का.आ. 2681(अ).—केन्द्रीय सरकार ने पेरोजलयम और खजनि पाइपलाइन (भूजम में उपयोग के अजधकार का अिजन)

अजधजनयम,1962 (1962 का 50) (जिसे इसमे इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 की उप-धारा (1) के

अधीन िारी की गई, भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना का.आ. 3397(अ) तारीख

28.09.2020 जिसका प्रकािन भारत के रािपत्र संख्या 3027, भाग-II, खण्ड 3, उप-खण्ड (ii) तारीख 30.09.2020 मे

दकया गया है । इस अजधसूचना में संलग्न अनुसूची में जिजनर्िजष्ट ओज़ििा राज्य के तहसील : एरसमा, जिला: िगतससंहपुर,

तहसील : जनआजल, क्णण्टपडा, जिला: कटक , तहसील : जपजपजल, जिला: पुरी , तहसील : टांजग, जिला: खोर्द्ाज, तहसील :

रणपुर, जिला: नयागढ़ की भूजम में, ओज़ििा राज्य में पारािीप से तेलंगाना राज्य में हैिराबाि तक पेरोजलयम उत्पािों के

पररिहन के जलये इंजडयन ऑयल कॉपोरेिन जलजमटेड के द्वारा दियाजन्द्ित दकए िा रहे "पारािीप-हैिराबाि पाइपलाइन

पररयोिना” के संबंध में पाइपलाइन जबछाने के प्रयोिन के जलये उपयोग के अजधकार का अिजन करने के जलये अपने आिय

की घोषणा की थी;

और उक्त रािपत्र अजधसूचना की प्रजतयााँ िनता को उपलब्ध करा िी गई थीं। और उक्त अजधजनयम की धारा 6 की

उपधारा (1) के अनुसरण में सक्षम प्राजधकारी नें केन्द्रीय सरकार को अपनी ररपोटज िे िी है;

और केन्द्रीय सरकार ने उक्त ररपोटज पर जिचार करने के पश्चात और यह समाधान हो िाने पर दक उक्त भूजम

पाइपलाइन जबछाने के जलये अपेजक्षत है, उसमें उपयोग के अजधकार का अिजन करने का जिजनश् चय दकया है;

अत:अब, केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िोजक्तयों का प्रयोग करते हुए

एति् द्वारा घोषणा करती है दक इस अजधसूचना से संलग्न अनुसूजच में जिजनर्िजष्ट भूजम में पाइपलाइन जबछाने के उपयोग का

अजधकार अर्िजत दकया िाए; और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िोजक्तयों का

प्रयोग करते हुए, यह जनिेि िेती है दक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय

सरकार में जनजहत होने के बिाए सभी जबल्लंगमों से मुक्त होकर इंजडयन ऑयल कॉपोरेिन जलजमटेड में जनजहत होगा।

NOTIFICATION

New Delhi, the 18th June, 2021

S.O. 2681(E).—Whereas by the notification of the Government of India in the Ministry of Petroleum

and Natural Gas, published in the Gazette of India Nos. 3027 Part-II, Section 3, Sub-section (ii) dated

30.09.2020 vide S.O.Number – 3397(E) dated 28.09.2020 issued under Sub-section (1) of Section 3 of the

Petroleum and Minerals pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of

1962),(hereinafter referred to as the said Act) the Central Government declared its intension to acquire the

right of user in the land situated in Tahasil- Erasama, District-Jagatsinghpur, Tahasils-Niali,

Kantapada, District-Cuttack, Tahasil-Pipili, District-Puri, Tahasil-Tangi, District-Khordha, Tahasil-

Ranapur, Ditrict-Nayagarh in Odisha State, specified in the schedule appended to that notification for the

purpose of laying pipeline for the transportation of petroleum products from Paradip in the State of Odisha

to Hyderabad in the State of Telengana by the Indian Oil Corporation Limited for implementing the

“Paradip-Hyderabad Pipeline Project”.

And whereas the copies of the Gazette were made available to the public. And whereas the Competent

Authority has under Sub-section (1) of section 6 of the said Act, has submitted his report to Central

Government;

And whereas, the Central Government after considering the said report and on being satisfied that the

said land is required for laying the pipeline, has decided to acquire right of the user therein;

Now, therefore, in exercise of the powers conferred by Sub-section (1) of section 6 of the said Act, the

Central Government hereby declares that the right of user in the land specified in the schedule appended to

this notification is hereby acquired for laying the pipeline;

\And further, in exercise of the powers conferred by Sub-section (4) of Section 6 of the said Act, the

Central Government hereby directs that the right of user of the said land for laying the pipeline shall,

instead of vesting in the Central Government, vests on the date of publication of the declaration, in Indian

Oil Corporation Limited, free from all encumbrances.
