संबंजधत अजधसूचिा

सं. सेबी/एलएडी-एिआरओ/िीएि/2021/05.—भारतीय प्रजतभूजत और जिजिमय बोडड, भारतीय प्रजतभूजत

और जिजिमय बोडड अजधजियम, 1992 (1992 का 15) की धारा 30 द्वारा प्रदत्त िजियों का प्रयोग करते हुए एतद्द्वारा

भारतीय प्रजतभूजत और जिजिमय बोडड (बािार सहभाजगयों के केन्द्रीय डाटाबेस) जिजियम, 2003 (िो भारत के

रािपत्र, असाधारण, भाग III - खण्ड 4 में, तारीख 20 ििम्बर, 2003 की भारतीय प्रजतभूजत और जिजिमय बोडड

की अजधसूचिा फा.सं. भाप्रजिबो/जिजध/26/2003 द्वारा, प्रकाजित हुए थे) को तुरंत प्रभाि से जिरजसत करता है ।

1. उपरोि जिजियमों के जिरजसत होिे से -

(i) उपरोि जिजियमों के पूिड प्रितडि अथिा उिके तहत की गई ककसी भी बात आकद या ि की गई

ककसी भी बात आकद;

(ii) उपरोि जिजियमों के तहत अर्िडत या प्रोद्भूत या उपगत ककसी अजधकार, जििेषाजधकार, बाध्यता या

दाजयत्ि;

(iii) उपरोि जिजियमों के अिुसार ककए गए ककसी उल्लंघि या अपराध के संबंध में लगाई गई ककसी

िाजस्ट्त (पेिल्टी) या कदए गए ककसी दंड;

(iv) उपरोिािुसार ककसी ऐसे अजधकार, जििेषाजधकार, बाध्यता, दाजयत्ि, िाजस्ट्त (पेिल्टी) या दंड की

बाबत ककसी अन्द्िेषण (इन्द्िेजस्ट्टगेिि), कािूिी कायडिाही या उपचार,

पर कोई असर िहीं पडेगा ।

ऐसा कोई अन्द्िेषण (इन्द्िेजस्ट्टगेिि), कािूिी कायडिाही या उपचार ककया िा सकेगा, उसे िारी रखा िा

सकेगा या उसे लागू कराया िा सकेगा, और ऐसी कोई िाजस्ट्त (पेिल्टी) लगाई िा सकेगी या ऐसा कोई दंड

कदया िा सकेगा, मािो कक उपरोि जिजियम जिरजसत ही ि हुए हों ।

NOTIFICATION

Mumbai, the 13th January, 2021

Notification repealing the Securities and Exchange Board of India (Central Database of Market Participants)

Regulations, 2003

No. SEBI/LAD-NRO/GN/2021/05—In exercise of the powers conferred by Section 30 of the Securities and

Exchange Board of India Act, 1992 (15 of 1992), the Securities and Exchange Board of India hereby repeals with

immediate effect the Securities and Exchange Board of India (Central Database of Market Participants) Regulations,

2003 published in Part-III, Section 4 of the Gazette of India, Extraordinary, under notification of the Securities and

Exchange Board of India number F. No. SEBI/LE/26/2003 dated the 20^th November, 2003.

1. The repeal of the said regulations shall not affect—

(i)

the previous operation of the said regulations or anything done or omitted to be done or suffered

therein;

(ii) any right, privilege, obligation or liability acquired or accrued or incurred under the said regulations;

(iii) any penalty or punishment incurred in respect of any contravention or offence committed under the said

regulations;

(iv) any investigation, legal proceedings or remedy in respect of any such right, privilege, obligation,

liability, penalty or punishment as aforesaid.

2. Any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such

penalty or punishment may be imposed as if the said regulations had not been repealed.
