का.अ. 281(ऄ).—केन्द्रीय सरकार ने, राष्ट्रीय रािमागग ऄजधजनयम, 1956 (1956 का 48) (जिसे आसमें आसके

पश्चात् ईक्त ऄजधजनयम कहा गया है) की धारा 3क की ईपधारा (1) के ऄधीन िारी की गइ भारत सरकार के सड़क

पररवहन और रािमागग मंत्रालय की ऄजधसूचना संख्या का.अ. 396, का.ऄ. 721 ददनांक 24 िनवरी, 2020 , िो भारत

के रािपत्र, ऄसाधारण, भाग II, खण्ड 3, ईपखंड (ii) में प्रकाजित की गइ थी, द्वारा गुिरात राज्य के भावनगर जिले में

NH51 के दक.मी. 07.090 से दक.मी. 53.585 (भावनगर - तलिा सेक्िन, पैकेि -I) (जडप्टी कलक्टर, भावनगर) तक के

राष्ट्रीय रािमागग के जनमागण (चौड़ा करने/चार लेन का बनाने, अदद), ऄनुरक्षण, प्रबंधन और प्रचालन के जलए ईस

ऄजधसूचना से ईपाबद्ध ऄनुसूची में जवजनर्ददष्ट भूजम का ऄिगन करने के ऄपने अिय की घोषणा की थी ;

और ईक्त ऄजधसूचना का सार ईक्त ऄजधजनयम की धारा 3क की ईपधारा (3) के ऄधीन तारीख "04.03.2020"

को "आंजडयन एक्सप्रेस" और "संदेि" दोनों में प्रकाजित दकया गया था ;

और अक्षेप प्राप्त हुए थे और सक्षम प्राजधकारी ने ईन पर जवचार कर जलया है और अक्षेपों को ऄननुज्ञात कर

ददया है ;

और सक्षम प्राजधकारी ने ईक्त ऄजधजनयम की धारा 3घ की ईपधारा (1) के ऄनुसरण में, केन्द्रीय सरकार को ऄपनी

ररपोटग दे दी है ;

ऄतः ऄब, केन्द्रीय सरकार, सक्षम प्राजधकारी की ईक्त ररपोटग प्राप्त हो िाने पर और ईक्त ऄजधजनयम की धारा 3घ

की ईपधारा (1) द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, यह घोषणा करती है दक ईक्त ऄनुसूची में जवजनर्ददष्ट भूजम का

पूवोक्त प्रयोिन के जलए ऄिगन दकया िाना चाजहए ;

और ऄब, केन्द्रीय सरकार, ईक्त ऄजधजनयम की धारा 3घ की ईपधारा (2) के ऄनुसरण में यह घोषणा करती है दक

आस ऄजधसूचना के रािपत्र में प्रकािन पर, ईक्त ऄनुसूची में जवजनर्ददष्ट भूजम सभी जवल्लंगमों से मुक्त होकर अत्यजन्द्तक रूप

से केन्द्रीय सरकार में जनजहत हो िाएगी ।

NOTIFICATION

New Delhi, the 20th January, 2021

S.O. 281(E).—Whereas by the notification of the Government of India in the Ministry of Road

Transport and Highways, S.O. Number 396(E) Dated 24th January 2020, published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National

Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government

declared its intension to acquire the land specified in the Schedule annexed to the said notification for

building (widening/four-laning, etc.), maintenance, management and operation of NH51 on the stretch of

land from Km. 07.090 to Km. 53.585 (Bhavnagar - Talaja Section, Package -I) (Deputy Collector Office

Bhavnagar) in the district of BHAVNAGAR in the state of GUJARAT;

And whereas the substance of the said notification has been published in “Indian Express” and

“Sandesh” both dated 04.03.2020; under sub-section (3) of section 3A of the said Act;

And whereas objections have been received and the same have been considered and disallowed by

the Competent Authority;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority

has submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the

powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby

declares that the land specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government

hereby declares that on publication of this notification in the Official Gazette, the land specified in the said

Schedule shall vest absolutely in the Central Government, free from all encumbrances.
