का.आ. 4790(अ).—केन्द्रीय सरकार, ठेका श्रम (जिजनयमन और उत्सािन) अजधजनयम, 1970 (1970 का 37)

की धारा 31 द्वारा प्रित िजियों का प्रयोग करते हुए, केन्द्रीय ठेका श्रम सलाहकार बोडड से परामिड करने के पश्चात् निेली

जलग्नाईट कॉरपोरेिन इंजडया जलजमटेड को तालाबीरा 2 और 3 आिंटटत कोल ब्लॉक के जलए जनम्नजलजखत ितों के अधीन

तीन िर्ड की अिजध के जलए क्रम संख्या 1 से 3 के सामने भारत के रािपत्र, भाग II, खंड 3, उपखंड (ii) में प्रकाजित भारत

सरकार के श्रम मंत्रालय की अजधसूचना संख्या का.आ. 2063, तारीख 21 िून, 1988 के उि अजधसूचना की अनुसूची में

जिजनर्िडष्ट कायों में ठेका श्रम के जनयोिन के संबंध में लागू होने में छूट प्रिान करती है, अर्ाडत्:--

(i) उपयुडि उजल्लजखत कायों में लगे कमडकारों के जहत संरजित हों;

(ii) ऐसे कमडकार को कोल इंजडया जलजमटेड, कोयला मंत्रालय, भारत सरकार द्वारा जनयुि उच्च अजधकार प्राप्त सजमजत के

जसफाटरिों के अनुसार और कोल इंजडया जलजमटेड द्वारा समय-समय पर अजधसूजचत िरों पर मििूरी और अन्द्य प्रसुजिधाएं

िी िाएं;

(iii) केन्द्रीय ठेका श्रम सलाहकार बोडड को यह सुजनजश्चत करने और िांच करने के जलए प्रजतष्ठान का जनरीिण करने का

अजधकार होगा दक क्या कोई एनएलसी इंजडया जलजमटेड में ऐसे कमडकारों को ऐसी मििूरी और प्रसुजिधााँए िी िाती हैं;

(iv) एनएलसी इंजडया जलजमटेड का प्रबंध यह सुजनजश्चत करेगा दक िब कभी संजििा में कोई पटरितडन होता है, तो जिद्यमान

ऐसे संजििा कमडकार को, िो कायडरत हैं, कतडव्यों का अनुपालन में समाधानप्रि के अध्यधीन रहते हुए आने िाले संजििाकार

द्वारा जनयोिन में अजधमान दिया िाएगा;

(v) उि अजधसूचना संख्या का.आ. 2063, तरीख 21 िून, 1988 की अनुसूची के क्रम संख्या 1 से 3 के सामने जिजनर्िडष्ट

कोयला खनन संकमड पर प्रासंजगक या आनुसंजगक नौकरी में कायडरत कमडकार कोल इंजडया जलजमटेड, कोयला मंत्रालय,

भारत सरकार द्वारा जनयुि उच्च अजधकार प्राप्त सजमजत द्वारा अिधाटरत और कोल इंजडया जलजमटेड द्वारा समय-समय पर

अजधसूजचत िरों के अनुसार मििूरी प्राप्त करेंगे;

(vi) संजििाकार, प्रधान जनयोिा के सार्-सार् उि उच्च अजधकार प्राप्त सजमजत की मििूरी की, िो प्रत्येक छह मास में

बढ़ती है और खान अजधजनयम, 1952 (1952 का 35) के उपबंधों के अनुसार अन्द्य फायिे का भी संिाय सुजनजश्चत करेगा;

(vii) संजििा कमडकार, उपिान संिाय अजधजनयम, 1972 (1972 का 39) के उपबंधों के अधीन आएंगे; और

(viii) संजििा कमडकारों को खान अजधजनयम, 1952 (1952 का 35) के उपबंधों के अनुसार मििूरी सजहत बोनस और छुट्टी

िी िाएगी ।

NOTIFICATION

New Delhi, the 31st December, 2020

S.O. 4790.(E).—In exercise of the powers conferred by section 31 of the Contract Labour (Regulation and

Abolition) Act, 1970 (37 of 1970), the Central Government, after consultation with the Central Advisory Contract

Labour Board, hereby exempts Talabira II & III Coal Block allotted to the Neyveli Lignite Corporation (NLC) India

Limited from the applicability of notification of the Government of India in the Ministry of Labour number S.O. 2063

dated the 21^st June, 1988, published in the Gazette of India, Part II, section 3, sub-section (ii), in respect of

employment of contract labour in the works specified in the Schedule to the said notification against serial numbers 1

to 3, for a period of three years subject to the following conditions namely:-

(i)

the interest of the workmen engaged in the above mentioned works be protected;

(ii)

such workmen be paid wages and other benefits as per the recommendations of the High Powered Committee

appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal

India Limited from time to time;

(iii)

the Central Advisory Contract Labour Board will have the right to inspect the establishment to ensure and

check whether such wages and benefits are given to such workers in NLC India Limited;

(iv)

the Management of NLC India Limited shall ensure that whenever there is a change of contract, existing

contract workmen who are working may be given preference in employment by the incoming contractor,

subject to satisfactory performance of duties;

(v)

the workmen working in jobs ancillary or incidental to coal mining works specified against serial numbers 1 to

3 of the Schedule to the said notification number S.O. 2063 dated the 21^st June, 1988, shall get wages as

determined by the High Powered Committee appointed by the Coal India Limited, Ministry of Coal,

Government of India and the rates notified by the Coal India Limited from time to time;

(vi)

the contractor, as well as the Principal Employer, shall ensure payment of the said High Powered Committee

wages, which increases every six months, and also other benefits as per the provisions of the Mines Act, 1952

(35 of 1952);

(vii) the contract workers shall be covered under the provisions of the Payment of Gratuity Act, 1972 (39 of 1972);

and

(viii) the contract workers shall be paid bonus and leave with wages as per the provisions of the Mines Act, 1952 (35

of 1952).
