7) की धारा 2 की ईपधारा (1) के खंड (क) के ईपखंड (i) के साथ पठित धारा 36 द्वारा प्रदत् त िजत तयक का प्रय ग करते ए,ए, लदाख
संघ राज् यक्षेत्र के जलए जन् नजलजखत जनयम बनाती ह, ऄथायत: --
ऄध्याय 1
प्रारंजभक
1. (1) संजक्षप्त नाम और प्रारंभ - आन जनयमक का संजक्षप् त नाम लदाख संघ राज् यक्षेत्र, पथ जवक्रेता (जीजवका संरक्षण और पथ जवक्रय
जवजनयमन) जनयम, 2021 ह, ।
(2) ये राजपत्र में प्रकािन की तारीख से प्रवृत् त हकगे ।
2. पठरभाषा- (1) आन जनयमक में, जब तक दक संदभय से ऄन् यथा ऄपेजक्षत न ह ,-
(क) “ऄजधजनयम” से पथ जवक्रेता (जीजवका संरक्षण और पथ जवक्रय जवजनयमन) ऄजधजनयम, 2014 (2014 का 7)
ऄजभप्रेत ह,;
(ख) ‘‘ईपजनयम” से ऄजधजनयम की धारा 37 के ऄधीन बनाए गए ईपजनयम ऄजभप्रेत हैं ;

‘‘सजमजत” से ऄजधजनयम की धारा 20 की ईपधारा (1) के ऄधीन गठित जिकायत प्रजतत षण और जववाद समाधान
सजमजत ऄजभप्रेत ह,;
(घ)
‘‘प्ररूप” से आन जनयमक में का क इ प्ररूप ऄजभप्रेत ह,;
(ङ)
‘‘सरकार” से लदाख संघ राज् यक्षेत्र का प्रिासक ऄजभप्रेत ह,;
(च) ‘‘स्ट् थानीय प्राजधकारी’’ से ऄजधजनयम की धारा 2 की ईपधारा (1) के खंड (ग) के ऄधीन पठरभाजषत स्ट् थानीय
प्राजधकारी ऄजभप्रेत ह,;
(छ) “नगरपाजलका अयुत त” से दकसी नगर जनगम का अयुत त या दकसी नगर पठरषद: का मु्य ऄजधकारी ऄजभप्रेत ह,
और आसके ऄंतगयत, यथाजस्ट् थजत, संघ राज् यक्षेत्र जवकास प्राजधकरण का ईपाध् यक्ष, यदद क इ ह , या छावनी ब डय का मु्य
काययपालक ऄजधकारी ऄजभप्रेत ह,;
(ज) “स्ट् कीम” से ऄजधजनयम की धारा 38 के ऄधीन केंद्रीय सरकार द्वारा जवरजचत क इ स्ट् कीम ऄजभप्रेत ह,;
(झ) “धारा” से ऄजधजनयम की क इ धारा ऄजभप्रेत ह, ।
(2) ईन िब् दक और पदक के, ज आसमें प्रयु है हैं और पठरभाजषत नहहै हैं दकन् तु ऄजधजनयम में पठरभाजषत हैं, वही ऄथय हकगे ज ईस
ऄजधजनयम में हैं ।
ऄध्याय 2
पथ जवक्रय का जवजनयमन
3. जवक्रय का प्रमाणपत्र जारी करने के जलए अयु जवजहत करना- क इ पथ जवक्रेता, जजसने चौदह वषय की अयु पूरी कर ली ह, ऄजधजनयम
की धारा 4 के ऄधीन ईपबंजधत रीजत में जवक्रय का प्रमाणपत्र जारी दकया जाएगा ।
ऄध्याय 3
जववाद समाधान तंत्र
4. जिकायत प्रजतत षण और जववाद समाधान सजमजत का गिन- (1) ऄजधजनयम की धारा 20 की ईपधारा (1) के ऄधीन सरकार द्वारा
प्रत् येक स्ट् थानीय प्राजधकरण के जलए एक जिकायत प्रजतत षण और जववाद समाधान सजमजत का गिन दकया जाएगा, ज एक ऄध् यक्ष, ज
जसजवल न् यायाधीि या न् याजयक मजजस्ट् रेट रहा रहा ह तथा सदस्ट् यक के रूप में द ऄन् य वृजतिककक से जमलकर बनेगी ।
(2) सजमजत के ऄध् यक्ष और सदस्ट् यक की जनयुजत त सरकार द्वारा पांच वषय की ऄवजध के जलए की जाएगी :
परंतु क इ ऄध् यक्ष ईस रूप में 67 वषय की अयु प्राप् त करने के पश् चात: पद धारण नहहै करेगा ।
5. सदस्ट् य के रूप में जनयुजत त के जलए ऄहयताएं और ऄनुभव- क इ व् यजत त सजमजत के वृजतिकक सदस्ट् य के रूप में जनयुजत त के जलए पात्र ह गा,
यदद वह,--
(i) पैंतीस वषय से ऄजधक अयु का ह, दकन् तु पैंसि वषय से ऄजधक अयु का नहहै ह,;
(ii) दकसी मान् यताप्राप् त जवश् वजव्ालय से दकसी जवषय में स्ट् नातक जडरी ी रखता ह,; और
(iii) य ग् यता, सत् यजन् िा और प्रजतठा ा का व् यजत त ह, तथा ईसके पास कम से कम दस वषक का सामाजजक कायय का या पथ
जवक्रेताओं से संबंजधत समस्ट् याओं से जनपट रहाने का या सावयजजनक मामलक या नगरपाजलका या ल क प्रिासन की पयायप्त जानकारी
या ऄनुभव ह, ;
6. ऄध् यक्ष और सदस्ट् यक का वेतन और ऄन् य भतिके तथा सेवा की जनबंधन और िततें- (1) सजमजत का ऄध् यक्ष और सदस्ट् य ससे वेतन, भत् ते और
ऄन् य पठरलजब् धयां प्राप् त करेंगे, ज समय-समय पर सरकार द्वारा ऄजधसूजचत दकया जाए ।
(2) सरकार, ऄध् यक्ष और सदस्ट् य क पद से हट रहाा सकेगी, यदद वह,--
(क) ददवाजलया न्यायजनणीत दकया गया ह, ; या
(ख) ससे दकसी ऄपराध के जलए द षजसद्ध दकया गया ह, जजसमें केंद्रीय सरकार की राय में न,जतक ऄधमता ऄंतवयजलत ह,;
या

(ग) िारीठरक रूप से या मानजसक रूप से ऄध् यक्ष या सदस्ट्य के रूप में कायय करने में ऄसमथय ह गया ह,; या
(घ) ईसने ससा ऄन् य जवत् तीय जहत ऄजितजत कर जलया ह, जजससे, यथाजस्ट् थजत, ऄध् यक्ष या सदस्ट् य के रूप में ईसके कृत् यक पर
प्रजतकूल प्रभाव पड़ने की संभावना ह,; या
(ङ) ईसने ऄपनी ह,जसयत का आस प्रकार दुरूपय ग दकया ह, जजससे ईसका पद पर बने रहना ल क जहत के प्रजतकूल ह गया
ह,:
परंतु ऄध् यक्ष या सदस्ट् य क सरकार द्वारा आस जनजमत् त जवजन्द् ट रहा प्रदक्रया के ऄनुसरण में की गइ जांच के ईसके जसवाय पद
से ईपजनयम (2) के खंड (घ) और खंड (ड) में जवजन्द् ट रहा अधारक पर नहहै हट रहााया जाएगा ।
(3) सजमजत के ऄध् यक्ष और सदस्ट् यक की सेवा के जनबंधनक और ितक में ईनकी पदावजध के दौरान ईनके ऄलाभप्रद रूप में
पठरवजिततत नहहै दकया जाएगा ।
7. सजमजत क अवेदन करने का प्ररूप और रीजत- (1) ऄजधजनयम की धारा 20 की ईपधारा (2) के ऄधीन जिकायत प्रजतत षण या
दकसी जववाद समाधान के जलए प्रत् येक अवेदन प्ररूप -1 में दकया जाएगा ।
(2) अवेदन पर अवेदक द्वारा हस्ट् ताक्षर दकया जाएगा और ईसे ईसके द्वारा स्ट्वयं या ईसके प्राजधकृत प्रजतजनजध द्वारा सजमजत क
या ससे व् यजत त क प्रस्ट् तुत दकया जाएगा जजसे सजमजत द्वारा आस जनजमत् त प्राजधकृत दकया जाए ।
(3) अवेदन तीन सेट रहाक में फाआल दकया जाएगा और ईसके साथ एक सौ रुपए की फीस संलग् न ह गी ।
(4) अवेदन के साथ अदेि या सूचना, यदद क इ ह , जजसके जवरुद्ध अवेदन दकया गया ह, और सुसंगत दस्ट् तावेज संलग् न हकगे ।
(5) पथ जवक्रेता द्वारा ससा अवेदन जिकायत या जववाद काठरत करने वाली दकसी घट रहाना के ह ने की तारीख से तीस ददन के
भीतर दकया जाएगा :
परंतु सजमजत जवलंब क ससी दिा में माफ कर सकेगी यदद ईसका यह समाधान ह जाता ह, दक अवेदक क जवजहत समय के
भीतर अवेदन करने से पयायप् त कारणक द्वारा जनवाठरत दकया गया था ।
8. अवेदन के सत् यापन की रीजत और जांच- (1) जिकायत क दूर करने के जलए प्रत् येक अवेदन के प्राप् त ह ने पर सजमजत द्वारा आस
जनजमत् त प्राजधकृत व् यजत त द्वारा आस प्रय जन के जलए रखे गए रजजस्ट् ट रहार में दजय की जाएगी और क्रम सं् यांक रूप से सं्यांदकत की
जाएगी ।
(2) आस जनजमत् त प्राजधकृत व् यजत त रजजस्ट् ट रहार में प्रजव् ट रहा करने के पश् चात: अवेदन क सजमजत के समक्ष रखेगा ।
(3) सजमजत, अवेदन की सुनवाइ के जलए एक तारीख जनयत करेगी ज अवेदन फाआल करने की तारीख से पन् द्रह ददन से परे नहहै
ह गी और पक्षकारक क सुनवाइ की न ठट रहास जारी करेगी ।
(4) सजमजत, ईपजनयम (3) के ऄधीन दकसी न ठट रहास क जारी करते समय प्रत् यथी क एक जलजखत कथन प्रस्ट् तुत करने के जलए
कहेगी ।
(5) पक्षकारक की हाजजरी के जलए आस प्रकार जनयत तारीख क सजमजत अवेदक क त्रुठट रहायक, यदद क इ ह , क िीक करने के जलए
कह सकेगी या पक्षकारक क सुसंगत ऄजभलेख प्रस्ट् तुत करने क या ससे ऄन् य दस्ट् तावेज या साष् य, ज वह िीक और समुजचत समझे, ईसके
द्वारा यथाजवजन्द् ट रहा ऄवजध के भीतर प्रस्ट् तुत करने के जलए कह सकेगी ।
(6) सजमजत, पक्षकारक द्वारा दकए गए प्रजतजवर ध के संबंध में ईसके द्वारा प्रस्ट् तुत ऄजभलेखक के जनद ि के साथ एक फील् ड जांच का
भी अदेि कर सकेगी ।
(7) सजमजत द नक पक्षकारक क सुनने और मामले के ऄजभलेख की जांच करने के पश् चात: अवेदन प्रस्ट् तुत करने के साि ददन के
भीतर, अवेदन का जवजनश् चय करेगी और ससा अदेि पाठरत करेगी ज वह िीक और समुजचत समझे :
परंतु मामले की सुनवाइ के दौरान यदद सजमजत का समाधान ह जाता ह, दक क इ ऄंतठरम ऄनुत ष ददया जाना चाजहए त
सजमजत ससे मामले के समाप् त ह ने तक या ऄजतठर है अदेि तक ससा ऄंतठरम अदेि पाठरत कर सकेगी ।
(8) सजमजत पक्षकारक के बीच समझौते की संभावना का भी पता लगाएगी और पक्षकारक के बीच समझौता ह जाने की दिा में
समझौते क ऄजभजलजखत करेगी, जजस पर पक्षकारक या ईनके प्राजधकृत प्रजतजनजधयक या ऄजधकाठरयक द्वारा हस्ट् ताक्षर दकए जाएंगे और
ससे समझौते के जनबंधनक में अवेदन का जनपट रहाारा दकया जाएगा ।
(9) सजमजत दकसी ससे अवेदन क री हण नहहै करेगी जहां,--
(क) अवेदन ऄनाम ह, या ईसमें साधारण और ऄस्ट् पष्ट अर प लगाए गए हैं ;
(ख) मामला दकसी जवजध के न् यायालय, ऄजधकरण या न् याजयक या ऄधय-न् याजयक प्राजधकारी के पास जवचाराधीन ह, ;

(ग) मामला ऄजधजनयम के क्षेत्राजधकार के परे ह, ;
(घ) अवेदक क अवेदन फाआल करने के जलए सुने जाने का ऄजधकार नहहै ह, ।
ऄध् याय 4
ऄपील
9. सजमजत के अदेि या जवजनश् चय के जवरुद्ध ऄपील- (1) सजमजत के दकसी अदेि या जवजनश् चय के जवरुद्ध दकसी व् यजथत व् यजत त द्वारा
प्ररूप-2 में स्ट्थानीय प्राजधकारी क ससे अदेि या जवजनश् चय, जजसके जवरुद्ध ऄपील की गइ ह, की संसूचना के तीस ददन के भीतर ऄपील
कर सकेगा :
परंतु स्ट्थानीय प्राजधकारी ससी दिा में जवलंब क माफ कर सकेगा यदद ईसका यह समाधान ह जाता ह, दक ऄपीलाथी क जवजहत
समय के भीतर ऄपील करने से जनवाठरत करने के पयायप् त कारण थे ।
(2) ऄपील एक ज्ञापन के रूप में ह गी और आस पर ऄपीलाथी द्वारा हस्ट् ताक्षर दकए जाएंगे तथा वह आसे व,यजत तक रूप से या
ऄपने प्राजधकृत प्रजतजनजध के माध् यम से स्ट् थानीय प्राजधकारी क प्रस्ट् तुत करेगा ।
(3) ऄपील ज्ञापन के साथ ईस मूल अदेि या अदेि की प्रमाजणत प्रजत ह गी, यदद क इ ह , जजसके जवरुद्ध ऄपील की गइ ह, ।
(4) ऄपील तीन सेट रहाक में की जाएगी और ईसके साथ 200 रुपए की फीस संलग् न ह गी ।
(5) ससी दकसी ऄपील क तब तक री हण नहहै दकया जाएगा जब तक ईसकी एक प्रजत, यथाजस्ट् थजत, प्रत् यथी या प्रत् यजितथयक क
तामील न कर दी गइ ह और ससी तामील का सबूत फाआल न कर ददया गया ह ।
(6) दकसी ऄपील क वहां री हण नहहै दकया जाएगा जहां अदेि सजमजत द्वारा पक्षकारक के बीच ए,ए समझौते के जनबंधनक में
पाठरत दकया गया ह, ।
10. नगर जवक्रय सजमजत के जवजनश् चय से ऄपील : (1) जवक्रय प्रमाणपत्र क जारी करने या जनरस्ट् त करने या रद करने की बाबत नगर
जवक्रय सजमजत के जवजनश् चय के जवरुद्ध धारा 11 के ऄधीन क इ ऄपील स्ट् थानीय प्राजधकारी के समक्ष ईस अदेि, जजसके जवरुद्ध ऄपील
की गइ ह, की संसूचना के तीस ददन के भीतर प्ररूप-3 में ऄपील कर सकेगा :
पंरतु स्ट्थानीय प्राजधकारी ससी दिा में जवलंब क माफ कर सकेगा, यदद ईसका यह समाधान ह जाता ह, दक ऄपीलाथी क
जवजहत समय के भीतर ऄपील करने से पयायप् त कारणक से जनवाठरत दकया गया था :
परंतु यह और दक ऄध् यक्ष की ऄनुपजस्ट् थजत में ऄध् यक्ष द्वारा नामजन्द् ट रहा दकसी भी सदस्ट् य द्वारा स्ट्थानीय प्राजधकरण की ब,िक की
ऄध् यक्षता की जा सकेगी ।
(2) ऄपील एक ज्ञापन के प्ररूप में ह गी और आस पर ऄपीलाथी द्वारा हस्ट् ताक्षर दकए जाएंगे तथा वह आसे व,यजत तक रूप से या
ऄपने प्राजधकृत प्रजतजनजध के माध् यम से ऄंरी ेजी या जहन् दी या स्ट् थानीय भाषा में प्रस्ट् तुत करेगा ।
(3) ऄपील ज्ञापन के साथ मूल अदेि या अदेि की प्रमाजणत प्रजत ह गी, यदद क इ ह , जजसके जवरुद्ध ऄपील की गइ ह, ।
(4) ऄपील तीन सेट रहाक में की जाएगी और ईसके साथ 200 रुपए की फीस संलग् न ह गी ।
(5) ससी दकसी ऄपील क तब तक री हण नहहै दकया जाएगा जब तक ईसकी एक प्रजत, ससी ऄपील फाआल करने से पूवय नगर
जवक्रय सजमजत क तामील न कर दी गइ ह और ससी तामील का सबूत ऄपील के साथ फाआल न कर ददया गया ह ।
11. स्ट् थानीय प्राजधकरण द्वारा ऄपीलक के जनपट रहाान की प्रदक्रया-- (1) स्ट् थानीय प्राजधकरण द्वारा आस जनजमत् त प्राजधकृत ऄजधकारी या
व् यजत त आस प्रय जन से रखे गए रजजस्ट् ट रहार में ईस तारीख क , जजसक ऄपील प्रस्ट् तुत की गइ ह, ऄपील की प्रजवज् ट रहा करेगा ।
(2) ऄपील प्राजधकारी के समक्ष ऄपील की जाएगी, ज ऄपील की सुनवाइ के जलए अवेदन फाआल की जाने की तारीख से 15
ददन के पश्चात: का न ह , सुनवाइ की तारीख जनयत करेगा और पक्षकारक क सुनवाइ की सूचना की तामील काठरत करेगा ।
(3) ऄपील प्राजधकरण पक्षकारक द्वारा ईसके समक्ष की गइ दलीलक के अधार पर और मामले के ऄजभलेखक और फील् ड जांच के
अधार पर, यदद क इ हक, अदेि दकया गया ह , कारणक क लेखबद्ध करते ए,ए ऄपील दकए गए अदेि की पुज् ट रहा करते ए,ए, ईपांतठरत
करते ए,ए या ईसे जनरस्ट् त करते ए,ए स्ट् थानीय प्राजधकरण द्वारा ऄपील की प्राजप् त के 60 ददन के भीतर ससा अदेि पाठरत करेगा ज,सा वह
िीक समझे :
परंतु मामले की सुनवाइ के दौरान, यदद स्ट्थानीय प्राजधकारी का यह समाधान ह जाता ह, दक ऄंतठरम ऄनुत ष प्रदान दकया
जाना चाजहए त स्ट्थानीय प्राजधकारी ससे मामले की समाजप् त तक या ऄजतठर है अदेि करने तक ससा ऄंतठरम अदेि पाठरत कर
सकेगा ।

ऄध् याय 5
नगर जवक्रय सजमजत
12. नगर जवक्रय सजमजत का गिन- (1) सरकार स्ट् थानीय प्राजधकरण में एक नगर जवक्रय सजमजत का गिन करेगी :
परंतु सरकार, यदद अवश् यक समझे त प्रत्येक ज न या वाडय के जलए एक से ऄजधक नगर जवक्रय सजमजत का गिन का ईपबंध कर
सकेगी ।
(2) यथाजस्ट्थजत, नगर अयु है या मु्य काययपालक ऄजधकारी नगर जवक्रय सजमजत का ऄध्यक्ष ह गा ।
(3) सरकार द्वारा नामजन्दष्ट नगर जवक्रय सजमजत के ऄन्य सदस्ट्यक की सं्या नीचे ददए गए ऄनुसार ह गी :--

(4) ग,र-सरकारी संगिनक का प्रजतजनजधत् व कर रहे सदस्ट् यक या समुदाय अधाठरत संगिनक या जनवासी कल् याण संगमक का
नामजनद िन सरकार द्वारा ऄजधकजथत ससे मानदंड के अधार पर, ज कम से कम द स्ट् थानीय समाचार पत्रक में ईसे प्रकाजित कर या
दकसी ऄन् य रीजत में जवज्ञाजपत करने के पश् चात: अवेदन अमंजत्रत दकए जाएंगे ।
13. पथ जवक्रेताओं में से सदस्ट् यक का जनवायचन करने की रीजत- (1) स्ट् थानीय प्राजधकरण ऄजधसूचना द्वारा ऄपनी के ऄधीन क्षेत्र के पथ
जवक्रेताओं का प्रजतजनजधत् व करने वाले सदस्ट् यक के नामजनद िन के जलए जनवायचन करेगा ।
(2) संबंजधत स्ट् थानीय प्राजधकरण ईपजनयम (1) के ऄधीन जनवायचन का संचालन करने के जलए एक ठरट रहानिनग अदफसर की जनयुजत त
करेगा ।
(3) ईपजनयम (2) के ऄधीन जनयुजत त ठरट रहानिनग अदफसर आन जनयमक से ईपाबद्ध ऄनुसूची में ईपबंजधत रीजत में जनवायचनक का
संचालन करेगा ।
(4) क इ पथ जवक्रेता सदस्ट्य के रूप में जनवायचन के जलए जनरजितहत ह गा यदद वह,--
(i) ससे दकसी ऄपराध के जलए द षजसद्ध दकया गया ह, जजसमें न,जतक ऄधमता ऄंतवयजलत ह,;
(ii) िारीठरक रूप से और या मानजसक रूप से सदस्ट्य के रूप में ऄपने कतयव्यक का जनवहयन करने में ऄसमथय ह गया ह, ।
(3) स्ट् थानीय प्राजधकरण द्वारा पथ जवक्रेताओं में से जनवायजचत सदस्ट् यक के नामक क सरकार क संसूजचत दकया जाएगा, ज ईसके
द्वारा नामजन्द् ट रहा ऄन् य नामक के साथ ससे नामक की प्राजप् त पर प्रत् येक स्ट्थानीय प्राजधकरण में नगर जवक्रय सजमजत के गिन क
ऄजधसूजचत करेगी ।
14. सदस्ट् यक की पदावजध- (1) नगर जवक्रय सजमजत के ऄन्य सदस्ट् यक की पदावजध ईनके नामजनद िन की तारीख से पांच वषय ह गी ।
(2) ऄन्य सदस्ट् यक के नामजनद िन की प्रदक्रया ईनकी पदावजध की समाजप् त से पूवय पूरी कर ली जाएगी ।
15. सदस्ट् यक का हट रहााया जाना-- (1) नगर जवक्रय सजमजत के दकसी सदस्ट् य क सरकार द्वारा हट रहााया जा सकेगा, यदद वह,--
(क) ऄजधजनयम और आन जनयमक के ऄधीन ईस पर ऄजधर जपत कतयव् यक का जनवयहन करने में लगातार व् यजतक्रम करता ह, या
ऄपनी िजत तयक से परे कायय करता ह, या ईनका दुरुपय ग करता ह, ;
(ख) ऄध् यक्ष की ऄनुज्ञा के जबना सजमजत की तीन लगातार ब,िकक में ऄनुपजस्ट् थत रहता ह, ;

(ग) दकसी जवजध के न् यायालय द्वारा दकसी दांजडक मामले में जसद्धद ष ह, :
परंतु ससे सदस्ट् य क ईसक हट रहााए जाने से पूवय सुने जाने का युजत तयुत त ऄवसर प्रदान दकया जाएगा ।
16. ठरत त स्ट् थानक क भरने की रीजत--(1) जहां दकसी नगर जवक्रय सजमजत में दकसी पथ जवक्रेता से जभन् न दकसी सदस्ट् य के त् यागपत्र, मृत् यु,
पद से हट रहााने या ऄन् यथा क इ ठरजत त ईत् पन् न ह ती ह, त ससी ठरजत त क भरने के जलए जनयम 12 में जवजन्द् ट रहा ईसी प्रदक्रया का
ऄनुसरण दकया जाएगा और आस प्रकार नामजन्द् ट रहा सदस्ट् य ईस सदस्ट् य, जजसके स्ट् थान पर ईसे नामजन्द् ट रहा दकया गया ह, की पदावजध
की िेष ऄवजध के जलए सदस्ट् य बना रहेगा ।
(2) यदद नगर जवक्रय सजमजत में दकसी सदस्ट् य, ज पथ जवक्रेता ह, के त् यागपत्र, मृत् यु, पद से हट रहााने या ऄन् यथा क इ ठरजत त ईत् पन् न
ह ती ह, त स्ट् थानीय प्राजधकरण जनयम 13 में यथाजवजन्दष्ट ईस ठरज है क भरेगा और आस प्रकार जनवायजचत सदस्ट् य ईस सदस्ट् य, जजसके
स्ट् थान पर ईसे जनवायजचत दकया गया ह, की पदावजध की िेष ऄवजध के जलए सदस्ट् य बना रहेगा ।
17. ऄध्यक्ष और ऄन्य सदस्ट् यक क संदेय भत् ते- नगर जवक्रय सजमजत के ऄध्यक्ष और ऄन्य सदस्ट्यक क ब,िक में भाग लेने के जलए केवल एक
हजार रुपए संदेय हकगे ।
18. नगर जवक्रय सजमजत की ब,िकें—(1) साधारणतया, नगर जवक्रय सजमजत तीन मास की ऄवजध में या ससे ऄंतरालक पर, ज ऄध् यक्ष
द्वारा जवजनश् चय दकया जाए, ईसके कारबार के संचालन के जलए एक ब,िक अय जजत करेगी :
परंतु नगर जवक्रय सजमजत की ब,िक ऄध् यक्ष द्वारा ईसके गिन के 45 ददन के भीतर बुलाइ जाएगी :
परंतु यह और दक सजमजत के एक जतहाइ से ऄन् यून सदस्ट् यक के ऄनुर ध पर दकसी जवजन्द् ट रहा मुदे पर ऄध् यक्ष द्वारा ऄध् यापेजक्षत
ब,िक बुलाइ जा सकेगी और आस प्रकार दकए गए ऄनुर ध की प्राजप्त के पश् चात: 72 घंट रहाें के भीतर ब,िक बुलाइ जाएगी ।
(2) ससी ब,िकें स्ट् थानीय प्राजधकरण के मु् यालय में या स्ट् थानीय प्राजधकरण की ऄजधकाठरता के भीतर ससे स्ट् थान पर ज,सा ऄध् यक्ष
द्वारा जवजनश् चय दकया जाए, अय जजत की जाएंगी ।
(3) दकसी ऄनुसूजचत ब,िक के 7 ददन पूवय सभी सदस्ट्यक क ब,िक के एंजेडा सजहत सूचना जारी की जाएगी ।
(4) ब,िक की गणपूजितत सजमजत की कुल सं् य के द जतहाइ सदस्ट् यक से ह गी ।
(5) गणपूजितत की ऄनुपजस्ट् थजत में क इ ब,िक अय जजत नहहै की जाएगी और गणपूजितत न ह ने पर ब,िक स्ट् थजगत कर दी जाएगी ।
19. कारबार के संव् यवहार की प्रदक्रया--(1) नगर जवक्रय सजमजत ऄपने कारबार के संव् यवहार के जलए ससी प्रदक्रया का ऄनुसरण करेगी
ज,सा ऄन्य सदस्ट् यक के परामिय से ऄध् यक्ष द्वारा जवजनश् चय दकया जाए ।
(2) ऄजधजनयम और जनयमक के ईपबंधक के ऄधीन रहते ए,ए और ईप जवजधयक में ऄंतजितवष्ट दकसी बात के ह ते ए,ए भी नगर जवक्रय सजमजत
की ब,िक में संकल्प ईपजस्ट्थत और मत देने वाले सदस्ट्यक के द -जतहाइ से ऄन्यून द्वारा पाठरत दकया जाएगा ।
(3) ऄध्यक्ष यह सुजनजश्चत करेगा दक प्रत्येक ब,िक के काययवृतिक क ऄजभजलजखत दकया जाए, जजस पर ईसके द्वारा हस्ट्ताक्षर दकए जाएंगे,
सदस्ट्यक के बीच ब,िक के एक मास के भीतर पठरचाजलत दकया जाएगा और ईसकी वेबसाआट रहा, यदद ईपलब्ध ह , पर प्रकाजित दकया
जाएगा ।
20. नगर जवक्रय सजमजत के कृत्य– नगर जवक्रय सजमजत जनम्नजलजखत कृत्यक का जन्पादन करेगी, ऄथायत: :--
(क) जवक्रय के जलए स्ट्थल और स्ट्थान की पहचान करना;
(ख) सावयजजनक स्ट्थानक पर भीड़-भाड़ न ह ने का सुजनश्चय करने के जलए जवक्रय के समय का जवजनयमन करना;
(ग) पथ जवक्रेताओं द्वारा ऄननुपालन के जवरुद्ध सुधारकारी तंत्र के प्रवतयन क सुजनजश्चत करना;
(घ) सजमजत और स्ट्थानीय प्राजधकरण के समक्ष लंजबत मामलक पर ऄनुवती कारयवाइ;
(ङ) ऄपने कृत्यक का दक्ष जनवयहन सुजनजश्चत करने के जलए ब,िकें अय जजत करना और समुजचत जवजनश्चय करना;
(च) कम से कम एक स्ट्थानीय भाषा, प्रमुख हहदी और ऄंरी ेजी के समाचार-पत्रक में पथ जवक्रेता चाट रहायर क प्रकाजित करना और
ईसका कायायलय और ऄन्य स्ट्थानीय जनकायक के कायायलयक में प्रदियन करना, ईसमें ईस समय क , जजसके भीतर पथ जवक्रेताओं
क जवक्रय प्रमाण-पत्र जारी दकया जाएगा तथा वह समय, जजसके भीतर जवक्रय प्रमाण पत्र का नवीकरण दकया जाएगा तथा
ईसमें जवजन्दष्ट समय-सीमा के भीतर जन्पाददत दकए जाने वाले ऄन्य दक्रयाकलापक क जवजन्दष्ट करना; और

(छ) ऄजधजनयम और जनयमक के दक्ष कायायन्वयन के जलए ससे ऄन्य कृत्यक का पालन करना, ज ईसे स्ट्थानीय प्राजधकरण या
सरकार द्वारा प्रत्याय जजत दकए जाएं ।
21. जविेषज्ञ व्यज हैयक का ऄस्ट्थायी रूप से सहयु है करना—(1) नगर जवक्रय सजमजत दकसी जव्यात समुजचत व्यज है क , जजसके पास ईस
क्षेत्र में पयायप्त जानकारी और ऄनुभव ह , पथ जवक्रेताओं से संबंजधत मामलक पर तकनीकी या व्यवसाजयक परामिय ऄजभप्राप्त करने के
जलए सहयु है कर सकेगी ।
(2) ईपजनयम (1) के ऄधीन जविेषज्ञ के रूप में सहयु है दकए जाने वाले व्यज है का चयन ईजचत और पारदिी रीजत में और
सरकारी जवभागक में परामियदाताओं और जविेषज्ञक क तकनीकी या व्यवसाजयक जविेषज्ञ के रूप में जनय जजत करने के जलए
प्रदक्रया का ऄनुसरण करके दकया जाएगा ।
(3) ईपजनयम (1) के ऄधीन जविेषज्ञ के रूप में सहयु है व्यज है क स्ट्थानीय प्राजधकरण द्वारा यथा ऄवधाठरत भतिके संदतिक दकए
जाएंगे ।
(4) ईपजनयम (1) के ऄधीन जविेषज्ञ के रूप में सहयु है व्यज है नगर जवक्रय सजमजत की ब,िकक में भाग ले सकेगा ककतु ससे
व्यज है क मत देने का ऄजधकार नहहै ह गा ।
22. नगर जवक्रय सजमजत के कमयचारी—स्ट्थानीय प्राजधकरण नगर जवक्रय सजमजत क ईतनी सं्या में कमयचारी ईपलब्ध कराएगा, ज,सा
दक ईसके कृत्यक के जनवयहन के जलए ईजचत समझे ।
ऄध्याय 1
प्रकीणय
23. ऄजभलेखक का रखा जाना--प्रत्येक नगर जवक्रय सजमजत रजजस्ट्रीकृत पथ जवक्रेताओं और पथ जवक्रेताओं के, जजन्हें जवक्रय का प्रमाण-पत्र
आल,तराजनकी प्ररूप में या म,नुऄली या द नक प्ररूपक में, ज,सा दक स्ट्थानीय प्राजधकरण द्वारा जवजनश्चय दकया जाए, ददया गया ह, के
ऄ्तन ऄजभलेख रखेगी ।
24. नगर जवक्रय सजमजत द्वारा जववरजणयक का प्रस्ट्तुत दकया जाना—प्रत्येक नगर जवक्रय सजमजत प्ररूप 4 में ब्यौरक सजहत प्रत्येक वषय के
जलए अवजधक जववरण त,यार करेगी और सरकार या स्ट्थानीय प्राजधकरण क प्रस्ट्तुत करेगी ।
25. स्ट्कीम के प्रकािन की रीजत--(1) स्ट्थानीय प्राजधकरण द्वारा सरकार द्वारा ऄजधसूजचत स्ट्कीम के सारांि का द प्रमुख द,जनक समाचार-
पत्रक में, जजनका ईसकी स्ट्थानीय ऄजधकाठरत के क्षेत्र में व्यापक रूप से पठरचालन ह , में सरकार द्वारा स्ट्कीम क ऄजधसूजचत दकए जाने
की तारीख से सात ददन के भीतर सावयजजनक सूचना द्वारा प्रकािन दकया जाएगा ।
(2) सूचना पर, यथाजस्ट्थजत, नगर पाजलका अयु है या स्ट्थानीय प्राजधकरण के मु्य काययपालक ऄजधकारी या ईसके द्वारा आस जनजमतिक
प्राजधकृत ऄजधकारी द्वारा हस्ट्ताक्षर दकए जाएंगे ।
(3) सूचना ससी भाषा या भाषाओं में ह गी, ज आस जनजमतिक यथाजस्ट्थजत, नगर पाजलका अयु है या स्ट्थानीय प्राजधकरण के मु्य
काययपालक ऄजधकारी द्वारा जवजन्दष्ट की जाएं ।

[पथ जवक्रेताओं का प्रजतजनजधत्व करने के जलए नगर जवक्रय सजमजत के सदस्ट्यक के जनवायचनक का संचालन करने की प्रदक्रया]
1. संबंजधत स्ट्थानीय प्राजधकरण ऄपनी ऄजधकाठरता के क्षेत्र में पथ जवक्रेताओं का प्रजतजनजधत्व करने के जलए नगर जवक्रय सजमजत के
सदस्ट्यक के जनवायचनक का संचालन का पययवेक्षण करेगा, जनदेि देगा और जनयंत्रण करेगा ।
2. जनयम 13 के ईपजनयम (1) के ऄधीन पथ जवक्रेताओं का प्रजतजनजधत्व करने के जलए नगर जवक्रय सजमजत के सदस्ट्यक के जनवायचनक का
संचालन करने के जलए स्ट्थानीय प्राजधकरण द्वारा ऄपने अिय क ऄजभव्य है करने की ऄजधसूचना जारी करने और ईस जनयम के
ईपजनयम (2) के ऄधीन जनवायचनक का संचालन करने के जलए जनयु है ठरट रहानिनग अदफसर की जनयुज है दकए जाने पर स्ट्थानीय प्राजधकरण
जनवायचनक का संचालन करने के जलए संकल्प द्वारा तारीख, समय और स्ट्थान का ऄवधारण करेगा ।
3. संकल्प की सूचना या स्ट्थानीय प्राजधकरण के जवजनश्चय क नगर जवक्रय सजमजत की ऄजधकाठरता के क्षेत्र में पथ जवक्रय की वृजतिक में लगे
ए,ए पथ जवक्रेताओं के बीच जनम्नजलजखत में से दकसी एक ढंग द्वारा पठरचाजलत दकया जाएगा, ऄथायत: :--

(क) हहदी, ऄंरी ेजी या स्ट्थानीय भाषा के दकन्हहै द प्रमुख द,जनक समाचार-पत्रक में ल क सूचना के प्रकािन द्वारा, ज,सा दक
स्ट्थानीय प्राजधकरण ईजचत समझे ;
(ख) स्ट्थानीय पठरदान द्वारा ;
(ग) डाक प्रमाणपत्र के ऄधीन डाक द्वारा ;
(घ) स्ट्पीड प स्ट्ट रहा या स्ट्थानीय प्राजधकरण के पास स्यकत: रजजस्ट्रीकृत कुठरयर सेवाओं के साथ ठरट रहानिनग अदफसर के सूचना
पट रहा पर और ससी सूचना में जनम्नजलजखत के संबंध में सूचना ऄंतजितवष्ट ह गी,--
(i) जनवायजचत दकए जाने वाले सदस्ट्यक की सं्या, जजसके ऄंतगयत ऄनुसूजचत जाजतयक, ऄनुसूजचत जनजाजतयक, ऄन्य जपछड़े
वगक, ऄल्पसं्यंकक, मजहलाओं, जभन्न रूप से य ग्य व्यज हैयक या दकन्हहै जवजन्दष्ट प्रवगक के प्रजतजनजधयक के जलए अरजक्षत
स्ट्थान हैं;
(ii) तारीख, स्ट्थान और समय, जजसके बीच नामजनद िन पेपर फाआल दकए जाएंगे, के जलए ससी तारीख जनवायचन के जलए
जनयत तारीख से सात स्ट्पष्ट ददन से ऄन्यून नहहै ह गी या यदद ससा ददन सावयजजनक ऄवकाि का ह ता ह, त ईस सावयजजनक
ऄवकाि का ईतिकरवती ऄगला ददन;
स्ट्पष्ट ीकरण—“सावयजजनक ऄवकाि” पद से क इ ददन ऄजभप्रेत ह, ज परक्रा्य जलखत ऄजधजनयम, 1881 (1881 का 26) की
धारा 25 के ऄधीन क इ सावयजजनक ऄवकाि ह, या क इ ससा ददन, जजसे सरकार द्वारा ईस सरकार के ऄधीन कायायलयक के
जलए सावयजजनक ऄवकाि ऄजधसूजचत दकया गया ह,;
(iii) नामजनद िन पेपरक की संवीक्षा के जलए तारीख और समय;
(iv) मतदान के जलए तारीख, स्ट्थान और समय ।
4. स्ट्थानीय प्राजधकरण नगर जवक्रय सजमजत की ऄजधकाठरता के क्षेत्र में पथ जवक्रेताओं की, ज दक नामजनद िन अमंजत्रत करने
की तारीख से 30 ददन पूवय ईसके क्षेत्र में ह, की एक सूची त,यार करेगी और ई है सूची की प्रजतयक क नगर जवक्रय सजमजत के
कायायलय के सूचना पट रहा पर नामजनद िन अमंजत्रत करने के जलए जनयत तारीख से कम से कम दस ददन पूवय चस्ट्पा करेगी ।
5. सूची में पथ जवक्रेता के जवक्रय की रजजस्ट्रीकरण सं्या या प्रमाणपत्र सं्या और पथ जवक्रेता के नाम, यथाजस्ट्थजत, जपता या
पजत के नाम क और पते क जवजन्दष्ट दकया जाएगा ।
6. यथाजस्ट्थजत, नगर जवक्रय सजमजत या स्ट्थानीय प्राजधकरण पथ जवक्रेताओं का ऄ्तन रजजस्ट्ट रहार और ससे ऄन्य रजजस्ट्ट रहार त,यार
करेंगे तथा ससे ऄजभलेखक, रजजस्ट्ट रहार या रजजस्ट्ट रहारक क ठरट रहानिनग अदफसर क जनवायचन के प्रय जन के जलए जनयत तारीख से 30
ददन पूवय सौंपेंगे, ज,सा दक वह ऄपेक्षा करे ।
7. सूची की एक प्रजत, यथाजस्ट्थजत, नगर जवक्रय सजमजत या स्ट्थानीय प्राजधकरण या ठरट रहानिनग अदफसर द्वारा दकसी पथ जवक्रेता
क स्ट्थानीय प्राजधकरण द्वारा यथाजवजन्दष्ट ससी फीस के संदाय पर प्रदान की जाएगी ।
8. ऄभ्यजितथयक का नामजनद िन प्ररूप-5 में दकया जाएगा, जजसक ठरट रहानिनग अदफसर द्वारा दकसी पथ जवक्रेता क जबना दकसी
लागत के प्रदान दकया जाएगा ।
9. ऄभ्यथी ऄपने नामजनद िन पेपरक के साथ प्रत्याभूजत जमा के द हजार रुपए नकद या बैंक ड्राफ्ट रहा या भुगतान अदेि के रूप
में देंगे और यदद वह मतदान दकए गए मतक के 1/6 मत प्राप्त करने में ऄसफल रहता ह, त प्रत्याभूजत जमा क जब्त कर जलया
जाएगा ।
10. प्रत्येक नामजनद िन पेपर ऄभ्यथी द्वारा स्ट्वयं व्यज हैगत रूप से या ईसके प्रस्ट्तावक या समथयक द्वारा ठरट रहानिनग अदफसर क
प्रस्ट्तुत दकया जाएगा ।
11. ठरट रहानिनग अदफसर नामजनद िन पेपर पर क्रम सं्या दजय करेगा और ईस तारीख और समय क प्रमाजणत करेगा जजस पर
ईसके द्वारा नामजनद िन प्राप्त दकया गया ह, तथा तुरंत नगर जवक्रय सजमजत या ठरट रहानिनग अदफसर की मुहर लगी जलजखत
ऄजभस्ट्वीकृजत देगा ।
12. क इ नामजनद िन पेपर ज ईसकी प्राजप्त के जलए जनयत तारीख और समय पर या ईससे पूवय प्राप्त नहहै दकया जाता ह, क
ऄस्ट्वीकार कर ददया जाएगा ।

13. नामजनद िन पेपरक की प्राजप्त के जलए जनयत तारीख से पश्चातवती ददन क ठरट रहानिनग अदफसर नामजनद िन पेपरक की
संवीक्षा करेगा ।
14. ठरट रहानिनग अदफसर नामजनद िन पेपरक की जांच करेगा और अक्षेप ज दकसी व्यज है द्वारा नामजनद िन के संबंध में दकए
गए ह, ससे अक्षेप दकए जाने पर या स्ट्वप्रेरणा से और ससी त्वठरत जांच करने के पश्चात:, यदद क इ हक, ज,सा दक ठरट रहानिनग
अदफसर ईजचत समझे, दकसी नामजनद िन क ऄस्ट्वीकार करेगा :
परंतु दकसी ऄभ्यथी के नामजनद िन क केवल ईसके नाम या ईसके प्रस्ट्तावक या समथयक के गलत जववरण या ऄभ्यथी या
ईसके प्रस्ट्तावक या समथयक से संबंजधत दकन्हहै जवजिजष्ट यक, ज,सा दक प,रा 4 में जन्दष्ट पथ जवक्रेताओं की सूची में दजय ह, से
संबंजधत गलत जववरण के अधार पर ऄस्ट्वीकार नहहै दकया जाएगा यदद, यथाजस्ट्थजत, ऄभ्यथी, प्रस्ट्तावक या समथयक की
पहचान दकसी युज हैयु है संदेह से परे साजबत की जाती ह, ।
15. ठरट रहानिनग अदफसर, यथाजस्ट्थजत, जनवायचन लड़ने वाले ऄभ्यजितथयक या प्रस्ट्तावक या समथयक क सभी नामजनद िन पेपरक की
जांच करने का और स्ट्वयं का यह समाधान करने की सभी युज हैयु है सुजवधाएं प्रदान करेगा दक जनवायचन लड़ने वाले ऄभ्यथी के
नाम क सज्मजलत दकया जाना व,ध ह, ।
16. ठरट रहानिनग अदफसर प्रत्येक नामजनद िन पेपर पर, यथाजस्ट्थजत, स्ट्वीकार करने या स्ट्वीकार करने के ऄपने जनणय क
पृठा ांदकत करेगा और यदद नामजनद िन पेपर ऄस्ट्वीकार दकया जाता ह, त वह ससे ऄस्ट्वीकार दकए जाने के ऄपने कारणक के
एक जलजखत संजक्षप्त जववरण क ऄजभजलजखत करेगा ।
17. ठरट रहानिनग अदफसर काययवाजहयक के दकसी स्ट्थगन क ऄनुज्ञात नहहै करेगा जसवाय तब जब ससी काययवाजहयक में दकन्हहै
दंगक, हंगामा या ईसके जनयंत्रण से परे कारणक द्वारा व्यवधान या बाधा न पए,ंचाइ जाए ।
18. व,ध नामजनद िनक की सूची ऄंरी ेजी में वणायनुक्रम में ऄभ्यथी के नाम और पते सजहत ज,सा दक ठरट रहानिनग अदफसर द्वारा
जवजनश्चय दकया जाए, ज,सा दक नामजनद िन पेपरक में ददया गया ह, ईसी ददन जजसक नामजनद िन पेपरक की संवीक्षा पूरी की
जाती ह, प्रदजितित या प्रकाजित की जाएगी ।
19. क इ भी ऄभ्यथी ऄपनी ऄभ्यजितथता क ईसके द्वारा नगर जवक्रय सजमजत के ठरट रहानिनग अदफसर क हस्ट्ताक्षठरत सूचना द्वारा
और व्यज हैगत रूप से ऄपने नामजनद िन पेपरक क प्रस्ट्तुत करने के पश्चात: दकसी भी समय ककतु ईस ददन के पश्चातवती ददन
क जजसक वह नामजनद िन प्रकाजित दकए जाते ह, पांच बजे से पूवय वापस ले सकेगा और ऄभ्यथी द्वारा नाम वापस लेने की
सूचना एक बार देने के पश्चात वापस नहहै ली जा सकेगी ।
20. यदद व,ध ऄभ्यजितथयक की सं्या जनवायजचत दकए जाने वाले ऄभ्यजितथयक से ऄजधक नहहै ह ती ह, त ठरट रहानिनग अदफसर ससे
सभी ऄभ्यजितथयक के नामक की स्यकतः चुने ए,ए के रूप में नगर जवक्रय सजमजत क उपर प,रा 19 में जवजन्दष्ट ऄभ्यजितथयक के
नाम क वापस लेने के ददन ऄंजतम घंट रहाे के पश्चात: घ जषत करेगा ।
21. यदद व,ध ऄभ्यजितथयक की सं्या जनवायजचत दकए जाने वाले ऄभ्यजितथयक की सं्या से ऄजधक ह ती ह, त ठरट रहानिनग अदफसर
आस प्रय जन के जलए जनयत तारीख क जनवायचनक की संचालन करेगा ।
22. ठरट रहानिनग अदफसर जनवायचन का संचालन करने के जलए यथावश्यक एक या ऄजधक जनवायचन ऄजधकाठरयक की जनयुज है कर
सकेगा ।
23. ईपय ग दकया जाने वाला मतदान-पत्र प्ररूप-6 में यथाजवजहत ह गा ।
24. स्ट्थानीय प्राजधकरण ठरट रहानिनग अदफसर क मतदान पेठट रहायां, मतदान-पत्र, पथ जवक्रेताओं या मतदाताओं की सूची की प्रजत
और ससी ऄन्य वस्ट्तुएं ज जनवायचनक के संचालन के जलए अवश्यक हक, प्रदान करेगा ।
25. मतदान पेट रहाी आस प्रकार जवजनजितमत की जाएगी दक मतपत्रक क ईसमें डाला जा सके ककतु पेठट रहायक क ख ले जबना ईन्हें
बाहर नहहै जनकाला जा सके ।
26. जनवायचन लड़ने वाला ऄभ्यथी ठरट रहानिनग अदफसर क पत्र द्वारा जहां मतदान दकया जाता ह, मतदाताओं की पहचान करने
के जलए और मतक के ऄजभलेखन क देखने के जलए ईसका प्रजतजनजधत्व करने हेतु ऄजभकती की जनयुज है कर सकेगा और ससे
पत्र में संबंजधत ऄजभकताय की प्ररूप-7 में जलजखत सहमजत ऄंतजितवष्ट ह गी ।
27. जहां जनवायचनक का संचालन दकया जा रहा ह, वहां दकसी भी व्यज है द्वारा मतक के जलए याचना प्रजतजषद्ध ह गी ।
28. जनवायचनक के प्रारंभ ह ने से तुरंत पूवय ठरट रहानिनग अदफसर ईस समय वहां ईपजस्ट्थत ऄभ्यजितथयक क खाली मतदान पेट रहाी
ददखाएगा और तत्पश्चात: ईसे बंद कर देगा और ईस पर ऄपनी मुहर चस्ट्पा करेगा ।
29. ऄभ्यती या ईसका ऄजभकताय यदद वांछा करें त वह ऄपनी स्ट्वयं की मुहर भी चस्ट्पा कर सकेंगे ।

30. प्रत्येक पथ जवक्रेता या मतदाता ज ऄपने मतदान के ऄजधकार के प्रय ग की वांछा करता ह, त सुजवधानुसार मुदद्रत,
ट रहााआप दकए ए,ए या साआतल स्ट्ट रहााआल दकए ए,ए ऄंरी ेजी वणायनुक्रम में चुनाव लड़ने वाले ऄभ्यजितथयक के नाम क ऄंतजितवष्ट करने
वाले पेपर की अपूजितत करेगा ।
31. मतदान पेपर पर नगर जवक्रय सजमजत की मुहर ह गी और ईस पर ठरट रहानिनग अदफसर के अ्क्षर और एक स्ट्तंभ ऄंतजितवष्ट
ह गा जजस पर मतदाता [x] का जचन्ह ईन व्यज हैयक के नाम के सामने लगाएगा जजनक वह मत देना चाहता ह, ।
32. प्रत्येक जनवायचन केन्द्र और जहां दकसी केन्द्र में एक से ऄजधक प हलग बूथ ह, ससे प्रत्येक बूथ में एक पृथक कक्ष ह गा
जजसमें पथ जवक्रेता या मतदाता ग पनीयता से ऄपने मतक क ऄजभजलजखत कर सकते ह ।
33. दकसी पथ जवक्रेता क या मतदाता क तब तक क इ मतपत्र जारी नहहै दकया जाएगा जब तक दक मतदान ऄजधकारी का
यह समाधान नहहै ह जाता ह, दक संबंजधत पथ जवक्रेता या मतदाता वही व्यज है ह, ज ईसे दी गइ सूची में न ट रहा दकया गया ह, ।
34. मतपत्र की प्राजप्त पर पथ जवक्रेता या मतदाता मतदान के प्रय जन के जलए पृथक: रखे गए कक्ष में ऄरी सर ह गा और ईस
व्यज है या व्यज हैयक के नामक क [x] जचह्न द्वारा, यथाजस्ट्थजत, ऄभ्यथी या ऄभ्यजितथयक क ईपदजितित करेगा, जजनके पक्ष में वह
मत देना चाहता ह, और मतपत्र क आस प्रय जन के जलए रखी गइ मतपेट रहाी में ऄजधकतम ग पनीयता से रख देगा ।
35. यदद ऄंधता या दकसी ऄन्य िारीठरक ऄक्षमता या ऄसाक्षरता के कारण क इ पथ जवक्रेता या मतदाता मतपत्र पर जचह्न
लगाने में ऄसमथय ह, त मतदान ऄजधकारी और जहां ससे दकसी मतदान ऄजधकारी की जनयुज है नहहै की गइ ह, त ठरट रहानिनग
अदफसर ऄभ्यथी या ऄभ्यजितथयक से यह पता लगाएगा दक वह दकसके पक्ष में मत देने की वांछा करते हैं, ईसके जनजमतिक [x]
जचह्न लगाएगा और मतपत्र क मतपेट रहाी में डाल देगा ।
36. यदद मतदान के दकसी प्रक्रम पर काययवाजहयक में दकसी दंगे या हंगामे के कारण क इ बाधा या रुकावट रहा अती ह, या ससे
जनवायचनक में दकसी पयायप्त कारण से जनवायचन का संचालन संभव नहहै ह ता ह, त ठरट रहानिनग अदफसर क मतदान क र कने के
कारणक क र कने की कारयवाइ के कारणक क नगर जवक्रय सजमजत की काययवृतिक पुजस्ट्तका में लेखबद्ध करते ए,ए, र कने की िज है
ह गी ।
37. दकसी पथ जवक्रेता या मतदाता क मतदान के जलए जनयत घंट रहाक के पश्चात: ऄनुज्ञात नहहै दकया जाएगा, ककतु क इ
मतदाता, ज ईन पठरसरक में, जहां मतपत्र जारी दकए जाते हैं, मतदान के समय से पूवय प्रजवष्ट ह जाता ह, क मतपत्र जारी
दकया जाएगा और ईसे मत देना ऄनुज्ञात दकया जाएगा ।
38. मतपत्रक की गणना मतदान समाप्त ह ने के तुरंत पश्चात: की जाएगी ।
39. यदद तुरंत मतगणना संभव नहहै ह त मतपेठट रहायक क ठरट रहानिनग अदफसर और जनवायचन लड़ने वाले ऄभ्यजितथयक या ईनके
ऄजभकतायओं क यदद वह ससी वांछा करें दक मुहर लगाकर मुहरबंद कर ददया जाएगा और ईन्हें सुरजक्षत ऄजभरक्षा के जलए
स्ट्थानीय प्राजधकरण के पास जमा कर ददया जाएगा तथा ततपश्चात: ठरट रहानिनग अदफसर घ षणा करेगा दक गणना ऄगले ददन की
जाएगी ।
40. मतगणना ठरट रहानिनग अदफसर के पययवेक्षण के ऄधीन की जाएगी ।
41. प्रत्येक ऄभ्यथी और ईसके प्राजधकृत ऄजभकताय क गणना के समय ईपजस्ट्थत ह ने का ऄजधकार ह गा ककतु गणना के समय
ईनकी ऄनुपजस्ट्थजत से गणना और पठरणामक की ठरट रहानिनग अदफसर द्वारा घ षणा जन्प्रभावी नहहै ह गी ।
42. प्रत्येक ऄभ्यथी द्वारा जलए गए मतक की सं्या और जनवायचनक के पठरणाम की ठरट रहानिनग अदफसर द्वारा मतगणना पूणय ह ने
के पश्चात: यथािीघ्र घ षणा की जाएगी ।
43. जनवायचनक के पठरणाम क नगर जवक्रय सजमजत की काययवृतिक पुजस्ट्तका में ऄजभजलजखत दकया जाएगा और ईसे ठरट रहानिनग
अदफसर द्वारा सत्याजपत दकया जाएगा तथा ईसक नगर जवक्रय सजमजत के सूचना पट रहा पर भी तुरंत ऄजधसूजचत दकया
जाएगा ।
44. मतक के बराबर रहने की दिा में ठरट रहानिनग अदफसर जसक्का ईछालकर जनवायचन के पठरणाम की घ षणा करेगा ।
45. मतपत्र क ठरट रहानिनग अदफसर द्वारा ऄस्ट्वीकार कर ददया जाएगा यदद,--
(i) ईस पर क इ ससा जचह्न लगा ह, जजसके द्वारा पथ जवक्रेता के मत की पहचान नहहै की जा सकती ह,;
(ii) ईस पर नगर जवक्रय सजमजत की मुहर या ठरट रहानिनग अदफसर के ऄ्ाक्षर नहहै ह,;
(iii) ईस पर मत क ईपदजितित करने वाला जचह्न ससी रीजत में लगाया गया ह, दक जजससे यह संदेहास्ट्पद ह जाता
ह, दक दकस ऄभ्यथी के पक्ष में मत ददया गया ह,;

(iv) वह आस प्रकार नष्ट या जवदक्रत ह, दक ईसकी वास्ट्तजवक मतपत्र के रूप में पहचान स्ट्थाजपत नहहै की जा सकती

46. जनवायचन के पठरणाम की घ षणा कर ददए जाने के पश्चात: जनवायचन का पठरणाम और ईसकी ठरप ट रहाय से स्ट्थानीय
प्राजधकरण के साथ सरकार क ठरट रहानिनग अदफसर द्वारा पठरणाम घ जषत ह ने के तीन ददन के भीतर संसूजचत दकया जाएगा ।
47. जनवायचन का पठरणाम घ जषत ह ने के पश्चात: ठरट रहानिनग अदफसर मतपत्र और ऄजभलेखक क एक मुहरबंद जलफाफे में
स्ट्थानीय प्राजधकरण क सौंपेगा और ईन्हें सुरजक्षत रूप से स्ट्थानीय प्राजधकरण द्वारा ऄगले जनवायचन पठरणामक के ईपलब्ध ह ने
तक पठररजक्षत दकया जाएगा तथा तत्पश्चात: ईन्हें स्ट्थानीय प्राजधकरण द्वारा नष्ट कर ददया जाएगा तथा जनवायचनक के
ऄजभलेखक क सौंपेने तथा लेने की प्रजत सरकार के साथ-साथ स्ट्थानीय प्राजधकरण क ठरट रहानिनग अदफसर द्वारा ऄपनी ठरप ट रहाय के
साथ भेजी जाएगी ।

NOTIFICATION
New Delhi, the 8th July, 2021
G.S.R. 483(E).—In exercise of the powers conferred by section 36 read with sub-clause (i) of clause (a) of
sub-section (1) of section 2 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act,
2014 (7 of 2014), the Central Government hereby makes the following rules for the Union territory of Ladakh,
namely:—
CHAPTER I
PRELIMINARY
1. Short title and commencement.- (1) These rules may be called the Union Territory of Ladakh Street
Vendors (Protection of Livelihood and Regulation of Street Vending) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- (1) In these rules, unless the context otherwise requires, -
(a) “Act” means the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act,
2014 (7 of 2014);
(b) “Bye-laws” mean the bye-laws made under section 37 of the Act;
(c) “committee” means the Grievance Redressal and Dispute Resolution Committee constituted under
sub-section(1) of Section 20 of the Act;

(d) “form” means a form in the schedule to these rules;
(e) “Government” means the Administrator of the Union territory of Ladakh;
(f) “local authority” means the local authority defined under clause (c) of sub-section (1) of section 2 of
the Act;
(g) “Municipal Commissioner” means the Commissioner of a Municipal Corporation or Chief Officer of a
Municipal Council and includes the Vice-Chairman of the Union Territory Development Authority, if
any; or as the case may be, the Chief Executive Officer of the Cantonment Board ;
(h) “scheme” means a scheme framed by the Central Government under section 38 of the Act;
(i) “section” means a section of the Act.
(2) Words and expressions used herein and not defined, but defined in the Act, shall have the meanings
respectively assigned to them in the Act.
CHAPTER II
REGULATION OF STREET VENDING
3. Prescription of age for issue of certificate of vending.- A street vendor who has completed the age of
fourteen years shall be issued a certificate of vending in the manner provided under section 4 of the Act.
CHAPTER III
DISPUTE REDRESSAL MECHANISM
4. Constitution of Grievance Redressal and Dispute Resolution Committee.- (1) There shall be constituted a
Grievance Redressal and Dispute Resolution Committee for each local authority, constituted by the
Government under sub-section (1) of section 20 of the Act, comprising of a Chairperson, who has been a
civil judge or a judicial magistrate and two other professionals as members.
(2) The Chairperson and members of the committee shall be appointed by the Government for a period of
five years:
Provided that no Chairperson shall hold office as such after he has attained the age of
sixty-
seven years.
5. Qualifications and experience for appointment as member.- A person shall be qualified to be appointed as
a professional member of the committee, if he,-
(i) is above thirty-five years but is not more than sixty-five years of age;
(ii) possesses a Bachelor's degree in any subject from a recognised university; and

(iii) is a person of ability, integrity and standing and has adequate knowledge or experience of, at least ten
years in social work or dealing with the problems relating to street vendors or of public affairs or of
municipal or public administration.
6. Salaries, other allowances and terms and conditions of service of Chairperson and members.- (1) The
Chairperson and members of the committee shall receive salary, allowances and other perquisites as may be
notified by the Government from time to time;
(2) The Government may remove from the office, the Chairperson and member, if he,-
(a) has been adjudged an insolvent; or
(b) has been convicted of an offence which, in the opinion of the Government involves moral turpitude;
or
(c) has become physically or mentally incapable of action as such Chairperson or member, as the case
may be; or
(d) has acquired such financial other interests as is likely to affect prejudicially his functions as the
Chairperson or a member, as the case may be; or
(e) has so abused his position as to render his continuance in office prejudicial to the public interest:
Provided that the Chairperson or member shall not be removed from his office on the grounds
specified in clauses (d) and (e) of sub-rule (2), except on an inquiry held by the Government in accordance
with such procedure as it may specify in this behalf.
(3) The terms and conditions of the service of the Chairperson and members of the committee shall not be
varied to their disadvantage during tenure of office.
7. Form and manner of making application to committee.- (1) Every application for redressal of a grievance
or resolution of a dispute under sub-section (2) of section 20 of the Act shall be in Form-1.
(2) The application shall be signed by the applicant and presented by him in person or through his authorised
representative to the committee or such other person as may be authorised by that committee in this
behalf.
(3) The application shall be filed in three sets and shall be accompanied by fee of rupees one hundred.
(4) The application shall be accompanied by a copy of the order or notice, if any, against which the
application is made and other relevant documents.
(5) Such application shall be filed by the street vendor within thirty days from the date of occurrence of any
incident causing grievance or dispute:

Provided that the committee may condone the delay in case it is satisfied that the applicant was
prevented by sufficient cause from preferring the application within the prescribed time.
8. Manner of verification of application and enquiry.- (1) Every application for redressal of grievance on
receipt, shall be entered and numbered in seriatum by the person authorised in this behalf by the committee in
a register kept for this purpose.
(2) The person authorised in this behalf, after making an entry in the register shall put up the application
before the committee.
(3) The committee shall fix a date for hearing of the application which shall not be later than fifteen days
from the date of filing of the application and shall issue notice of the hearing to the parties.
(4) The committee while issuing a notice containing a statement to this effect under sub-rule (3), shall call
upon the respondent to submit a written statement.
(5) On the date fixed for the appearance of the parties, the committee may call upon the applicant to remedy
the defects, if any, or may call upon the parties to furnish relevant records or such other documents or
evidence as it may deem fit and proper within such period as may be specified by it.
(6) The committee may order for a field enquiry in connection with the contentions made by the parties with
reference to the records submitted by them.
(7) The committee after hearing both the parties and examining the record of the case shall decide the
application and pass such orders as it may deem fit and proper within sixty days from the date of presentation
of the application:
Provided that during the hearing of the case, if the committee is satisfied that an interim relief
should be provided, the Committee may until the conclusion of the case or until further orders, pass interim
orders.
(8) The committee may explore the possibility of a settlement between the parties and in case the parties
arrive at a settlement, it shall record the settlement, which shall be signed by the parties or their authorised
representatives or officers and shall dispose of the application accordingly.
(9) The committee shall not entertain an application where the,-
(a) application is anonymous or it contains general and vague allegations;
(b) matter is sub-judice in any court of law, tribunal or a judicial or quasi-judicial authority;
(c) matter is beyond the purview of the Act;
(d) applicant has no locus standi to file the application.

CHAPTER IV
APPEALS
9. Appeal against order or decision of committee.- (1) An appeal against an order or decision of the
committee may be preferred by an aggrieved person in Form-2, to the local authority within thirty days from
the date of communication of such order or decision appealed against:
Provided that the local authority may condone the delay in case it is satisfied that the applicant was
prevented by sufficient cause from preferring the appeal within the prescribed time.
(2) The appeal shall be in the form of a memorandum and shall be signed by the appellant and presented in
person or through his authorised representative to the local authority.
(3) The memorandum of appeal shall be accompanied by the original order or certified copy of the order, if
any, against which the appeal is preferred.
(4) The appeal shall be filed in three sets and accompanied by fee of rupees two hundred.
(5) No such appeal shall be entertained unless a copy thereof has been served upon the respondent or
respondents, as the case may be and proof of such service has been filed along with the appeal.
(6) No appeal shall be entertained where the order has been passed by the committee in terms of the settl-
ement arrived between the parties.
10. Appeal from decision of Town Vending Committee.- (1) An appeal under section 11 against the decision
of the Town Vending Committee with respect to issue or cancellation or suspension of certificate of vending
shall be preferred before the local authority in Form-3, within thirty days from the date of communication of
the order appealed against:
Provided that the local authority may condone the delay in case it is satisfied that the appellant was
prevented by sufficient cause from preferring the appeal within the prescribed time:
Provided further that in the absence of Chairperson any one of the members designated by the
Chairperson may chair the meeting of the local authority.
(2) The appeal shall be in the form of a memorandum and signed by the appellant and presented in person or
through his authorised representative, either in English, Hindi or the local language.
(3) The memorandum of appeal shall be accompanied by the original order or certified copy of the order, if
any, against which the appeal is preferred.
(4) The appeal shall be filed in three sets and accompanied by fee of rupees two hundred.

(5) No appeal shall be entertained unless a copy thereof has been served upon the Town Vending Committee
which made the order appealed against, prior to filing of such appeal and proof of such service has been filed
along with the appeal.
11. Procedure for disposal of appeals by local authority.- (1) The officer or the person authorised in this
behalf by the local authority shall make an entry of the appeal in the register kept for the purpose with the
date on which it was presented.
(2) The appeal shall be put up before the local authority which shall fix a date for hearing of the appeal not
later than fifteen days from the date of filing of the application and cause notice of the hearing to the parties.
(3) The local authority shall, on the basis of submissions made before it by the parties and records of the case
and on the basis of field enquiry, if any, pass such order, as it may deem fit and proper, with reasons to be
recorded in writing, confirming, modifying or annulling the order appealed against within sixty days from the
date of receipt of the appeal by the local authority:
Provided that during the hearing of the case, if the local authority is satisfied that an interim relief
should be provided, the local authority may until the conclusion of such case or until further orders, pass
interim orders.
CHAPTER V
TOWN VENDING COMMITTEE
12. Constitution of Town Vending Committee.- (1) The Government shall constitute one Town Vending
Committee in the local authority:
Provided that the Government may, if it considers necessary, provide for constitution of more than
one Town Vending Committee for each zone or ward in the Local authority.
(2)
The Municipal Commissioner or Chief Executive Officer, as the case may be, shall be the
Chairperson of the Town Vending Committee.
(3)
The number of other members of the Town Vending Committee nominated by the Government shall
be as under:-

The nomination of members representing non-governmental organisations or community based
organisations or resident welfare associations shall be carried out on the basis of criteria laid down by the
Government, after inviting applications, by publishing the same in at least two local newspapers or
publicising in any other manner.
13. Manner of election of members from amongst street vendors.-(1) The local authority shall, by notification
conduct elections for the nomination of members representing the street vendors of the area under its
jurisdiction.
(2) The local authority shall appoint a returning officer for conducting the election under sub-rule (1).
(3) The returning officer appointed under sub-rule (2) shall, conduct the elections in the manner provided in
the Schedule appended to these rules.
(4) A street vendor shall be disqualified to be elected as member, if, he is,-
(i) convicted of an offence involving moral turpitude; and
(ii) physically and, or mentally incapable of discharging his duties as member.
(3) The names of the elected members from amongst the street vendors shall be intimated by the local
authority to the Government which shall upon receipt of such names along with other members nominated
by it, notify the constitution of the Town Vending Committee in each local authority.
14. Term of other members.-(1) The term of other members of the Town Vending Committee shall be five
years from the date of their nomination.
(2) The process of nomination of other members shall be completed before the expiry of the term.
15. Removal of members.- Any member of a Town Vending Committee may be removed by the Government, if
he,-
(a) persistently makes default in the performance of duties imposed on him under the Act and the rules or
exceeds or abuses his powers;
(b) remains absent for three consecutive meetings of the committee without the permission of the
Chairperson;
(c) is convicted of any criminal case by a court of law:

Provided that such member shall be given a reasonable opportunity of being
heard before his
removal.
16. Method of filling vacant post.- (1) Where any vacancy occurs in a Town Vending Committee due to
resignation, death, removal or otherwise of any member, other than a street vendor, the procedure specified in
rule 12 shall be followed to fill up such vacancy and the member so nominated shall continue to be a member
for the remaining period of term of that member in whose place he has been nominated.
(2) Where any vacancy occurs in a Town Vending Committee due to resignation, death, removal or otherwise
of any member who is a street vendor, the local authority shall fill up that vacancy as specified in rule 13 and
the member so elected shall continue to be a member for the remaining period of term of that member in
whose place he has been elected.
17. Allowances to Chairperson and other members.- The allowances payable to the Chairperson and other
members of a Town Vending Committee, shall be rupees one thousand for attending the meeting.
18. Meetings of Town Vending Committee.- (1) A Town Vending Committee shall ordinarily hold one
meeting within a period of three months or at any such interval as the Chairperson may decide for the
transaction of its business:
Provided that the meeting of a Town Vending Committee shall be convened by the Chairperson
within forty-five days of its constitution:
Provided further that a requisition meeting may be called by the Chairperson on a specific issue on
the request of not less than one-third of the members of that Committee and the meeting shall be convened
within seventy-two hours after receiving the request.
(2) The meetings shall be held at the headquarters of the local authority or at such place within the
jurisdiction of the local authority as may be decided by the Chairperson.
(3) A notice shall be issued before seven days of a scheduled meeting to all the members along-with the
agenda of the meeting.
(4) The quorum for the meeting shall be two-third members of the total strength of that Committee.
(5) No meeting shall be held in the absence of the quorum and where there is no quorum, the meeting shall be
adjourned.
19. Procedure for transaction of business.- (1) The Town Vending Committee shall follow such procedure for
transaction of its business as may be decided by the Chairperson in consultation with other members.

(2) Subject to the provisions of the Act and rules and notwithstanding anything contained in the bye-laws, the
resolution passed in the meeting of a Town Vending Committee shall be by not less than two-thirds of the
members present and voting.
(3) The Chairperson shall ensure that the minutes of each meeting are recorded which shall be signed by him,
circulated amongst the members and published on its website, if available, within one month of the meeting.
20. Functions of Town Vending Committee.- A Town Vending Committee shall perform the following
functions, namely:-
(a) identify sites and spaces for vending;
(b) regulate timings for vending to ensure non-congestion of public spaces;
(c) ensure enforcement of corrective mechanism against defiance by street vendors;
(d) follow up cases of dispute pending before the committee and the local authority;
(e) hold meetings and take appropriate decisions to ensure efficient discharge of its functions;
(f) publish the street vendor's charter in at least one local language, Hindi and English newspapers of repute
and display in the office and other offices of the local bodies, specifying therein the time within which
the certificate of vending shall be issued to the street vendors and time within which such certificate of
vending shall be renewed and other activities to be performed within the time limit specified therein; and
(g) perform such other functions for effective implementation of the Act and the rules as may be delegated
to it by the local authority or the Government.
21. Temporary association of expert persons.-(1) A Town Vending Committee may associate any suitable
person of repute having adequate knowledge and experience in the field, as expert to obtain technical or
professional advice on matters relating to street vendors.
(2) The person to be associated as expert under sub-rule (1) shall be selected in a fair and transparent manner
and by following the procedure for engagement of consultants and experts as technical or professional
experts in Government Departments.
(3) The person associated as expert under sub-rule (1) shall be paid allowances as determined by the local
authority.
(4) The person associated as expert under sub-rule (1) may take part in the meetings of the Town Vending
Committee, but such persons shall not have voting right

22. Employees of Town Vending Committee - The local authority shall make available to the Town Vending
Committee such number of employees as it may consider necessary for discharge of the functions.
CHAPTER VI
MISCELLANEOUS
23. Maintenance of records.- Every Town Vending Committee shall maintain upto date records of registered
street vendors and of those street vendors to whom certificate of vending has been given in electronic form or
manually or in both forms, as may be decided by the local authority.
24. Town Vending Committee to furnish returns.- Every Town Vending Committee shall prepare and furnish
to the Government and the local authority, periodical returns for each year with details in Form-4.
25. Manner of publication of scheme.- (1) A summary of the scheme notified by the Government shall be
published by the local authority by a public notice given in two prominent daily newspapers for being widely
circulated known in the area or locality of its jurisdiction within seven days from the date the scheme is
notified by the Government.
(2) The notice shall be signed by the Municipal Commissioner or the Chief Executive Officer of the local
authority, as the case may be, or by an officer authorised by him in this behalf.
(3) The notice shall be in such language or languages as the Municipal Commissioner or the Chief Executive
Officer of the local authority, as the case may be, specify in this behalf.
SCHEDULE

[PROCEDURE FOR THE CONDUCT OF ELECTIONS OF MEMBERS OF TOWN VENDING
COMMITTEE REPRESENTING STREET VENDORS]
1. The local authority concerned shall supervise, direct and control the conduct of elections of the members of a
Town Vending Committee representing the street vendors in the area of its jurisdiction.
2. As soon as the notification expressing the intention of the local authority to conduct elections for members of
a Town Vending Committee representing the street vendors has been issued under sub-rule (1) of rule 13 and
a returning officer has been appointed for conducting the elections under sub-rule (2) of that rule, the local
authority shall by a resolution determine the date, time and place for conduct of elections.
3. The notice of the resolution or decision of the local authority shall be circulated among the street vendors
engaged in the vocation of street vending in the area of jurisdiction of the Town Vending Committee, by any
of the following modes, namely:-

(a) by public notice published in two prominent daily newspapers in Hindi, English or such other language as the
local authority thinks fit;
(b) by local delivery;
(c) by post under certificate of posting;
(d) by speed post or courier services, duly registered with competent authority as well as on the notice board of
the returning officer and such notice shall contain information regarding,-
(i) number of members to be elected including seats reserved for representatives of the Scheduled Castes, the
Scheduled Tribes, Other Backward Classes, minorities, women, persons with disabilities or any other
specified categories;
(ii) date, place and the hours between which nomination papers shall be filed, such date being not less than seven
clear days before the date fixed for election or if that day happens to be public holiday, the next succeeding
day which is not a public holiday.
Explanation.- The term “public holiday” means any day which is a public holiday under section 25 of the
Negotiable Instruments Act, 1881 [26 of 1881] or any day which has been notified by the Government to be a
public holiday for offices under the Government;
(iii) date and the hour for scrutinisation of the nomination papers;
(iv) date, place and hours of polling.
4. The local authority shall prepare a list of street vendors in the area of jurisdiction of the Town Vending
Committee as it stood thirty days before the date fixed for inviting the nominations and publish copies of the
said list by affixing them on the notice board of the office of the Town Vending Committee, not less than ten
days prior to the date fixed for inviting nominations.
5. The list shall specify the registration number or number of certificate of vending and the name of the street
vendor, the name of the father or husband, as the case may be, and the address of the street vendor.
6. The Town Vending Committee or the local authority, as the case may be, shall bring up-to-date register of
street vendors and such other register as the returning officer may require and hand over such records,
register or registers to the returning officer thirty days prior to the date fixed for the purpose of election.
7. A copy of the list shall be supplied by the Town Vending Committee or the local authority, or returning
officer, as the case may be, to any street vendor on payment of such fee as specified by the local authority.

8. The nomination of the candidates shall be made in Form-5 which shall be supplied by the returning officer to
any street vendor, free of cost.
9. The candidate shall make a security deposit of rupees two thousand in cash or bank draft or pay order along
with the nomination papers and if he fails to get less than one-sixth of the votes polled, the security deposit
shall be forfeited.
10. Every nomination paper shall be presented in person by the candidate himself or by his proposer or seconder
to the returning officer.
11. The returning officer shall enter the serial number on the nomination paper and certify the date and hour at
which the nomination is received by him and shall immediately give a written acknowledgement bearing the
seal of the Town Vending Committee or the returning officer.
12. Any nomination paper which is not received on or before the date and time fixed for its receipt shall be
rejected.
13. On the day following the date fixed for the receipt of nomination papers, the returning officer shall take up
the scrutiny of the nomination papers.
14. The returning officer shall examine the nomination papers and raise objections, which may be made by any
person in respect of any nomination and may, either on such objection, or on his own motion and after such
summary inquiry, if any, as the returning officer thinks necessary, reject any nomination:
Provided that the nomination of a candidate shall not be rejected merely on the ground of an
incorrect description of his name or the name of his proposer or seconder, or any other particulars relating to
the candidate or his proposer or seconder, as entered in the list of street vendors referred to in paragraph 4 if
the identity of the candidate, the proposer or seconder, as the case may be, is established beyond reasonable
doubt.
15. The returning officer shall give all reasonable facilities to the contesting candidates or the proposer or
seconder as the case may be, to examine all the nomination papers and to satisfy themselves that the
inclusion of the name of the contesting candidate is valid.
16. The returning officer shall endorse on each nomination paper his decision accepting or rejecting the same as
the case may be, and if the nomination paper is rejected, he shall record in writing a brief statement of his
reasons for such rejection.
17. The returning officer shall not allow any adjournment of the proceedings except when such proceedings are
interrupted or obstructed by riots or affray or by causes beyond his control;

18. The list of valid nominations as decided by the returning officer with names in English alphabetical order and
addresses of the candidates as given in the nomination papers will be displayed or published on the same day
on which the scrutiny of the nomination papers is completed.
19. Any candidate may withdraw his candidature by notice in writing signed by him and submitted in person, at
any time after the presentation of his nomination paper but before 05.00 pm on the day following the day on
which the valid nominations are published, to the returning officer of the Town Vending Committee and a
notice of withdrawal of candidates once given shall be irrevocable.
20. If the number of valid candidates does not exceed the number of candidates to be elected, the returning
officer shall announce the names of all such candidates duly elected to the Town Vending Committee after
the closing hour of the day of withdrawal of candidatures specified in paragraph 19 above.
21. If the number of valid candidates exceeds the number to be elected, the returning officer shall arrange for
conducting a poll on the date fixed for the purpose.
22. The returning officer may appoint one or more polling officers as may be necessary for conducting the poll.
23. The ballot paper to be used shall be as prescribed in Form-6.
24. The local authority shall provide the returning office with ballot boxes, ballot papers copy of list of street
vendors or voters and such other articles as may be necessary for the conduct of elections.
25. The ballot box shall be so constructed that ballot papers can be inserted therein but cannot be taken out there
from without the boxes being unlocked.
26. A candidate contesting the election may, by a letter to the returning officer appoint an agent to represent him
where polling is held to identify the voters and to watch the recording of votes and such letter shall contain
the consent in writing of the agent concerned in Form-7.
27. Canvassing for votes by any person at the place where elections are to be conducted shall be prohibited.
28. Immediately before the commencement of the poll, the returning officer shall show the empty ballot box to
such persons as may be present at that time and shall then lock it up and fix his seal.
29. The candidate or his agent may also affix his own seal, if he so desire
30. Every street vendor or voter who desires to exercise his right to vote shall be supplied with a ballot paper
containing the names of contesting candidates arranged in the English alphabetical order either printed, type
written or cyclostyled, according to convenience, on the ballot paper.

31. The ballot paper shall bear the seal of the Town Vending Committee and initials of the returning officer and
contain a column, for the voter to inscribe his mark [x] against the names of persons to whom he wants to
vote.
32. Each polling station and where there is more than one polling booth at a station, each such booth shall
contain a separate compartment in which the street vendors or voters can record their votes in secrecy.
33. No ballot paper shall be issued to a street vendor or voter unless the polling officer is satisfied that the street
vendor or voter concerned is the same person as noted in the list furnished to him.
34. On receipt of ballot paper, the street vendor or voter shall proceed to the polling compartment set apart for
the purpose and indicate the person or persons in whose favour he exercises his vote by inscribing a mark [x]
against the names of the candidate or candidates, as the case may be, and put the ballot paper in the ballot
box kept for the purpose with utmost secrecy.
35. If owing to blindness or other physical infirmity or illiteracy, the street vendor or voter is unable to inscribe
the mark on the ballot paper, the polling officer and where no such polling officer is appointed, the returning
officer shall ascertain from him the candidate or candidates in whose favour he desired to vote, inscribe the
mark [x] on his behalf and put the ballot paper in the ballot box.
36. If at any stage of the polling, the proceedings are interrupted or obstructed by any riot or affray or if at such
elections, it is not possible to conduct the poll for any sufficient cause, the returning officer shall have the
power to stop the poling, recording his reasons for such action in the minute book of the Town Vending
Committee.
37. No street vendor or voter shall be allowed after the hours fixed for the poll but a voter, who enters the
premises where ballot papers are being issued before the close of the polling hour shall be issued the ballot
paper and allowed to vote.
38. The counting of votes shall take place immediately after close of the poll.
39. If immediate counting is not possible, the ballot box shall be sealed with the seal of the returning officer and
the contesting candidates or their agents, if they so desired, and deposit with the local authority for safe
custody and the returning officer shall then announce the counting to be done the next day.
40. The votes shall be counted by or under the supervision of the returning officer.
41. Each candidate and his authorised agent shall have a right to be present at the time of counting, but their
absence at the time of counting shall not vitiate counting and announcement of results by returning officer.
42. The number of votes secured by each candidate and the result of the elections shall be announced by the
returning officer as soon as the counting is over.

43. The result of the elections shall be recorded in the minute book of the Town Vending Committee and attested
by the returning officer and shall also be notified immediately on the notice board of the Town Vending
Committee.
44. In case of equality of votes, the returning officer shall declare the election result by tossing coin.
45. The ballot paper shall be rejected by the returning officer if,-
(i) it bears any mark by which the street vendor's vote can be identified;
(ii) it does not bear the seal of the Town Vending Committee or the initials of the returning officer;
(iii) the mark indicating the vote thereon is placed in such a manner as to make it doubtful to which
candidate the vote has been cast;
(iv) is so damaged or mutilated that its identity as a genuine ballot paper cannot be established.
46. After the result of election has been announced, the result of the election and a report thereon shall be
communicated to the local authority as well as to the Government by the returning officer within three days
of the declaration of result.
47. After the declaration of the result of the election, the returning officer shall handover the ballot paper and
records to the local authority in a sealed cover and the same shall be safely preserved by the local authority
till the next election results are available and shall thereafter be destroyed by the local authority and a copy of
the handing over and taking over record of elections shall be sent to the Government as well as local
authority by the returning officer along with his report.
