमें संरजक्षत िन कम्पाटजमेंट संखया पी-372 और पी-368 ह ।

(2) रेखा जबन्द्दु संखया 8 से 10 : रेखा जबन्द्दु संखया 8 से प्रारंभ होती ह , कोयला ब्लॉक के उत्तर-पूिज छोर से और

जबसरार नाला में सजम्मजलत होते हुए पहुंचती ह और रेखा जबन्द्दु संखया 10 (जोदक ब्लॉक का दजक्षण-पूिज छोर ह )

और इसमें संरजक्षत िन कम्पाटजमेंट संखया पी-368 और पी-366 ह ।

(3) रेखा जबन्द्दु संखया 10 से प्रारंभ होती ह , कोयला ब्लॉक के दजक्षण-पूिज छोर से और मोरगा ग्राम से होकर पहुंचती

ह और जबन्द्दु संखया 1 से होते हुए कोयला ब्लॉक का दजक्षण-पजिम छोर ह ।

(4) रेखा जबन्द्दु संखया 1 से 6 : रेखा जबन्द्दु संखया 1 से प्रारंभ होती ह , कोयला ब्लॉक के दजक्षण छोर से और मोरगा

और केतमा ग्राम से होकर पहुंचती ह और जबन्द्दु संखया 6 से होते हुए जोदक कोयला ब्लॉक का उत्तर-पजिम ह ।

NOTIFICATION

New Delhi, the 24th December, 2020

S.O. 4686(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O.

687, dated the 18^th August, 2020 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and

Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India,

Part II, Section 3, Sub-section (ii), dated the 22^nd August, 2020, the Central Government gave notice of its intention to

prospect for coal in 712.072 hectares (approximately) or 1759.530 acres (approximately) of the lands in the locality

specified in the Schedule annexed to that notification;

And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed

in the Schedule appended to this notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the

Central Government hereby gives notice of its intention to acquire the land measuring 712.072 hectares

(approximately) or 1759.530 acres (approximately) and all rights in or over the said lands described in the schedule

appended hereto:

Note 1: The plan bearing number APMDC/ Madanpur/CBA/Sec 7/Plan No.1, dated the 11^th August, 2020 of the area

covered by this notification may be inspected in the office of the District Collector, District Korba (Chhattisgarh) or in

the office of the Coal Controller, 1, Council House Street, Kolkata - 700001 or in the office of the General Manager

(Finance), The Andhra Pradesh Mineral Development Corporation Limited, 294/1D,100 Feet Road, Tadigadapa to

Enikepadu Road, Kanur,Vijayawada – 521137, Andhra Pradesh.

Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows: -

―8. Objection to acquisition. - (1) Any person interested in any land in respect of which a notification under section 7

has been issued, may, within thirty days of the issue of the notification, object to the acquisition of the whole or any

part of the land or any rights in or over such land.

Explanation. - It shall not be an objection within the meaning of this section for any person to say that he himself

desires to undertake mining operation in the land for the production of coal and that such operations should not be

undertaken by the Central Government or by any other person.

(2)

Every objection under sub-section (1) shall be made to the competent authority in writing and the competent

authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall,

after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a

report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land

or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central

Government, containing his recommendations on the objections, together with the record of the proceedings held by

him, for the decision of that Government.

For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to

claim an interest in compensation if the land or any rights in or over such land were acquired under this Act‖.

Note 3 : The Coal Controller has been appointed by the Central Government as the competent authority under section

3 of the said Act, vide notification number S.O. 411, dated the 27^th May, 2020, published in Part II, Section 3, Sub-

section (ii) of the Gazette of India, dated the 30^th May, 2020.

follow the alignment all along Bisrar Nalah and reaches point no. 8 (north east corner of the block) mainly

intersect Protected Forest Compartment no. P 372 and P 368.

(2) Line from Point no.8 to 10. The line start at point no. 8 in the north east Corner and follow the alignment

all along Bisrar Nala and reaches point no. 10 (south east corner of the coal block and intersect Protected

Forest Compartment no. P 368 and P 366.

(3) Line from point no. 10 in the south east Corner of the coal block and passing through the Morga Village

and reaches point no. 1 which is south west Corner of the Coal Block.

(4) Line from Point no. 1 to 6.The line starts from Pont no. 1 in the south west corner of the coal block and

passing through Morga and Ketma village and reached point no. 6 north west of the coal block.
