का.आ. 297(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइंस (भूजम में उपयोग के अजधकार का
अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 की
उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्रकृजतक गैस मंत्रालय की अजधसूचना संख्या
का. आ. 4420 (अ) तारीख 09 दिसम्बर, 2019, भारत के रािपत्र सं. 3975 तारीख मंगलवार, 10 दिसम्बर, 2019 में
प्रकाजित की गई थी | इस अजधसूचना से संलग्न अनुसूची में जवजनर्िजष्ट भूजम में जबहार राज्य में “हल्िीया - बरौनी
पाइपलाइन जसस्ट्टम्स पररयोिना’’ हेतु जिला पटना में कच्चा तेल के पररवहन हेतु इंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा
पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपने आिय की घोषणा की थी|
और उक्त रािपत्र अजधसूचना की सूचना संबजन्द्धत भू-स्ट्वाजमयों को तारीख 22 िुलाई 2020 तक उपलब्ध करा िी
गई थीं,
और सक्षम प्राजधकारी (बरौनी, जबहार) ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार
को ररपोटज िे िी है,

और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो िाने पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत है, उसमें उपयोग के अजधकार के अिजन करने का जवजनश्चय दकया है;
अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग करते हुए
यह घोषणा करती है की इस अजधसूचना से संलग्न अनुसूची में जवनीर्िजष्ट भूजम में पाइपलाइन जबछाने के जलए उपयोग के
अजधकार का अिजन दकया िाए ,
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेती है दक उक्त भूजम में उपयोग के अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के
बिाए, सभी जवल्लंगमों से मुक्त होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड में जनजहत होगी,
पेरोजलयम और खजनि पाइपलाइंन अजधजनयम,1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए इंजडयन
ऑयल कॉपोरेिन जलजमटेड पूणजतया उत्तरिाई होगा और पाइपलाइन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के
जवरुद्ध कोई िावा या कानूनी कायजवाही नहीं हो सकेगी |

NOTIFICATION
New Delhi, the 13th January, 2021
S.O. 297(E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum and
Natural Gas S. O. No. 4420 (E) Dated 09 December, 2019, published in the Gazette of the India issued under sub-
section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50
of 1962), (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the right of
user in the land specified in the Schedule appended to that notification for the purpose of laying “Haldia-Barauni
Pipeline Systems Project” for the transportation of Crude Oil in Patna District in the state of Bihar by Indian Oil
Corporation Limited.
And whereas copies of the said Gazette notification were made available to the public up to 22 July 2020.
And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted report
to the Central Government;
And whereas the central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the
Central Government, vest on the date publication of the declaration, in Indian Oil Corporation Limited, free from all
encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to the pipeline.

का.आ. 298(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइंस (भूजम में उपयोग के अजधकार का अिजन)
अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 की उपधारा (1) के अधीन
िारी की गई भारत सरकार के पेरोजलयम और प्रकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ. 639 (अ) तारीख 7 फरवरी,
2020, भारत के रािपत्र सं. 585 तारीख 11 फरवरी, 2020 में प्रकाजित की गई थी | इस अजधसूचना से संलग्न अनुसूची में जवजनर्िजष्ट
भूजम में जबहार राज्य में “हल्िीया - बरौनी पाइपलाइन जसस्ट्टम्स पररयोिना “ हेतु जिला िमुई में कच्चा तेल के पररवहन हेतु इंजडयन
ऑयल कॉपोरेिन जलजमटेड द्वारा पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपने आिय की घोषणा की
थी|
और उक्त रािपत्र अजधसूचना की सूचना संबजन्द्धत भू-स्ट्वाजमयों को तारीख 12, जसतंबर, 2020 तक उपलब्ध करा िी गई थी,
और सक्षम प्राजधकारी (बरौनी, जबहार) ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोटज
िे िी है,
और केन्द्रीय सरकार ने, उक्त ररपोटज पर जवचार करने के पश्चात और यह समाधान हो िाने पर दक उक्त भूजम पाइपलाइन
जबछाने के जलए अपेजक्षत है, उसमें उपयोग के अजधकार के अिजन करने का जवजनश्चय दकया है;
अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग करते हुए यह घोषणा
करती है की इस अजधसूचना से संलग्न अनुसूची में जवनीर्िजष्ट भूजम में पाइपलाइन जबछाने के जलए उपयोग के अजधकार का अिजन दकया
िाए ,
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित िजक्तयों का प्रयोग करते हुए, यह जनिेि िेती है
दक उक्त भूजम में उपयोग के अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के बिाए, सभी जवल्लंगमों से
मुक्त होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड में जनजहत होगी,
पेरोजलयम और खजनि पाइपलाइंन अजधजनयम,1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए इंजडयन ऑयल
कॉपोरेिन जलजमटेड पूणजतया उत्तरिाई होगा और पाइपलाइन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जवरुद्ध कोई िावा या
कानूनी कायजवाही नहीं हो सकेगी |
