का.आ. 2(अ).—केंद्रीर् सरकार, भारत के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना संख र्ांक

1242(अ), तारीख 8 माचा, 2019 [जिसे इसमें इसके पश् चातद वीपीप तयीर् जवजनर्मन पररषेतेत्र (आईसीआरिेड) अजधसूचना,

2019 कहा गर्ा है] वीपारा कजतपर् तयीर् खंड को तयीर् जवजनर्मन पररषेतेत्र के रूप में घोजित दकर्ा गर्ा था और उक् त

पररषेतेत्र में, उद्योगों की स्ट् थापना करना तथा जवस्ट् तार करना, प्रचालनों और प्रदिर्ाओं पर जनर्बंधन अजधरोजपत दकए गए थे ;

और केंद्रीर् सरकार को वीपीप तयीर् जवजनर्मन पररषेतेत्र (आईसीआरिेड) अजधसूचना के उपर्बंधों के अधीन समूह-1

से समूह-2 तक र्बडा जनकोर्बार वीपीप का पुन: वगीकरण के संर्बंध में अंिमान और जनकोर्बार प्रिासन से अभ् र्ावेिन प्रा‍ त

हुए हैं ;

और तयीर् पररषेतेत्र प्रर्बंध प्राजधकरण ने 4 नवम् र्बर, 2020 को आर्ोजित अपनी 41वीं र्बैठक में र्ह भी जवजनश् चर्

दकर्ा दक र्बडा जनकोर्बार के पुन: वगीकरण पर जवचार करने की आवश् र्कता है ;

और केंद्रीर् सरकार की, पर्ाावरण (संरषेतण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (4) के उपर्बंधों को ध् र्ान में

रखते हुए र्ह रार् है दक वीपीप तयीर् जवजनर्मन पररषेतेत्र (आईसीआरिेड) अजधसूचना, 2019 का संिोधन करने के जलए

उक् त जनर्मों के जनर्म 5 के उपजनर्म (3) के खंड (क) के अधीन सूचना की अपेषेता को अजभमुजक् त िेना लोकजहत में है ;

अत:, अर्ब, केंद्रीर् सरकार, पर्ाावरण (संरषेतण) जनर्म, 1986 के जनर्म 5 के उपजनर्म (3) के खंड (घ) के साथ

परठत पर्ाावरण (संरषेतण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v)

वीपारा प्रित् त िजक् तर्ों का प्रर्ोग करते हुए, वीपीप तयीर् जवजनर्मन पररषेतेत्र (आईसीआरिेड) अजधसूचना, 2019 का

जनम् नजलजखत और संिोधन करती है, अथाातद :--

उक् त अजधसूचना में,-

(क) पैरा 1 में, खंड (ii) के स्ट् थान पर जनम् नजलजखत खंड रखा िाएगा, अथाातद :--

‘‘(ii) अंिमान और जनकोर्बार (आईसीआरिेड वीपीप समूहों) में आठ र्बडे महासागरीर् वीपीपों को जनम् नजलजखत समूहों

में रखा िाएगा :--

समूह-1 : 1000 वगा दकलोमीयर से अजधक भौगोजलक षेतेत्रफल वाले वीपीप िेसे िजषेतणी अंिमान, मध् र्

अंिमान और उत् तरी अंिमान

समूह-2 : 100 वगा दकलोमीयर से अजधक दकन् तु 1000 वगा दकलोमीयर से कम भौगोजलक षेतेत्रफल वाले

वीपीप िैसे र्बारायांग, छोया अंिमान, हैवलोक, कार जनकोर्बार और र्बडा जनकोर्बार ’’;

(ख) पैरा 8 के खंड (i) में, उपखंड (ङ) के स्ट् थान पर जनम् नजलजखत उपखंड रखा िाएगा, अथाातद :--

‘‘(ङ) पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के कार्ाालर् आिेि संख र्ांक िे-17011/8/92-

IAIII, तारीख 8 अगस्ट् त, 2019 वीपारा पररलजषेतत अजभकरणों में से दकसी अजभकरण वीपारा 1:4000 मापमान में

तैर्ार दकर्ा गर्ा मानजचत्र, जिसमें एनसीएससीएम वीपारा वीपारा दकए गए सीमांकन के अनुसार एचयीएल र्ा

एलयीएल का उपर्ोग दकर्ा गर्ा हो ’’

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 1st January 2021

S.O. 2(E).—WHEREAS, by notification of the Government of India in the Ministry of

Environment, Forest and Climate Change number S.O. 1242(E), dated the 8^th March, 2019 [hereinafter

referred to as the Island Coastal Regulation Zone (ICRZ) Notification, 2019], the Central Government

declared certain coastal stretches as Coastal Regulation Zone and restrictions were imposed on the setting

up and expansion of industries, operations and processes in the said zone;

AND WHEREAS, the Central Government have received representations from Andaman and

Nicobar Administration regarding re-categorisation of Great Nicobar Island from Group –I to Group –II

islands under the provisions of the Island Coastal Regulation Zone (ICRZ) notification;

AND WHEREAS, the National Coastal Zone Management Authority in its 41^st meeting held on the

4^th November, 2020 had also decided that the re-categorisation of Great Nicobar need consideration;

AND WHEREAS, the Central Government, having regard to the provision of sub-rule (4) of rule 5

of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with

the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for amending the Island

Coastal Regulation Zone (ICRZ) Notification, 2019.

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clause (v) of

sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with clause (d) of

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes

the following further amendments in the Island Coastal Regulation Zone (ICRZ) Notification, 2019,

namely: -

In the said notification, -

(a)

in paragraph 1, for clause (ii), the following clause shall be substituted, namely: -

“(ii)

The eight bigger oceanic islands in Andaman and Nicobar (ICRZ Islands) shall be grouped as

follows: -

Group-I: Islands with geographical areas >1000 sq.km such as South Andaman, Middle

Andaman and North Andaman.

Group-II: Islands with geographical areas >100 sq.km but < 1000 sq.km such as Baratang, Little

Andaman, Havelock, Car Nicobar and Great Nicobar.”;

(b)

in paragraph 8, in clause (i), for sub-clause (e), the following sub-clause shall be substituted,

namely: -

“(e) CRZ map in 1:4000 scale, drawn up by any of the agencies identified by the Ministry of

Environment, Forest and Climate Change vide its Office Order number J-17011/8/92-IAIII, dated

the 8^th August, 2019 using the demarcation of the HTL or LTL, as carried out by NCSCM.”.
