सा.का.जन. 42(अ).—िायुयान जनयम, 1937 को और संिोजधत करने के जलए कजतपय जनयमों का जनम् नजलजखत प्रारूप, जिसे

केंद्रीय सरकार िायुयान अजधजनयम, 1934 (1934 का 22) की धारा 5, धारा 10 की उप-धारा (2), धारा 10क और धारा 12ख द्वारा

प्रित् त िजियों का प्रयोग करके बनाना प्रस्ट् ताजित करती है, इससे प्रभाजित होने िाले सभी संभाजित व् यजियों की सूचनार्थ, उक् त

अजधजनयम की धारा 14 द्वारा यर्ोपेजित,एतद्द्वारा प्रकाजित करती है; और एतद्द्वारा सूचना िी िाती है दक उक् त प्रारूप जनयमों पर उस

तारीख से पंद्रह दिन के अिजध के बाि जिचारार्थ जलया िाएगा जिस पर भारत के रािपत्र की प्रजतयां, जिसमें यह अजधसूचना प्रकाजित

की गई है, िनता को उपलब् ध कराई िाती हैं।

ऊपर जिजनर्िथष् ट अिजध की समाजि से पूिथ उक् त प्रारूप जनयमों के संबंध में दकसी भी व् यजि से प्राप् त हो सकने िाली दकसी

भी आपजि या सुझाि पर केंद्रीय सरकार द्वारा जिचार दकया िाएगा।

ये जनयम सरकारी रािपत्र में इनके प्रकािन की तारीख को प्रिृत् त होंगे।

2.

िायुयान जनयम, 1937 में;-

(क)

जनयम 3 में, उपबंध (47ख), (47ग), (47घ) और (47ङ) का जिलोप दकया िाएगा;

(ख)

जनयम 3ख को, जनम् नजलजखत जनयम से प्रजतस्ट् र्ाजपत दकया िाएगा, नामत:—

“3ख. अपीलें — (1) अजधजनयम या इन जनयमों द्वारा प्रित् त िजियों का प्रयोग करते हुए दकसी अजधकारी द्वारा पाररत

आिेि द्वारा असंतुष् ट कोई भी व् यजि, इस मामले में अजधकारिेत्र िाले अपीलीय अजधकारी को और उस आिेि को पाररत करने िाले

अजधकारी से अगले उच् च स्ट् तर के अजधकारी को प्रर्म अपील करने को अजधमान िे सकता है।

(2) यदि कोई व् यजि उक् त-जनयम (1) के अधीन अपीलीय अजधकारी द्वारा पाररत व् यजि द्वारा असंतुष् ट है, तो िह उस आिेि

के जिरुद्ध इस मामले में अजधकारिेत्र रखने िाले और प्रर्म अपील को सुनने के बाि आिेि पाररत करने िाले अजधकारी से अगले उच् च

स्ट् तर के अजधकारी को िूसरी अपील करने को अजधमान िे सकता है।

(3) इस जनयम के उप जनयम (1) या (2) के अधीन प्रत् येक अपील उस तारीख से तीस दिन के भीतर िायर की िाएगी जिसमें

अजधकारी या अपीलीय अजधकारी द्वारा दिए गए आिेि की प्रजत असंतुष् ट व् यजि को प्राप् त होती है और उस अपील के सार् एक हिार

रुपए का िुल् क संलग् न होगा।

(4) अपीलीय अजधकारी, अपील के पिकारों को सुनिाई का अिसर िेने के बाि, जिरुद्ध अपील की पुजि, संिोधन या उसे

खाररि करने िाला आिेि पाररत कर सकता है, िैसा िह उजचत समझे।

परंतु यह दक महाजनिेिक द्वारा पाररत आिेि के मामले में, अपील नागर जिमानन संबंधी मामलों से संबंजधत मंत्रालय में

भारत सरकार के सजचि के पास की िाएगी और भारत सरकार के सजचि द्वारा पाररत उस आिेि के जिरुद्ध कोई अपील नहीं की

िाएगी, चाहे िह प्रर्म अपील हो या िूसरी।

परंतु यह भी दक अजधजनयम की धारा 10क और इन जनयमों के जनयम 162 के प्रािधानों के अंतगथत अपीलीय अजधकारी द्वारा

पाररत अर्थिंड लगाने के आिेि के जिरुद्ध कोई िूसरी अपील नहीं की िाएगी।

परंतु यह भी दक अजधजनयम की धारा 5क के अधीन िारी आिेि इस जनयम के अधीन अपील-योग् य नहीं होगा।

(2) अपील के जलए िुल् क का भुगतान महाजनिेिक द्वारा यर्ा जिजनर्िथष् ट तरीके से दकया िाएगा।”;

(ग)

जनयम 15क का जिलोप दकया िाएगा;

(घ)

जनयम 20 को जनम् नजलजखत जनयम से प्रजतस्ट् र्ाजपत दकया िाएगा, नामत:—

“20. कजतपय जनयम िो ग् लाइडरों और पतंगों पर प्रयोज् य नहीं हैं — जनयम 7 ग् लाइडरों पर लागू नहीं होगा, और जनयम 26

के अपिाि सजहत, जनयम 5, 6, 7, 12, 15, 17, 19 और भाग III में अन् य जनयम पतंगों पर लागू नहीं होंगे।”;

(ङ)

जनयम 161 को जनम् नजलजखत जनयम से प्रजतस्ट् र्ाजपत दकया िाएगा, नामत:—

“161.अपराध, िगीकरण और अपराध िमन। — (1) कोई भी व् यजि जिसने इन जनयमों की अनुसूची VIक में यर्ा जिजनर्िथष् ट

दकसी भी जनयम का उल् लंघन करने या इनका अनुपालन करने में जिफल कोई भी व् यजि िायुयान अजधजनयम, 1934 (1934 का 22)

की धारा 10 की उप-धारा (2) और अनुसूची VIक के प्रािधानों के अनुसार न् यायालय द्वारा िंड के योग् य होगा।

(2) यदि यह स्ट् र्ाजपत हो िाता है दक ऐसा हस्ट् तिेप या जिफलता ऐसे व् यजि के जनयंत्रण के परे के कारकों या पररजस्ट्र्जतयों के

कारण या ऐसे व् यजि की िानकारी या चूक के जबना उत् पन् न हुई हैं या घरटत हुई हैं। ऐसी पररजस्ट्र्जतयों में मौसम की िबाि, िास्ट् तजिक

त्रुरट या कोई भी अपररहायथ कारण या पररजस्ट्र्जत िाजमल हो सकती है।

(3) िंड प्रदिया संजहता, 1973 (1974 का 2) में जनजहत दकसी भी बात के बाििूि, जनयम 8 के उप-जनयम (1) का उल् लंघन,

जनयम 24 के उप-जनयम (1) के अंतगथत उडान के िम में निीले या मनो-सदिय पिार्ों का सेिन, जनयम 41ख के उप-जनयम (1) के

उल् लंघन में गैर-अनुमोिन उडान प्रजििण संगठन द्वारा प्रजििण प्रिान दकया िाना, जनयम 157 का उल् लंघन, जनयम 158 का उल् लंघन

और जनयम 159 का उल् लंघन संज्ञेय होगा।

(4) िायुयान अजधजनयम, 1934 (1934 का 22) की धारा 10, 11, 11क, 11ख और 12 और इन जनयमों की अनुसूची VIक

में यर्ा जिजनर्िथष् ट जनयमों के अधीन िंडनीय अपराधों का िमन, प्रत् येक अनुसूची में यर्ा जिजनर्िथष् ट तरीके और प्रदिया से, दकसी भी

अजभयोिन संस्ट् र्ा से पूिथ या बाि में, महाजनिेिक द्वारा अर्िा अजधजनयम की धारा 4क की उप-धारा (4) के अधीन जििेष रूप से

िजिप्राप् त दकसी भी अजधकारी द्वारा दकया िा सकता है।

162. अर्थिंड — (1) कोई भी व् यजि, जिसने इन जनयमों की अनुसूची VIख में यर्ा जिजनर्िथष् ट दकसी भी जनयम का उल् लंघन

दकया है या इनका अनुपालन दकया है, िह नाजमत अजधकाररयों द्वारा, उस सूची में यर्ा जनधाथररत सीमा तक और िायुयान अजधजनयम,

1934 (1934 का 22) की धारा 10क के प्रािधानों के अनुसार, अर्थिंड लगाए िाने का पात्र होगा।

(2) अर्थिंड का न् यायजनणथयन,ऐसी अनुसूची में यर्ा जिजनर्िथष् ट तरीके और प्रदिया से,नाजमत अजधकाररयों या अपीलीय

अजधकारी, िैसा भी मामला हो, द्वारा दकया िाएगा।”;

नोट —

1. "व्यजि" का तात्पयथ एक व्यजि से है।

2. “संगठन” का तात्पयथ सामाजिक जनकाय या व्यजियों का संघ है, चाहे िह पंिीकृत हो या नहीं।

3. “कमथचारी" का तात्पयथ कोई भी व्यजि जिसे संगठन द्वारा समझौते के तहत, अस्ट्र्ायी या स्ट्र्ायी रूप से जनयुि, कायथरत या काम में

लगाया गया हो।

अपराधों के िमन की प्रदिया -

(क) आिेिक द्वारा अपराध के िमन के जलए महाजनिेिक द्वारा यर्ा जनधाथररत रूप से एक हिार के िुल् क सजहत फरमथ-क में महाजनिेिक

या केन् द्रीय सरकार द्वारा जिजिष् ट रूप से िजिप्रिान दकसी अन् य अजधकारी को आिेिन करेगा या दकसी

(ख)

िमन के जलए आिेिन प्राप् त होने पर, ऐसा अजधकारी आिेिक द्वारा प्रस्ट् तुत अजभलेखों और आिेिन की जिषयिस्ट् तु के आधार

पर आिेिन की िांच करेगा।

(ग) ऐसा अजधकारी आिेिक से िमन की प्रदिया के जलए संगत समझे गए दकसी सूचना, ररकाडथ या दकसी अन् य िस्ट् तािेि की मांग कर

सकता है। यदि उल्लंघनकताथ जनर्िथि अिजध के भीतर अजतररि िानकारी या अजभलेखों को प्रस्ट्तुत करने में जिफल रहता है, तो िमन

हेतु आिेिन को अस्ट्िीकृजत दकया िा सकता है।

(घ) ऐसा अजधकारी मामले के सभी संबंजधतों को इस प्रदिया में भाग लेने के जलए नोरटस िारी कर सकते हैं।

(ड.)िमन की प्रदिया के िौरान, ऐसा अजधकारी आिेिक को सुने िाने हेतु पयाथप् त अिसर प्रिान करने के प्‍ चात पैरा-1, 2 और 3 के

अनुसार अपराध के िमन की राजि का जनधाथरण। यदि आिेिक को इस राजि के संबंध में ऐसे अजधकारी का जनणथयस्ट्िीकायथ नहीं है, तो

आिेिक तीन दिनों के भीतर या ऐसे अजधकारी द्वारा जनधाथररत उजचत अिजध के भीतर ऐसे अजधकारी को जलजखत रूप में प्रस्ट्तुत करेगा।

(च) आिेिक द्वारा अपना मत प्रस्ट्तुत करने या युजिसंगत समय के भीतर प्रस्ट् तुत न करने के प्‍ चात, िमन की प्रदिया समाि हो िाएगी

और इस मामले पर िायुयान अजधजनयम, 1934 और इनके जनयमों के प्रािधानों के अनुसार आगे की कारथिाई की िाएगी। अजधकारी

इन प्रदियाओं के संबंध में एक ररपोटथ तैयार करेगा।

छ) िमन की गई राजि का भुगतान िमन के जनणथय के 30 दिनों के भीतर महाजनिेिक द्वारा यर्ा जिजनर्िथष् ट रूप में दकया िाएगा।

(ि) यदि कोई व्यजि आिेि के 30 दिनों के भीतर िमन की राजि का भुगतान करने में जिफल रहता है, तो यह माना िाएगा दक उसने

िायुयान अजधजनयम, 1934 और इन जनयमों के प्रािधानों के तहत िमन के जलए कोई आिेिन नहीं दकया है।

(i) अपराधों की िमन की प्रदिया को तीव्रता के सार् पूरा दकया िाएगा और ऐसा आिेिन की तारीख से 60 दिनों के भीतर दकया

िाएगा। आपिादिक पररजस्ट्र्जतयों में महाजनिेिक द्वारा 60 दिनों की इस अिजध को 90 दिनों तक बढाया िा सकता है।

3. "कमथचारी" का अर्थ है दकसी संगठन द्वारा जनयुि, कायथरत या उससे िुडा हुआ व्यजि चाहे िह अस्ट्र्ायी या स्ट्र्ायी

3. नाजमत अजधकाररयों द्वारा िण्ड के अजधजनणथय हेतु प्रदिया.—

(क) अपनी इस संतुजि पर दक व्यजि ने उपरोि ताजलका के अनुच्छेि 2 में जिजनर्िथि दकसी जनयम का उल्लंघन दकया है, नाजमत

अजधकारी, ऐसे व्यजि पर, उसे सुने िाने का उजचत अिसर प्रिान करने के उपरांत, मांग नोरटस के सार्, दकए गए उल्लंघन की प्रकृजत

का ब्यौरा िेते हुए, जनयमों के उन प्रािधानों का जििरण िेते हुए जिनका उल्लंघन दकया गया है तर्ा इस प्रकार के िण्ड को अजधरोजपत

करने का कारण बताते हुए, जलजखत में आिेि द्वारा, ताजलका के अनुच्छेि 1 तर्ा 2 के अनुसार िण्ड अजधरोजपत कर सकता है।

(ख) नाजमत अजधकारी, दकसी व्यजि पर िण्ड अजधरोपण की कायथिाही के जलए तब आगे नहीं बढेगा, यदि, उसके संज्ञान में यह आता है

दक जनलंबन अर्िा लाइसेंस, प्रमाण पत्र अर्िा अनुमोिन िैसा भी मामला हो, के रद्दीकरण को, कारथिाई के एक ही कारण पर उसी

जनयम के उल्लंघन के जलए, िायुयान अजधजनयम, 1934 के खंड 10ख के िम में संजस्ट्र्त दकया गया है।

(ग) मांग नोरटस के सार् नाजमत अजधकारी द्वारा पाररत िण्डािेि की एक प्रजत, ऐसे व्यजि को, प्रिान दकए िाने के दकसी स्ट्िीकृत

मोड द्वारा प्रिान की िाएगी।

(घ) खंड (क) के अधीन िारी आिेि से व्यजर्त व्यजि, नाजमत अजधकारी के द्वारा िारी दकए गए आिेि को प्राि करने की जतजर् से तीस

दिनों के अंतगथत प्रारूप ख में प्रस्ट्तुत कर सकता है।

(ङ) अपील अजधकारी, अपीलकताथ को सुने िाने का एक अिसर प्रिान करने के पश्चात, नाजमत अजधकारी द्वारा पाररत आिेि की पुजि,

संिोजधत अर्िा उसे अपास्ट्त करते हुए एक आख्यापक आिेि िारी करेगा।

(च) अपील अजधकारी द्वारा पाररत आिेि की प्रजत अपीलार्ी तर्ा संबंजधत नाजमत अजधकारी को प्रिान की िाएंगी।

(छ) अपील अजधकारी द्वारा पाररत दकए गए ऐसे आिेि की प्राजि की जतजर् से तीस दिनों के भीतर, नाजमत अजधकारी, उस व्यजि को

जिसके जखलाफ आिेि में िुमाथने की राजि के जलए आिेि पाररत दकया गया है, संिोजधत मांग नोरटस िारी करके आिेि को प्रभाि

प्रिान करेगा।

(ि) इस प्रकार अजधरोजपत िुमाथने का भुगतान, ऐसे व्यजि द्वारा, उसे प्रिान दकए गए मांग नोरटस के तीस दिनों के भीतर,

महाजनिेिक द्वारा जिजनर्िथि प्रदिया के अनुसार दकया िाएगा।

(झ) यदि, जिस व्यजि पर िुमाथना लगाया गया है िह मांग नोरटस में जनधाथररत समय में उसका भुगतान करने में जिफल रहता है, तो,

NOTIFICATION

New Delhi, the 25th January, 2021

G.S.R. 42(E).—The following draft of certain rules further to amend the Aircraft Rules, 1937,

which the Central Government proposes to make in exercise of the powers conferred by section 5, sub-

section (2) of section 10, section 10A and section 12B of the Aircraft Act, 1934 (22 of 1934), is hereby

published as required by section 14 of the said Act, for information of all persons likely to be affected

thereby; and notice is hereby given that the said draft rules will be taken into consideration after a period of

fifteen days from the date on which copies of the Gazette of India, in which this notification is published,

are made available to the public;

Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation,

Opposite Safdarjung Airport, New Delhi-110003 or mailed to [email protected].

Any objection or suggestion which may be received from any person with respect to the said draft

rules before the expiry of the period specified above will be considered by the Central Government.

Draft Rules

1. (1) These rules may be called the Aircraft (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Aircraft Rules, 1937,—

(A) in rule 3, the clauses (47B), (47C), (47D) and (47E) shall be omitted;

(B) for rule 3B, the following rule shall be substituted, namely:—

“3B. Appeals. — (1) Any person aggrieved by an order passed by an officer in exercise of a power

conferred on him by the Act or these rules, he may prefer first appeal, to an appellate officer

having jurisdiction in matter and is next higher in rank to the officer who has passed such order.

(2) If any person is aggrieved by an order passed by an appellate officer under sub- rule (1), he may

prefer a second appeal against such order, to an appellate officer, having jurisdiction in matter and

is next higher in the rank to the officer who passed the order after hearing first appeal.

(3) Every appeal under sub rule (1) or (2) of this rule shall be filed within thirty days from the date

on which the copy of the order made by the officer or the appellate officer, is received by the

aggrieved person and shall be accompanied by the fee of rupees one thousand.

(4) The appellate officer may after giving the parties to the appeal, an opportunity of being heard,

pass such order as he thinks fit, confirming, modifying or setting aside the order appealed against.

Provided that in case of an order passed by the Director General, the appeal will lie to the Secretary

to the Government of India in the Ministry dealing with Civil Aviation matters and no appeal shall

lie against such order passed by the Secretary to the Government of India, irrespective of whether it

is first or second appeal.

Provided further that no second appeal shall lie against the order imposing penalty, passed by the

appellate officer, under the provisions of section 10A of the Act and rule 162 of these rules.

Provided also that the order issued under section 5A of the Act shall not be appealable under this

rule.

(2) The fee for appeal shall be paid in the manner as specified by the Director-General.”;

(C) rule 15A shall be omitted;

(D) for rule 20, the following rule shall be substituted, namely:—

“20. Certain rules not applicable to Gliders and Kites. — The rule 7 shall not apply to

gliders, and rules 5, 6, 7, 12, 15, 17, 19 and the rules in Part III, with the exception of rule 26, shall

not apply to kites.”;

(E) for rule 161, the following rules shall be substituted, namely:—

“161. Offences, Classification and Compounding. — (1) Any person who has

contravened or failed to comply with any rule as specified in Schedule VIA of these rules, shall be

punishable by the Court in accordance with the provisions of sub-section (2) of section 10 of the

Aircraft Act, 1934 (22 of 1934) and Schedule VIA.

(2) It shall be a defence to any proceedings for contravention of or failure to comply with these

rules if it is established that such contravention or failure is caused or has happened due to factors

or circumstances beyond the control of such person or without the knowledge or fault of such

person. Such circumstances may include, stress of weather, bonafide error or any other unavoidable

cause or circumstances.

(3) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974),

contravention of sub-rule (1) of rule 8, consumption of intoxicating and psychoactive substances in

the course of flight under sub-rule (1) of rule 24, imparting of training by unapproved Flying

Training Organisation in contravention of sub-rule (1) of rule 41B, contravention of rule 157,

contravention of rule 158, and contravention of rule 159 shall be cognizable.

(4) Offences punishable under sections 10, 11, 11A, 11B and 12 of the Aircraft Act, 1934 (22 of

1934) and rules as specified in schedule VIA of these rules, may be compounded by the Director

General or any officer specially empowered under sub-section (4) of section 4A of the Act, either

before or after the institution of any prosecution, in the manner and procedure as specified in the

such Schedule.

162. Penalties. — (1) Any person who has contravened or failed to comply with any rule as

specified in Schedule VIB of these rules, shall be liable for imposition of penalty by the designated

officers, to the extent as laid down in the such Schedule and in accordance with the provisions of

section 10A of the Aircraft Act, 1934 (22 of 1934).

(2) The penalty shall be adjudicated by the designated officers or the appellate officer, as the case

may be, in the manner and procedure as specified in the such Schedule.”;

(F) for Schedule VI, the following Schedules shall be substituted, namely:—

4. Procedure for compounding of offences. —

(a) An application for compounding of an offence shall be made by the applicant to the Director General or

any officer specially empowered by the Central Government in Form A along with the fee of rupee one

thousand in the manner as specified by the Director General.

(b) On receipt of the application for compounding, such officer shall examine the application based on the

documents submitted and submissions made in the application.

(c) Such officer may call for any information, record or any other document from the applicant, if the same

is considered relevant to the compounding proceedings. In case the contravener fails to submit the

additional information or documents called for within the specified period, the application for compounding

will be liable for rejection.

(d) Such officer may issue notice to all the concerned of the case to participate in the proceedings.

(e) During the compounding proceedings, such officer after giving due opportunity to the applicant of being

heard, shall determine the amount for compounding of offence in accordance with the tables of paragraphs

1, 2 and 3. If the decision of such officer in respect the amount so determined is not acceptable to the

applicant then the applicant shall submit the same in writing to such officer within three days or within such

reasonable period as determined by such officer.

(f) After such submission by the applicant or non-submission with in such reasonable time, the

compounding proceedings shall cease and the matter shall be proceeded further in accordance with the

provisions of the Aircraft Act, 1934 and these rules. The Officer shall prepare a report in respect of these

proceedings.

g) The amount for which the contravention is compounded shall be paid in the manner as specified by the

Director-General within the 30 days of the date of decision of compounding.

(h) In case a person fails to pay the amount for compounding within 30 days of the order, he shall be

deemed to have never made an application for compounding of any offence under the provisions of the

Aircraft Act, 1934 and these rules.

(i) The process of compounding of offences shall be completed expeditiously and not later than 60 days

from the date of application. This period of 60 days may be extended up to 90 days by the Director-General

in exceptional circumstances.

3. Procedure for adjudication of penalty by designated officers. —

a. The designated officer upon his satisfaction that a person has contravened any of the rule as

specified in the table of paragraph 2 above, he may, after giving a reasonable opportunity of being

heard to such person, by an order in writing, impose penalty in accordance with tables of paragraph
