उपरोक् त तिर्ि पिोन् नजत, जनम् नजलजखत ितों के अध् यधीन होगी :—

i.

तिर्ि पिोन् नजत, जनम् नजलजखत न् यायालयी मामले में जनणिय के अध् यधीन होगी : —

(क) जसजिल ररट याजचका (सीडब्‍ ल् यूपी) सं. 13218/2009 में माननीय पंिाब एिं हररयाणा उच् च न् यायालय

द्वारा पाररत अंजतम जनणिय एिं आिेि दिनांक 15.07.2011 के पररणामस्ट् िरूप िायर एसएलपी (जस)

सं. 30621/2011 तर्ा माननीय सिोच् च न् यायालय में अन् य संबंजधत मामले।

(ख) अजखल भारतीय समता मंच एिं अन् य बनाम भारत सं एिं अन् य द्वारा िायर ररट याजचका (जस) सं.

3490/2010 में माननीय उच् च न् यायालय, दिल् ली द्वारा दिए गए जनणिय दिनांक 23.08.2017 के

पररणामस्ट् िरूप एसएलपी (जस) सं. 31288/2017

(ग) उच् च न् यायालय, दिल् ली द्वारा दिए गए जनणिय दिनांक 12.11.2018 के जिरुद्ध एस.एन. िसरा एिं राि

कुमार के संबंध में एसएलपी सं. 5724-5725/2019

( ) कोई अन् य संबंजधत न् यायालयी मामला।

ii.

यह तिर्ि पिोन् नजत, जनयुक् त अजधकाररयों को अजनजित अिजध तक अिरसजचि के ग्रेड में बने रहने अर्िा उक् त

ग्रेड में जनयजमत पिोन् नजत के जलए चयन सूची में िाजमल होने अर्िा उक् त ग्रेड में िररष्‍ट ठता का िािा करने के जलए

कोई अजधकार प्रिान नहीं करती।

iii.

तिर्ि आधार पर पिोन् नजत की यह अिजध आरंभ में 30.06.2021 तक अर्िा अगले आिेिों तक, िो भी पहले हो,

होगी।

iv.

तिर्ि आधार पर प्रिान की गई यह पिोन् नजत, जबना कोई कारण बताए दकसी भी समय समाप् त की िा सकती ह।

No. AD-06/1/2018-Admin.—In pursuance of Department of Personnel and Training’s Order No. 5/10/2020-

CS.I(U) dated 21.12.2020, the President is pleased to promote following Section Officers to the Grade-I

(Under Secretary) of CSS in the Pay Matrix level-11 (Rs. 67,700-2,08,700) purely on ad-hoc basis for a period up to

30.06.2021 or till the posts are filled up on regular basis or until further orders whichever is earlierw.e.f. the date

shown against their names:—

The above ‘ad-hoc’ promotion is subject to the following conditions:—

i.

The ad hoc promotion will remain subject to the outcome of the following Court Cases:

(a) The SLP (C) No.30621/2011 arising out of final judgement and order dated 15.07.2011 in CWP

No.13218/2009 passed by the Hon'ble High Court of Punjab & Haryana and other tagged cases before the

Hon'ble Supreme Court;

(b) The SLP (C) No.31288/2017 arising out of Hon'ble Delhi High Court Judgement dated 23.08.2017 in

WP(C) No.3490/2010 filed by the All India Equality Forum & Others vs. UoI&Ors.

(c) The SLP Nos.5724-5725/2019 in respect of S.N. Jasra & Raj Kumar against Delhi High Court's judgement

dated 12.11.2018.

(d) Any other connected court matter

ii.

The ad hoc promotions shall not confer any right on the officers to continue in the grade of Under Secretary

indefinitely or for inclusion in the Select List for regular promotion to the grade or to claim seniority in the

grade.

iii.

The ad hoc promotions shall be initially for a period upto 30.06.2021 or until further orders, whichever is

earlier.

iv.

The ad hoc promotions may be terminated at any point of time without giving any reason therefor.
