सा.का.जन. 34(ऄ).—केन्द्रीय सरकार, पौधा ककस्ट्म और कृिक कल्याण ऄजधजनयम, 2001 (2001 का 53) की

धारा 96 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, पौधा ककस्ट्म और कृिक ऄजधकार संरक्षण जनयम, 2003 का और

संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, ऄथाात् :-

1.

(1) इन जनयमों का नाम पौधा, ककस्ट्म और कृिक ऄजधकार संिोधन (दूसरा संिोधन) जनयम, 2020 है ।

(2) ये रािपत्र में उनके प्रकािन की तारीख को प्रिृत्त होंगे ।

पौधा ककस्ट्म और कृिक ऄजधकार संरक्षण जनयम, 2003 (जिसे इसमें इसके पश्चात् उि जनयम कहा गया है ।) के

जनयम 19 में,-

(i) उप जनयम (2) में,-

(क) “या समामेलन” िब्दों का लोप ककया िाएगा ;

(ख) खंड (ख) में,-

(I) उपखंड (ii) में “सेिा ककया हो” के पश्चात् “और” िब्द रखा िाएगा ;

(II) उपखंड (ii) के बाद जनम्नजलजखत खंड को रखा िाएगा, ऄथाात् :-

“(iii) खंड (क) के उपखंड (ii) में यथा जिजनर्ददष्ट िैक्षजणक ऄहाताएं धाररत करता हो ।”।

3. उि जनयम के, उपजनयम (4) के बाद जनम्नजलजखत उप जनयम को ऄंतःस्ट्थाजपत ककया िाएगा, ऄथाात् :-

“महारजिस्ट्रार पद पर जनयुजि के जलए चयन सजमजत का गठन जनम्नजलजखत प्रकार से होगा :-

(i) सजचि, कृजि, सहकाररता और ककसान कल्याण जिभाग - ऄध्यक्ष

(ii)ऄध्यक्ष, पौधा ककस्ट्म और कृिक ऄजधकार संरक्षण प्राजधकारी - सदस्ट्य

(iii)सजचि, िैि-प्रौद्योजगकी जिभाग – सदस्ट्य

(iv)सजचि, कृजि ऄनुसंधान और जिक्षा जिभाग- सदस्ट्य

NOTIFICATION

New Delhi, the 19th January, 2021

G.S.R. 34(E).—In exercise of the powers conferred by section 96 of the Protection of Plant

Varieties and Farmers Rights Act, 2001 (53 of 2001), the Central Government hereby makes the following

rules further to amend the Protection of Plant Varieties and Farmers’ Rights Rules, 2003, namely:-

1. (1) These rules may be called the Protection of Plant Varieties and Farmers’ Rights (Second

Amendment) Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Protection of Plant Varieties and Farmers’ Rights Rules, 2003 (hereinafter referred to as the

said rules), in rule 19,-

(i)

In sub-rule (2), -

(a) in the opening portion, the word “absorption” shall be omitted;

(b) in Clause (b),-

(I)

in sub-clause (ii), for the words “in the pay matrix:”, the words “in the pay

matrix; and”, shall be substituted;

(II)

after sub-clause (ii), the following sub-clause shall be inserted, namely:-

“(iii) possessing educational qualifications as specified in sub-clause (ii) of

clause (a).”.

3. In the said rules, after sub-rule (4), the following sub-rule shall be inserted, namely:-

“The composition of Selection Committee for appointment to the post of Registrar General shall be

as under:-

(i)

Secretary, Department of Agriculture, Co-operation & Farmers’ Welfare-

Chairman

(ii) Chairperson, Protection of Plant Varieties and Farmers Rights Authority-

Member

(iii) Secretary, Department of Bio-Technology-

Member

(iv) Secretary, Department of Agriculture Research and Education-

Member
