सा. का.जन. 39(अ).— राष्ट्रपजत, संजिधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त िजियों का प्रयोग करते हुए

और जिजध और न् याय मंत्रालय, जिधायी जिभाग, राजभाषा खंड (समूह ‘क’ और समूह ‘ख’ पद) भती जनयम, 2003 को,

जहां तक उनका संबंध अपर जिधायी परामिी (प्रादेजिक भाषा िाखा) के पद से है तथा जिजध और न् याय मंत्रालय, जिधायी

जिभाग, राजभाषा खंड (समूह ‘क’ पद प्रादेजिक भाषा िाखा) भती जनयम, 2013 को, उन बातों के जसिाय अजधक्ांत करते

हुए, जजन् हें से अजधक्मण से पहले दकया गया है या करने का लोप दकया गया है, राजभाषा खंड, जिधायी जिभाग, जिजध

और न् याय मंत्रालय में समूह ‘क’ (प्रादेजिक भाषा) के पदों पर भती की पद्धजत का जिजनयमन करने के जलए जनम् नजलजखत

जनयम बनाते हैं, अथाात् :-

1. संजिप्त नाम और प्रारंभ.- (1) इन जनयमों का संजिप्त नाम जिजध और न् याय मंत्रालय, जिधायी जिभाग,

राजभाषा खंड (समूह ‘क’ पद प्रादेजिक भाषा) भती जनयम, 2020 है ।

(2) ये राजपत्र में प्रकािन की तारीख को प्रिृत्त होंगे ।

2. पद-संख्या, िगीकरण और िेतन मैट्ररक्स में स्ट् तर.- पदों की संख्या, उनका िगीकरण और इससे संलग् न िेतन

मैट्ररक्स में स्ट् तर िे होंगे जो इन जनयमों से उपाबद्ध अनुसूची के स्ट्तंभ (2) से स्ट्तंभ (4) में जिजनर्ददष्ट हैं ।

3. भती की पद्धजत, आयु-सीमा, अहाताएं, आदद.- उि पदों पर भती की पद्धजत, आयु-सीमा, अहाताएं और उनसे

संबंजधत अन्य बातें िे होंगी जो पूिोक् त अनुसूची के स्ट्तंभ (5) से स्ट्तंभ (13) में जिजनर्ददष्ट हैं ।

4. जनरहाता.- िह व्यजि, -

(क) जजसने से व्यजि से, जजसका पजत या जजसकी पत्नी जीजित है, जििाह दकया है या जििाह की संजिदा

की है ; या

(ख) जजसने अपने पजत या अपनी पत्नी के जीजित रहते हुए, दकसी व्यजि से जििाह दकया है या जििाह की

संजिदा की है,

उि पदों पर जनयुजि का पात्र नहीं होगा :

परन्तु यदद केन्रीय सरकार का यह समाधान हो जाता है दक सा जििाह से व्यजि और जििाह के अन्य पिकार

को लागू स्ट्िीय जिजध के अधीन अनुज्ञेय है और सा करने के जलए अन्य आधार हैं तो िह दकसी व्यजि को इस जनयम के

प्रितान से छूट दे सकेगी ।

5. जिजथल करने की िजि.- जहां केन्रीय सरकार की यह राय है दक सा करना आिश्यक या समीचीन है, िहां

िह उसके जलए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेिा आयोग से परामिा करके इन जनयमों के दकसी उपबंध

को दकसी िगा या प्रिगा के व्यजियों की बाबत, आदेि द्वारा जिजथल कर सकेगी ।

6. व्यािृजत्त. - इन जनयमों की कोई बात, से आरिण, आयु-सीमा में छूट और अन्य ट्ररयायतों पर प्रभाि नहीं

डालेगी, जजनका केन्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी दकए गए आदेिों के अनुसार अनुसूजचत जाजतयों,

अनुसूजचत जनजाजतयों, अन् य जपछडे िगों, भूतपूिा सैजनकों और अन्य जििेष प्रिगा के व्यजियों के जलए उपबंध करना

अपेजित है ।

प्रोन् नजत: राजभाषा खंड, जिधायी जिभाग के से उप-

जिधायी परामिी (प्रादेजिक भाषा) जजन् होंने उस श्रेणी

में पांच िषा जनयजमत सेिा की है और जो सुसंगत

जिषय िेत्र या िेत्र में दो सप् ताह की अिजध का

प्रजििण सफलतापूिाक पूरा दकया हो ।

ट्रटप्पण : जहां से कजनष्ठ व्यजियों के संबंध में,

जजन्होंने अपनी अहाक या पात्रता सेिा पूरी कर ली है,

प्रोन्नजत के जलए जिचार दकया जा रहा हो िहां उनसे

ज्येष्ठ व्यजियों के संबंध में भी जिचार दकया जाएगा

परंतु यह तब जब दक उनके द्वारा की गई सी अहाक

या पात्रता सेिा, अपेजित अहाक या पात्रता सेिा के

आधे से अजधक से या दो िषा से, इनमें से जो भी कम

हो, कम न हो और उन्होंने अपने से कजनष्ठ व्यजियों

सजहत जजन्होंने सी अहाक या पात्रता सेिा पहले ही

पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नजत के जलए

अपनी पट्ररिीिा की अिजध सफलतापूिाक पूरी कर ली

हो ।

प्रजतजनयुजि :

केन्रीय या राज्य सरकार या संघ राज्य िेत्रों के अधीन

से अजधकारी :

(क) (i) जो मूल काडर या जिभाग में जनयजमत

आधार पर सदृि पद धारण दकए हुए हैं ; या

(ii) जजन्होंने मूल काडर या जिभाग में िेतन मैट्ररक् स में

स्ट् तर 12 (78800-209200/- रू0) या समतुल् य में

जनयजमत आधार पर उस पद पर जनयुजक् त के पश् चात्

उस श्रेणी में पांच िषा सेिा की हो ; और

(ख) जजनके पास जनम् नजलजखत िैजिक अहाताएं और

अनुभि हो :-

(अ) (i) दकसी मान्यताप्राप्त जिश्वजिद्यालय या संस्ट् था

से जिजध में मास्ट् टर जडग्री ; और

(ii) जजनके पास जनम् नजलजखत हो :-

राज् य न् याजयक सेिा का दस िषा की अिजध के जलए

सदस्ट् य रहा हो; या

केन् रीय या राज् य या संघ राज् यिेत्र के से सरकारी

कमाचारी या कायापालक अथिा पज‍ लक सेक् टर उपक्म

या कानूनी जनकाय या स्ट् िायत जनकाय के से

अजधकारी जजन् हें जिजधक काया का दस िषा का अनुभि

हो; या

सा अर्हहत जिजध व् यिसायी जो दस िषा तक उसी

रूप में व् यिसाय दकया हो; या

दकसी मान् यताप्राप् त संस्ट् था में दस िषा तक जिजध का

अध् यापक रहा हो ; या

केन् रीय सरकार या राज् य सरकार या संघ राज् यिेत्र में

कानूनों, कानूनी जनयमों और आदेिों का संबद्ध भाषा

(संजिधान की आठिीं अनुसूची में उजल् लजखत जहन् दी से

जभन् न कोई एक भाषा) में अनुिाद का दस िषा का

अनुभि हो ; या

केन् रीय सरकार या राज् य सरकार या संघ राज् यिेत्र में

कानूनों के प्रारूपण का दस िषा का अनुभि हो ; और

(iii) दकसी मान् यताप्राप् त बोडा या जिश् िजिद्यालय या

संबद्ध भाषा (संजिधान की आठिीं अनुसूची में

उजल् लजखत ंहदी से जभन् न कोई एक भाषा) के माध् यम

के दकसी संस्ट् था से माध् यजमक जिद्यालय परीिा या

कोई उच् चतर परीिा उत् तीणा या दकसी मान् यताप्राप् त

बोडा या जिश् िजिद्यालय या दकसी संस्ट् था या केन् रीय

सरकार द्वारा अनुमोददत जिदेिी जिश् िजिद्यालय से

माध् यजमक जिद्यालय परीिा या कोई उच् चतर परीिा

में संबद्ध प्रस्ट् ताजित भाषा एक जिषय के रूप में रहा

हो ।

अथिा

(आ) (i) दकसी मान्यताप्राप्त जिश्वजिद्यालय या संस्ट् था

से जिजध में बैचलर जडग्री ; और

(ii) जजनके पास जनम् नजलजखत हो –

राज् य न् याजयक सेिा का बारह िषा की अिजध के जलए

सदस्ट् य रहा हो ; या

केन् रीय या राज् य या संघ राज् यिेत्र के से सरकारी

कमाचारी या कायापालक अथिा पज‍ लक सेक् टर उपक्म

या कानूनी जनकाय या स्ट् िायत जनकाय के से

अजधकारी जजन् हें जिजधक काया का बारह िषा का

अनुभि हो ; या

सा अर्हहत जिजध व् यिसायी जो बारह िषा तक उस

रूप में व् यिसाय दकया हो ; या

हो ।

ट्रटप् पण 1 : आिश् यक अहातां में प्रयुक् त अर्हहत जिजध

व् यिसायी पद से सा व् यजक् त अजभप्रेत है जो

अजधिक् ता या अजभिक् ता है और उसने जिजध में

मास्ट् टर जडग्री की दिा में पांच िषा या जिजध में बैचलर

जडग्री की दिा में सात िषा तक उसी रूप में व् यिसाय

दकया हो ।

ट्रटप् पण 2 : जिजधक काया में अनुभि की अिजध से

सरकार या पज‍ लक सेक् टर उपक्म या कानूनी जनकाय

या स्ट् िायत जनकाय के अधीन मूल जिजधक पद धारण

करने की अिजध अजभप्रेत है, जजसके जलए जिजध में

बैचलर जडग्री भती के जलए पूिाापेजित या आिश् यक

अहाता है ।

िाछंनीय:

(i) केन् रीय या राज् य सरकार में संबद्ध भाषा (संजिधान

की आठिीं अनुसूची में उजल् लजखत ंहदी से जभन् न कोई

एक भाषा) में जिधायी प्रारूपण का पांच िषा का

अनुभि ।

(ii) दकसी मान् यताप्राप् त जिश् िजिद्यालय या संस्ट् था से

बैचलर जडग्री जजसमें जडग्री स्ट् तर पर संबद्ध भाषा

(संजिधान की आठिीं अनुसूची में उजल् लजखत ंहदी से

जभन् न कोई एक भाषा) एक जिषय या माध् यम रहा

हो ।

ट्रटप् पण 1 : पोषक प्रिगा के से जिभागीय अजधकारी,

जो प्रोन्नजत की सीधी पंजि में है, प्रजतजनयुजि पर

जनयुजि के जलए जिचार दकए जाने के पात्र नहीं होंगे ।

इसी प्रकार, प्रजतजनयुि व्यजि प्रोन्नजत द्वारा जनयुजि

के जलए जिचार दकए जाने के पात्र नहीं होंगे ।

ट्रटप् पण 2 : प्रजतजनयुजि की अिजध, जजसके अंतगात

केन्रीय सरकार के उसी या दकसी अन्य संगठन या

जिभाग में इस जनयुजि से ठीक पहले धाट्ररत दकसी

अन्य काडर बाह्य पद पर प्रजतजनयुजि की अिजध है

साधारणतया पााँच िषा से अजधक नहीं होगी ।

ट्रटप् पण 3 : प्रजतजनयुजि द्वारा जनयुजि के जलए

अजधकतम आयु-सीमा आिेदन प्राप्त करने की अंजतम

तारीख को छप् पन िषा से अजधक नहीं होगी ।

यदद जिभागीय प्रोन्नजत सजमजत है, तो उसकी संरचना ।

भती करने में दकन पट्ररजस्ट्थजतयों में संघ लोक सेिा आयोग

से परामिा दकया जाएगा ।

समूह ‘क’ जिभागीय प्रोन् नजत सजमजत (प्रोन् नजत के संबंध में जिचार

करने के जलए) जजसमें जनम् नजलजखत होंगे-

ज्येष्ठ व्यजियों के संबंध में भी जिचार दकया जाएगा

परंतु यह तब जब दक उनके द्वारा की गई सी अहाक

या पात्रता सेिा, अपेजित अहाक या पात्रता सेिा के

आधे से अजधक से या दो िषा से, इनमें से जो भी कम

हो, कम न हो और उन्होंने अपने से कजनष्ठ व्यजियों

सजहत जजन्होंने सी अहाक या पात्रता सेिा पहले ही

उस श्रेणी में पांच िषा सेिा की हो ; और

(ख) जजनके पास स्ट् तंभ (7) के अधीन सीधे भती दकए

जाने िाले व् यजक् तयों के जलए जिजहत िैजिक अहाताएं

और अनुभि हो ।

ट्रटप् पण 1 : पोषक प्रिगा के से जिभागीय अजधकारी,

जो प्रोन्नजत की सीधी पंजि में है, प्रजतजनयुजि पर

जनयुजि के जलए जिचार दकए जाने के पात्र नहीं होंगे ।

इसी प्रकार, प्रजतजनयुि व्यजि प्रोन्नजत द्वारा जनयुजि

के जलए जिचार दकए जाने के पात्र नहीं होंगे ।

ट्रटप् पण 2 : प्रजतजनयुजि की अिजध, जजसके अंतगात

केन्रीय सरकार के उसी या दकसी अन्य संगठन या

जिभाग में इस जनयुजि से ठीक पहले धाट्ररत दकसी

अन्य काडर बाह्य पद पर प्रजतजनयुजि की अिजध है

साधारणतया चार िषा से अजधक नहीं होगी ।

ट्रटप् पण 3 : प्रजतजनयुजि द्वारा जनयुजि के जलए

अजधकतम आयु-सीमा आिेदन प्राप्त करने की अंजतम

तारीख को छप् पन िषा से अजधक नहीं होगी ।

G.S.R. 39(E).— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in

supersession of the Ministry of Law and Justice, Legislative Department, Official Languages Wing (Group’A’ and

Group ‘B’ Posts) Recruitment Rules, 2003 in so far as they relates to the post of Additional Legislative Counsel

(Regional Languages) and in supersession of the Ministry of Law and Justice, Legislative Department, Official

Languages Wing, (Group ‘A’ Posts Regional Languages) Recruitment Rules, 2013, except as respects things done or

omitted to be done before such suppression, the President hereby makes the following rules regulating the method of

recruitment to Group ‘A’ posts (Regional Languages) in the Official Languages Wing, Legislative Department,

Ministry of Law and Justice, namely:-

1. Short title and commencement. - (1) These rules may be called the Ministry of Law and Justice, Legislative

Department, Official Languages Wing, (Group ‘A’ posts Regional Languages) Recruitment Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix.– The number of posts, their classification and level in the

pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment to the said posts, age-limit,

qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

Disqualification.- No person -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal

law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt

any person from the operation of this rule.

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it

may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service

Commission, relax any of the provisions of these rules with respect to any class or category of persons.

Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions

required to be provided for candidates belonging to the Scheduled Castes, the Scheduled Tribes, the other backward

classes, the ex-servicemen and other special categories of persons in accordance with the orders issued by the Central

Government from time to time, in this regard.
