30 मई, 2013 और का. आ. 701(अ) तारीख 10 मार्व, 2016 के साथ पठित औषध (कीमत जनयंत्रण) आदेि, 2013 के
पैरा 5,11 और 15 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, राष्ट्रीय औषध मूल्य जनधावरण प्राजधकरण(जिसको संजिप्त रूप
में एनपीपीए कहा िाता है) नीर्े की सारणी के स्ट्तंभ(6) में जर्जनर्दवष्ट खुदरा मूल्य को उि सारणी के स्ट्तंभ(3),(4) और (5)
में तत्सस्ट्थानी प्रजर्जष्टयों में जर्जनर्दवष्ट प्रबलता, इकाई (यूजनट) और जर्जनमावता और जर्पणन कंपजनयों के नाम सजहत स्ट्तंभ(2)
में की तत्सस्ट्थानी प्रजर्जष्ट में से प्रत्सयेक की, र्स्ट्तु एर्ं सेर्ा कर, यदद कोई है, को छोड़कर अजधकतम खुदरा मूल्य के रूप में

(क) उपयुवि दी गई जर्जनर्दवष्ट फॉमूवलेिन के जर्जनमावता अथावत िो “नई ड्रग” डीपीसीओ, 2013 के पैराग्राफ 2(यू) के तहत
उपयुवि दी गई सारणी के स्ट्तंभ (6) में जर्जनर्दवष्ट खुदरा मूल्य जनधावठरत करेंगे।
(ख) अगर जनमावताओं ने उपयुवि सारणी के स्ट्तंभ (6) में र्र्णवत अजधकतम कीमत पर सरकार को र्ास्ट्तर् में भुगतान दकया है
या यह देय है तो र्े र्स्ट्तु एर्ं सेर्ा कर को िोड़ सकते हैं।
(ग) औषध (मूल्य जनयंत्रण) आदेि, 2013 के पैराग्राफ 11 में ददए गए प्रार्धानों के तहत जनमावताओं को उपयुवि सारणी के
स्ट्तंभ (6) में जर्जनर्दवष्ट खुदरा मूल्य के आधार पर अनुसूजर्त जर्जनर्मवजतयों के पैकों के जलए खुदरा मूल्य जनधावठरत करें।
जनमावता औषध (मूल्य जनयंत्रण) आदेि, 2013 के पैराग्राफ 24 के तहत फॉमव V में अजधसूर्ना की तारीख से एक मूल्य सूर्ी
एनपीपीए को आईपीडीएमएस के माध्यम से िारी करें तथा उसकी काप ी राज्य औषजध जनयंत्रकों और जर्जनमावता जर्तरकों
को िारी करें।
(घ) औषध (मूल्य जनयंत्रण) आदेि, 2013 के 24 (4) के उपबंधों के अनुसार प्रत्सयेक फुटकर जर्क्रेता और जर्तरक जर्जनमावता
द्वारा ददए गए रूप में ऐसे पठरसर, िहां कारबार को इस प्रकार दकया िा रहा है दक उससे परामिव के इच्छुक दकसी व्यजि

के जलए पहुंर् आसान हो, र्हां उसके दकसी सहिदृष्य भाग पर कीमत सूर्ी और पूरक सूर्ी, यदद कोई हो, को संप्रदर्षवत
करेगा।
(ड.) उपयुवि गैर अजधकतम कीमत (खुदरा मूल्य) केर्ल उपयुवि जनमावता/जर्पणन के जलए लागू है िैसा दक उन्होंने औषध
(मूल्य जनयंत्रण) आदेि, 2013 के तहत अनुबद्ध मूल्य जनधावरण/संिोधन के जलए फॉमव I पर िमा दकया गया था और
सरकार द्वारा जनधावठरत सभी लागू र्ैधाजनक आर्श्यकताओं की पूर्तव के अधीन प्रासंजगक जर्जधयों/जनयमों के अन्तगवत िैसा
दक केन्रीय/राज्य लाइसेससंग ऑथोठरटी के सिम प्राजधकारी द्वारा मेन्यूफेक्र्ररंग लाइसेंस मंिूरी के तहत संबंजधत जर्जनर्मवत
जनमावता/जर्पणन कम्पजनयां िो अनुपालन करती है।
(र्) जर्जनमावता या जर्पणन कम्पनी, उपरोि जर्जनर्मवजतयों और जर्जनर्दवष्ट ितों का पालन नहीं करती हैं तो र्े आर्श्यक
र्स्ट्तुएाँ अजधजनयम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रार्धानों के अधीन ब्याि सजहत अजधप्रभाठरत राजि को
िमा करने के जलए दायी होंगे।
(छ) इस आदेि में उपरोि सारणी के स्ट्तंभ (2) में की तत्सस्ट्थानी प्रजर्जष्ट में जर्जनर्दवष्ट जर्जनर्मवजतयों के पैकों की खुदरा मूल्य
जनयत होने के पठरणामस्ट्र्रुप, आदेि िो दक इस आदेि से पूर्व िारी हुए है, स्ट्र्तः ही जनरस्ट्त हो िायेंगे।

S. O. 4773 (E).—In exercise of the powers conferred by paragraphs 5, 11 and 15 of the Drugs (Prices
Control) Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S. O. 701(E) dated 10th March, 2016
issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing
Authority (hereinafter referred as NPPA), hereby fixes, the price as specified in column (6) of the table herein below
as the retail price, exclusive of goods and services tax, if any, in relation to the formulation specified in the
corresponding entry in column (2) of the said Table with the strength, unit and name of manufacturer & marketing
company, as specified in the corresponding entries in columns (3), (4) and (5) thereof;

Note:
(a) The manufacturer of above mentioned formulations i.e. “new drug” under paragraph 2(u) of the DPCO, 2013
shall fix the retail price as specified in column (6) of the table hereinabove.
(b) The manufacturer may add goods and services tax only if they have paid actually or it is payable to the
Government on the retail price mentioned in column (6) of the above said table.
(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturer in
accordance with the retail price specified in column (6) of the above table as per provisions contained in
paragraph 11 of the DPCO, 2013. The manufacturer shall issue a price list in Form–V from date of
Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State
Drug Controller and dealers.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on
business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) The above mentioned retail price is applicable only to the individual manufacturer / marketer as mentioned
above i.e. who have applied for the same by submitting Form-I for price fixation / revision as stipulated
under DPCO, 2013 and subject to fulfilment of all the applicable statutory requirements as laid down by the
Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent
Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned
manufacturer/marketing companies.
(f) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price
notification and notes specified hereinabove, then the concerned manufacturer/marketing company shall be
liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO,
2013 read with the Essential Commodities Act, 1955.
(g) Consequent to the issue of ceiling price of such formulation as specified in column (2) of the above table in
this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of
notification, stand(s) superseded.

का. आ. 4774(अ).—िबदक भारत सरकार के रसायन और उर्वरक मंत्रालय के ददनांक 29 अगस्ट्त, 1997 के
संकल्प सं. 33/7/97-पी आई-I द्वारा राष्ट्रीय औषध मूल्य जनधावरण प्राजधकरण (एनपीपीए) की स्ट्थापना, अन्य बातों के
साथ-साथ थोक औषजधयों तथा जर्जनर्मवजतयों के मूल्य जनधावठरत करने और उनमें पठरर्तवन यदद कोई हों, को अजधसूजर्त
करने, अजनयंजत्रत औषजधयों और जर्जनर्मवजतयों के मूल्यों पर निर रखने और औषध (मूल्य जनयंत्रण) आदेि (डीपीसीओ) के
प्रार्धानों का कायावन्र्यन करने के जलए, की गई थी।
2. और िबदक, रसायन एर्ं उर्वरक मंत्रालय के ददनांक 30 मई, 2013 के कायावलय आदेि सं. 1394(अ) के द्वारा आर्श्यक
र्स्ट्तु अजधजनयम, 1955 की धारा 3 तथा 5 द्वारा प्रदत्त िजियों का प्रयोग करते हुए डीपीसीओ, 2013 की जर्जिष्ट
पैराग्राफ के संबंध में उि आदेि के पैराग्राफ 32 सजहत एनपीपीए को केन्र सरकार की ओर से िजियां प्रत्सयोजित की गई
हैं।
3. और िबदक, मैससव सन फामावस्ट्यूठटकल्स इंडस्ट्रीि जल. से प्राप्त आर्देन द्वारा डीपीसीओ, 2013 के प्रार्धानों से छूट के
जलए, पैराग्राफ 32 (i) के अन्तगवत उि आदेि में दफक्स्ट्ड डोि कॉजम्बनेिन जसल्र्र सल्फैडज़ाइन आईपी (नैनोनाइज़्ड)
0.5% डब्लू/डब्लू और क्लोरहेजक्सडाइन ललूकोनेट 0.2% डब्लू/डब्लू रोजपकल क्रीम िो दक ड्रलस एंड कॉस्ट्मेठटक्स
अजधजनयम, 1940 और जनयम के तहत केंरीय ड्रलस स्ट्टैंडडव कंरोल ऑगेनाइिेिन (भारत) द्वारा जर्जधर्त रूप से नई दर्ा के
रूप में अनुमोददत दकया गया था। इसके अलार्ा पेटेंट कायावलय भारत ने मैससव सन फामावस्ट् यूठटकल् स इंडस्ट् रीि जल. को एक
जस्ट्थर रोजपकल फामावस्ट्युठटकल रर्ना जिसमें नैनोनाइज़्ड जसल्र्र सल्फैडज़ाइन िाजमल है जिसे 27 िुलाई 2016 से 20
र्षों के कायवकाल के जलए पेंटेंट अजधजनयम,1970 के तहत अनुमोदन कराया गया । (पेटेंट संख्या 349599 और अनुमोदन
प्रदान करने की जतजथ 20.10.2020)।
4. और िबदक, एनपीपीए ने ददनांक 23.12.2020 को अपनी 82र्ीं बैिक में यह उल्लेख दकया दक मैससव सन
फामावस्ट्यूठटकल्स इंडस्ट्रीि जल. द्वारा प्रस्ट्तुत दस्ट्तार्ेि डीपीसीओ, 2013 के पैराग्राफ 32 (i) की आर्श्यकता को पूरा करते हैं
और जनणवय जलया है दक डीपीसीओ, 2013 के पैरा 32(i)के अंतगवत मैससव सन फामावस्ट्यूठटकल्स इंडस्ट्रीि जल. को अपने
उत्सपाद दफक्स्ट्ड डोि कॉजम्बनेिन जसल्र्र सल्फैडज़ाइन आईपी (नैनोनाइज़्ड) 0.5% डब्लू/डब्लू और क्लोरहेजक्सडाइन
ललूकोनेट 0.2% डब्लू/डब्लू रोजपकल क्रीम का उपयोग करने के जलए छूट दी िा सकती है ।
5. अब इसजलए का.आ 1394(अ), ददनांक 30 मई, 2013 को रसायन एर्ं उर्वरक मंत्रालय, भारत सरकार द्वारा िारी
औषजध (मूल्य जनयंत्रण) आदेि, 2013 के पैरा 32 के अन्तगवत प्रदत्त िजियों का प्रयोग करते हुए, उपयुवि उि औषजध
अथावत देि में इसके र्ाजणजज्यक जर्पणन की िुरूआत की तारीख से पांर् र्षव की अर्जध के जलए दफक्स्ट्ड डोि कॉजम्बनेिन
जसल्र्र सल्फैडज़ाइन आईपी (नैनोनाइज़्ड) 0.5% डब्लू/डब्लू और क्लोरहेजक्सडाइन ललूकोनेट 0.2% डब्लू/डब्लू रोजपकल
क्रीम के संबंध में उि आदेि के पैराग्राफ 32 (i) के अन्तगवत डीपीसीओ, 2013 के प्रार्धानों से मैससव सन फामावस्ट्यूठटकल्स
इंडस्ट्रीि को छूट दी गई है। इसके अलार्ा पांर् साल की अर्जध भारतीय पेटेंट की अर्जध के साथ सह-टर्मवनस है।
6. कंपनी एनपीपीए को दफक्स्ट्ड डोि कॉजम्बनेिन जसल्र्र सल्फैडज़ाइन आईपी (नैनोनाइज़्ड) 0.5% डब्लू/डब्लू और
क्लोरहेजक्सडाइन ललूकोनेट 0.2% डब्लू/डब्लू रोजपकल क्रीम के व्यार्साजयक जर्पणन की तारीख और डीपीसीओ, 2013 के
तहत फॉमव V में मूल्य सूर्ी िारी करके उि औषजध के बारे में कम्पनी द्वारा तय की गई खुदरा जर्क्रेता को कीमत
(पीटीआर) और अजधकतम खुदरा मूल्य एनपीपीए को सूजर्त करेगी।

New Delhi, the 30th December, 2020
S.O. 4774(E).—Whereas the National Pharmaceutical Pricing Authority (NPPA) was established vide the
Resolution of the Government of India in the Ministry of Chemicals and Fertilizers No. 33/7/97-PI.I dated 29th
August, 1997, inter-alia, to fix prices and notify the changes therein, if any, of bulk drugs and formulations, monitor
the prices of non-scheduled drugs and formulations and oversee the implementation of the provisions of the Drugs
(Price Control) Order (DPCO).
2. And whereas the Ministry of Chemicals and Fertilizers vide S.O.1394 (E) dated the 30th May, 2013, in exercise of
the powers conferred by Section 3 and 5 of Essential Commodities Act, 1955 has delegated the powers in respect of
specified paras of the DPCO, 2013, including para 32 of the said order to be exercised by the NPPA on behalf of the
Central Government.`
3. And whereas an application received from M/s Sun Pharmaceuticals Industries Limited, for exemption from the
provisions of DPCO, 2013 under para 32 (i) of the said order in respect of Fixed Dose Combination (FDC) of Silver
Sulfadiazine IP (Nanonized) 0.5% w/w and Chlorhexidine Gluconate 0.2% w/w topical cream which was duly
approved by the Office of Central Drugs Standard Control Organisation (India) as ‘new drug’ under the Drugs and
Cosmetics Act, 1940 and Rules thereunder. Further, the Patent office, India has granted Patent Certificate to M/s Sun
Pharmaceutical Industries Ltd for an invention entitled ‘A stable topical Pharmaceutical composition comprising
Nanonized Silver Sulfadiazine’ for the term of 20 years from 27th July 2016 in accordance with the provisions of the
Patents Act, 1970 (Patent No. 349599 and Date of Grant: 20.10.2020).
4. And whereas the NPPA at its 82nd meeting dated 23.12.2020 noted that M/s Sun Pharmaceutical Industries Ltd
meets the requirement of para 32(i) of DPCO 2013 and decided that exemption may be granted to M/s Sun
Pharmaceutical Industries Ltd under para 32(i) of DPCO, 2013 for their product Fixed Dose Combination (FDC) of
Silver Sulfadiazine IP (Nanonized) 0.5% w/w and Chlorhexidine Gluconate 0.2% w/w topical cream.
5. Now, therefore, in exercise of the powers delegated under para 32 of the Drugs (Prices Control) Order, 2013 vide
S.O. 1394(E) dated 30th May, 2013 issued by the Government of India in the Ministry of Chemicals and Fertilizers,
M/s Sun Pharmaceuticals Industries Limited is exempted from the provisions of DPCO, 2013 under para 32 (i) of the
said order in respect of above said drug viz. Fixed Dose Combination (FDC) of Silver Sulfadiazine IP (Nanonized)
0.5% w/w and Chlorhexidine Gluconate 0.2% w/w topical cream for a period of five years from the date of
commencement of its commercial marketing by the manufacturer in the country. Further, the period of five years is
co-terminus with the duration of Indian Patent.
6. The company shall inform NPPA the date of commercial marketing of ‘Fixed Dose Combination (FDC) of Silver
Sulfadiazine IP (Nanonized) 0.5% w/w and Chlorhexidine Gluconate 0.2% w/w topical cream’ in the country and the
Price to Retailer (PTR) and Maximum Retail Price fixed by the company in respect of above said formulation by
issuing a price list in Form V under DPCO, 2013.
