का.आ. 4816(अ).—केंद्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का
अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमे इसके पिचात उक्त अजधजनयम कहा गया है) की धारा 3 की
उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या
का. आ. 1573(अ) तारीख 24 माचज 2020, िो भारत के असाधारणा रािपत्र तारीख 21 मई 2020, में प्रकाजित की गई
थी, द्वारा उस अजधसूचना से संलग्न अनुसूची में जिजनर्िजष्ट भूजम में आंध्र प्रिेि राज्य के पजिम गोिािरर जिल्ला में
आर.िी.टी.आई.एल (ताड़ेपल्लीगुडेम गांि) से तेलंगाना राज्य के पेद्दापल्ली जिल्ला में आई.पी.एस-3 (गुमनूर गांि) तक
प्राकृजतक गॅस के पररिहन के जलए िी.एस.पी.एल इंजडया रानस्ट्को जलजमटेड (िी.आई.टी.एल) द्वारा पाइपलाइन जबछाने के
प्रयोिन के जलए उपयोग के अजधकार का अिजन के अपने आिय की घोषणा की थी;
और उक्त असाधारण रािपत्र अजधसूचना की प्रजतया िनता को ताररख 22 िून 2020 तक उपलब्ि करा िी गई
थी;
और सक्षम प्राजधकारी ने, उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्द्रीय सरकार को ररपोटज िे िी
है;
और केंद्रीय सरकार ने, उक्त ररपोटज पर जिचार करने के पिात, और यह समाधान हो िाने पर की उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत है, उसमें उपयोग के अजधकार का अिजन करने का जिजनिय दकया है;

अतः अब, केन्द्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए,
यह घोषणा करती है दक इस अजधसूचना से संलग्न अनुसूची में जिजनर्िजष्ट भूजम में पाइपलाइन जबछाने के जलए उपयोग के
अजधकार का अिजन दकया िाए;
और केंद्रीय सरकार उक्त अजधजनयम दक धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेनी है दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन दक तारीख से केन्द्द्रीय सरकार में जनजहत होने के
बिाए, सभी जिल्लंगमों से मुक्त होकर िी.एस.पी.एल इंजडया रानस्ट्को जलजमटेड (िी.आई.टी.एल) में जनजहत होगा ।
पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 दक धारा 10 के अध्यधीन दकसी भी क्षजतपूर्तज के जलए
िी.एस.पी.एल इंजडया रानस्ट्को जलजमटेड (िी.आई.टी.एल) पूणजतया उक्तिायी होगी और पाइपलाइन से सम्बजन्द्धत दकसी
भी मामले पर केन्द्द्रीय सरकार के जिसृद्द कोई िाि, िािा या कानूनी कायजिाही नहीं हो सकेगी।

MINISTRY OF PETROLEUM AND NATURAL GAS
NOTIFICATION
New delhi, the 29th December, 2020
S.O. 4816(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and
Natural Gas S.O.No.1573 (E) dated the 24th March, 2020, issued under Sub-section (1) of Section 3 of the Petroleum
and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the
said Act), published in the Extraordinary Gazette of India dated 21st May, 2020, the Central Government declared its
intention to acquire the Right of User in the land specified in the schedule appended to that notification for the purpose
of laying pipeline in State of Telangana for transportation of Natural Gas from West Godavari District of Andhra
Pradesh RGTIL (Tadepallegudem) to Peddapalli District of Telangana State IPS.3 (Gumnoor Village) under
Mallavaram - Bhopal- Bhilwara - Vijaipur pipeline by the GSPL India Transco Limited, Gandhinagar, Gujarat State.
And whereas copies of the said Extraordinary Gazette notification were made available to the public up to
22 June 2020.
And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report
to the Central Government.
And whereas the Central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of the section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date of publication of the declaration, in GSPL INDIA TRANSCO LIMITED
(GITL), free from all encumbrances.
GSPL INDIA TRANSCO LIMITED (GITL) shall be exclusively liable for any compensation in terms of
Section 10 of the P& MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government
on any matter relating to the pipeline.
