का. आ. 2669 (अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइंस (भूजम मे उपयोग के अजधकार का
अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 की उपधारा
(1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्रकृजतक गैस मंत्रालय की अजधसूचना संख्या का॰ आ॰
3953(अ) तारीख 25 अक्तूबर, 2019, भारत के रािपत्र सं० 3561 तारीख 31 अक्तूबर, 2019, में प्रकाजित की गई थी |
इस अजधसूचना से संलग्न अनुसूची में जिनीर्िजष्ट भूजम में जबहार राज्य में “पारािीप-हल्िीया- िुगाजपुर पाइपलाइन का संिधजन
तथा
पटना
और
मुिफ्फरपुर
तक
इसका
जिस्ट्तार”
पाररयोिना
हेतु
जिला
लखीसराय
के
अंचल-
सूयजगढ़ा,जपपररया,लखीसराय तथा बड़जहया में पैरोजलयम पिाथो के पररिहन हेतु इंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा
पाइपलाइन जबछाने के प्रयोिन के जलए उपयोग के अजधकार के अिजन के अपने आिय की घोषणा की थी|
और उक्त रािपत्र अजधसूचना की सूचना संबजन्द्धत भू-स्ट्िाजमयों को तारीख 28,दिसम्बर, 2020 तक उपलब्ध करा
िी गई थी,
और सक्षम प्राजधकार , बरौनी, जबहार (श्री भुिनेश्वर जमश्रा ) ने उक्त अजधजनयम की धारा 6 की उपधारा (1) के
अधीन केन्द्रीय सरकार को ररपोटज िे िी है,
और केन्द्रीय सरकार ने, उक्त ररपोटज पर जिचार करने के पश्चात और यह समाधान हो िाने पर दक उक्त भूजम
पाइपलाइन जबछाने के जलए अपेजक्षत है, उसमे उपयोग के अजधकार के अिजन करने का जिजनश्चय दकया है;
अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित िजक्तयों का प्रयोग करते हुए
यह घोषणा करती है की इस अजधसूचना से संलग्न अनुसूची में जिनीर्िजष्ट भूजम में पाइपलाइन जबछाने के जलए उपयोग के

अजधकार का अिजन दकया िाए ,
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित िजक्तयों का प्रयोग करते हुए, यह
जनिेि िेती है दक उक्त भूजम में उपयोग के अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के
बिाए, सभी जिल्लंगमो से मुक्त होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड में जनजहत होगी,
पेरोजलयम और खजनि पाइपलाइंन अजधजनयम,1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तज के जलए इंजडयन
ऑयल कॉपोरेिन जलजमटेड पूणजतया उत्तरिाई होगा और पाइपलाइन से संबजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के
जिरुद्ध कोई िािा या कानूनी कायजिाही नहीं हो सकेगी |

NOTIFICATION
New Delhi, the 18th June, 2021
S. O. 2669 (E).—Whereas by the notification of the Government of the India in the Ministry of Petroleum
and Natural Gas S. O. No. 3953(E) Dated 25 October, 2019 published in the Gazette of the India Gazette No-3561
dated 31st October, 2019 issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines
(Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central
Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that
notification for the purpose of laying pipeline by Indian oil corporation limited in Anchals – Suryagarha, Pipariya,
Lakhisarai and Barahiya of Lakhisarai district under “Augmentation of Paradip–Haldia-Durgapur LPG Pipeline
and its Extension up to Patna & Muzaffarpur” for the transportation of LPG products.
And whereas copies of the said Gazette notification were made available to the public up to 28 December
2020
And whereas the Competent Authority, Barauni, Bihar (Shri Bhubneshwar Mishra) has under sub-section (1)
of section 6 of the said Act submitted report to the Central Government;
And whereas the central Government, after considering the said report and on being satisfied that the said
land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the
Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central
Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the

Central Government, vest from the date of publication of the declaration, in Indian Oil Corporation Limited, free from
all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the
P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter
relating to the pipeline.

का. आ. 2670 (अ).— केन्द्रीय सरकार को ऐसा प्रतीत होता है दक लोक जहत में यह आिश्यक है दक ‘पारािीप-हजल्िया-
िुगाजपुर एलपीिी पाइपलाइन का संबधजन तथा पटना और मुिफ्फरपुर तक इसका जिस्ट्तार’ पररयोिना के अन्द्तगजत पेरोजलयम पिाथो
के पररिहन हेतु जबहार राज्य के बेगूसराय जिले के अंचल- बरौनी तथा मटीहानी में इंजडयन ऑयल कॉपोरेिन जलजमटेड द्वारा
पाइपलाइन जबछाई िानी चाजहए;
और केन्द्रीय सरकार को ऐसी पाइपलाइन जबछाने के प्रयोिन के जलए यह आिश्यक प्रतीत होता है दक उस भूजम में जिसके
भीतर उक्त पाइपलाइन जबछाई िाने का प्रस्ट्ताि है और िो इस अजधसूचना से संलग्न अनुसूची मे िर्णजत है, उपयोग के अजधकार का
अिजन दकया िाए ;
अतः अब, केन्द्रीय सरकार, पेरोजलयम और खजनि पाइपलाइंस (भूजम मे उपयोग के अजधकार का अिजन) अजधजनयम, 1962
(1962 का 50) की धारा 3 दक उप धारा (1) द्वारा प्रित िजक्तयों का प्रयोग करते हुए, उस भूजम मे उपयोग के अजधकार का अिजन करने
के अपने आिय की घोषणा करती है ;
कोई व्यजक्त, िो उक्त अनुसूची में िर्णजत भूजम में जहतबद्ध है, उस तारीख से जिसको, भारत के रािपत्र में यथा प्रकाजित इस
अजधसूचना की प्रजतयााँ साधारण िनता को उपलब्ध करा िी िाती है, इक्कीस दिन के अन्द्िर, भूजम के भीतर पाइपलाइन जबछाये िाने हेतु
उपयोग के अजधकार के अिजन के जलए, श्री भुिनेश्वर जमश्रा, से॰ जन॰ अपर सजचि जबहार सरकार ि सक्षम प्राजधकार, इंजडयन ऑयल
कॉपोरेिन जलजमटेड (पाइपलाइंस जडजििन), पारािीप-हजल्िया-िुगाजपुर एलपीिी पाइपलाइन का संबधजन तथा पटना और मुिफ्फरपुर
तक इसका जिस्ट्तार पररयोिना, बरौनी जनमाजण कायाजलय, बी॰ के॰ पी॰ एल॰ मुख्यालय पररसर, पो॰ बरौनी आयल ररफ़ाइनरी, जिला

NOTIFICATION

S. O. 2670 (E).—Whereas, it appears to the Central Government that it is necessary in the public interest that
a pipeline should be laid by the Indian Oil Corporation Limited in Anchal-Barauni and Matihani, District.-Begusarai
in the State of Bihar for Proposed “Augmentation of Paradip-Haldia-Durgapur LPG pipeline and its extension upto
Patna and Muzaffarpur’’ for the transportation of Petroleum Product;
And whereas, it appears to the Central Government that for the purpose of laying such pipeline, it is
necessary to acquire the right of user in land under which the said pipeline is proposed to be laid and which is
described in the Schedule annexed hereto;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Petroleum and
Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), the Central Government hereby
declares its intention to acquire the right of user therein;
Any person interested in the land described in the said schedule may, within twenty-one days from the date
on which copies of the Gazette of India containing this notification are made available to the general public, object in
writing to the acquisition of the right of user therein for laying of the pipeline under the land to Shri Bhubneshwar
Mishra, Additional Secretary (Retd.), Govt. of Bihar & Competent Authority, Indian Oil Corporation Limited,
Pipeline Division, Augmentation of Paradip-Haldia-Durgapur LPG pipeline and its extension upto Patna and
Muzaffarpur Project, BKPL Head Quarter, Post- Barauni Oil Refinery, District – Begusarai, Bihar – 851114.
