NOTIFICATION

New Delhi, the 11th January, 2021

S.O. 111(E).—Whereas by the notification of the Government of India in the Ministry of

Petroleum and Natural Gas S.O. No. 661(E) dated the 10^th February, 2020, issued under sub-section (1) of

section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of

1962), (hereinafter referred to as the said Act), published in the Gazette of India dated the 12^th February,

2020 the Central Government declared its intention to acquire the right of user in the land specified in the

Schedule appended to that notification for the purpose of laying ‘Augmentation of Paradip-Haldia-

Durgapur LPG Pipeline and its extension up to Patna and Muzaffarpur’ Pipeline Project’ for the

transportation of Petroleum Products in Block-Musahari, District-Muzaffarpur in the state of Bihar by

Indian Oil Corporation Limited;

And whereas copies of the said Gazette notification were made available to the concerned land

owner by 28^th February 2020.

And whereas Shri Arun Kumar Jha, Competent Authority Patna (Bihar) has under sub-section (1)

of section 6 of the said Act submitted report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that

the said land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,

the Central Government hereby declares that the right of user in the land specified in the Schedule

appended to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the

Central Government hereby directs that the right of user in the said land for laying the pipeline shall,

instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian

Oil Corporation Limited, free from all encumbrances.

का.आ. 112(अ).—केन्द्रीय सरकार को ऐसा प्रतीत होता है दक लोकजहत में यह आवश्यक है दक ‘पारािीप-

हजल्िया-िुगाापुर एलपीिी पाइपलाइन का संबधान तथा पटना और मुिफ्फरपुर तक इसका जवस्ट्तार’ पररयोिना के अन्द्तगात

पेरोजलयम पिाथो के पररवहन हेतु जबहार राज्य के लखीसराय जिले के अंिल- सूयागढ़ा तथा लखीसराय में इंजडयन ऑयल

कॉपोरेिन जलजमटेड द्वारा पाइपलाइन जबछाई िानी िाजहए;

और केन्द्रीय सरकार को ऐसी पाइपलाइन जबछाने के प्रयोिन के जलए यह आवश्यक प्रतीत होता है दक उस भूजम में

जिसके भीतर उक्त पाइपलाइन जबछाई िाने का प्रस्ट्ताव है और िो इस अजधसूिना से संलग्न अनुसूिी मे वर्णात है, उपयोग

के अजधकार का अिान दकया िाए ;

अतः अब, केन्द्रीय सरकार, पेरोजलयम और खजनि पाइपलाइंस (भूजम में उपयोग के अजधकार का अिान)

अजधजनयम, 1962 (1962 का 50) की धारा 3 की उप-धारा (1) द्वारा प्रित िजक्तयों का प्रयोग करते हुए, उस भूजम में

उपयोग के अजधकार का अिान करने के अपने आिय की घोषणा करती है।

कोई व्यजक्त, िो उक्त अनुसूिी में वर्णात भूजम में जहतबद्ध है, उस तारीख से जिसको, भारत के रािपत्र में यथा-

प्रकाजित इस अजधसूिना की प्रजतयााँ साधारण िनता को उपलब्ध करा िी िाती है, इक्कीस दिन के अन्द्िर, भूजम के भीतर

पाइपलाइन जबछाये िाने हेतु उपयोग के अजधकार के अिान के जलए, श्री भुवनेश्वर जमश्रा, से. जन. अपर सजिव जबहार

सरकार व सक्षम प्राजधकार, इंजडयन ऑयल कॉपोरेिन जलजमटेड (पाइपलाइंस जडजविन), बरौनी जनमााण कायाालय, बी. के.

पी. एल. मुख्यालय पररसर, पो. बरौनी आयल ररफ़ाइनरी, जिला बेगूसराय, जपन– 851114 (जबहार) को जलजखत रूप में

आक्षेप भेि सकेगा ।

S.O. 112(E).—Whereas, it appears to the Central Government that it is necessary in the public

interest that a pipeline should be laid by the Indian Oil Corporation Limited in Anchal- suryagarha and

Lakhisarai of Lakhisarai district in the State Bihar for “Augmentation of Paradip-Haldia-Durgapur LPG

pipeline and its extension up to Patna and Muzaffarpur” Project for the transportation of LPG Product.

And whereas, it appears to the Central Government that for the purpose of laying such pipeline,

it is necessary to acquire the right of user in land under which the said pipeline is proposed to be laid

and which is described in the Schedule annexed hereto;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the

Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the

Central Government hereby declares its intention to acquire the right of user therein;

Any person interested in the land described in the said schedule may, within twenty one days

from the date on which copies of the Gazette of India containing this notification are made available to

the general public, object in writing to the acquisition of the right of user therein for laying of the

pipeline under the land to Shri. Bhubneshwar Mishra, Additional Secretary (Retd.), Govt. of Bihar &

Competent Authority, Indian Oil Corporation Limited, Pipeline Division Barauni Construction Office,

BKPL Head Quarter, Post- Barauni Oil Refinery, District – Begusarai, Bihar – 851114

का.आ. 113(अ).— केन्द्रीय सरकार ने पेरोजलयम और खजनि पाईपलाईन (भूजम में उपयोग के अजधकार का

अिान) अजधजनयम 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया हैं) की धारा 3 की

उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूिना संख्या

का.आ. 2337 (अ) तारीख 13 िुलाई 2020, िो भारत के असाधारण रािपत्र तारीख 14 िुलाई 2020, में प्रकाजित

की गई थी द्वारा उस अजधसूिना से संलग् न अनुसूिी में जवजनर्िाष्ट भूजम में जबहार राज्य में "पारािीप हल्िीया-िुगाापुर

पाइपलाइन संबद्धान पररयोिना तथा पटना और मुिफ्फरपुर तक इसका जवस्ट्तार" अन्द्तगात जिला पटना में एलपीिी

पिाथा के पररवहन के जलए इंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा पाईपलाईन जबछाने के प्रयोिनाथा उपयोग के

अजधकार के अिान के अपने आिय की घोषणा की थी ;

और उक्त रािपत्र अजधसूिना की प्रजतयां िनता को तारीख 22 अगस्ट्त 2020 तक उपलब्ध करा िी गई थी ;

और सक्षम प्राजधकारी ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोटा िे

िी है ;

और केन्द्रीय सरकार ने, उक्त ररपोटा पर जविार करने के पश्चात् और यह समाधान हो िाने पर दक उक्त भूजम

पाईपलाईन जबछाने के जलए अपेजक्षत है, उसमें उपयोग के अजधकार का अिान करने का जवजनश्चय दकया है ;

अतः अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रद्त्त िजक्तयों का प्रयोग करते हुए

यह घोषणा करती है दक इस अजधसूिना से संलग्न अनुसूिी में जवजनर्िाष्ट भूजम में पाईपलाईन जबछाने के जलए उपयोग के

अजधकार का अिान दकया िाए ;

और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रद्त्त िजक्तयों का प्रयोग करते हुए,

यह जनिेि िेती है दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत

होने के बिाए, सभी जवल्लंगमों से मुक्त होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड में जनजहत होगी।

पेरोजलयम ओर खजनि पाईपलाईन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्ता के जलए

इंजडयन ऑयल कॉपोरेिन जलजमटेड पूणातया उतरिायी होगी और पाईपलाईन से सम्बजन्द्धत दकसी भी मामले पर

केन्द्रीय सरकार के जवरुद्ध कोई वाि िावा या कानूनी कायावाही नहीं हो सकेगी।

August 2020;

And whereas the competent authority has under sub-section (1) of section 6 of the said Act

submitted report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied

that the said land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said

Act, the Central Government hereby declares that the right of user in the land specified in the Schedule

appended to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act,

the Central Government hereby directs that the right of user in the said land for laying the pipeline shall,

instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian

Oil Corporation Limited, free from all encumbrances.

Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of

Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central

Government on any matter relating to the pipeline.

S.O. 114(E).—In exercise of the powers conferred by Sub section (1) of Section 3 of the Petroleum

and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central

Government hereby makes the following amendments in the notification of the Government of India in the

Ministry of Petroleum and Natural Gas of S.O. 2241(E) dated the 25.06.2020, published in the pages

(Hindi) as given below of Part- II, Section 3, Sub section (ii) of the Extra Ordinary Gazette of India No.

1981 dated 07.07.2020.
